Functional Assessments In The Rodent Stroke Model, K.L. Schaar, M.M. Brenneman, S.I. Savitz Jan 2010

Functional Assessments In The Rodent Stroke Model, K.L. Schaar, M.M. Brenneman, S.I. Savitz

Psychology

Stroke is a common cause of permanent disability accompanied by devastating impairments for which there is a pressing need for effective treatment. Motor, sensory and cognitive deficits are common following stroke, yet treatment is limited. Along with histological measures, functional outcome in animal models has provided valuable insight to the biological basis and potential rehabilitation efforts of experimental stroke. Developing and using tests that have the ability to identify behavioral deficits is essential to expanding the development of translational therapies. The present aim of this paper is to review many of the current behavioral tests that assess functional outcome after …

Levinas, Law Schools And The Poor: They Stand Over Us, Marie Failinger Jan 2010

Levinas, Law Schools And The Poor: They Stand Over Us, Marie Failinger

Faculty Scholarship

In the style of philosopher Emmanuel Levinas, who has written about the ethics of the Face, this essay challenges the complacency of most American law schools in response to the plight of the poor and proposes ways in which the law school curriculum, space and programs can be re-configured to bring the poor into community with legal educators and students.

A Relationship Study Of Student Satisfaction With Learning Online And Cognitive Load, George Bradford Jan 2010

A Relationship Study Of Student Satisfaction With Learning Online And Cognitive Load, George Bradford

Electronic Theses and Dissertations

This study sought to explore if a relationship exists between cognitive load and student satisfaction with learning online. The study separates academic performance (a.k.a., 'learning') from cognitive load and satisfaction to better distinguish influences on cognition (from cognitive load) and motivation (from satisfaction). Considerations that remain critical to the field of instructional design, as they apply to learning online, were described and used to guide a review of the literature to find directions to fulfill the goal of this study. A survey was conducted and 1,401 students responded to an instrument that contained 24 items. Multiple analysis techniques found a …

“Runaway Train”: Controlling Crimes Committed By Private Contractors Through Application Of The Uniform Code Of Military Justice, Matthew Dahl Jan 2010

“Runaway Train”: Controlling Crimes Committed By Private Contractors Through Application Of The Uniform Code Of Military Justice, Matthew Dahl

Barry Law Review

This paper will argue that, in the absence of effective alternatives, the new law granting court-martial jurisdiction over civilians is a necessary step in effectively controlling crimes by private contractors and other civilians accompanying U.S. armed forces overseas if other measures are not effectuated. Part II will look at two important Supreme Court decisions that currently restrict the military’s ability to court-martial civilians, and it will also highlight the government’s attempts over the past 50 years to come up with a solution to the problem. Part III will examine three alternatives to the amendment to Article 2(a)(10) that could make …

The 'Show' In The 'Show Trial': Contextualizing The Politicization Of The Courtroom, Awol K. Allo Jan 2010

The 'Show' In The 'Show Trial': Contextualizing The Politicization Of The Courtroom, Awol K. Allo

Barry Law Review

Questioning the indifference of the law to its own normative correctness and its claim to legitimacy, this article explores the epistemological and ontological foundations upon which the concept and lexicon of show trial is predicated. By invoking the theory of performativity, the article distinguishes between the different models of show trials to allow for a more complex and nuanced reading of the particular nature of the show in judicial practices often called ‘show trials.’ By emphasizing the peculiarity of the ‘show’ in each ‘show trial’, the article seeks to reconceptualize the ambit of the criminal trial. Arguing against the emphasis …

Testing Assumptions Of Distance Sampling On A Pelagic Seabird, Paul M. Lukacs, Michelle L. Kissling, Mason Reid, Scott M. Gende, Stephen B. Lewis Jan 2010

Testing Assumptions Of Distance Sampling On A Pelagic Seabird, Paul M. Lukacs, Michelle L. Kissling, Mason Reid, Scott M. Gende, Stephen B. Lewis

Wildlife Biology Faculty Publications

Distance sampling along a line transect is used commonly for monitoring changes of birds’ abundance at sea. A critical yet rarely tested assumption of line-transect-sampling theory is that all birds along the transect line (i.e., directly in front of the boat) are detected or that probability of detecting a bird on the line can be estimated. As part of a long-term research and monitoring program for the Kittlitz’s Murrelet (Brachyramphus brevirostris), we tested the assumption of complete detection of murrelets on the water along a transect line directly in front of a moving boat. Following standard survey procedures, we approached …

