Managing Incidental Findings In Human Subjects Research: Analysis And Recommendations, Ellen Wright Clayton, Susan M. Wolf, Frances P. Lawrenz, Charles A. Nelson, Et Al. Jul 2009

Managing Incidental Findings In Human Subjects Research: Analysis And Recommendations, Ellen Wright Clayton, Susan M. Wolf, Frances P. Lawrenz, Charles A. Nelson, Et Al.

Vanderbilt Law School Faculty Publications

Researchers, institutional review boards (IRBs), participants in human subjects research, and their families face an important but largely neglected problem - how should incidental find- ings (IFs) be managed in human subjects research. If researchers unexpectedly stumble upon information of potential health or reproductive significance, should they seek expert evaluation, contact the participant's physician, tell the research participant, or respond with some combination? What should consent forms and the entire consent process say about how IFs will be handled in research? What should IRBs require? An IF is a finding concerning an individual research participant that has potential health or …

Back To A Future: Reversing Keith Simpson's Death Sentence And Making Peace With The Victim's Family Through Post-Conviction Investigation, John H. Blume, Sheri Lynn Johnson Jul 2009

Back To A Future: Reversing Keith Simpson's Death Sentence And Making Peace With The Victim's Family Through Post-Conviction Investigation, John H. Blume, Sheri Lynn Johnson

Cornell Law Faculty Publications

In 1993, Keith Simpson was arrested for the murder of Joe Harrison; in 2006, he was sentenced to life with the possibility of parole in 2022. Between those two events, Simpson was sentenced to death, had his death sentence vacated by the post-conviction relief court, reached a plea agreement with the victim's family and the new Solicitor, saw the agreement invalidated when the Attorney General's office overrode the family and the Solicitor by appealing the post-conviction court's decision, lost the lower court's decision to an appellate reversal, and won a cross-appeal for a new trial. You just never know. You …

Metabolic Syndrome And Risk Of Cancer Mortality In Men, Jason R. Jaggers, Xuemei Sui, Steven P. Hooker, Michael J. Lamonte, Charles E. Matthews, Gregory A. Hand, Steven N. Blair

Faculty and Staff Scholarship

Background—Metabolic syndrome (MetS) has been linked with an increased risk of developing cancer; however the association between MetS and cancer mortality remains less clear. Little research has focused on pre-cancer risk factors that may affect the outcome of treatment. The purpose of this study was to examine the association between MetS and all-cancer mortality in men. Methods—The participants included 33,230 men aged 20-88 years who were enrolled in the Aerobics Center Longitudinal Study and free of known cancer at baseline. Results—At baseline 28% of all the participants had MetS. During an average of 14 years followup there were a total …

Excess Of Glucocorticoid Induces Cardiac Dysfunction Via Activating Angiotensin Ii Pathway, Sreerupa Ghose Roy, Priyanka De, Debasri Mukherjee, Vivek Chander, Aditya Konar, Debasish Bandyopadhyay, Arun Bandyopadhyay

School of Integrative Biological & Chemical Sciences (Formerly Dept. of Chemistry)

Background: Glucocorticoid is widely used as an anti-inflammatory drug in various diseases however excess of it often causes cardiovascular complications. The present study was undertaken to understand the molecular mechanism of glucocorticoid-induced cardiac dysfunction.

Methods: Rats were treated daily with synthetic glucocorticoid, dexamethasone with or without mifepristone or losartan up to 15 days. Hemodynamic parameters were measured by PV-loop method using Millar's instrument. Cardiac remodelling, fibrosis and oxidative stress were monitored after 15 days.

Results: The systolic blood pressure was increased whereas the heart beat and cardiac output (n=6) were decreased by dexamethasone. Dexamethasone caused increase in the heart …

These documents will reside in the university’s digital repository, operated on a DSpace platform. This article reviews practices for thesis and dissertation metadata creation with a focus on DSpace instances, best practice recommendations for authorsubmitted metadata, recommendations for subject analysis, and training for metadata practitioners. The article recommends processes for author submission, metadata quality control and enhancement, and crosswalking of the metadata to the library’s catalog to maximize discovery.

Muddy Waters: Congressional Consent And The Great Lakes-St. Lawrence River Basin Resources Compact, Sonya Ziaja Jul 2009

Muddy Waters: Congressional Consent And The Great Lakes-St. Lawrence River Basin Resources Compact, Sonya Ziaja

All Faculty Scholarship

After nearly a century of negotiations among the Great Lakes states, tribes, and provinces, a promising new agreement was recently ratified by the parties and recognized by Congress, this is the Great Lakes-St. Lawrence River Basin Water Resources Compact ("GLC"). Interstate compacts, like the GLC, may serve as a particularly useful tool for solving regional environmental problems which the federal government lacks the interest to resolve. However, due to constitutional strictures, interstate compacts are not binding unless Congress grants consent to the compact. This Note will focus on the GLC as a means to examine the current state of the …

Legal Strategies To Address Child Support Obligations For Nonresident Fathers In The Child Welfare System, Daniel L. Hatcher Jul 2009

Legal Strategies To Address Child Support Obligations For Nonresident Fathers In The Child Welfare System, Daniel L. Hatcher

All Faculty Scholarship

The legal and practical issues surrounding child support obligations have enormous impact on families in the child welfare system. Unfortunately, these issues are often ignored, overlooked, or misunderstood. A much-needed effort to engage nonresident fathers in the child welfare system is underway, but those efforts will often be derailed if child support is not properly addressed. This article sheds light on the legal and policy concerns regarding child support enforcement in child protection cases and provides legal strategies for advocates to address those concerns. While primarily aimed at advocates for nonresident fathers, this article should also benefit advocates for custodial …

The Dna Of An Argument: A Case Study In Legal Logos, Colin Starger Jul 2009

The Dna Of An Argument: A Case Study In Legal Logos, Colin Starger

All Faculty Scholarship

This Article develops a framework for analyzing legal argument through an in-depth case study of the debate over federal actions for post-conviction DNA access. Building on the Aristotelian concept of logos, this Article maintains that the persuasive power of legal logic depends in part on the rhetorical characteristics of premises, inferences, and conclusions in legal proofs. After sketching a taxonomy that distinguishes between prototypical argument logo (formal, empirical, narrative, and categorical), the Article applies its framework to parse the rhetorical dynamics at play in litigation over post-conviction access to DNA evidence under 42 U.S.C. § 1983, focusing in particular on …

How Color Affects Food Choices, Costa Magoulas Jul 2009

How Color Affects Food Choices, Costa Magoulas

UNLV Theses, Dissertations, Professional Papers, and Capstones

Color has a very strong influence in the hospitality industry. How much thought has been given to food choices because of color, and how influential is that on customers’ satisfaction of a food product? Staff that prepares food must understand how color and taste work together through presentation and eye appeal to create the WOW factor since customers eat with their eyes first. People associate different foods with different colors. When this perception changes it often has a detrimental effect on the customer’s perception of how that food should taste. Scientific information was gathered on the history of food, the …
