Psychology: Faculty Publications and Other Works
What is the role of research in the field of pediatric psychology? To answer this question, it is useful to imagine what clinical practice would be like if we had no research foundation for our work. Without such a foundation, practitioners would have no basis for suggesting specific interventions or understanding why some interventions are successful and why others fail. Similarly, without a research foundation, assessments conducted with children would be based on unstandardized assessment methods, and no normative data would be available. Clearly, most of us would agree that scientific research is the foundation of pediatric psychology, including all …

We examined populations of perennial, shrubby buckwheats in the Eriogonum corymbosum complex and related Eriogonum species in the subgenus Eucycla, to assess genetic affiliations of the recently named E. corymbosum var. nilesii. The known populations of this varietyare all located in Clark County, Nevada, U. S. A. We compared AFLP profiles and chloroplast DNA sequences of plants sampled from populations of E. corymbosum var. nilesii with those of plants representing other E. corymbosum varieties and related Eriogonum species from Colorado,Utah, northern Arizona, and northern New Mexico. We found evidence of genetic cohesion among the Clark County populations as well astheir …

Bracken ferns (genus Pteridium) represent an ancient species complex with a natural worldwide distribution. Pteridium has historically been treated as comprising a single species, but recent treatments have recognized several related species. Phenotypic plasticity, geographically structured morphological variation, and geographically biased sampling have all contributed to taxonomic confusion in the genus. We sampled bracken specimens worldwide and used variable regions of the chloroplast genome to investigate phylogeography and reticulate evolution within the genus. Our results distinguish two major clades within Pteridium, a primarily northern hemisphere Laurasian/African clade, which includes all taxa currently assigned to P. aquilinum, and a primarily southern …

The chloroplast gene trnK and its associated group II intron appear to be absent in a large and ancient clade that includes nearly 90% of fern species. However, the maturase protein encoded within the intron (matK) is still present and located on the boundary of a large-scale inversion. We surveyed the chloroplast genome sequence of clade-member Adiantum capillus-veneris for evidence of a still present but fragmented trnK intron. Lack of signature structural domains and sequence motifs in the genome indicate loss of the trnK intron through degradation in an ancestor of the clade. In plants, matK preferentially catalyzes splicing of …

My View: Automated Weed Control In Organic Cropping Systems, Stephen L. Young
My View: Automated Weed Control In Organic Cropping Systems, Stephen L. Young
West Central Research and Extension Center, North Platte
In 2005, for the first time, all 50 states in the United States had some certified organic farmland (USDA 2007). Producers in the United States dedicated over 1.62 million hectares of farmland to organic production systems in 2005. The increase in the number of hectares of crops being grown organically has brought with it a growing need for more labor and nonconventional inputs for weed control. Currently, weed control is ranked as the number one production cost by organic and many conventional growers. Over the past 10 yr, development of machine-guided technologies for site-specific (precision) weed control has advanced rapidly, …

West Central Research and Extension Center, North Platte
Plant community functional composition can be manipulated in restored ecosystems to reduce the establishment potential of invading species. This study was designed to compare invasion resistance among communities with species functionally similar or dissimilar to yellow starthistle (Centaurea solstitialis), a late-season annual. A field experiment was conducted in the Central Valley of California with six experimental plant communities that included (1) six early-season native annual forbs (AF); (2) five late-season native perennials and one summer annual forb (NP); (3) a combination of three early-season native annual forbs and three late-season native perennials (FP); (4) six early-season non-native annual …

