Moving Targets: Placing The Good Faith Doctrine In The Context Of Fragmented Policing, Hadar Aviram, Jeremy Seymour, Richard A. Leo
Fordham Urban Law Journal
The debate sparked by Herring v. United States is a microcosm of the quintessential debate about the scope of the Fourth Amendment’s exclusionary rule and ultimately the appropriate breadth of police authority and constitutional review by courts. Offering a new reading of the decision, this article argues that Herring reflects a healthy dosage of real politic and an acknowledgment that American policing is characterized by a fragmented, localized structure with little overview and control, and much reliance on local agencies. Part I presents the authors’ interpretation of Herring as a case hinging upon the question “who made the mistake?” as …

“The Tunisia Paradox: Italy’S Strategic Aims, French Imperial Rule, And Migration In The Mediterranean Basin.” California Italian Studies 1, “Italy In The Mediterranean” (2010): 1-20., Mark I. Choate
Faculty Publications
This article explores contradictions in Italy’s relationship with the Mediterranean basin, setting Tunisia as a focal point. Tunisia was a paradoxical case at the intersection of Italy’s foreign policy: it was a former Roman imperial colony with a strategic location, but it was also a large and vibrant Italian emigrant settlement, like the Italian “colonies” of Buenos Aires, Sao Paolo, New York, and San Francisco. This situation caused much confusion in debates over how Italy should develop its international influence. Faced with a choice of priorities, the Italians of Tunisia called for Italy to concentrate on establishing territorial colonies in …
Social Class Experiences Of Working-Class Students: Transitioning Out Of College, Carey Treager Huber
Social Class Experiences Of Working-Class Students: Transitioning Out Of College, Carey Treager Huber
All-Inclusive List of Electronic Theses and Dissertations
Issues surrounding social class are often overlooked and rarely discussed in higher education; however, they affect students and institutions in critical ways. Although research has demonstrated that social class is a predictor of access to college, retention, academic performance, overall undergraduate and graduate experience, and college completion, little is known about the effect of social class on students‟ transition out of college and into the workplace. This transition is critical to explore because research suggests that the way in which students approach their first years of work have an impact on future job success and satisfaction. A phenomenological method of …

The Canadian Public Domain: What, Where, And To What End?, Carys J. Craig
Articles & Book Chapters
This essay explores the important body of scholarship that has emerged on the substance, nature, and role of the public domain in intellectual property law. I offer some concrete definitions of the public domain in the copyright context, identify some ongoing sources of debate in the literature, and highlight some particularly significant voices in public domain discourse. In doing so, my aim is twofold: first, I mean to present a reasonably comprehensive but concise review of the academic public domain movement, which has been directed towards substantiating and politicizing the concept of the public domain, second, I hope to re-situate …

Kno.e.sis Publications
In this paper we discuss the collection, semantic annotation and analysis of real-time social signals from micro-blogging data. We focus on users interested in analyzing social signals collectively for sensemaking. Our proposal enables flexibility in selecting subsets for analysis, alleviating information overload. We define an architecture that is based on state-of-the-art Semantic Web technologies and a distributed publish subscribe protocol for real time communication. In addition, we discuss our method and application in a scenario related to the health care reform in the United States.
Pollock, Macomber, And The Role Of The Federal Courts In The Development Of The Income Tax In The United States, Charlotte Crane
Pollock, Macomber, And The Role Of The Federal Courts In The Development Of The Income Tax In The United States, Charlotte Crane
Law and Contemporary Problems
Crane notes that the federal income tax is much more a lawyer's tax than either the income taxes of other jurisdictions or the several nonincome federal taxes. She locates the source of the legalistic nature of the tax in the Supreme Court's 1895 opinion in Pollock v. Farmers' Loan & Trust Co., invalidating the income tax of 1894 as a constitutionally impermissible unapportioned direct tax. She describes how the ghost of Pollock hovered over the income tax for decades after its reintroduction in 1913, inspiring Eisner v. Macomber and other judicial explorations of the constitutional meaning of income. Moreover, she …

Green Local Governments In Florida: Assessment Of Sustainability Performance, Naimish Upadhyay, Robert Brinkmann
School of Geosciences Faculty and Staff Publications
The sustainability performance of local governments that adopted the Florida Green Building Coalition’s Green Local Government standard was evaluated using a web-based review and survey of 26 local governments within the context of the Three Es of environment, equity, and economic development. The results indicate that while many local governments exhibit a broad commitment to sustainability as evidenced by the inclusion of sustainability in formal documents, such efforts are not present across all government functions or departments. In addition, while local issues are often addressed, interrelated sustainability goals of equity and economic development are not clearly articulated. Most local governments …

