Stealth Preemption: The Irs's Nonprofit Corporate Governance Initiative, James J. Fishman Jan 2010

Stealth Preemption: The Irs's Nonprofit Corporate Governance Initiative, James J. Fishman

Elisabeth Haub School of Law Faculty Publications

The Internal Revenue Service, the primary federal regulator of charities, has initiated a corporate governance initiative. The intervention by the Internal Revenue Service into an area traditionally the preserve of state nonprofit corporate law has little relationship to issues of tax compliance. This corporate governance initiative has been accomplished in the face of IRS acknowledgement that it has no statutory authority relating to these issues. Yet, the power of the Service to recognize tax exempt status and the method it has used to ensure it vision of correct corporate governance practices through a series of questions when an organization applies …

Evaluating The Target Pipeline In A Pharmaceutical Acquisition, Daniel Vass Jan 2010

Evaluating The Target Pipeline In A Pharmaceutical Acquisition, Daniel Vass

Business and Economics Honors Papers

Many firms in the pharmaceutical industry turn to acquisitions when faced with gaps in their drug development pipelines and patent expirations as an alternative to making long-term investments in internal research and development. Investors are generally negative on this strategy, and upon the announcement of a pharmaceutical acquisition the stock of the acquiring firm often drops. This decline in share price creates an opportunity for the investor who can identify the characteristics of a target firm that increase the probability that the transaction will ultimately be a success, as measured by the subsequent appreciation in the acquirer's stock. It is …

A Current Review Of Chinese Land-Use Law And Policy: A "Breakthrough" In Rural Reform?, Robin Dean, Tobias Damm-Luhr Jan 2010

A Current Review Of Chinese Land-Use Law And Policy: A "Breakthrough" In Rural Reform?, Robin Dean, Tobias Damm-Luhr

Washington International Law Journal

Three decades ago, China moved from a communal system of farming to a system that granted more extensive land-use rights to individual households, starting rural China on a path to greater prosperity. Today, however, the law and policy promulgated by the Chinese government prevents farmers from fully realizing this prosperity. The Land Administration Law gives farmers thirty-year contractual rights to the land they farm and the Law on Rural Land Contracting strengthens this right by more specifically enumerating requirements for land contracting and the transfer of contractual rights. Nevertheless, the rural-urban gap is the worst it has been in decades …

Hydatid Cyst Disease Of The Thorax, Saulat H. Fatimi, Naima Waqar Butt, Taimur Saleem, Mohammad Asim Beg Jan 2010

Hydatid Cyst Disease Of The Thorax, Saulat H. Fatimi, Naima Waqar Butt, Taimur Saleem, Mohammad Asim Beg

Section of Cardiothoracic Surgery

Hydatid disease is a frequently encountered entity in endemic areas and constitutes a serious health problem. The lung is the second most commonly affected organ after the liver. In three of four cases of pulmonary hydatid cyst, the cyst is solitary. The early phase after primary infection is always asymptomatic. Primary symptoms in patients with pulmonary cystic echinococcosis include cough, fever, and chest pain. The clinical and radiological manifestations for the hydatid cyst in the lung depend on the integrity of the cyst. Bronchial fistulization is an important event in the evolution of the cyst. In cases of dubious orientation …

Effect Of Standing Estrus Prior To An Injection Of Gnrh On Steriodogenic Enzyme Expression In Luteal Tissue, Kaycee Gebhart Jan 2010

Effect Of Standing Estrus Prior To An Injection Of Gnrh On Steriodogenic Enzyme Expression In Luteal Tissue, Kaycee Gebhart

The Journal of Undergraduate Research

Cows detected in estrus around the time of fixed-time AI had increased pregnancy success and progesterone concentrations. Additionally, GnRH following onset of estrus influenced LH pulse frequency and CL formation/function. Therefore our objective was to determine steriodogenic enzyme expression within luteal tissue of cows that were or were not detected in standing estrus prior to an injection of GnRH. Cows were synchronized with the CO-Synch protocol (day -9 100 mg GnRH; day -2 25 mg PGF2α; day 0 100 mg GnRH). Estrus was detected with the HeatWatch system. Location and size of the ovulatory follicle was determined on day 0 …

If Mowat And Davis Are Correct, Then Teaching Is Hard: A Response To Elizabeth Mowat & Brent Davis, Kris H. Green, Bernard P. Ricca Jan 2010

If Mowat And Davis Are Correct, Then Teaching Is Hard: A Response To Elizabeth Mowat & Brent Davis, Kris H. Green, Bernard P. Ricca

Mathematical and Computing Sciences Faculty/Staff Publications

In lieu of an abstract, below is the article's first paragraph.