Differences In Nitrate Uptakeamong Benthic Algal Assemblages In A Mountain Stream, Michelle A. Baker, G. De Guzman
Biology Faculty Publications
We evaluated how benthic algal assemblages that vary in composition, richness, and other diversity metrics remove NO 3 -N from the water column of a mountain stream. Ecological theory and empirical studies suggest that ecosystem process rates should increase as richness increases because of niche separation or activity of dominant taxa. Accordingly, we predicted that algal assemblages with highest richness would show the highest rates of NO 3 -N uptake. To test this prediction, we transplanted 225 rocks representing 3 patch types (green, yellow, and brown) that differed macroscopically in algal composition from a lake outflow stream to a lake …
The Federal Common Law Of Nations, Bradford R. Clark
The Federal Common Law Of Nations, Bradford R. Clark
GW Law Faculty Publications & Other Works
Courts and scholars have vigorously debated the proper role of customary international law in American courts: To what extent should it be considered federal common law, state law, or general law? The debate has reached something of an impasse, in part because various positions rely on, but also are in tension with, historical practice and constitutional structure. This Article describes the role that the law of nations actually has played throughout American history. In keeping with the original constitutional design, federal courts for much of that history enforced certain rules respecting other nations' "perfect rights" (or close analogues) under the …

This essay examines the WTO’s dispute resolution system known as the Dispute Settlement Understanding (“DSU”). Inspiration for this essay comes from an influential article written by Michael Reisman four decades ago titled “The Enforcement of International Judgments.” Professor Reisman’s article presented a model for improving enforcement of international judicial decisions in cases between states. My essay shows that the DSU has achieved much of what Professor Reisman envisioned with respect to systematic enforcement of multilateral tribunal decisions. My essay begins by summarizing the institutional improvements recommended by Professor Reisman. Then the essay demonstrates how the DSU achieves many of those …

Criminalizing Humanitarian Intervention, Sean D. Murphy
GW Law Faculty Publications & Other Works
The States Parties of the International Criminal Court (ICC) will likely vote in 2010 on whether to amend the Rome Statute to allow the ICC to prosecute the crime of aggression. If a robust amendment is widely ratified by states, and if the mechanism for triggering ICC jurisdiction in a particular situation is the ICC itself, then the ICC may emerge as an important voice in the debate over the legality of humanitarian intervention taken without Security Council authorization. Prosecutions, or at least indictments, of leaders of those interventions would considerably strengthen the hand of those who regard such intervention …

In the past generation, in all countries in all parts of the world, using all different forms of constitutional government, a new form of separation of powers has emerged, what this Article calls “government in opposition.” After democratic elections are held, power to govern is granted to the winner of those elections - but substantial power to govern is also granted to the loser of those elections as well. This Article first discusses how this emerging regime of separation of powers differs from other major forms of separation of powers, and in doing so introduces a new way of understanding …

A comparison of 3 methods for variance component estimation to compute the heritability of meat quality characteristics (body weight, breast meat weight, breast yield, l, a, b, c, h, and ph) was performed using the methods of maximum likelihood (ML), restricted maximum likelihood (REML), and minimum variance quadratic unbiased estimator (MIVQUE). The parent population was set up at random from a closed population of Japanese quail (Coturnix coturnix japonica). Selection was not applied for any productive characteristics and no special care was taken to avoid inbreeding. After 12-h feed withdrawal, the birds were weighed and slaughtered at 35 days of …
Effect Of Docking And Diet Energy On Carcass Fat Characteristics In Fat-Tailed Baluchian Sheep, Ali̇ Moharrery
Effect Of Docking And Diet Energy On Carcass Fat Characteristics In Fat-Tailed Baluchian Sheep, Ali̇ Moharrery
Turkish Journal of Veterinary & Animal Sciences
Effects of docking on carcass fat characteristics were studied in fat-tailed sheep. Male lambs were randomly divided into 2 groups. One group was docked after birth using rubber rings, and the tails of the other group were left intact (control). After weaning, 20 lambs from each group were divided into 2 subgroups; one subgroup was fed with a normal energy diet (10.25 MJ/kg ME) and the other one with a high-energy diet (11.42 MJ/kg ME) for 84 days. At the end of the fattening period, 28 lambs were slaughtered for determination of warm carcass weight (WCW) and other carcass characteristics. …

