Leaving The Chisholm Trail: The Eleventh Amendment And The Background Principle Of Strict Construction, Kurt T. Lash

Most scholars and courts assume that the Eleventh Amendment emerged from a sudden 'shocked' public reaction to the Supreme Court's decision in Chisholm v. Georgia. The Supreme Court's decision in Hans v. Louisiana has been subject to particular criticism for extending the doctrine of sovereign immunity beyondthe text of the amendment and the particular subject matter before the Court in Chisholm. This article contends that the modern emphasis on Chisholm v. Georgia as the generative source of the Eleventh Amendment is historically incorrect. A six-volume work, this set constitutes a major revision and massive expansion of the 1995 Oxford Encyclopedia of the Modern Islamic World. In addition to covering Islamic societies in the modern world from the eighteenth century to the present, as the earlier four-volume set did, it will add a depth of historical background going back to the pre- Islamic era. The new reference also covers the full geographical extent of Islam by focusing not only on the countries in which Islam is dominant, but also on regions in which Muslims live as minorities, such as Europe and the Americas.

Three-dimensionally distributed electrical functioning is the trigger of mechanical contraction of the heart. Disturbance of this electrical flow is known to predispose to mechanical catastrophe but, due to its amenability to certain intervention techniques, a detailed understanding of subject-specific cardiac electrophysiological conditions is of great medical interest. In current clinical practice, body surface potential recording is the standard tool for diagnosing cardiac electrical dysfunctions. However, successful treatments normally require invasive catheter mapping for a more detailed observation of these dysfunctions. Child soldiering has occurred throughout history in the never-ending battle over land, resources and human rights. The earliest mention of minors in war comes from antiquity however it was not until the 1970s that the first international convention came into effect in an attempt to limit the participation of children in armed conflict (Wikipedia, 2009b). Satisfaction with sexual health education can be seen as student evaluation of how effectively the sexual health education curriculum meets its goals. First-year university students completed one questionnaire containing measures concerning satisfaction with high school sexual health education, sexuality-related individual difference variables, and intentions to pursue further sexual health education at the university level. Question 1 was whether students were satisfied with their high school sexual health education. Results were examined for differences by gender and type of school attended (i.e., public or Catholic). Protein-protein interactions are critical for many biochemical processes and for cellular function. Understanding interactions between proteins and ligands, as well as other proteins are necessary for the modelling of biological systems. Protein import into chloroplasts is one such system where the understanding of interactions between members of the translocation complex is limited. The translocon at the outer envelope membrane of chloroplasts (Toe complex) consists of three core components: Toc75, Tocl59, and Toc34. In 2002, under its new management by the Toronto Community Housing Corporation, the development was announced to undergo a total redevelopment to be completed over 12 years. Despite advances in neuroscience some sceptics, e.g., David Chalmers, Colin McGinn and Thomas Nagel, contend that we are no nearer to achieving a scientific understanding of phenomenal consciousness. These sceptics claim that naturalising consciousness, i.e., subsuming it under our scientific theories, is either impossible, at least without radically reforming our current scientific practices, or perhaps beyond our cognitive grasp. Their scepticism is based on what is called the ‘problem of consciousness’ or the ‘hard problem’. I argue that their pessimism is unwarranted. This book explores learning through ritualizing in introductory meditation courses offered at two Tibetan-based, western Buddhist centres in Toronto. Through interviews with several of the centres’ newcomers, experienced members and teachers, it explores students’ reasons for enrolling in meditation classes as well as their attitudes towards religion and ritual. The study's primary focus is on respondents’ experiences of learning through formal practices such as meditation postures and techniques. Ritualizing is interpreted in part through performance theory, an approach which highlights the performative elements of ritual and the physical enactment of ritualized postures and gestures. In this thesis, I argue for a set of basic human rights to constrain the practices of corporate entities in the context of economic globalization. These basic rights are derived through a concrete interpretation of specific articles in the Universal Declaration of Human Rights. My focus is on constructing a middle-ground approach to economic globalization by building on the work of Peter Singer, Onara O’Neill, John Bishop, and Leo Groarke, but with particular emphasis on Groarke’s notion of a mitigated capitalism. My dissertation, “Phantoms of Old Forms: The Gothic Mode in the Dramatic Verse of Tennyson and Browning” situates Alfred Lord Tennyson and Robert Browning within a lineage of writers who experimented with the Gothic mode in dramatic and verse forms. This study is, in the first instance, an experiment in applying a specific strain of Gothic critical theory, one that addresses issues of gender, to canonical literary materials not ordinarily approached in that light. In the 1990s, Canadian readers were offered a new literary trend: the Atlantic Canadian Catholic novel. In this dissertation, I examine works from six authors whose writing reflects the scope of this trend and I argue for a consideration of their collective impact on our social imaginary. This thesis examines the experiences of the 4th Canadian Armoured Division as it prepared for and carried out its role in the battle of Normandy and the libeation of France in 1944. The factors that limmited opportunities to practice the formation in large-scale exercises are noted as are the methods used by the General Officer Commanding, Major-General George Kitching, to compensate for the limitations. From 1933 to 1941, the eight existing Waldorf schools in Germany were forced to close. As an alternative system of education, they were considered a threat to National Socialism. Yet, they were not systematically nor uniformly brought into line with the Nazi state through the process of Gleichschaltung. Very few studies address the history of the Waldorf schools under National Socialism, and those that do are invariably written by members of the Waldorf school community. When identity is conceptualized as a fluid and ongoing process that is mutually influenced by subjective and constructed experience, an interplay can occur that engenders and signifies collective life. With an acknowledgement of motherhood as a politically and emotionally charged identity experience, and asserting the capacity of social policy to sustain a constructed ideology, this paper explores a conversation that occurred between 28 mothers in Canada. Within Southern Ontario’s highly fragmented greater natural ecosystem, there remain numerous relatively small scattered areas which bear at least some resemblance to their former pre-European/Canadian settlement natural ecosystem. In their present state they serve as reservoirs of their particular ecoregion’s indigenous plant and animal species. In proportion to their limited spatial areas, degree of isolation, existing ecological integrity, and long-term ecological carrying capacity they are stores of natural capital, which is beneficial to both nature and society.