Mowat & Davis (this issue) present a model of learning mathematics that relies heavily on ideas from network (or graph) theory. The important questions (to us, at least) concern the dynamics of the nodes and links. Answers – even tentative ones such as we present here – to these questions lead to a second set of questions concerning the implications of these answers to teachers and researchers.

Staging The Self, Staging Empowerment: An Overview Of Latina Theater And Performance, Rita Urquijo-Ruiz Jan 2010

Staging The Self, Staging Empowerment: An Overview Of Latina Theater And Performance, Rita Urquijo-Ruiz

Modern Languages and Literatures Faculty Research

The origins of U.S. Latina1 theater and performance can be situated in the Southwest during the time this geographical region was still under Spanish colonial domination.2 Historically, Latinas have contributed to all the creative and technical components of U.S. theater and performance from its incipiency. I begin this chapter with a brief overview starting in the twentieth century and offer an example of an early type of performance, and then I proceed to focus, primarily, on the works created since 1980, briefly analyzing three Latina plays. Anglo American theater has slowly begun to recognize and incorporate theatrical cultural …

Assessment Strategies: Tools That Support Nonverbal Students, With Multiple Disabilities, Acquiring Literacy Skills, Jamie Creeden

Education Masters

The purpose of this study was to determine effective instructional tools that teachers can utilize to help plan instruction so that nonverbal students with multiple disabilities can acquire literacy skills in the classroom. One student, Trinity, who is nonverbal and has been diagnosed with Chiari malformation, was assessed using a variety of formal (Peabody Nonverbal Picture Vocabulary Assessment (Form A)), and informal assessment tools (interviews and teacher-made literacy assessments) to determine what literacy skills she possesses. The findings suggest that Trinity possesses a variety of receptive and expressive literacy skills typical of other children her age. Teachers just need the …

Unbalanced Nature, Unbounded Bodies, And Unlimited Technology: Ecocriticism And Karen Traviss’S Wess’Har Series, Heather I. Sullivan Jan 2010

Unbalanced Nature, Unbounded Bodies, And Unlimited Technology: Ecocriticism And Karen Traviss’S Wess’Har Series, Heather I. Sullivan

Modern Languages and Literatures Faculty Research

While nature is often claimed to be a space of harmonized balance or an antidote to the chaos of the modern world, we need a more grounded assessment of nature as endlessly changing and much less predictable than we like to assume. In this essay, I explore Karen Traviss’ provocative exploration of unbalanced nature and unbounded bodies in her wess’har series with the guidance of two ecocritics who reject the concept of balanced nature, Dana Phillips and Ursula Heise. Additionally, I turn to the environmental philosopher Val Plumwood for insights regarding Traviss’ spurious yet rather standard vision of an unlimited …

Vegetarians And Vegans In Kentucky, Danita Martha Hines Jan 2010

Themistius On Concept Acquisition And Knowledge Of Essences, Myrna Gabbe Jan 2010

Themistius On Concept Acquisition And Knowledge Of Essences, Myrna Gabbe

Philosophy Faculty Publications

Themistius's (ca. 317-ca. 388 C.E.) paraphrase of the De Anima is an influential and important work; however, it is not now regarded as profound or original and thereby sutTers from neglect. I argue that Themistius is misunderstood on the matter of Aristotle's productive and potential intellects. It is commonly held that Themistius gives to the productive intellect the role of illuminating images in order to produce universal thoughts In the potential intellect with epistemic certainty. I argue that Themistius's productive intellect does not transform images to reveal the forms contained therein, but gives to the potential intellect the ability, first, …

Feminism, Cultural Violence Of, Danielle Poe Jan 2010

Feminism, Cultural Violence Of, Danielle Poe

Philosophy Faculty Publications

For most, if not all, self-defined feminists, feminism means support for equality between women and men. The difficulty with this definition, though, is determining what one means by "equality," by "women and men," and by "sex" and "gender." For some feminists, equality requires that differences between women and men be acknowledged and valued. For other feminists, equality means that the category "human" encompasses women and men and that the differences within a sex are greater than differences between the sexes.

