Positive Aging: Resilience And Reconstruction, Kenneth J. Gergen, M. Gergen Jan 2010

Positive Aging: Resilience And Reconstruction, Kenneth J. Gergen, M. Gergen

Psychology Faculty Works

From a social constructionist perspective, conceptions of aging emerge from participation in relationships. Thus, there is reason to counter the Western stereotype of aging as decline with a more robust and positive vision. In the same way, resilience in everyday life may be achieved by engaging creatively and collaboratively in coordinating the flow of circumstances and interpretations making up daily life. We illustrate the potentials of resilience in terms of collaborative attempts to generate positive reconstructions of what are often defined as debilitating circumstances: reduced income, diminished attractiveness in physical appearance, declining physical and mental abilities, physical handicaps, the “empty …

Habermas And The Feminist Engagement With Communicative Ethics: Solidarity And Utopian Interests As A Corrective To Normative Political Problematics, Taine Duncan Jan 2010

Habermas And The Feminist Engagement With Communicative Ethics: Solidarity And Utopian Interests As A Corrective To Normative Political Problematics, Taine Duncan

Electronic Theses and Dissertations

My dissertation subjects Habermas to a critique inspired by ethical and political feminist philosophy. Whereas Habermas believes particularized political interests are foundational for communicative ethics, neo-Marxist feminists argue that he makes naïve assumptions about the separation of public from private interests. Habermas, on one hand, sees communication as politically oriented dialectics that culminates in rational consensus and normative guidelines. Seyla Benhabib, on the other hand, claim that Habermas' notion of consensus is obtained through false dialectical syntheses. In her view, Habermas cannot preserve the utopian goals cherished by diverse and marginalized members of society. Benhabib thus attempts to reconcile contemporary …

Obama Effect: A Pipeline Issue, A Felicia Epps Jan 2010

Obama Effect: A Pipeline Issue, A Felicia Epps

Journal Publications

The law allows schools to strive for a "critical mass" of minority students. As law schools are already required to demonstrate a commitment to diversity, they must take steps to ensure that the pool of qualified candidates for positions in the academy expands instead of contracts. President Obama can have an impact on this process by taking steps to improve our educational system, encouraging students to make the most of their educations, and increasing the availability of higher education for all students. African Americans will then have access and ability to succeed in their academic pursuits. As a result, more …

Screen, Stabilize, And Ship: Emtala, U.S. Hospitals, And Undocumented Immigrants (International Patient Dumping), Jennifer M. Smith

Journal Publications

Pursuant to the Emergency Medical Treatment and Active Labor Act (EMTALA), patient dumping is illegal in the United States. American hospitals cannot inappropriately discharge or transfer unstable patients to other medical facilities in the United States without violating EMTALA. Yet, American hospitals are doing this very thing- international patient dumping, by inappropriately transferring or discharging (i.e. shipping) indigent undocumented immigrants in arguably unstable conditions to Third World medical facilities in the home country of the immigrant absent federal government oversight or compliance with EMTALA.

Correcting Mismatched Authorities: Erecting A New "Water Federalism", Robert H. "Bo" Abrams Jan 2010

Correcting Mismatched Authorities: Erecting A New "Water Federalism", Robert H. "Bo" Abrams

Journal Publications

In the United States water law is a subset of property law that controls the use and allocation of the water resource. Water law was, and remains, state law; nothing in the Constitution purports to change that. The scope of federal sovereignty at the time of nationhood did not include even the possibility of playing a major role in regulating resources because the national government was not a significant landholder. The twentieth century changed water federalism dramatically. In the twentieth century, even while laws and rhetoric respected the division of authority favoring the states, the real power over water in …

Segmentation In Social Marketing: Insights From The European Union’S Multi-Country, Antismoking Campaign, Gianfranco Walsh, Louise M. Hassan, Edward Shiu, J. Craig Andrews, Gerard Hastings

Marketing Faculty Research and Publications

Purpose – In 2005, the European Union launched a four-year antismoking television advertising campaign across its 25 Member States. This study aims to evaluate the second and third years (2006 and 2007) of the campaign based on telephone interviews with over 24,000 consumers (smokers, non-smokers, and ex-smokers).

