Throughout the 1980's and onward, professional commentary, editorials and models have been put forward to expand roles for school psychologists beyond assessment and special education. The harbinger has been to move away from traditional roles towards including all students in prevention, mental health and regular education initiatives. Recent legislation passed including NCLB, 2001 and IDEA, 2004 for schools across the country represented a major change for the directions of public school curriculum to include scientific based research instruction, more accountability and increased assessment at each grade level. In October, 2009, I attended a presentation on Sustainability where the argument was made this concept is an issue for government and administrative agencies. The problem with this summation is in its exclusion of individuals existing outside of these agencies who interact with their environment on a daily basis. This exclusion potentially encompassed an extinguishing effect in that it closed off the term to multiple interpretations and possibilities I believe sustainability possesses; a "closing" that does not provoke the liberating nature associated with more open forms of dialogue and engagements. Over the past several years excavations have been underway within a structure at the Mont Repose plantation site located near Coosawhatchie, South Carolina. This structure has yielded an array of artifacts including numerous faunal remains. Species recovered thus far include domestic species such as cow, pig, and chicken. The wild species represented within the collection include deer, opossum, raccoon, fish, bird, turtle, and alligator. By comparing the findings from the Mont Repose structure with other coastal plantation sites, it is suggested that conclusions can be drawn about who was occupying the structure. Universal Biases In Self-Perception: Better And More Human Than Average, Steve Loughnan, Bernhard Leidner, Guy Doron, Nick Haslam, Yoshihisa Kashima, Jennifer Tong, Victoria Yeung

There is a well-established tendency for people to see themselves as better than average (self-enhancement), although the universality of this phenomenon is contested. Much less well-known is the tendency for people to see themselves as more human than average (self-humanizing). We examined these biases in six diverse nations: Australia, Germany, Israel, Japan, Singapore, and the USA. Both biases were found in all nations. The self-humanizing effect was obtained independent of self-enhancement, and was stronger than self-enhancement in two nations (Germany and Japan). Self-humanizing was not specific to Western or English-speaking cultures and its magnitude was less cross-culturally variable than self-enhancement. …

Western burrowing owls (Athene cunicularia hypugaea) are ground-dwelling owls distributed throughout western North America. Because of population declines, this species is considered endangered in Canada, and burrowing owls are listed as a species of conservation concern in states of the western USA. Korfanta et al. (2002) previously presented primers for seven microsatellite loci in burrowing owls. Parentage and relatedness studies require a larger number of markers for accuracy and precision. Here, we developed and characterized 18 additional microsatellite DNA loci, and we tested these loci in 23 individuals. The number of alleles per locus ranged from 2 to …

Note – The Un-Creation Of Rights: An Argument Against Administrative Disclaimers, Josephine K. Mason

Boilerplate disclaimers appear with some frequency in administrative regulations, yet there has been a striking absence of discussion as to their validity. This Note argues that administrative disclaimers threaten two key constitutional concerns inherent in administrative law—proper government structure and fairness to individuals—and that courts should therefore approach administrative disclaimers with a high degree of skepticism.

Since the Supreme Court’s widely criticized decision in DeShaney v. Winnebago County Department of Social Services, the principle that the Constitution affords no relief for a social worker’s failure to prevent harm to a child has been described as a “staple of our constitutional law.” Whatever might be said about this principle on its own terms, it produces very troubling incentives for social workers, who may still face constitutional tort liability when they act affirmatively to intervene in troubled families—the unjustified removal of a child from her parents’ custody, after all, is the sort of infringement proscribed by our Constitution’s …

The 1969 case Stanley v. Georgia forbade the government from restricting the books that an individual may read or the films he may watch “in the privacy of his own home.” Since that time, the Supreme Court has repeatedly emphasized that Stanley’s protection applies solely within the physical boundaries of the home: While obscene books or films are protected inside of the home, they are not protected en route to it—whether in a package sent by mail, in a suitcase one is carrying to one’s house, or in a stream of data obtained through the Internet. The purpose of this dissertation was to compare the characteristics and attributes of an effective first grade teacher of writing to English learners through the lens of the "third space." The "third space" represents a place where sociocultural theory interacts with language and culture, and authentic, integrated literacy instruction. Because there is no empirical evidence to support the theory of the "third space" the observation and interview data were analyzed using literature that draws on three areas of study: English learners, first grade literacy, and urban schools. Economists are often called on to help address pressing problems of the day, yet many economists are uncomfortable about disclosing the values that they bring to this work. This essay explores how an inadequate understanding of the role of methodology, as related to ethics and human emotions of concern, underlies this reluctance and compromises the quality of economic advice. The tension between caring about the problems, on the one hand, and writing within the existing culture of the discipline, on the other, are illustrated with examples from U.S. policymaking, behavioral economics, and the economics of climate change and global poverty. …

