Exploring Arts Organizations As A Catalyst For Community Development, Amy Carrington Jan 2010

Exploring Arts Organizations As A Catalyst For Community Development, Amy Carrington

University of Kentucky Master's Theses

The purpose of this project was to examine the arts as a positive change agent for community development. Exploring how and for what purpose nonprofit arts organizations can create social capital can provide insight on how the arts industry can be a leader in the transformation of communities and regions around the globe. The perspectives of artists, community developers, sponsors and beneficiaries of the arts provided insight on how and in what ways the arts can evoke change by building connections and inspiring participation. Community development theorist Bhattacharyya (2004) distinguished community development from related fields such as economic development and …

Genetic Algorithm Controlled Common Subexpression Elimination For Spill-Free Register Allocation, Shashi Deepa Arcot Jan 2010

Genetic Algorithm Controlled Common Subexpression Elimination For Spill-Free Register Allocation, Shashi Deepa Arcot

University of Kentucky Master's Theses

As code complexity increases, maxlive increases. This is especially true in the case of the Kentucky If-Then-Else architecture proposed for Nanocontrollers. To achieve low circuit complexity, computations are decomposed to bit-level operations, thus generating large blocks of code with complex dependence structures. Additionally, the Nanocontroller architecture allows for only a small number of single bit registers and no extra memory.

The assumption of an infinite number of registers made during code generation becomes a huge problem during register allocation because the small number of registers and no additional memory. The large basic blocks mean that maxlive almost always exceeds the …

Rethinking Contractual Limits On Fiduciary Duties, Christina M. Sautter Jan 2010

Rethinking Contractual Limits On Fiduciary Duties, Christina M. Sautter

Journal Articles

The recent financial crisis has placed a renewed focus on completion risk in the world of mergers and acquisitions. Dealmakers have increasingly attempted to control for such risks by altering merger agreement provisions to achieve a greater level of deal certainty. This Article addresses one such provision – the merger recommendation covenant and its related fiduciary out. The purpose of the merger recommendation fiduciary out is to address a tension created by two fundamental precepts arising under corporate law and contract law – a board of director’s duties to the corporation and its stockholders versus the binding covenants of a …

When Is A Use In Commerce A Noncommercial Use?, Lee Ann Lockridge Jan 2010

When Is A Use In Commerce A Noncommercial Use?, Lee Ann Lockridge

Journal Articles

When is a use in commerce a noncommercial use? This question may sound like the opening for a ridiculous legal riddle, but it is a real conundrum in trademark dilution law. The current federal dilution statute, section 43(c) of the Lanham Act, creates liability based on the "use of a mark or trade name in commerce," when that use is likely to blur or tarnish a famous mark. At the same time, the statute characterizes certain activities as nonactionable "exclusions," including 'any noncommercial use of a mark." So the use of a mark in commerce can be a noncommercial use-but …

The Effects Of Multiple Deployments On Army Adolescents, Leonard Wong Dr., Stephen J. Gerras Dr. Jan 2010

The Effects Of Multiple Deployments On Army Adolescents, Leonard Wong Dr., Stephen J. Gerras Dr.

Books, Monographs & Collaborative Studies

Multiple deployments have become a way of life for our Soldiers. In Army families, these frequent deployments increase the burden on children who must face the stress and strain of separation and anxiety. The authors take a much-needed, detailed look at the effects of multiple deployments on Army adolescents. The results of this study reinforce some of what we already know concerning deployments and children, but they also reveal some very interesting, counterintuitive findings that challenge the conventional wisdom concerning Army adolescents. This study goes beyond merely explaining the impact 8 years of war is having on the children of …

From Gats To Apec: The Impact Of Trade Agreements On Legal Services, Laurel S. Terry

Faculty Scholarship

This article provides a comprehensive overview of the treatment of legal services in the United States’ international trade agreements. Although many individuals are now familiar with the General Agreement on Trade in Services (GATS), far fewer realize that legal services are included in at least fifteen international trade agreements to which the United States is a party. This article begins by identifying those trade agreements and other developments including the 2009 Legal Services Initiative of the Asia Pacific Economic Cooperation (APEC). The article continues by explaining the structure of the GATS and comparing its provisions to the provisions found in …

High Frequency Vco And Frequency Divider In Vlsi 90nm Technology, Paesol Veerakitti Jan 2010

High Frequency Vco And Frequency Divider In Vlsi 90nm Technology, Paesol Veerakitti

Browse all Theses and Dissertations

A Voltage Controlled Oscillator (VCO) is essentially a tunable frequency generator. A VCO is used as a part in PLL system which is a system that generates a stable oscillating signal. As the digital electronic industry demands an ever increasing performance in speed, VCO's are required to create higher frequency signals. However, the phase noise performance of a VCO decreases as the operating frequency gets higher. The LC VCO is developed in this thesis to be used in with a tunable frequency divider as a part of a PLL system. The LC VCO structure design takes the advantage of a …

I Could Have Been A Contender: Summary Jury Trial As A Means To Overcome Iqbal's Negative Effects Upon Pre-Litigation Communication, Negotiation And Early, Consensual Dispute Resolution, Nancy A. Welsh

With its recent decisions in Ashcroft v. Iqbal and Bell Atlantic v. Twombly, the Supreme Court may be intentionally or unintentionally “throwing the fight,” at least in the legal contests between many civil rights claimants and institutional defendants. The most obvious feared effect is reduction of civil rights claimants’ access to the expressive and coercive power of the courts. Less obviously, the Supreme Court may be effectively undermining institutions’ motivation to negotiate, mediate - or even communicate with and listen to - such claimants before they initiate legal action. Thus, the Supreme Court’s recent decisions have the potential to deprive …

Regulation And Mindful Resident Care In Nursing Homes, Cathleen S. Colón-Emeric, Donde Ashmos Plowman, Donald Bailey, Kirsten Corazzini, Queen Utley-Smith, Natalie Ammarell, Mark Toles, Ruth Anderson

Department of Management: Faculty Publications

Regulatory oversight is intended to improve the health outcomes of nursing home residents, yet evidence suggests that regulations can inhibit mindful staff behaviors that are associated with effective care. We explored the influence of regulations on mindful staff behavior as it relates to resident health outcomes, and offer a theoretical explanation of why regulations sometimes enhance mindfulness and other times inhibit it. We analyzed data from an in-depth, multiple-case study including field notes, interviews, and documents collected in eight nursing homes. We completed a conceptual/thematic description using the concept of mindfulness to reframe the observations. Shared facility mission strongly impacted …