Concentration Of Products Of Nitric Oxide Oxidation And Some Vitamins In Sheep With Naturally Acquired Babesiosis, Handan Mert, İbrahi̇m Yörük, Yeter Değer, Ni̇hat Mert, Semi̇ha Dede, Fatmagül Yur
Turkish Journal of Veterinary & Animal Sciences
The aim of the present study was to determine serum concentrations of the products of nitric oxide oxidation (nitrate and nitrite) and some vitamins (retinol acetate, \alpha- and \delta-tocopherol, and vitamin D_3) in sheep naturally infected with Babesia ovis. The investigation included 30 infected and 10 control sheep. Serum \alpha -tocopherol levels were significantly lower (P < 0.05), and nitrate and nitrite concentrations were significantly higher (P < 0.05) in infected animals than in controls. It is thought that the elevated nitrate and nitrite levels of the sheep infected with babesiosis were due to the result of damage caused by Babesia. On the other hand, a significant decrease was observed in \alpha -tocopherol levels in sheep with babesiosis because of damage and pathophysiological changes to erythrocytes.

Medical And Surgical Treatment Of Chylothorax In A Dog With Right-Sided Heart Failure, Hakan Salci, Zeki̇ Yilmaz, A. Sami̇ Bayram, Ebru Yalçin, Meti̇n Kaya
Turkish Journal of Veterinary & Animal Sciences
Chylothorax due to right-sided heart failure was diagnosed in a 3.5-year-old, male Rottweiler, based on the clinical, radiological, and echocardiographic examinations, and serum biochemical test results (pleural fluid cytology and triglyceride levels of the serum and pleural fluid). En bloc ligation of thoracic duct along with its branches and pleural abrasion were performed after the failure of the initial medical management including pleural drainage via tube thoracostomy, and enalapril, furosemide, and low-fat diet (Prescription Diet Canine r/d, Hill´s Pet Product, Topeka, Kansas, USA). Combination medical and surgical therapy resulted in an excellent postoperative outcome. Six months after surgery the dog …

Multicentric Intrahepatic Biliary Cystadenoma In A Dog, Ahmet Akkoç, İ. Taci̇ Cangül, M. Özgür Özyi̇ği̇t
Turkish Journal of Veterinary & Animal Sciences
This report describes a case of multicentric intrahepatic biliary cystadenoma observed in a 13-year-old, male, Irish setter dog. The dog had a history of chronic inappetence, weight loss, intermittent icterus, and diarrhoea. In the ultrasonographic examination of the abdominal organs, 5 spherical masses were found in various liver lobes. The largest mass was 12 cm in diameter and was located on the quadrate lobe. It had spongy consistency and had several cystic structures, 3 mm-2.5 cm in diameter, on the cut surface. While this mass bulged through the normal outline of the liver, smaller masses were engraved within the liver …

This paper, presented at the West Government Contracts Year in Review Conference (covering 2008), attempts to identify the key trends and issues for 2009 in U.S. federal procurement. In large part, the paper focuses upon the challenges facing the incoming Obama administration, which faces a number of interrelated, critical, systemic challenges that pervade the acquisition landscape. Federal procurement spending has exploded in this decade. As a result - and, in addition to decisions made during the 1990's - the Government is heavily outsourced, dependent upon contractors to an extent - in degree and in type - that makes many uncomfortable. …

In an era of globalization, "culture" is sometimes treated as a dirty word. For those who see the world as increasingly "flat," culture can seem to be merely a retrograde imposition of local prerogative that stands in the way of progress. Likewise, those who seek greater harmonization of human rights norms, commercial trade rules, or other legal standards may view culture as simply a monkey wrench in the machinery of global consensus and cooperation. In such debates, culture is often conceptualized as fundamentally pre-modern, something "they" cling to, but that "we" have long since jettisoned.

