Phenyl-Substituted Siloxane Hybrid Gels That Soften Below 140[Degrees]C, Andrei Jitianu, Glenn Amatucci, Lisa C. Klein Jan 2009

Phenyl-Substituted Siloxane Hybrid Gels That Soften Below 140[Degrees]C, Andrei Jitianu, Glenn Amatucci, Lisa C. Klein

Publications and Research

A characteristic of so-called melting gels is that the gels, which are rigid at room temperature, are able to soften and resoften at temperatures around 110 [degrees]C. However, after consolidation at temperatures higher than 150 [degrees]C, the gels no longer resoften. Two systems of melting gels were investigated: phenyltrimethoxysilane (PhTMS)–diphenyldimethoxysilane (DPhDMS) and phenyltriethoxysilane (PhTES)–diphenyldiethoxysilane (DPhDES). The influence of disubstituted versus monosubstituted alkoxide on the softening behavior and the temperature of decomposition was studied. The consolidation temperature increased as the amount of disubstituted alkoxide increased, while the decomposition temperature increased only slightly. In general, the ethoxy-containing gels (maximum at 150[degrees]C) consolidated …

Temporal And Spatial Stability Of Anopheles Gambiae Larval Habitat Distribution In Western Kenya Highlands, Li Li, Ling Bian, Laith Yakob, Guofa Zhou, Guiyun Yan

Political Science & Geography Faculty Publications

Background: Localized mosquito larval habitat management and the use of larvicides have been proposed as important control tools in integrated malaria vector management programs. In order to optimize the utility of these tools, detailed knowledge of the spatial distribution patterns of mosquito larval habitats is crucial. However, the spatial and temporal changes of habitat distribution patterns under different climatic conditions are rarely quantified and their implications to larval control are unknown.

Results: Using larval habitat data collected in western Kenya highlands during both dry and rainy seasons of 2003-2005, this study analyzed the seasonal and inter-annual changes in the spatial …

The Inter-American System And Its Evolution, Claudio Grossman Jan 2009

The Inter-American System And Its Evolution, Claudio Grossman

Scholarly Articles in Law Reviews & Journals

The American Declaration on the Rights and Duties of Man (hereinafter: American Declaration) and the American Convention on Human Rights (hereinafter: American Convention), are the two most important instruments of the Inter-American system for the protection and promotion of human rights. Supervision of compliance is carried out by the Inter-American Commission on Human Rights (hereinafter: the Commission) and the Inter-American Court of Human Rights (hereinafter: the Court). The Commission fulfills its functions primarily through country reports analyzing the overall human rights situation in a country and through decisions on individual petitions presented by individuals who complain that their internationally protected …

What Screen Do You Have In Mind? Contesting The Visual Context Of Law And Film Studies, Richard K. Sherwin Jan 2009

What Screen Do You Have In Mind? Contesting The Visual Context Of Law And Film Studies, Richard K. Sherwin

Articles & Chapters

Law on the screen gives rise to a distinct way of doing jurisprudence. In this sense, it is incumbent upon legal scholars to discern with great care the kind of reality and the way of being that cinematic and electronic screens invite us to assume. Jurisprudence theorizes law in accordance with the cultural and cognitive meaning making tools at its disposal: story frames, character types, social scenarios, metaphors, as well as cultural and socially embedded or constructed emotional patterns, among other narratival and purely sensational elements. Law and film studies thus may be viewed as encompassing a larger concern with …

Ethical Challenges And Opportunities At The Edge: Incorporating Spirituality And Religion Into Psychotherapy, John C. Gonsiorek, P. Scott Richards, Kenneth I. Pargament, Mark R. Mcminn Jan 2009

Ethical Challenges And Opportunities At The Edge: Incorporating Spirituality And Religion Into Psychotherapy, John C. Gonsiorek, P. Scott Richards, Kenneth I. Pargament, Mark R. Mcminn

Faculty Publications - Doctor of Psychology (PsyD) Program

Incorporating spirituality and religion into psychotherapy has been controversial, but recent contributions have argued the importance and provided foundations for doing so. Discussions of ethical challenges in this process are emerging, and this contribution discusses several preliminary issues, relying on the Resolution on Religious, Religion-Based and/or Religion-Derived Prejudice adopted by the American Psychological Association in 2007, as guidance when used with the American Psychological Association’s (2002) Ethical Principles of Psychologists and Code of Conduct. Specifically, this discussion of preliminary challenges addresses competence, bias, maintaining traditions and standards of psychology, and integrity in labeling services for reimbursement. Commentators deepen the discussion, …

The Witness Who Saw, He Left Little Doubt: A Comparative Consideration Of Expert Testimony In Mental Disability Law Cases, Michael L. Perlin, Astrid Birgden, Kris Gledhill Jan 2009

The Witness Who Saw, He Left Little Doubt: A Comparative Consideration Of Expert Testimony In Mental Disability Law Cases, Michael L. Perlin, Astrid Birgden, Kris Gledhill

Articles & Chapters

The question of how courts assess expert evidence - especially when mental disability is an issue - raises the corollary question of whether courts adequately evaluate the content of the expert testimony or whether judicial decision making may be influenced by teleology (‘cherry picking’ evidence), pretextuality (accepting experts who distort evidence to achieve socially desirable aims), and/or sanism (allowing prejudicial and stereotyped evidence). Such threats occur despite professional standards in forensic psychology and other mental health disciplines that require ethical expert testimony. The result is expert testimony that, in many instances, is at best incompetent and at worst biased. The …

