Acceptable Deviance And Property Rights, Mark A. Edwards Jan 2010

Acceptable Deviance And Property Rights, Mark A. Edwards

Faculty Scholarship

Compliance with - or deviance from - law is often dependent upon the law’s convergence with - or divergence from - normative sensibilities. Where the legality and social acceptability of behavior diverge, some deviance is socially acceptable. Property rights evolve in response to changes in normative sensibilities. Constructing a model of acceptable deviance and applying it to property rights, we can predict and actually observe the evolution of property rights in response to changes in normative sensibilities in areas as diverse as file-sharing, foreclosures, the use of public space, and fishing rights. We can also predict and observe stresses in …

Which Came First The Parent Or The Child?, Mary P. Byrn, Jenni Vainik Ives Jan 2010

Which Came First The Parent Or The Child?, Mary P. Byrn, Jenni Vainik Ives

Faculty Scholarship

From the moment a child is born, she is a juridical person endowed with constitutional rights. A child’s parents, however, do not become legal parents until a state statute grants them the fundamental right to raise one’s child. The state, therefore, exercises considerable power and discretion when it drafts the parentage statutes that determine who becomes a legal parent. This article asserts that the state, through its parens patriae power, has a duty to act as an agent for children when it drafts its parentage statutes. In particular, the state must adopt parentage statutes that satisfy children’s fundamental right to …

Effective Environmental Management Of The National Park Service: A Case Study Of Channel Islands National Park, Daniel T. Olmsted Jan 2010

Effective Environmental Management Of The National Park Service: A Case Study Of Channel Islands National Park, Daniel T. Olmsted

CMC Senior Theses

The topic of protected area management serves as the focal point of my thesis. The fundamental question I seek to answer is; what constitutes effective environmental management and how is it exemplified in the National Park Service (NPS)? How exactly does the NPS continually earn the trust and confidence of the American people when so many other government agencies are viewed in a negative light? How does the Channel Islands National Park, in particular, shape the economic and political framework in which it operates to achieve its goals? How does this agency effectively manage such a complex ecosystem spanning across …

Renegotiating Barbuda's Commons: Recent Changes In Barbudan Open-Range Cattle Herding, Andrew Sluyter, Amy E. Potter Jan 2010

Renegotiating Barbuda's Commons: Recent Changes In Barbudan Open-Range Cattle Herding, Andrew Sluyter, Amy E. Potter

Faculty Publications

Barbuda remains little developed and sparsely populated relative to its neighbors in the Leeward Lesser Antilles, a rather extraordinary and relatively unknown Caribbean place. Much of its distinctiveness derives from the communal land-tenure system, itself rooted in three centuries of open-range cattle herding. Yet, as revealed through interviews, newspaper archives, and landscape observations, openrange cattle herding has declined over the past three decades, with related changes in land tenure. As the new Barbuda Land Act came into effect in 2008, codifying the communal tenure system, the very landscape elements that manifest open-range herding have become obscure. In particular, the rock-walled …

The Hispanic Atlantic's Tasajo Trail, Andrew Sluyter Jan 2010

The Hispanic Atlantic's Tasajo Trail, Andrew Sluyter

Faculty Publications

Produced along the Río de la Plata during the nineteenth century, shipped to Havana, and consumed by African slaves, the salt-cured beef known as tasajo affected both of those places and, to some degree, the Atlantic world in general. Initial exploration of the tasajo trail that connected Buenos Aires and Cuba employs primary sources such as nineteenth-century descriptions and shipping records to characterize the landscapes, places, routes, and agents of the largely unexplored research territory of that anomalous commodity: one that, unlike others such as sugar, slaves not only produced but also consumed; one that underpinned more prominent, latitudinal transatlantic …

Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton Jan 2010

Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton

Honors Theses

The human geography of Ecuador is changing. Urban Afro-Ecuadorians now outnumber those living in the two rural regions that have been the ancestral homelands of the population. This physical transformation assaults Ecuador's historically racialized geography, which conflated cities, modernity and white-mestizo identity. Though Afro-Ecuadorians living in the rural north had previously been physically and figuratively located outside of the national project, Ecuador’s new constitution has sought to reverse this institutionalized exclusion. National belonging has been reframed through the concept of interculturality, which recognizes diversity and equality at the same time. I conducted two periods of fieldwork in the north-central Chota …

Soviet Education: Communism In The Classroom, Alison W. Berryman Jan 2010

Soviet Education: Communism In The Classroom, Alison W. Berryman

Honors Theses

My thesis examines the Soviet Union’s educational system during Stalin’s rule. It proves that the goal of the Soviet educational system in the 1920s and 1930s was to instill strong Communist loyalty from a very early age and to expedite the process of industrialization by educating future workers in “socially useful” labor.

