The Genetic Information Nondiscrimination Act of 2008 (“GINA”) is the first federal, uniform protection against the use of genetic information in both the workplace and health insurance. Signed into law on May 21, 2008, GINA prohibits an employer or health insurer from acquiring or using an individual’s genetic information, with some exceptions. One of the goals of GINA is to eradicate actual, or perceived, discrimination based on genetic information in the workplace and in health insurance. Last summer, I was thinking about a public service project for my disability discrimination law course. I teach the course in fall, and try to incorporate a project each year. At the same time, I was working on a project looking at barriers to health care for people with disabilities. Some of the barriers are well known, such as lower average incomes, disproportionate poverty, and issues with insurance coverage, to name just a few. I was looking at barriers of a different type, however: those posed by physically inaccessible facilities and equipment. This was a new area for me. Like …

Accrediting The Accreditors: A New Paradigm For Correctional Oversight, Lynn S. Branham

Correctional accreditation processes can be revamped to bring more transparency and accountability into the operation of correctional facilities and to help ensure that they comport with sound correctional practices, legal requirements, and basic human-rights precepts. Becoming accredited is now largely optional, and correctional accreditation processes are fee-based. Consequently, correctional accrediting entities are vulnerable to pressures to water down accreditation standards and make accreditation procedures more lax. The federal government should therefore adopt two requirements. First, prisons, jails, and other correctional facilities should have to be accredited by a certified accrediting entity in order to be eligible to receive federal funds. …

Canaries were used in times past to alert miners to the presence of dangerous gases in a mine. A canary would die, and the miners would thereby become aware of deadly, but sometimes odorless, gases. Just as canaries have alerted miners to the presence of dangerous gases in mines, workers exposed to dangerous pollutants and conditions in workplaces may function as societal canaries warning the broader public of environmental dangers; but hopefully without having to die in the process. Context. Rehabilitation for chronic ankle instability is constantly evolving in an attempt to determine the correct course to reduce the deficits associated with chronic ankle instability. Research has shown that balance training over a 4 week period was beneficial in improving self-reported function, dynamic postural control and static postural control. Fungi are ubiquitous microorganisms that commonly cause diseases with high mortality rates in immunocompromised hosts. In order to successfully treat the infection and subsequently decrease mortality rates, it is necessary to rapidly identify the causal organism(s) and promptly begin the proper treatment. Common identification methods, such as viable culture characterization, are often time consuming or not species-specific, as is the case with many molecular or immunodiagnostic assays. Matrix-assisted laser desorption/ionization time-of-flight mass spectrometry (MALDI-TOF MS) has been used to discriminate between many clinically relevant microorganisms. Rates of nonmedical psychostimulant use among emerging adults have been previously examined using self-report, but rates among adolescents have not been well documented. Additionally, few studies have examined the relation of nonmedical psychostimulant use and sleep. One purpose of this study was to examine rates of nonmedical psychostimulant use and sleep among adolescents and emerging adults utilizing the same self-report measures. Selenium Removal By Nano-Magnetite Impregnated Diatomaceous Earth, Isabel Cardona

The purpose of this study was to remove selenium from aqueous solution using nano-magnetite impregnated diatomaceous earth (DE) as an adsorbent. The adsorbent was prepared at the laboratory with a ratio of magnetite/DE of 10%. Batch adsorption experiments were conducted to evaluate the effects of pH, temperature, adsorbent concentration, selenium speciation, contact time and presence of competing anions on selenium removal efficiency in conjunction with studies on adsorption kinetics, isotherms, and adsorptive thermodynamics. Rapid adsorption occurred within 30 min and selenium uptake decreased with increase in temperature. Low pH values (i.e. 2--4) favored selenium adsorption as expected for anion adsorption …

