Ecological Invasion In Spatially Competitive Systems, Andrew James Allstadt Jan 2010

Ecological Invasion In Spatially Competitive Systems, Andrew James Allstadt

Legacy Theses & Dissertations (2009 - 2024)

Although the term invasion conjures images of invasive species, the dynamics of rarity is fundamental to many ecological processes. The community-level effects of invasion are determined by interactions between individuals in the system. Competition is most intense between neighboring individuals, which may generate spatial organization that can affect the outcome and time scale of an invasion. In this dissertation, I use analytic and simulation models of invasion to study preemptive competition between a rare invading type, and a resident that already occupies the system. In Chapter 1, I give motivation for these studies, and then introduce a spatially structured, individual-based …

Offender Routines And Awareness Space : Looking Beyond Space And Place To Predict The Spatial Clustering Of Crime, Gina Penly Hall Jan 2010

Offender Routines And Awareness Space : Looking Beyond Space And Place To Predict The Spatial Clustering Of Crime, Gina Penly Hall

Legacy Theses & Dissertations (2009 - 2024)

Research confirms what many people witness everyday--levels of crime are higher at and around some places compared to others. Explanations surrounding the spatial clustering of crime incidents, or hotspots, typically focus on characteristics of the criminal event and devote little attention to the role of the offender. Building from ideas set forth in routine activities and crime pattern theories, the first goal of this dissertation is to address this missing element. The presence of crime hotspots are estimated using geocoded crime incidents. The resulting maps, along with bivariate and multivariate analyses, examine offender-based explanations for the development of crime hotspots …

Fall-Out: New York V. United States And The Low-Level Radioactive Waste Problem, Samantha Dreilinger Jan 2010

Fall-Out: New York V. United States And The Low-Level Radioactive Waste Problem, Samantha Dreilinger

Northwestern Journal of Law & Social Policy

For over thirty years, the United States has failed to solve its low-level radioactive waste problem. Working independently, state governments have not developed a single new disposal site for low-level radioactive waste. Congress' best efforts to address the growing quantities of waste included passing a law that, in part, required states to accept responsibility for all low-level radioactive waste. Unsurprisingly, most states opposed this provision and were relieved when the Supreme Court deemed it unconstitutional in New York v. United States. As the states and the federal government remain at an impasse, low-level radioactive waste accumulates in countless makeshift storage …

Crossroads And Signposts: The Ada Amendments Act Of 2008, Jeannette Cox Jan 2010

Crossroads And Signposts: The Ada Amendments Act Of 2008, Jeannette Cox

Indiana Law Journal

Although the apparent purpose of the 2008 amendments to the Americans with Disabilities Act (ADA) is solely to broaden the ADA 's protected class, the manner in which the amendments achieve this purpose erodes the statute's explicit textual support for understanding persons with disabilities as a politically subordinated minority. The amendments also strengthen the statutory link between the biological severity of a person's disability and that person's right to sue for ADA accommodations. Accordingly, for some courts, the amendments will reinforce the perception that the ADA differs from traditional civil rights law.

Federal courts' understanding of the ADA 's relationship …

Clinton, Ginsburg, And Centrist Federalism, Russell A. Miller Jan 2010

Clinton, Ginsburg, And Centrist Federalism, Russell A. Miller

Indiana Law Journal

This Article examines Justice Ginsburg's overlooked federalism jurisprudence and concludes that it almost perfectly complements President Bill Clinton's New Democratic centrism, especially his pro-state federalism agenda. The Article concludes that their nuanced, "centrist" approach to federalism has two characteristics. First,t hey value the states 'governing autonomy and show respect for the state agents that realize that autonomy. Second, they credit the states as intersubjective actors engaged in the pursuit of their interests, albeit in political processes usually carried out at the federal level.

Securities Intermediaries And The Separation Of Ownership From Control, Jill E. Fisch Jan 2010

Securities Intermediaries And The Separation Of Ownership From Control, Jill E. Fisch

Seattle University Law Review

The Modern Corporation & Private Property is a paradigm-shifting analysis of the modern corporation. The book is perhaps best known for the insights of Berle and Means about the separation of ownership from control and the consequences of that separation for the allocation of power within the corporation. The Berle and Means story focuses on the shareholder as the owner of the corporation. Berle and Means saw the mechanism of centralized management—in which the shareholder retains the economic interest but not the control rights associated with ownership—as threatening the conception of shareholder interests in terms of property rights. In particular, …