The Legal Origins Theory In Crisis, Lisa M. Fairfax
The Legal Origins Theory In Crisis, Lisa M. Fairfax
GW Law Faculty Publications & Other Works
The Legal Origins Theory purports to predict how countries respond to economic and social problems. Specifically, the legal origins of the United States should strongly influence the manner it approaches economic problems and its approach should be distinct from the response of civil law countries. If the theory is accurate, America's legal tradition should have a profound impact on its response to the crisis. This Article seeks to test the boundaries of the theory by assessing whether it could have predicted the manner the U.S. responded to the current economic crisis. After analyzing the U.S. response to the crisis, this …

This Article seeks to ascertain the impact of the Securities and Exchange Commission's rejection in 2007 of a proxy access rule, a rule that would have required corporations to include shareholder-nominated candidates on the ballot. On the one hand, the SEC's rejection appears to be a stunning blow to the shareholders' rights campaign because many shareholders' rights advocates have long considered access to the corporate ballot as the "holy grail" of their campaign for increased shareholder power. On the other hand, some corporate experts maintain that characterizing proxy access as the indispensable ingredient for sufficient shareholder influence fails to appreciate …

Placing Children In Context: Parents, Foster Care, And Poverty, Naomi R. Cahn
GW Law Faculty Publications & Other Works
This essay provides an overview of federal involvement in foster care, starting with the 1909 White House Conference on Dependent Care, to show the historical relationship between aid to children and in-home care. This historical look reveals a shift toward child rescue that amounts to an overreaction to a perceived bias towards family preservation.
This essay advocates a returned focus on children as members of an existing family within a larger community as the means for grounding the child welfare system. I suggest alternative approaches to the current abuse and neglect system that will keep children safe in their families. …

Outsourcing Immigration Compliance, Eleanor Marie Brown
GW Law Faculty Publications & Other Works
Immigration is a hot button issue about which Americans have sent a clear message. They prefer not to admit more aliens until the government is able to credibly screen for entrants who will abide by the terms of admission and sanction those who do not. While immigration debates now focus almost entirely on undocumented workers, they have overshadowed another critical, yet poorly understood challenge: designing institutions to properly screen for aliens who are visa-compliant and sanction non-compliant aliens. Because failed guest worker programs unquestionably increase the size of the undocumented population, this article addresses the difficulty of institutional design by …

This essay was published as part of a symposium hosted by the New York University Journal of Law and Liberty in March 2009. The journal citation is: Gregory E. Maggs, Which Original Meaning Matters to Justice Thomas?, 4 N.Y.U. J. L. & Liberty 494 (2009).
The essay addresses a basic question about Justice Clarence Thomas’s originalist jurisprudence. When Justice Thomas looks for the original meaning of the Constitution, does he seek (a) the meaning intended by the Framers at the Constitutional Convention in Philadelphia (“original intent”), (b) the meaning as understood by the delegates to the thirteen state ratifying conventions …

This chapter examines attitudes towards national diversity in one piece of the emerging European constitution-the right to privacy. There is a thick constitutional culture of privacy in Europe. The familiar debate of how to balance the right to privacy against freedom of expression, the market, and public security can be heard in many places: before the Court of Justice and the European Court of Human Rights, in the European Parliament and the European Council, and before Europe's numerous data privacy ombudsmen. And in these places, the less familiar problem of tolerance of diversity within Europe, among Europe's different national communities, …

Most discussions of a rights-based approach to the environmental crises facing the planet have centered on demanding that governments take action to prevent or mitigate environmental harm that diminishes, for those within their territory and jurisdiction, the enjoyment of internationally-guaranteed human rights. Yet, the consequences of pollution -- especially anthropogenic climate change due to greenhouse gas emissions -- are not confined within the boundaries of a single state: pollution knows no boundaries. Instead, throughout the world, individuals, communities and entire nations face significant threats to their wellbeing and even their lives from climate change and its effects.

This paper traces the history of attempts to restrict contraception, the legal events securing widespread access to contraception and their importance to a generation of college-aged women, the short-lived nature of the consensus that produced them, and the potential of the issue to serve as a rallying point for a revitalized feminism. It explores the hypocrisy of a system that, whatever its values, makes reproductive autonomy readily available for the affluent and the sophisticated and increasingly beyond the reach of the most vulnerable. Finally, it considers the potential of contraception as a reframing device, capable of exposing the hypocrisy of …
