From The Protection Of Children Against Sexual Exploitation Act Of 1977 To The Adam Walsh Child Protection And Safety Act Of 2006: How Congress Went From Censoring Child Pornography To Censoring Protected Sexual Speech, Onki Kwan Jan 2009

From The Protection Of Children Against Sexual Exploitation Act Of 1977 To The Adam Walsh Child Protection And Safety Act Of 2006: How Congress Went From Censoring Child Pornography To Censoring Protected Sexual Speech, Onki Kwan

UC Law Constitutional Quarterly

Congress first outlawed child pornography in the Protection of Children Against Sexual Exploitation Act of 1977. The statute was amended in 1984 because Congress found that the 1977 Act did not adequately protect children from sexual exploitation and abuse. In 1988, Congress introduced record-keeping requirements as codified in 18 U.S.C. § 2257 to supplement existing the 1984 statute. Since 1988, § 2257 has been amended several times, broadening in scope each time. Today, the statute is so broad that it infringes on constitutionally protected speech. As such, in Keisler v. Connection Distribution Company the Sixth Circuit held that § 2257 …

Web-Assisted Suicide And The First Amendment, Ellen Luu Jan 2009

Web-Assisted Suicide And The First Amendment, Ellen Luu

UC Law Constitutional Quarterly

The proliferation of online social networking websites such as MySpace, Facebook, and message boards has introduced a new threat in the form of suicidepromoting cyber-speech. In countries such as the United States, Japan, and the United Kingdom, individuals have used these social networks to access advertisements for suicide partners, feedback on self-murder plans, and guides on how to commit suicide. In light of claims that this cyber-speech serves the legitimate purpose of providing an open forum for discussion on such topics, is such speech protected under the First Amendment?

While the Supreme Court has upheld the prohibition of assisted suicide, …

The Use Of Heat Recovery Devices For Reducing Energy Consumption Of Treating Ventilation Air In A Tropical Operating Theatre, Y.H. Yau, C.B. Lim Jan 2009

The Use Of Heat Recovery Devices For Reducing Energy Consumption Of Treating Ventilation Air In A Tropical Operating Theatre, Y.H. Yau, C.B. Lim

Research Publications (2006 to 2010)

In the operating theatre, where exhausted air is not permitted to be re-circulated, maintaining the conditions could be tedious on the HVAC systems and found to be energy inefficient. This research will look into the potential energy savings using heat recovery devices in treating the ventilation air, without compromising the occupants’ thermal comfort and health in the conditioned space. For the purpose of this research, Operating Theatre 1 of a private hospital in Malaysia was used for analysis and simulation. The existing air conditioning system was modeled in TRNSYS as the baseline model and verified using measured data obtained from …

Disordered Eating, Antifat Attitudes, And Barriers To Treatment In College Women From Urban And Rural Areas, Alison Christine Pepper Jan 2009

Disordered Eating, Antifat Attitudes, And Barriers To Treatment In College Women From Urban And Rural Areas, Alison Christine Pepper

Graduate Student Theses, Dissertations, & Professional Papers

Disordered eating (DE) is associated with physical and emotional consequences. Most incidence studies comparing rates in urban and rural regions are international. Only one examined regional differences within the United States, and no significant differences emerged. Additionally, no investigations focus on DE treatment barriers specific to rural regions. In 106 college women with significant DE patterns, this study investigated weight-based prejudices, system-level barriers, and regional status. Despite no significant regional differences in DE or barriers to treatment, results revealed high prevalence of DE and exposed barriers to DE-treatment among college women. Exploratory analyses supplement the dearth of research focusing on …

Past Periphery, Lisa Nicole Jarrett Jan 2009

Past Periphery, Lisa Nicole Jarrett

Graduate Student Theses, Dissertations, & Professional Papers

Past Periphery examines a contemporary manifestation of the mammy archetype. The common threads between the works presented in the thesis exhibition are erasure, invisibility, and projection. The flattening of a person into icon is the equivalent of the One standing in for the Many. The One embodies surface qualities only and ultimately provides and inadequate summary of the individual or the group. This misrepresentation is the face offered up for public consumption and becomes the foundation for commodity as well as identity. We label, package, sell, and consume this icon as true and correct. But it becomes impossible to define …

The Purpose Of Facebook: The Value Of Facebook Friends In Increasing Self-Perceived Popularity, Michael J. Cronin Jan 2009

The Purpose Of Facebook: The Value Of Facebook Friends In Increasing Self-Perceived Popularity, Michael J. Cronin