This thesis centers on the simulation and optimization of a hybrid transit bus when operated over transient emissions cycles. The simulation was conducted using Powertrain System Analysis Toolkit (PSAT) as a platform by integrating components' data and operation maps of a "pre-transmission" parallel hybrid transit bus. The model was validated against the limited experimental data when operated over the China's Urban Bus (CUB) driving cycle and the Beijing cycle. Metal and metal alloys are critical components of high-tech applications. Beryllium (Be), chromium (Cr), and nickel (Ni) are among the most economically important metals for high-tech applications because of their extraordinary physical properties. These metals pose two different problems for workers who work with them: (1) allergic contact dermatitis from exposure to Cr and Ni, which is widely accepted to account for a significant percentage of occupational skin irritations and (2) possible systemic sensitization from skin contact with airborne Be. It ranges from northeastern Minnesota eastward through southern Quebec, and from the southern Appalachian Mountains to northern Georgia and Alabama.;This majestic tree is threatened with elimination by an invasive species Hemlock Woolly Adelgid (HWA) Adelges tsugae introduced in the USA in 1924, which is believed to be a native of Asia. Lip prints have been proposed as a type of impression evidence with similar issues as fingerprints, but with greater scrutiny by the forensic community due to a lack of history in using this type of impression as evidence. A survey of 11 questions about lip print examination was sent to 63 members of the Chesapeake Bay Division of the International Association for Identification (CBD-IAI) to gather opinions from active forensic scientists in determining an appropriate direction for this study. Solutions to non-linear requirements engineering problems may be "brittle"; i.e. small changes may dramatically alter solution effectiveness. Hence, it is not enough to just generate solutions to requirements problems---we must also assess solution robustness. This thesis aims to address two concerns: (a) Is demonstrating robustness a time consuming task? and (b) Is it necessary that solution quality be traded off against solution robustness?;Using a Bayesian ranking heuristic, the KEYS2 algorithm fixes a small number of important variables, rapidly pushing the search into a stable, optimal plateau. By design, KEYS2 generates decision ordering diagrams (in time experimentally shown to be O(N2)). …

The present study examined relations of death anxiety to age, gender, trait anxiety, future time perspective, religiousness, spirituality, and religious doubt. The primary goals of the investigation were to test for a curvilinear relation between religious meaning and death anxiety and to test whether the relations of age and gender with death anxiety were mediated by trait anxiety, future time perspective, religiousness, spirituality, and religious doubt. Participants were adults (18 to 89 years of age, M = 38.28 years, SD = 19.30, 79.1% female, 93.8% Caucasian) who completed the pertinent questionnaires online. Objectives. Postpartum maternal sleep disturbance is common. However, little research has examined postpartum fathers' sleep. Additionally, the magnitude of postpartum mothers' and fathers' daytime sleepiness has not been objectively indexed. The aims of this dissertation study were to: (1) objectively examine the difference in sleep and sleepiness levels among first-time mothers and fathers during their early postpartum period; (2) examine parents' perceptions of their own and their partner's mood, sleep, and sleepiness.;Method. The purpose of the present study was to examine boys' and girls' endorsement of communal and agentic conflict-management strategies in three types of relationships: same-sex friends, other-sex friends, and romantic relationships. Relationship type was examined as a moderator of gender differences and similarities in strategies. Also, the role of gender-typed personality traits (expressive, instrumental) was examined as a covariate to investigate whether gender differences in conflict-management strategies reflect personality traits.;Participants (N = 108; 49 boys; 59 girls) were adolescents aged 14-17 years (M age = 15.79 years, SD = 1.07). Research suggests mood can influence recall of emotionally-relevant information. Yet, despite multiple studies examining the association of anxiety and exaggerated prediction and recall of dental pain, the influence of other moods on prediction and recall of dental pain remains poorly investigated. Further, the potential moderation and mediation effects for dental fear, fear of pain, and mood state have not been properly researched. The present study investigated variables associated with predicted pain (pain expected during the dental procedure) and recalled pain in oral surgery patients. The varied growing conditions, fractured topography, and diversity of woody species in the Central Appalachians ensure that the harvest response of forest stands in the region will never be easily predictable. Clearcutting exposes the seedbed and freshly cut stumps of a harvested forest to full sunlight, encouraging the regeneration of the greatest number of species possible for that region. This exploratory study examined Vuot Len So Phan , a Vietnamese philanthropy newspaper column in Sai Gon Tiep Thi, a Vietnamese newspaper from April to December 2009. Guided by framing literatures, 39 episodic frames stories portraying financially disadvantaged people were content analyzed in terms of demographics of the featured subjects and emotional phrases used in the stories. The hypothesis predicting a positive correlation between emotional phrases and money raised was supported. This means the more emotional phrases used in an episodically framed story, the more money it was likely to raise. This study found an unexpected result that donations were …