Rescuing Trafficking From Ideological Capture: Prostitution Reform And Anti-Trafficking Law And Policy, Janie Chuang
Rescuing Trafficking From Ideological Capture: Prostitution Reform And Anti-Trafficking Law And Policy, Janie Chuang
Scholarly Articles in Law Reviews & Journals
In the decade since it became a priority on the United States' national agenda, the issue of human trafficking has spawned enduring controversy. New legal definitions of “trafficking” were codified in international and U.S. law in 2000, but what conduct qualifies as “trafficking” remains hotly contested. Despite shared moral outrage over the plight of trafficked persons, debates over whether trafficking encompasses voluntary prostitution continue to rend the anti-trafficking advocacy community - and are as intractable as debates over abortion and other similarly contentious social issues. Attempts to equate trafficking with slavery invite both disdain and favor: they are often rejected …

Saving Saba Bank: Policy Implications Of Biodiversity Studies, Paul C. Hoetjes, Kent E. Carpenter
Saving Saba Bank: Policy Implications Of Biodiversity Studies, Paul C. Hoetjes, Kent E. Carpenter
Biological Sciences Faculty Publications
Saba Bank has always been an area of special importance to the neighboring island of Saba in the Netherlands Antilles. Sabans traditionally fished on the Bank as far back as 1907, but increasing foreign fishing pressures on the Bank in the 1970s and 1980s forced many Saban fishermen out. Concerns were compounded by the suspicion that shipping was also damaging the benthic habitat of the bank. Fishery legislation, enacted in 1996, brought an end to unlicensed fishing and established Coast Guard enforcement on the Bank, but also led to protests from neighboring countries that previously fished on the Bank.Research was …

Using data for 25,780 species categorized on the International Union for Conservation of Nature Red List, we present an assessment of the status of the world's vertebrates. One-fifth of species are classified as Threatened, and we show that this figure is increasing: On average, 52 species of mammals, birds, and amphibians move one category closer to extinction each year. However, this overall pattern conceals the impact of conservation successes, and we show that the rate of deterioration would have been at least one-fifth again as much in the absence of these. Nonetheless, current conservation efforts remain insufficient to offset the …

Climatic And Spatial Variations Of Mount Rainier's Glaciers For The Last 12,000 Years, Michael Leslie Hekkers
Dissertations and Theses
Regional paleoclimatic proxies and current local climate variables and were analyzed to reconstruct paleoglaciers in an effort to assess glacier change On Mount Rainier. Despite the dry and generally warm conditions (sea surface temperatures (SST) -0.15°C to +1.8°C relative to current temperatures), the previously documented McNeeley II advance (10,900 - 9,950 cal yr B.P.) was likely produced by air temperature fluctuations. The average SST record and the terrestrial climate proxies show cooling temperatures with continued dryness between McNeeley II and the Burroughs Mountain advance (3,442 - 2,153 cal yr B.P.). The paleoclimate during the Burroughs Mountain advance was both cool …

This Article reflects some of the insights from the Stanford Criminal Justice Center's (SCJC's) year-long project on data and operations integration in California's criminal justice system. Part I lays out some of the benefits of an integrated system as a means of illustrating why law enforcement agencies across the state are actively pursuing data integration. Part II discusses three organizational and political obstacles to creating an integrated system: defining what we mean by the criminal justice "system," drawing boundaries of relevant networks, and resolving tensions among state and local agencies with concurrent jurisdiction. Part III then discusses three ways in …

Internal Displacement In Colombia: Violence, Resettlement, And Resistance, Juan Esteban Zea
Dissertations and Theses
The majority of the estimated four million internally displaced persons (IDPs) in Colombia who have fled from their lands and homes have migrated to urban centers. This study, performed in Bogotá, Colombia between April and September 2009, examines how IDPs cope with living in a new, urban environment after violent displacement. I held interviews with IDPs, the non-displaced public, and government workers; performed participant-observation in government offices and neighborhoods; and examined archival material. The work examines cultural anthropological topics of violence, migration, and resistance. A discussion of state and structural violence reveals the current hardships many rural Colombians face. Analysis …

Port Development In Muskegon, Michigan, Brian Mulnix
Port Development In Muskegon, Michigan, Brian Mulnix
SPNHA Review
Muskegon Lake provides one of the deepest ports on the Great Lakes. While the port is used on a regular basis for recreational and commercial activity, there may be potential for expanding these activities and providing for a self-sustaining facility that will provide the needed infrastructure to enhance port use in Muskegon. Regionally, West Michigan provides an extensive transportation network that would support such development. With the manufacturing and agricultural base in West Michigan, there is much potential for an expanded import-export market that would provide port related activity. My research provides a basic framework for looking at the port …
Sustainable Mountain Tourism Development Illustrated In The Case Of Switzerland, Benedikt Schorner
Sustainable Mountain Tourism Development Illustrated In The Case Of Switzerland, Benedikt Schorner
SPNHA Review
The concept of sustainable mountain tourism development meets the needs of the present tourists and host regions while protecting and enhancing opportunities for future generations (WTO, 2001). The principles of sustainable tourism development are composed of environmental, economic, and socio-cultural aspects. In order to be successful in the long-term, an equilibrium among these three dimensions must be established (Samy & El-Barmelgy, 2005). The Swiss Federal Council established a general framework for its Sustainable Development Strategy 2000, which is used in this paper to show successful policymaking in this area. Furthermore, policy priorities, recommendations, challenges, and successful strategies for sustainable mountain …