Nuclear magnetic resonance (NMR) spectroscopy has been extensively used to investigate numerous systems of interest, ranging from collections of molecules to living organisms. However, NMR suffers from one key drawback: an inherent lack of detection sensitivity, as compared to other common forms of spectroscopy. This is due to the minute nuclear magnetic moments and low nuclear spin polarization levels at thermal equilibrium (~10-5 to 10-6), and thus necessitates the use of relatively large sample volumes. One way to overcome this low detection sensitivity is to introduce a species with highly non-equilibrium nuclear spin polarization, such as `hyperpolarized' xenon-129. Hyperpolarized xenon …

The burning of fossil fuels, and other natural processes, has led to an increase of carbon dioxide (CO2) in the atmosphere. The equilibration of atmospheric CO2 with surface waters causes the ocean pH to decrease from the current value of 8.1. Evidence suggests that as the ocean becomes more alkaline, organisms such as the bay scallop, Argopecten irradians¸will become more stressed due to increased energy demands to maintain shell deposition and growth. Colostrum is the first milk produced by mammals within a 24 to 72 hour period after parturition. Bovine colostrum is sold commercially as a nutraceutical product and its manufacturers purport numerous health benefits of the product for treating gastrointestinal disorders, respiratory tract disorders, viral and bacterial infections, and promoting tissue repair.
Four commercially available colostrum products, two whey, and one non-fat dry milk were obtained on separate days. These products were analyzed for fat, protein, ash, moisture and dry matter content. One colostrum product did not adhere to label claims in that it contained a mean of 19.1% fat whereas …

Trillium persistens, a federally endangered perennial herb, exists as fragmented populations in Georgia and South Carolina, U.S.A.I quantified the demography of T. persistens across its range and described its associated plant community, including a fire-dependent habitat. To examine the demography of T. persistens, one study site was established in each of four population fragments (Battle Creek, Moccasin Creek, Moody Creek, and Panther Creek) located in and around Tallulah Gorge State Park. At Moody Creek, T. persistens occurs in the threatened, fire-dependent Table Mountain pine ecosystem, dominated by Pinus pungens. To gain insight into how genomic information is translated into cellular and developmental programs, the Drosophila model organism Encyclopedia of DNA Elements (modENCODE) project is comprehensively mapping transcripts, histone modifications, chromosomal proteins, transcription factors, replication proteins and intermediates, and nucleosome properties across a developmental time course and in multiple cell lines. We have generated more than 700 data sets and discovered protein-coding, noncoding, RNA regulatory, replication, and chromatin elements, more than tripling the annotated portion of the Drosophila genome. Correlated activity patterns of these elements reveal a functional regulatory network, which predicts putative new functions for genes, reveals stage- and …

West Virginia University's Center for Alternative Fuels, Engines, and Emissions (CAFEE) has designed and constructed, with support from the U.S. Department of Energy (DOE), the 'next level' transportable dual-primary full-flow dilution tunnel emissions-measurement laboratory. As one of the major contributors, the author participated in the design and the fabrication processes of this laboratory. A systematic SimulinkRTM model was built for the Particulate Matter (PM) sampling system and a parametric study of the PM system was performed. Corridor D was one of the original 23 highway corridors selected by the Appalachian Highway Development System in 1965 and stretches from Bridgeport, West Virginia to Cincinnati, Ohio. The last piece of Corridor D to be completed was the Blennerhassett Island Bridge which crosses over the Ohio River and Blennerhassett Island near Parkersburg, West Virginia and Belpre, Ohio. The Blennerhassett Island Bridge is a tied-arch style bridge about 1,220 m in length and 24 m above the ground and water surface. Why are some free trade agreements (FTAs) in the western hemisphere successfully negotiated and implemented while others seem to stagnate during negotiations? FTAs are more likely to develop when there is an asymmetrical power relationship and potential partners are satisfied with projected trade patterns. The European Union (EU) and United States have been successful in negotiating agreements with the Caribbean and Central American (CCA) countries. However, current bilateral and multilateral trade talks between the EU, the Common Market of the South (MERCOSUR), and United States are at a standstill. Since the 1990s, the amount of attention and funding for bicycle and pedestrian infrastructure has increased significantly. This, combined with the role of transportation in public health and environmental concerns, has raised expectations for engineering and planning practitioners to possess more knowledge and skills related to pedestrian and bicycle planning and design.