Islam's Fourth Amendment: Search And Seizure In Islamic Doctrine And Muslim Practice, Sadiq Reza Jan 2009

Islam's Fourth Amendment: Search And Seizure In Islamic Doctrine And Muslim Practice, Sadiq Reza

Articles & Chapters

Modern scholars regularly assert that Islamic law contains privacy protections similar to those of the FourthAmendment to the U.S. Constitution. Two Quranic verses in particular - one that commands Muslims not to enter homes without permission, and one that commands them not to 'spy' - are held up, along with reports from the Traditions (Sunna) that repeat and embellish on these commands, as establishing rules that forbid warrantless searches and seizures by state actors and require the exclusion of evidence obtained in violation of these rules. This Article tests these assertions by: (1) presenting rules and doctrines Muslim jurists of …

Coming Together After The Crisis: Global Convergence Of Private Equity And Hedge Funds, Houman B. Shadab Jan 2009

Coming Together After The Crisis: Global Convergence Of Private Equity And Hedge Funds, Houman B. Shadab

Articles & Chapters

Prior to the subprime-initiated financial crisis, there was a trend within the alternative investment industry towards the convergence of certain private equity and hedge fund strategies and structures. This brief article suggests that although the financial crisis will slow the process of convergence, the trend toward convergence will ultimately continue and strengthen, albeit in some ways along a different trajectory than before the crisis and with some important variations across national boundaries.

Talking The Talk, Or Walking The Walk? Outcome-Based Regulation Of Transnational Investment, Jerry Ellig, Houman B. Shadab Jan 2009

Talking The Talk, Or Walking The Walk? Outcome-Based Regulation Of Transnational Investment, Jerry Ellig, Houman B. Shadab

Articles & Chapters

Today, individual U.S. retail investors have virtually limitless opportunities to invest their money, with a notable exception: they cannot directly invest in securities of foreign issuers and still be protected under U.S. law. This missing opportunity deprives U.S. investors of the ability to fully diversify their investments and also imposes undue costs and risks upon investors seeking to invest directly overseas. This Article shows that a Securities and Exchange Commission ("SEC") policy of "mutual recognition" of foreign regulatory regimes that achieve investor protection outcomes comparable to those of the SEC would solve this problem. A foreign issuer or other entity …

Only A Sith Thinks Like That: Llewellyn's "Dueling Canons," Thirteen To Sixteen, Michael B.W. Sinclair Jan 2009

Only A Sith Thinks Like That: Llewellyn's "Dueling Canons," Thirteen To Sixteen, Michael B.W. Sinclair

Articles & Chapters

This is the third installment in a series of articles examining the famous twenty eight pairs of "dueling canons" left to us in 1950 by Karl N. Llewellyn ("Remarks on the Theory of Appellate Decision and the rules or Canons of about how Statutes are to be Construed," 3 VANDERBILT L.REV. 395 (1950). In the first two installments, examining Pairs 1 through 12, Llewellyn's "fiendish deconstruction" of these twenty-four canons proved quite innocuous. This installment covers pairs 13 to 16. Once again, looking at the reasons underlying the canons in each pair and the appropriate context for their use completely …

Private Conservation Easements: Balancing Private Initiative And The Public Interest, Gerald Korngold Jan 2009

Private Conservation Easements: Balancing Private Initiative And The Public Interest, Gerald Korngold

Articles & Chapters

A commonly used property rights approach to conserving the environment is private conservation easements. Gerald Korngold discusses the benefits of this policy and proposes methods to mediate some of his concerns about the program. In essence, a conservation easement gives a nonprofit entity or government a perpetual right to restrict changing the present use of the land. If the easement is donated to a nonprofit, the landowner receives tax benefits at the federal, state, and local levels.

Korngold argues that conservation easements have added tremendous value to land preservation in the United States. The method alleviates the government’s need to …

Where The Home In The Valley Meets The Damp Dirty Prison: A Human Rights Perspective On Therapeutic Jurisprudence And The Role Of Forensic Psychologists In Correctional Settings, Astrid Birgden, Michael L. Perlin Jan 2009

Where The Home In The Valley Meets The Damp Dirty Prison: A Human Rights Perspective On Therapeutic Jurisprudence And The Role Of Forensic Psychologists In Correctional Settings, Astrid Birgden, Michael L. Perlin

Articles & Chapters

The roles of forensic psychologists in coerced environments such as corrections include that of treatment provider (for the offender) and that of organizational consultant (for the community). This dual role raises ethical issues between offender rights and community rights; an imbalance results in the violation of human rights. A timely reminder of a slippery ethical slope that can arise is the failure of the American Psychological Association to manage this balance regarding interrogation and torture of detainees under the Bush administration. To establish a “bright-line position” regarding ethical practice, forensic psychologists need to be cognizant of international human rights law. …

Introduction: Feminist Advocacy, Constitutions And Law, Penelope Andrews Jan 2009

Introduction: Feminist Advocacy, Constitutions And Law, Penelope Andrews

Articles & Chapters

The programs and projects of the last few decades of feminist advocacy have been applauded, resisted, andvilified. Despite these divergent responses, there is no doubt that in societies across the globe women’s voices in the legal and political realm are no longer muted. Organizing and lobbying on all five continents, aided and abetted by the liberating possibilities of the innovative communications technology, especially the internet, women advocates have created the discursive space in the political, legal, social, and economic realm to influence governmental policies, law and practice. Developments in the last few decades have illustrated the concerted efforts by women …
