Judicial Review, Local Values, And Pluralism, Richard W. Garnett Jan 2009

Judicial Review, Local Values, And Pluralism, Richard W. Garnett

Journal Articles

At the Federalist Society's 2008 National Student Symposium, a panel of scholars was asked to consider the question, does pervasive judicial review threaten to destroy local identity by homogenizing community norms? The answer to this question is yes, pervasive judicial review certainly does threaten local identity, because such review can homogenize[e] community norms, either by dragging them into conformity with national, constitutional standards or (more controversially) by subordinating them to the reviewers' own commitments. It is important to recall, however, that while it is true that an important feature of our federalism is local variation in laws and values, it …

Does Free Exercise Of Religion Deserve Constitutional Mention?, John M. Finnis Jan 2009

Does Free Exercise Of Religion Deserve Constitutional Mention?, John M. Finnis

Journal Articles

The article discusses the inclusion of the free exercise of religion among a society's constitutional guarantees in the U.S. It cites Christopher Eisgruber and Lawrence Sager, authors of the book "Religious Freedom and the Constitution," who hold that religion does not deserve constitutional mention on account of any special value. It disputes this view and states that religion does deserve constitutional mention and that the constitution should protect a citizen's right to practice his or her religion.

Committee Size And Smart Growth: An Optimal Solution, Russell Kashian, Heather Kohls Jan 2009

Committee Size And Smart Growth: An Optimal Solution, Russell Kashian, Heather Kohls

Economics Faculty Research and Publications

Wisconsin is one of many states that have enacted a “Smart Growth Initiative” law that requires inclusion of the public in the creation and development of a Comprehensive Plan. One implication of public participation is the strategic development of a comprehensive planning committee. Two crucial decisions occur when the committee is formed: the size of the committee and the composition of the committee. This paper models a relation between committee size and the accuracy of plan, as well as the relationship between the inclusion of experts, whether paid consultants or planners, and the quality of the outcome. Based on a …

Trademark Use And The Problem Of Source, Mark P. Mckenna Jan 2009

Trademark Use And The Problem Of Source, Mark P. Mckenna

Journal Articles

This Article mediates a scholarly debate regarding the existence and desirability of a "trademark use" doctrine. It argues that trademark use is a predicate of liability under the Lanham Act, but those who advocate treating trademark use as a threshold question put much more weight on that concept than it can bear. Courts cannot consistently apply trademark use as a distinct element of the plaintiff's prima facie case because trademark use can be determined only from the perspective of consumers. Specifically, courts can determine whether a defendant has made trademark use of a plaintiff's mark only by asking whether consumers …

Interactive Effects Of Time, Co2, N, And Diversity On Total Belowground Carbon Allocation And Ecosystem Carbon Storage In A Grassland Community, E. Carol Adair, Peter B. Reich, Sarah E. Hobbie, Johannes M.H. Knops Jan 2009

Interactive Effects Of Time, Co2, N, And Diversity On Total Belowground Carbon Allocation And Ecosystem Carbon Storage In A Grassland Community, E. Carol Adair, Peter B. Reich, Sarah E. Hobbie, Johannes M.H. Knops

School of Biological Sciences: Faculty Publications

Predicting if ecosystems will mitigate or exacerbate rising CO2 requires understanding how elevated CO2 will interact with coincident changes in diversity and nitrogen (N) availability to affect ecosystem carbon (C) storage. Yet achieving such understanding has been hampered by the difficulty of quantifying belowground C pools and fluxes. Thus, we used mass balance calculations to quantify the effects of diversity, CO2, and N on both the total amount of C allocated belowground by plants (total belowground C allocation, TBCA) and ecosystem C storage in a periodically burned, 8-year Minnesota grassland biodiversity, CO2, and N experiment …

Videogame Use Among Male Residents In University Housing At Eastern Illinois University, Mark Bodnar Nicklaus

Masters Theses

The present quantitative study of 331 male students living in university residence halls or in university fraternity housing explored whether playing video games promoted social networking and social opportunities for males living in college residence halls. Previous research on video gaming focused on the social networks created among players; however, little research focused directly on male students living in residence halls. Most participants (73%) played video games between 6 p.m. and midnight. Using the Spearman Rho for rank ordered data, a positive relationship was found between the number of hours spent playing video games and the time spent in conversation …

Ethnic Lesbian Identity Development: A Focus On African American And Latino Women, Alexandria Quinones

Masters Theses

The purpose of this qualitative study was to investigate if there were differences in the developmental progression of a lesbian identity for ethnic women, specifically African American and Latino women, from that of majority lesbian women. Selected societal, familial and personal beliefs were examined to discover their influences on the women's development of a lesbian identity. Responses from ten women indicated there was a variation during their progression towards a lesbian identity in relation to the previous stage models based on majority homosexual individuals. Future recommendations for practitioners and researchers included considering environmental influences for expanding research models examining lesbian …

Defining Success With Big Ideas: A New Teacher’S Growth And Challenges, Meg Sampson

Journal of Inquiry and Action in Education

This article is a compellation of my work with big ideas and my findings based on that work for the second semester of the 2006-2007 school year. I worked with three 11th grade students that have in the past struggled to pass the Global Studies Regents exam. The class was created as a RCT (Regents Competency Test) preparation course. The purpose of this class, as it was told to me in January, was to give these students the skills and motivation they needed to pass the Global Studies RCT in June. I encountered many obstacles along the way, attendance issues, …

The Evolution Of A Big Idea: Why Don’T We Know Anything About Africa?, Michael James Meyer Jan 2009

The Evolution Of A Big Idea: Why Don’T We Know Anything About Africa?, Michael James Meyer

Journal of Inquiry and Action in Education

This article is about my experiences as a ninth grade history teacher trying to implement a “big idea” unit on ancient African history. My experiences as a first year teacher and also my experience in seeing this unit develop over three years are chronicled. I conclude that implementing a big idea strategy of instruction is possible in a “real” classroom, that this implementation is more of a journey than a destination, and that big ideas do help students to learn.

Human Relations: Assessing The Affect Of Cultural Awareness Curriculum On Preservice Teachers, Seth D. Olson, Kristine M. Reed Ph.D., Amy Schweinle

Journal of Inquiry and Action in Education

Human relations training is intended to prepare teachers to be more culturally sensitive to an increasingly diverse population. There is a growing trend in teacher education to train preservice teachers more effectively to meet the demands of multicultural society. However, limited research is available to guide the future design of human relations training courses. This research was conducted to address the gap in the literature, by investigating the effectiveness of human relations training course on preservice teachers. Results indicated that the course made a significant difference on improving knowledge and skills categories for participants, but there was no significant improvement …

What follows is a small action research project aimed at elevating moral and ethical wherewithal among graduate students studying school administration. Ninety-Six percent of the students indicated that learning through dialogue or Socratic questioning, deepened their understanding of the topic. …

Does Substitute Teaching Before Graduation Improve First Year Teacher Quality?, Timothy Sharer Jan 2009

Does Substitute Teaching Before Graduation Improve First Year Teacher Quality?, Timothy Sharer

Journal of Inquiry and Action in Education

Several problems exert force on teachers just entering the profession including mandated testing, public reporting, and the loss of the flexible contexts teacher preparation institutions had for developing undergraduate teacher candidates. Teacher training institutions are scrambling to implement more effective ways to prepare teachers without losing richness and thoroughness. The problems of entry level teacher quality and the opportunity to gain experience through substitute teaching are related. Enhancing the development of pre-service teacher quality is directly influenced by “real” teaching experience. The Northeast Nebraska Teacher Academy is a palpable response undertaken by a Midwestern public college to provide these types …