You Drank My Milkshake! Accusations Of Water Rights Takings In Estate Of Hage V. United States, Holly E. Cheong

Nevada Law Journal

This Note examines both the physical and regulatory takings of water rights found in Estate of Hage and provides an analysis of how takings law should apply to water rights. Part II of this Note provides a brief background of takings law under the Fifth Amendment of the Constitution with a focus on case law involving water rights. Parts III and IV review the history of the Estate of Hage case and focus on the recent Estate of Hage decision, including Judge Smith's logic for finding that there was a taking of water rights. In Part V, this Note analyzes …

Mortality Of Parental Mountain Plovers (Charadrius Montanus) During The Post-Hatching Stage, Victoria J. Dreitz Jan 2010

Mortality Of Parental Mountain Plovers (Charadrius Montanus) During The Post-Hatching Stage, Victoria J. Dreitz

Wildlife Biology Faculty Publications

Monitoring, management, and conservation of grassland birds are topics of importance because of widespread population declines. Annual estimates of survival are available for many species, however knowledge of how survival varies on a seasonal basis remains poor. Information on the relative effects of breeding, overwintering, and migratory periods on population dynamics is necessary for effective management. Mortality risks often vary with the stage of the breeding cycle. In precocial species, mortality risks of adult birds are often higher during post-hatching care than prehatching. Using a multistate modeling approach, I investigated the influence of both environmental characteristics, measured by habitat, and …

Building A Mechanistic Understanding Of Predation With Gps-Based Movement Data, Evelyn Merrill, Ha˚Kan Sand, Barbara Zimmermann, Heather Mcphee, Nathan Webb, Mark Hebblewhite, Peter Wabakken, Jacqueline L. Frair

Biological Sciences Faculty Publications

Quantifying kill rates and sources of variation in kill rates remains an important challenge in linking predators to their prey. We address current approaches to using global positioning system (GPS)-based movement data for quantifying key predation components of large carnivores. We review approaches to identify kill sites from GPS movement data as a means to estimate kill rates and address advantages of using GPS-based data over past approaches. Despite considerable progress, modelling the probability that a cluster of GPS points is a kill site is no substitute for field visits, but can guide our field efforts. Once kill sites are …

Dead On The Vine: Living And Conceptual Art And Vara, Charles Cronin Jan 2010

Dead On The Vine: Living And Conceptual Art And Vara, Charles Cronin

Vanderbilt Journal of Entertainment & Technology Law

The Visual Artists Rights Act of 1990 (VARA) broadened general copyright protection under U.S. law by granting to artists who have created certain copyrightable physical works of visual art, the moral rights of attribution and integrity. Since the time of VARA's enactment (and for some time before) many artists have worked with unconventional genres and media to produce art that is not comfortably accommodated among the visual art works contemplated by VARA. An increasing number of recent works of Conceptual and Appropriationist Art raise doubts about fixation and original expression, both of which are required for copyrightability which, in turn, …

The Weak Protection Of Strong Encryption: Passwords, Privacy, And Fifth Amendment Privilege, Nathan K. Mcgregor Jan 2010

The Weak Protection Of Strong Encryption: Passwords, Privacy, And Fifth Amendment Privilege, Nathan K. Mcgregor

Vanderbilt Journal of Entertainment & Technology Law

While the constitutional protection afforded private papers has waxed and waned for more than a century, the Supreme Court has greatly restricted the Fifth Amendment privilege against self-incrimination--at least as applied to voluntarily prepared documents. Specifically, where the government knows of the existence and location of subpoenaed documents, the Fifth Amendment guarantee will not justify a failure to produce them, unless the act of production would itself incriminate the defendant. However, the Self-Incrimination Clause still precludes the compelled creation of documents that are both incriminating and testimonial.