Honors Program Theses

A survey of 407 students was conducted at a medium-sized Midwestern university to examine what motivates college students to have friends on Facebook. The goal of the study was to see if people interact with more Facebook friends than they do offline friends on a regular basis and to see if the primary reason students become friends with others on Facebook is to increase their popularity. The results suggest that students do not become Facebook friends with others to increase their popularity, which is in contrast to previous research. Results were inconclusive in determining if people regularly interact with more …

Patent Exhaustion And Implied Patent License In Connection With Free And Open Source Software, Anna Haapanen Jan 2009

Patent Exhaustion And Implied Patent License In Connection With Free And Open Source Software, Anna Haapanen

LL.M. Essays & Theses

This study examines the patent law doctrines of patent exhaustion and implied patent license, and their application to the commercial use of free and open source software (FOSS), an area not thoroughly examined despite the doctrines' otherwise well-established preconditions. The analysis first clarifies the preconditions, scope and key differences of the two doctrines, then applies them to the sale and licensing of FOSS components under the BSD, MIT and GPLv2 licenses. The study addresses the risk that technology companies distributing patented FOSS components may inadvertently dilute their own patent portfolios through exhaustion or implied licensing. It concludes that the patent-related …

Bloudy Tygrisses: Murderous Women In Early Modern English Drama And Popular Literature, Alexandra Hill Jan 2009

Bloudy Tygrisses: Murderous Women In Early Modern English Drama And Popular Literature, Alexandra Hill

Electronic Theses and Dissertations

This thesis examines artistic and literary images of murderous women in popular print published in sixteenth and seventeenth-century England. The construction of murderous women in criminal narratives, published between 1558 and 1625 in pamphlet, ballad, and play form, is examined in the context of contemporary historical records and cultural discourse. Chapter One features a literature review of the topic in recent scholarship. Chapter Two, comprised of two subsections, discusses representations of early modern women in contemporary literature and criminal archives. The subsections in Chapter Two examine early modern treatises, sermons, and essays concerning the nature of women, the roles and …

Privilege, Police Power And Res Extra Commercium - Glaring Conceptual Errors, Arvind P. Datar Jan 2009

Privilege, Police Power And Res Extra Commercium - Glaring Conceptual Errors, Arvind P. Datar

National Law School of India Review

In this article, the author critiques the Indian Supreme Court's understanding of the concepts of privilege, police power and res extra commercium and suggests that these have been incorrectly applied in the context of trade in noxious substances. After tracing the evolution of these concepts through Indian case law and in other jurisdictions, he argues that the principles of privilege and police power originated in the United Kingdom and United States respectively in specific contexts. Therefore, they cannot be applied to the Indian constitutional scheme as the Constitution has other provisions to regulate the same subject matter. The author also …

Enhancing Academic Currency By The Visiting Lecturer Programme, Tadhg Walshe

Level 3

Most lecturers in 3rd level educational institutions realise that they need to maintain academic and professional currency; they need to research and refresh if they are to be properly relevant to students and to make their jobs fulfilling. How can we stay abreast of our subjects and deliver lectures that engage the interest and participation of our student audience? Take a subject like ‘Building Management’; since I joined the staff of Bolton Street many years ago, I have been grappling with how to make my ‘Management’ lectures interesting and useful, and so ensure a ‘captive’ audience in the classroom!

Constructed Global Space, Constructed Citizenship, Micky Lee Jan 2009

Constructed Global Space, Constructed Citizenship, Micky Lee

College of Arts & Sciences Faculty Works

This article examines the relation between global space and citizenship by examining the cases of WTO meeting and Hong Kong Disneyland. Scholars assert that global space can unsettle naturalised social relations. Yet, an ambiguous and vague sense of citizenship and a neoliberal spatiotemporal frame constrain how the state, the media, and the locals interpret the meanings of space, and how citizenship is manifested in space. In the global space of the WTO meeting and the Hong Kong Disneyland, the Hong Kong Chinese identity is reinforced by demonising South Korean farmers and mainland Chinese.

The Poetic Is Political….And Other Notes On Engaged Scholarship, Lynn M. Harter, Laura L. Ellingson, Mohan J. Dutta, S. Norander

Communication

Instrumental and objectivist logics maintain a hegemonic place in Western scholarship, reasoning skills powerfully equipped to address certain dilemmas even as they may obscure other ways of knowing. In this chapter, we enlarge dominant notions of rationality by offering an aesthetic view of knowledge as vital for engaged communication scholarship. Our interest in aesthetic logics parallels concerns that have led scholars to develop feminist practices of inquiry (e.g., Harding, 1998; Hesse-Biber, 2007), interrogate the aesthetics of representations in West-centric knowledge structures from postcolonial and Subaltern Studies standpoints (e.g., Broadfoot & Munshi, 2007; Dutta, 2007, 2008), focus on autoethnographic and poetic …
