Lovable Pirates - The Legal Implications Of The Battle Between Environmentalists And Whalers In The Southern Ocean Note, Amanda M. Caprari Jan 2010

Lovable Pirates - The Legal Implications Of The Battle Between Environmentalists And Whalers In The Southern Ocean Note, Amanda M. Caprari

Connecticut Law Review

The International Whaling Commission has banned commercial whaling by member nations since 1986. Although a member of this Commission, Japan has continued its whaling practices under the guise of scientific research, hunting hundreds of whales every season in the Antarctic waters. The Sea Shepherd Conservation Society, a radical environmentalist group, has declared war on the Japanese whaling fleet and mounted a campaign to attack the Japanese whaling fleet using nonlethal tactics. The environmentalists and whalers are now locked in a bitter battle in the Southern Ocean, where there is little enforcement of domestic and international law. This Note examines the …

Situations, Frames, And Stereotypes: Cognitive Barriers On The Road To Nondiscrimination, Marybeth Herald Jan 2010

Situations, Frames, And Stereotypes: Cognitive Barriers On The Road To Nondiscrimination, Marybeth Herald

Michigan Journal of Gender & Law

A study of the psychological literature can enhance legal theory by focusing attention on how the human brain perceives, distinguishes, categorizes, and ultimately makes decisions. The more that we learn about the brain's intricate operations, the more effective we can be at combating the types of gender biased decisions that influence our lives. In developing strategies to achieve equality, feminist, gay, lesbian, bisexual, transgender, and intersex activists would be wise to learn from the psychological literature. This Article highlights a few examples illustrating how this knowledge might re-direct strategic choices for combating gender inequality.

Defining Sex: On Marriage, Family, And Good Public Policy, Mark Strasser Jan 2010

Defining Sex: On Marriage, Family, And Good Public Policy, Mark Strasser

Michigan Journal of Gender & Law

Transgendered individuals and their families face legal risks that most families do not, at least in part, because state laws are often unclear about whether or under what conditions transgendered individuals are permitted to marry the individuals whom they love. Challenges to the validity of marriages involving the transgendered may arise under a variety of circumstances, ranging from cases in which individuals may have hidden or may not even have known that they were transgendered until after their marriages, to cases in which the individuals had already transitioned and had explained their personal histories to their partners before they were …

Reforming 501(C)(3): Putting The Charity Back In The Charitable Deduction, Jennifer Mccrabb Black

Richmond Journal of Law and the Public Interest

This paper seeks to lay out a proposal to redefine what it takes to receive tax-deductible donations. Part H of this paper will summarize the current state of the law as it applies to the charitable contribution deduction and the qualification for tax exemption under the Internal Revenue Code. Part III discusses the Charities Act 2006, a recent British act aimed at attempting to redefine charity for England and Wales by requiring organizations to prove that they provide a public benefit before receiving the benefits of being a charity. Part IV proposes additions and changes to the Internal Revenue Code …

Entity And Identity, Usha Rodrigues Jan 2010

Entity And Identity, Usha Rodrigues

Emory Law Journal

The function, indeed the very existence, of nonprofit corporations is undertheorized. Recent literature suggests that only preferential tax treatment adequately accounts for the persistence of the nonprofit form. This explanation is incomplete. Drawing on psychology¿s social identity theory, this Article posits that the nonprofit form can create a special ¿warm-glow¿ identity that cannot be replicated by the for-profit form. For example, a local nonprofit food cooperative sells more than the free-range eggs or organic strawberries that Whole Foods and other for-profits market so effectively. The co-op offers community participation and an investment in local farms, a distinctive ethos that is …

Conceptual Model For Thermal Limits On The Distribution Of Reptiles, J. Sean Doody, Jennifer A. Moore Jan 2010

Conceptual Model For Thermal Limits On The Distribution Of Reptiles, J. Sean Doody, Jennifer A. Moore

USF St. Petersburg Campus Faculty Publications

Recent climate change has re-invigorated scientific interest in the dynamics of geographic distributions of organisms. Climate responses and their biogeographical ramifications can be predicted indirectly by studying variation in fitness-related traits across environmental gradients in wide-ranging species. We review evidence for such variation in reptiles. Clinal variation in seasonal timing (onset) of nesting is common but may offer only minor compensation. In contrast, clinal variation in nesting behavior in two wide-ranging species suggests that reptiles can use nest site choice to counter climate differences. We suggest that when range boundaries located at climate extremes are determined by thermal conditions of …

Americans Perceptions Of Food Safety: A Comparative Study Of Fresh Produce, Beef And Poultry Products, Benjamin Morang’A Onyango, Neal Hooker, William Hallman, Cara Cuite Jan 2010

Americans Perceptions Of Food Safety: A Comparative Study Of Fresh Produce, Beef And Poultry Products, Benjamin Morang’A Onyango, Neal Hooker, William Hallman, Cara Cuite

College of Agriculture

This study examines public perceptions of the safety of fresh produce (spinach and lettuce), beef, and poultry, employing survey data collected during the 2006 nationwide recall of fresh spinach contaminated with E. coli O157:H7. The results show that white respondents perceived all products to be safe. In contrast, young people, people with only a high school education, and those with lower household incomes ($50,000 or below), were more likely to view fresh produce, beef, and poultry as unsafe. Trust in the USDA as well as conventional farmers contributed toward more positive perceptions of spinach and lettuce. Low levels of objective …

An Ill Wind: Air Pollution In The Pearl River Delta, Caitlin Morray Jan 2010

An Ill Wind: Air Pollution In The Pearl River Delta, Caitlin Morray

Washington International Law Journal

Marine transport is an efficient and cost-effective way to transport goods around the world; at least ninety percent of all global trade is served by the shipping industry and shipping trade is expected to triple in the next two decades. However, because of the poor quality of the fuel used by the shipping industry, ocean-going ships disproportionately impact the environment and human health. The shipping industry is presently estimated to generate almost thirty percent of the world’s smog-forming nitrogen oxide emissions and nearly ten percent of sulfur dioxide emissions that cause acid rain and deadly fine particles. The Pearl River …

Did Dr. Abe Sell His Soul? The Defamation Case In Japan's Hiv-Tainted Blood Scandal, Rebecca R. Carlson Jan 2010

Did Dr. Abe Sell His Soul? The Defamation Case In Japan's Hiv-Tainted Blood Scandal, Rebecca R. Carlson

Washington International Law Journal

Is Japan a “paradise for the press?” Or is robust discourse on matters of public interest in Japan stifled because of defamation laws that heavily favor the plaintiff? Kamakami v. Sakurai, as one of the final events in Japan’s HIV-tainted blood scandal, is a provocative and illustrative chapter in the freedom of press and defamation law in Japan. In the early 1980s, hemophiliacs faced an HIV epidemic. When researchers concluded the HIV virus could be transferred by blood, they recognized that the blood products created from plasma pooled from hundreds of donors used to treat hemophiliacs could carry the …
