One Step Forward, Two Giant Steps Back: How The "Existing Indian Family" Exception (Re)Imposes Anglo American Legal Values On American Indian Tribes To The Detriment Of Culltural Autonomy, Suzianne D. Painter-Thorne

American Indian Law Review

This article describes the profound changes to American Indian kinship and social structures caused when European and Anglo American legal norms were imposed on American Indian tribes without respect for Indian culture or values. Although these sovereign nations were entitled to self-determination, they were for centuries subjected to laws crafted without their input or representation. This article takes the position that law should come from within a culture to ensure that it reflects that culture's values and permits it to flourish in its own way. United States V. Hatahley: A Legal Archaeology Case Study In Law And Racial Conflict, Debora L. Threedy

American Indian Law Review

This article is a case study of United States v. Hatahley using the methodology of "legal archaeology" to reconstruct the historical, social, and economic context of the litigation. In 1953, a group of individual Navajos brought suit under the Federal Tort Claims Act for the destruction of over one hundred horses and burros. The first section of the article presents two contrasting narratives for the case. The first relates what we know about the case from the reported opinions, while the second locates the litigated case within the larger social context by examining the parties, the history of incidents culminating …

We read with interest the recent article by Lim et al.1 This article demonstrated a strong correlation between a novel longitudinal strain delay index and left ventricular end-systolic volume reduction in both ischemic and nonischemic patients.

The principle outlined by the authors is that an increased longitudinal strain delay index requires both dyssynchrony (defined in their article as a discrepancy between the time of end-systolic contraction and the time to peak strain) and residual contractility. Response To Rambachan's "The Advaita Worldview" And Thatamanil's "The Immanent Divine", Michelle Voss Roberts

Journal of Hindu-Christian Studies

In light of postcolonial and feminist criticism, it has become good form for scholars to "locate themselves" with regard to their subject matter by laying out their values and presuppositions to the extent possible. Because supposedly "objective" or "neutral" scholarship often reflects hegemonic interests, this practice ideally brings self-awareness about the discourses we carry into the hermeneutical process. Postcolonial discourse since Edward Said's Orientalism (1978) instructs that if Western academics are to continue representing the so-called East, they must at least acknowledge the dominance of Western and Christian presuppositions in this scholarly tradition.

There are many possible ways to define Moufang element. We show that the traditional definition is not the most felicitious—for instance, the set of all Moufang elements in an arbitrary loop, qua the traditional definition, need not form a subloop. We offer a new definition of Moufang element that ensures that the set of all Moufang elements in an arbitrary loop is a subloop. Moreover, this definition is “maximally algebraic” with respect to autotopisms. We also give an application of this new definition by showing that a flexible A-element in an inverse property loop is, in fact, a Moufang element, …