‘Drive-Thru’ Arbitration In The Digital Age: Empowering Consumers Through Regulated Odr, Amy J. Schmitz Jan 2010

‘Drive-Thru’ Arbitration In The Digital Age: Empowering Consumers Through Regulated Odr, Amy J. Schmitz

Faculty Publications

Online Dispute Resolution (ODR) has been promoted for quickly and conveniently resolving claims using online “drive-thru” processes instead of more costly and time-consuming face-to-face meetings and hearings. Most commentators have nonetheless focused mainly on non-binding or automated bidding processes, perhaps due in part to fairness concerns associated with off-line arbitration. This Article, however, explores the potential for online binding arbitration (OArb), and sheds new light on arbitration as means for empowering consumers to obtain remedies on their e-merchant claims. By moving arbitration online, OArb helps address concerns regarding companies’ use of arbitration clauses to curb consumers’ access to remedies on …

Lessons In Price Stability From The U.S. Real Estate Market Collapse, Andrea Boyack Jan 2010

Lessons In Price Stability From The U.S. Real Estate Market Collapse, Andrea Boyack

Faculty Publications

The U.S. residential housing market collapse illustrates the consequences of ignoring risk while funding mortgage borrowing. Collateral over-valuation was a foundational piece of the crisis. Over the past few decades, secondary markets, securitization, policy and psychology increased the flow of funds into real estate. At the same time, financial market segmentation divorced risk from reward. Increased mortgage capital availability, unmitigated by proper risk allocation, led to real estate price inflation. Social trends and government policies exacerbated both the mortgage capital over-supply and the risk-valuation disconnect.

The Dodd-Frank Act inadequately addresses the underlying asset valuation problem. Federal regulation may support market …

Increasing Teachers' Metacognition Develops Students' Higher Learning During Content Area Literacy Instruction: Findings From The Read-Write Cycle Project, Margaret Sauceda Curwen, Roxanne Greitz Miller, Kimberly A. White-Smith, Robert C. Calfee Jan 2010

Increasing Teachers' Metacognition Develops Students' Higher Learning During Content Area Literacy Instruction: Findings From The Read-Write Cycle Project, Margaret Sauceda Curwen, Roxanne Greitz Miller, Kimberly A. White-Smith, Robert C. Calfee

Education Faculty Articles and Research

Success in the 21st century, for individuals and societies, requires competence in comprehending and communicating in the academic disciplines--the natural sciences, history, geography, and more. The Read-Write Cycle (RWC) Project, a three year longitudinal research study conducted from 2005-2008 in ten public elementary schools in southern California, explored the effectiveness of curriculum and instructional strategies that integrate literacy with disciplinary knowledge with the simultaneous goals of: (1) enhancing students' literacy outcomes; and (2) broadening and deepening knowledge of the content area. Funded by the U.S. Institute of Education Sciences, the RWC Project concentrated over years one and two on 1,024 …

Relocation Revisited: Sex Trafficking Of Native Women In The United States, Sarah Deer Jan 2010

Relocation Revisited: Sex Trafficking Of Native Women In The United States, Sarah Deer

Faculty Scholarship

The Trafficking Victim Protection Act of 2000 (TVPA) signaled a comprehensive campaign by the United States (US) government to address the scourge of human trafficking in the US and abroad. The US rhetoric about sex trafficking suggests that the problem originates in foreign countries and/or is recent problem. Neither claim is correct. This article details the historical and legal context of sex trafficking from its origin among the colonial predecessors of the US and documents the commercial trafficking of Native women over several centuries. Native women have experienced generations of enslavement, exploitation, exportation, and relocation. Human trafficking is not just …

Solving The Childcare And Flexibility Puzzle: How Working Parents Make The Best Feasible Choices And What That Means For Public Policy, Arthur C. Emlen Jan 2010

Solving The Childcare And Flexibility Puzzle: How Working Parents Make The Best Feasible Choices And What That Means For Public Policy, Arthur C. Emlen

Regional Research Institute for Human Services

This monograph’s contribution to knowledge was two-fold: 1) reliable measures of the quality of childcare as perceived and assessed by the parents themselves; and 2) discovery that the quality of the care chosen by working parents depends upon the amount of flexibility they can muster from their immediate environment at work, at home, or from accommodating childcare providers. It doesn’t matter which source of flexibility works best for them. It’s the flexibility that allows optimum choice. The findings suggest that public policy should recognize the vast diversity of parental choices and the flexibility needed to improve their choices. That means …

Tracking Bare Sand Mobilization Arising From Landscape Manipulations In The Grasslands Destabilization Experiment (Gdex) In The Nebraska Sandhills Using Imaging Spectroscopy, Benjamin Helder

The Journal of Undergraduate Research

The Grassland Destabilization Experiment (GDEX) is a landscape scale manipulative experiment initiated in 2004 in the Nebraska Sandhills to evaluate changes in surface properties following the abrupt loss of stabilizing vegetation. The GDEX features five treatments allocated among ten plots of 120 m in diameter (1.13 ha). The Aggressive Bare Sand protocol included chemical defoliation and subsequent shallow disking and raking in 2004 to devegetate the plot with periodic physical disturbance to maintain bare sand. The Long Term Disturbance (Press) protocol includes an initial chemical defoliation in May 2005 and seasonal spring reapplications, but no physical disturbance. Short Term Disturbance …
