The Child As Victim And Perpetrator: Laws Punishing Juvenile "Sexting", Joanna L. Barry Jan 2010

The Child As Victim And Perpetrator: Laws Punishing Juvenile "Sexting", Joanna L. Barry

Vanderbilt Journal of Entertainment & Technology Law

As penalties for child pornography increase in severity across the United States, new technologies and teenage ingenuity are creating problems that legislatures never considered. In response to the "sexting" phenomenon, prosecutors are charging minors under traditional child pornography laws--originally intended to punish adult behavior--with creating, possessing, and distributing child pornography. These charges carry severe penalties, including sex offender registration, and unfairly punish impulsive juveniles. Some states, conscious of prosecutors' and parents' struggle to respond to this behavior, are proposing new legislation, such as supplementing traditional child pornography charges with a new offense for sexting and allowing prosecutors to choose from …

Allocating Liability For Deficient Warnings On Generic Drugs: A Prescription For Change, Sarah C. Duncan Jan 2010

Allocating Liability For Deficient Warnings On Generic Drugs: A Prescription For Change, Sarah C. Duncan

Vanderbilt Journal of Entertainment & Technology Law

Brand-name pharmaceutical companies create pioneer drugs that cure diseases around the world. However, because research and development costs are very high, brand-name drugs are expensive. In response to escalating costs, Congress enacted the Drug Price Competition and Patent Term Restoration Act of 1984 ("Hatch-Waxman Act") to promote generic competition. As generics become more prominent in the pharmaceutical marketplace, individuals injured by generic drugs are suing the manufacturers with more frequency. The cases often turn on which company should bear the liability for failing to warn--the brand-name manufacturer or the generic drug maker. Although the injured person took the generic drug, …

George W. Bush's Rhetoric Of Compassionate Conservatism And Its Value As A Tool Of Presidential Politics, Richard Holtzman

History and Social Sciences Faculty Journal Articles

This essay presents a situational analysis of George W. Bush’s rhetoric of compassionate conservatism. It explores Bush’s regular use of this discourse to address a number of political exigencies that confront all presidents, such as displaying personal character, framing issues, and energizing national values. I examine Bush’s public discourse from the declaration of his presidential candidacy in 1999 to his 2002 State of Union address to illuminate the development of this rhetorical construct and identify how it was employed to address shifting rhetorical situations. While the language did not change over time, the purposes and meanings of compassionate conservatism were …

Creating Electronic Evidence Rooms For Ncate Accreditation: Using College Livetext Solutions, Natalie A. Johnson-Leslie

Teacher Education Faculty Publications

For nearly a century the clarion call for more accountability at all levels of education across the USA has been made. As a result, we find accreditation bodies (national, regional and specialized), in the USA being independent of the Department of Education. In this chapter, the focus will be on creating electronic evidence rooms for The National Council for the Accreditation of Teacher Education (NCATE). NCATE was developed over 50 years ago requiring concrete evidence that teacher candidates are prepared rigorously to acquire the relevant body of knowledge and field experiences needed for them to be successful teachers. With technological …

In this comprehensive article, Professor Varona identifies and examines five interrelated tactical lessons the LGBT movement can glean from these recent defeats. He also provides a roadmap at the end of the Introduction to the article, describing the five subsections devoted to these individual lessons.

Loss Of The Monster: From Horror To Hedonism In "The Picture Of Dorian Gray", Joy Larissa Scholing Jan 2010

Loss Of The Monster: From Horror To Hedonism In "The Picture Of Dorian Gray", Joy Larissa Scholing

USF St. Petersburg campus Honors Program Theses (Undergraduate)

"Basil Hallward is what I think I am: Lord Henry what the world thinks me: Dorian is what I'd like to be--in other ages perhaps," Oscar Wilde says of the characters in his only novel, The Picture of Dorian Gray (Letters 352). One cannot determine how flippant or serious he might have been in making that statement, but it nonetheless encapsulates one of the greatest difficulties in studying Wilde: determining where art and biography intersect in his works.

Increased Perfusion And Angiogenesis In A Hindlimb Ischemia Model With Plasmid Fgf-2 Delivered By Noninvasive Electroporation, B. Ferraro, Y. L. Cruz, M. Baldwin, D. Coppola, R. Heller

Bioelectrics Publications

Gene therapy approaches delivering fibroblast growth factor-2 (FGF-2) have shown promise as a potential treatment for increasing blood flow to ischemic limbs. Currently, effective noninvasive techniques to deliver plasmids encoding genes of therapeutic interest, such as FGF-2, are limited. We sought to determine if intradermal injection of plasmid DNA encoding FGF-2 (pFGF) followed by noninvasive cutaneous electroporation (pFGFE+) could increase blood flow and angiogenesis in a rat model of hindlimb ischemia. pFGFE+ or control treatments were administered on postoperative day 0. Compared to injection of pFGF alone (pFGFE-), delivery of pFGFE+ significantly increased FGF-2 expression for 10 days. Further, the …