The "private papers" doctrine has remained relatively stable for approximately thirty years now, …

I Put You There: User-Generated Content And Anticircumvention, Rebecca Tushnet Jan 2010

I Put You There: User-Generated Content And Anticircumvention, Rebecca Tushnet

Vanderbilt Journal of Entertainment & Technology Law

This Article discusses recent rulemaking proceedings before the Copyright Office concerning the anticircumvention provisions of the Digital Millennium Copyright Act (DMCA). During these proceedings, non-institutionally affiliated artists organized to assert their interests in making fair use of existing works, adding new voices to the debate. A proposed exemption for noncommercial remix video is justified to address the in terrorem effect of anticircumvention law on fair use. Without an exemption, fair users are subjected to a digital literacy test combined with a digital poll tax, and this regime suppresses fair use. The experience of artists (vidders) confronting the law illustrates both …

Field-Induced Quantum Phase Transitions In The Spin-1/2 Triangular-Lattice Antiferromagnet Cs2cubr4, Nathanael Alexander Fortune, Scott T. Hannahs, Y. Takano, Y. Yoshida, T. Sherline, A. A. Wilson-Muenchow, T. Ono, H. Tanaka Jan 2010

Field-Induced Quantum Phase Transitions In The Spin-1/2 Triangular-Lattice Antiferromagnet Cs2cubr4, Nathanael Alexander Fortune, Scott T. Hannahs, Y. Takano, Y. Yoshida, T. Sherline, A. A. Wilson-Muenchow, T. Ono, H. Tanaka

Physics: Faculty Publications

In classical magnetic spin systems, geometric frustration leads to a large number of states of identical energy. We report here evidence from magnetocaloric and related measurements that in Cs2CuBr4 — a geometrically frustrated Heisenberg S= 1/2 triangular antiferromagnet — quantum fluctuations stabilize a series of gapped collinear spin states bounded by first-order transitions at simple increasing fractions of the saturation magnetization for fields directed along the c axis. Only the first of these quantum phase transitions has been theoretically predicted, suggesting that quantum effects continue to dominate at fields much higher than previously considered.

The Potential For Gaseous Biofuels In Ireland, Darren Kenneally Jan 2010

The Potential For Gaseous Biofuels In Ireland, Darren Kenneally

Theses

According to the EU Renewables Directive 2009/28/EC, 20% of the energy across Europe needs to be renewable by 2020. This is inclusive of the energy utilised in the transport sector where 10% of this energy needs to be renewable. In order for Ireland to meet the targets set in the Renewables Directive various changes need to be applied. The utilisation of gaseous biofuels produced from the anaerobic digestion of various feedstocks will aid Ireland in meeting this directive.

In this study biodegradable municipal waste (BMW) and energy crops are analysed as potential feedstocks for the production of biomethane. This biomethane …

Undocumented Migrant Workers In A Fragmented International Order, Chantal Thomas Jan 2010

Undocumented Migrant Workers In A Fragmented International Order, Chantal Thomas

Cornell Law Faculty Publications

This Paper tries to show the effects of a central challenge of contemporary global governance: the "interaction between normative orders that are fundamentally different in their underlying conceptual structure." The argument is that the dynamics of globalization create and accentuate particular social phenomena as well as efforts towards coordinated regulation of these phenomena, but that the latter are far from sufficient to meet the former. A further assertion is that global relations and distributions of power determine the operation of this fragmented framework. Social vulnerability is reflected in and reinforced by it. As such, the undocumented migrant worker challenges, in …

Investigating Fabrication Methods For Micro Single-Chamber Solid Oxide Fuel Cells, Man Yang Jan 2010

Investigating Fabrication Methods For Micro Single-Chamber Solid Oxide Fuel Cells, Man Yang

Dissertations

A Solid Oxide Fuel Cell (SOFC) is a green energy technology that offers a cleaner and efficient alternative to fossil fuels. The efficiency and utility of SOFCs can be enhanced by fabricating miniaturized component structures within the fuel cell footprint. This research focuses on the microfabrication of parallel-connected inter-digitized design of micro single chamber SOFC (µ-SC-SOFCs). In this dissertation, candidate micro/nano fabrication techniques to precisely fabricate micro patterns on planar substrates have been studied. These include EBL, soft lithography, photolithography, and direct-writing. After analyzing preliminary results, two combinational approaches were further investigated. The first method involves the combination of the …

D Is For Digitize: An Introduction, James Grimmelmann Jan 2010

D Is For Digitize: An Introduction, James Grimmelmann

Cornell Law Faculty Publications

This symposium issue of the New York Law School Law Review collects seven articles springing from the D Is for Digitize conference on the Google Books lawsuit and settlement, held at New York Law School October 8-10, 2009. In the spirit of Chaucer's "good feyth," thirty panelists and over one hundred attendees (plus dozens more watching online) gathered to discuss the legal and social issues raised by the proposed settlement. For three days, lawyers, academics, librarians, programmers, and public-interest advocates met for a rich, respectful, and wide-ranging conversation on this once-in-a-lifetime settlement. These articles continue that conversation.