Design/methodology/approach – The study focuses on smokers and examines the potential for using segmentation and targeting in informing the campaign. Three important factors are used to identify clusters: attitude toward the campaign; comprehension of the campaign; and inclination to think responsibly about their smoking behaviour.

Findings – Cluster analyses identify three distinct and …

A Tale Of Election Day 2008: Teaching Storytelling Through Repeated Experiences, Serge A. Martinez, Stefan H. Krieger

Faculty Scholarship

In Part I, we describe our experience supervising our clinic students on Election Day 2008 and our observations of their learning through the repetitive experiences they had representing several clients in rapid succession. In Part II, we discuss cognitive science research into skills learning, including several necessary elements for optimal learning. In Part III, we review existing legal scholarship on teaching storytelling to lawyers and compare it with cognitive science findings. Finally, in Part IV, we apply cognitive science principles to teaching storytelling through experiential learning and describe the necessary elements for creating effective learning situations. We also suggest some …

Trauma Exposure And Risk Recognition In Young Adults: The Role Of Attention Biases And Memory Biases, Elizabeth Reichert Jan 2010

Trauma Exposure And Risk Recognition In Young Adults: The Role Of Attention Biases And Memory Biases, Elizabeth Reichert

Open Access Master's Theses

The vast literature on trauma and revictimization suggests that it is still relatively unknown as to why some people are more susceptible to re-experiencing trauma. Research suggests that women with previous histories of sexual victimization are at increased risk for revictimization. Increasingly, studies have demonstrated that women with histories of sexual assault took significantly longer to recognize risk as compared to non-victimized women. However, the research on risk recognition has focused almost exclusively on sexually victimized women. Extant studies however, have not examined risk recognition in a more diverse group of traumatized individuals nor the potential contributions of cognitive biases …

Facilitating Wage Theft: How Court Use Procedural Rules To Undermine Substantive Rights Of Low-Wage Workers, Nantiya Ruan

Scholarly Works

In race and sex discrimination class actions, if a defendant employer makes a Rule 68 offer of judgment to the named plaintiffs, courts routinely refuse to dismiss the class claims. In stark contrast, in collective actions for failure to pay lawful wages, if a defendant employer makes a Rule 68 offer of judgment, courts will often dismiss the entire collective action as having been mooted by the named plaintiffs’ recovery. The outcome of such a dichotomy is that low-wage workers are increasingly unable to challenge unlawful wage violations successfully because the aggregation mechanism is too easily defeated. Without an ability …

Effectiveness Of Weight Control Through Weight Watch Programs, V. A. Black, P. Boumtje

Journal of the Arkansas Academy of Science

Linear probability estimation and survey data are employed to quantify the influence of the lifestyles of individuals on the change in their body mass index (BMI). The analysis also explores the effects of demographic characteristics (age, gender, and ethnicity) in weight management. Results suggest evidence of association between changes in lifestyle and changes in the BMI of individuals.

Exploring Men’S Intimate Relationships (With Feminism): Another Side Of Feminist Consciousness, Jol Dupler Jan 2010

Exploring Men’S Intimate Relationships (With Feminism): Another Side Of Feminist Consciousness, Jol Dupler

McNair Scholars Journal

Research on feminist consciousness and its corresponding benefits has largely been conducted on women. Many feminists find this problematic because it neglects feminist men and the favorable outcomes that have been empirically linked to strong feminist identities for men. In this study, I examined men’s feminist consciousness and explored whether correlations exist between men’s feminist consciousness, their partners’ and peers’ attitudes towards feminism, and the overall health of their long-term monogamous relationships. Several different measures of consciousness were utilized, including “Self-identification” (Gurin, 1980), “Feminist Analysis” (Henderson-King & Stewart, 1997) and “Sensitivity to Sexism” (Henderson-King & Stewart, 1997). Additionally, previously developed …