Feminists also differ on what they mean by "women" and "men"; these terms can be defined biologically, genetically, culturally, religiously, …

Branched And Spiral Organic Nanotubes Based On The Self-Assembly Of Bile Acids, Xuejun Zhang Jan 2010

Branched And Spiral Organic Nanotubes Based On The Self-Assembly Of Bile Acids, Xuejun Zhang

Electronic Theses and Dissertations

The self-assembly of chiral amphiphilic molecules in aqueous solutions is of particular interest because the chirality of individual molecules is often expressed in their supermolecular structures. Self-assembled tubes made of chiral amphiphilic molecules represent useful supramolecular architectures which hold promise as controlled release vehicles for drug delivery, encapsulates for functional molecules, and nanoreactors for chemical reactions. Lithocholic acid (LCA) is a secondary bile acid with the concentration being identical to that of cholesterol in the hepatic bile and gallbladder. It has a rigid, nearly planar hydrophobic steroid nucleus, with four hydrogen atoms and one hydroxyl group directed toward the concave …

Tuning The Properties Of Nanomaterials As Function Of Surface And Environment, Ajay Karakoti Jan 2010

Tuning The Properties Of Nanomaterials As Function Of Surface And Environment, Ajay Karakoti

Electronic Theses and Dissertations

Nanotechnology has shaped the research and development in various disciplines of science and technology by redefining the interdisciplinary research. It has put the materials science at the forefront of technology by allowing the researchers to engineer materials with properties ranging from electronics to biomedical by using materials as diverse as ceramics to just plain carbon. These exceptional properties are achieved by minimizing the dimension of particles in such smaller domains that the boundary between the individual atoms, ions or cluster of particles is very small. This results in a change in conventional properties of particles from continuum physics to quantum …

Analysis And Optimization Of A Solar Thermal Collector With Integrated Storage, Monica Bonadies Jan 2010

Analysis And Optimization Of A Solar Thermal Collector With Integrated Storage, Monica Bonadies

Electronic Theses and Dissertations

Solar energy, a topic popular in the United States during the oil embargo of the 1970’s, has become a relevant topic once more with the current focus on reducing greenhouse emissions. Solar thermal energy in particular has become popular as it uses existing steam turbine technology to produce electricity, with the benefit of using solar energy to produce steam rather than coal or nuclear heat sources. Solar thermal can also be used at lower temperatures to heat water for pools or for residential use. While this energy source has its benefits, it has the problem of being opportunistic – the …

Comparison Of Traditional Standard Drainfield With Innovative B&G Treatment Bed For Nutrient Removal From Septic Tank Wastewater, Fahim Hossain Jan 2010

Comparison Of Traditional Standard Drainfield With Innovative B&G Treatment Bed For Nutrient Removal From Septic Tank Wastewater, Fahim Hossain

Electronic Theses and Dissertations

Nowadays people are more alert about conservation of water and water scarcity. The amount of usable water is decreasing due to unavailability of pure water for day to day use. Both surface and groundwater is contaminated by untreated wastewater discharged from improper onsite wastewater treatment system, nutrient laden agricultural runoff and increasing use of fertilizer in fields. This elevated nutrient level is increasing the maintenance and operation cost of water treatment plant. So it is an important task to remove those nutrients from wastewater and other water bodies by applying environmental friendly process. In the USA, about 25% homes are …

Real-Time Cinematic Design Of Visual Aspects In Computer-Generated Images, Juraj Obert Jan 2010

Real-Time Cinematic Design Of Visual Aspects In Computer-Generated Images, Juraj Obert