Integration Of Spirituality And Cognitive-Behavioral Therapy For The Treatment Of Depression , Jennifer J. Good Jan 2010

Integration Of Spirituality And Cognitive-Behavioral Therapy For The Treatment Of Depression , Jennifer J. Good

PCOM Psychology Dissertations

Major depressive disorder (MDD) is a common mental health problem that is treated by many mental health practitioners. Cognitive-behavioral therapies have proven to be effective in helping restructure the cognitions of the client, which in turn reduces depressive symptom. Research has shown that individuals with MDD who value spirituality tend to view the world in a different way than those individuals that do not hold spirituality as an important value in their life. Spiritual individuals have religious schemas, and therefore, it would be important to incorporate spirituality into the treatment setting. This pilot study utilized a manualized treatment approach that …

Enhancing Group Cognitive Behavioral Therapy For Hispanic/Latino Clients With Depression : Recommendations For Culturally Sensitive Practice, Elizabeth Suarez Kuneman

PCOM Psychology Dissertations

Using a qualitative approach, this study explored the process of developing treatment suggestions for adding cultural sensitivity to an empirically supported, group cognitive-behavioral therapy (CBT) treatment manual for Hispanic/Latino clients with depression. Suggestions were formulated through the implementation of one vignette centered on a male character, addressing Hispanic/Latino cultural values as described in the literature. This researcher sought bilingual mental health providers (English-Spanish/Spanish-English) who worked with Hispanic/Latino clients; four from a group of ten who responded, reviewed the researcher’s suggestions and answered a seven item semi-structured questionnaire, which was developed to elicit their comments. Analysis of the data revealed themes …

The progression of chronic obstructive pulmonary disease (COPD) in older adults has been associated with a high prevalence of depression and anxiety (Kunik et al., 2005). The purpose of this study was to examine the effects of a COPD-specific individual cognitive behavioral therapy (CBT) intervention on depression and anxiety in older adults with COPD. Three older adult patients with moderate to severe COPD and comorbid depression and anxiety were recruited from a large hospital affiliated pulmonary practice to participate in this single subject multiple baseline feasibility study. Pre-test-post test assessments were conducted utilizing the Geriatric Depression Scale (GDS), the State …

School Psychologists' Confidence Level With Suicide Intervention And Prevention In The Schools, Jodi L. Stein-Erichsen

PCOM Psychology Dissertations

Schools psychologists are often called upon to work with suicidal students regardless of previous training or the comfort levels that they possess in this area (Debski, Spadafore, Jacob, Poole, and Hixon, 2007; Oordt, Jobes, Fonseca, and Schmidt, 2009). This study evaluates the results of a survey created by this study’s investigator. It was disseminated to members of the National Association of School Psychologists’ Listserv (NASP-Listserv) and gathers general and demographic data as well as information that contribute to the assessment of suicide intervention and prevention experience and training received by the participants. Also investigated was whether or not suicide intervention …

Gender Differences In Symptom Presentation Of Sexually Abused African American Children Ages 8 Through 12, Tania Czarnecki Wismar Jan 2010

Gender Differences In Symptom Presentation Of Sexually Abused African American Children Ages 8 Through 12, Tania Czarnecki Wismar

PCOM Psychology Dissertations

A well-documented connection exists between child sexual abuse and psychological symptoms that may persist into adulthood. Because of the significant public health implications of child sexual abuse, it is critical to examine the many variables related to such a potentially traumatic event, including its psychological effects and effects on gender, so that treatment providers are able to gain a better understanding of how males and females are affected by their abuse experiences. This study examined the role of gender on psychological symptoms in a largely understudied population of inner city African American children; it also examined gender roles regarding the …

Improving Validity Of Referrals For Comprehensive Autism Evaluation : A Tier-2 Direct Autism Observation Checklist, Mary Heim Elberson Jan 2010

Improving Validity Of Referrals For Comprehensive Autism Evaluation : A Tier-2 Direct Autism Observation Checklist, Mary Heim Elberson

PCOM Psychology Dissertations

Early identification of autism has received national attention and can lead to positive treatment outcomes. Research has demonstrated that qualitative impairments in social and communicative behaviors can be detected within the first two years of life. Unfortunately, many children with autism will not receive an autism diagnosis until they enter preschool. Professionals within school settings have not often received extensive training on assessment of autism spectrum disorders. Expectations, however, are that school-based teams can identify students who demonstrate characteristics associated with autism and refer those students for a comprehensive autism evaluation. Currently, autism screening tools are limited to rating scales …