Electronic Theses and Dissertations

Creation of visually-pleasing images has always been one of the main goals of computer graphics. Two important components are necessary to achieve this goal --- artists who design visual aspects of an image (such as materials or lighting) and sophisticated algorithms that render the image. Traditionally, rendering has been of greater interest to researchers, while the design part has always been deemed as secondary. This has led to many inefficiencies, as artists, in order to create a stunning image, are often forced to resort to the traditional, creativity-baring, pipelines consisting of repeated rendering and parameter tweaking. Our work shifts the …

Assessment Of Aquifer Storage And Recovery Impact On Phosphorus Stability In Lake Sediment, Sha Liu Jan 2010

Assessment Of Aquifer Storage And Recovery Impact On Phosphorus Stability In Lake Sediment, Sha Liu

Electronic Theses and Dissertations

Lake Okeechobee, the second largest natural freshwater lake in the United States, had experienced a historical drought in 2007-2008 and the inflow to Lake Okeechobee has been reduced by 40% of the average daily mean between warm phase and cold phase due to the impact of Atlantic Multidecadal Oscillation in the past six decades. To cope with this water resources management problem, the US Army Corps of Engineers (USACE) proposed the largest national implementation plan of aquifer storage and recovery (ASR) project in the Kissimmee River Basin. Routine operation of ASR will deliver recovered water from ASR wells into the …

A New Development Of Feedback Controller For Left Ventricular Assist Device, Yu Wang Jan 2010

A New Development Of Feedback Controller For Left Ventricular Assist Device, Yu Wang

Electronic Theses and Dissertations

The rotary Left Ventricular Assist Device (LVAD) is a mechanical pump surgically implanted in patients with end-stage congestive heart failure to help maintain the flow of blood from the sick heart. The rotary type pumps are controlled by varying the impeller speed to control the amount of blood flowing through the LVAD. One important challenge in using these devices is to prevent the occurrence of excessive pumping of blood from the left ventricle (known as suction) that may cause it to collapse due to the high pump speed. The development of a proper feedback controller for the pump speed is …

A Field Investigation For The Wind Load Performance Of Vegetated Greenroofs Using Monitoring Systems, Melike Minareci Jan 2010

A Field Investigation For The Wind Load Performance Of Vegetated Greenroofs Using Monitoring Systems, Melike Minareci

Electronic Theses and Dissertations

Greenroof systems have been shown to be an environmentally friendly alternative based on various factors; such as, reduced lifecycle cost, improved air quality, ambient temperature reduction, stormwater management credit, sustainability and preservation of the environment. Recent research studies attempt to determine the construction methods of an ideal greenroof for environmental purposes, yet there is an absence of standards for the best design required to achieve acceptable structural performance and sustainability under wind loads. As a result, there is a need to document the effectiveness of greenroofs under high wind events by addressing the following questions: Do winds have an effect …

Female And Male Psychologists In Academic Administration: Resource Control And Perceived Influence, Jennifer Schenk Jan 2010

Female And Male Psychologists In Academic Administration: Resource Control And Perceived Influence, Jennifer Schenk

Doctor of Psychology (PsyD)

This study examined male and female psychologists in academic administrative positions with regard to their perceptions of their own power and their actual power within the administrative hierarchies in which they work. In the past, researchers have compared women and men in academic administrative positions with regard to parity of numbers, salaries, number of publications and citations, types of institutions where they work and, the job titles they hold. These indices had suggested that women administrators had less prestige, control fewer resources, and a more limited scope of job responsibilities than did men. However, there had been no comparison of …

Episodic Memory Model For Embodied Conversational Agents, Miguel Elvir Jan 2010

Episodic Memory Model For Embodied Conversational Agents, Miguel Elvir

Electronic Theses and Dissertations

Embodied Conversational Agents (ECA) form part of a range of virtual characters whose intended purpose include engaging in natural conversations with human users. While works in literature are ripe with descriptions of attempts at producing viable ECA architectures, few authors have addressed the role of episodic memory models in conversational agents. This form of memory, which provides a sense of autobiographic record-keeping in humans, has only recently been peripherally integrated into dialog management tools for ECAs. In our work, we propose to take a closer look at the shared characteristics of episodic memory models in recent examples from the field. …
