International Human Rights Law, Co-Parent Adoption, And The Recognition Of Gay And Lesbian Families, Elizabeth Burleson

Children would benefit substantially if governments legally recognized same sex marriages and parenting. This article analyzes international human rights law, co-parent adoption, and the legal recognition of gay and lesbian families. It addresses civil marriage and adoption challenges for same sex families and assesses European Court of Human Rights jurisprudence relating to same-sex adoption. This Article considers the international community's efforts to implement the best interest of the child standard concluding that recognition of same sex families is in the best interest of the child and should be facilitated in a timely manner by jurisdictions at all levels.

This paper examines the technical aspects and policy implications of each of four strategies to effectuate environmentally conscious policies in the federal government's food procurement procedures: a litigation strategy, a rulemaking strategy, a NEPA strategy, and a legislative strategy.

'False But Highly Persuasive:' How Wrong Were The Probability Estimates In Mcdaniel V. Brown?, David H. Kaye

In McDaniel v. Brown, the Supreme Court will review the use of DNA evidence in a 1994 trial for sexual assault and attempted murder. The Court granted certiorari to consider two procedural issues - the standard of federal postconviction review of a state jury verdict for sufficiency of the evidence, and the district court's decision to allow the prisoner to supplement the record of trials, appeals, and state postconviction proceedings with a geneticist's letter twelve years after the trial.

The Right Remedy For The Wrongly Convicted: Judicial Sanction For Destruction Of Dna Evidence, Cynthia E. Jones

Many state innocence protection statutes give courts the power to impose appropriate sanctions when biological evidence needed for postconviction DNA testing is wrongly destroyed by the government. Constitutional claims based on wrongful evidence destruction are governed by the virtually insurmountable “bad faith” standard articulated in Arizona v. Youngblood. The wrongful destruction of DNA evidence in contravention of state innocence protection laws, however, should be governed by the standards used to adjudicate other “access to evidence” violations in criminal cases, including disclosures mandated by the rules of criminal procedure, the Jencks Act, and Brady v. Background: Localized mosquito larval habitat management and the use of larvicides have been proposed as important control tools in integrated malaria vector management programs. In order to optimize the utility of these tools, detailed knowledge of the spatial distribution patterns of mosquito larval habitats is crucial. However, the spatial and temporal changes of habitat distribution patterns under different climatic conditions are rarely quantified and their implications to larval control are unknown.

Of all mental faculties, memory is unique. It defines who we are and places our lives on a narrative continuum from birth to death. It helps to structure our days, it guides our daily tasks and goals, and it provides pleasurable interludes as we anticipate the future and recall the past. As a core, defining feature of the self (Birren & Schroots, 2006), memory takes on heightened meaning as we age. In the face of other losses that accumulate with age, memory can serve to preserve our sense of self and place in time. In normal aging, memory loss is …

The present study used a context-based model of assessment and intervention to explore whether interventions that modify context result in reduction of problem behavior in ecologically valid settings (i.e., typical routines implemented by typical education personnel in neighborhood schools). The Contextual Assessment Inventory (CAI) and a post-assessment interview were administered to parents and teachers of eight children with Autism Spectrum Disorder to identify problem contexts. Then, environmental modification techniques were implemented in three priority contexts: namely, transitions, termination of preferred activities, and presence of a feared stimulus. Objective: To assess the current knowledge of eating disorders among college students and to determine the effectiveness of a prevention program in increasing eating disorder knowledge. Participants: College students enrolled in the University of Mississippi and in a Family and Consumer Sciences (FCS) 311 Nutrition course. Methods: Participants in attendance of an FCS 311 Nutrition course were administered a 21 question survey to assess a baseline knowledge level of eating disorders. Participants were later educated on eating disorders through a primary prevention program “Eating Disorders 101”. Fire has become more extensive in recent decades in southwestern United States arid lands. Burned areas pose management challenges and opportunities, and increasing our understanding of post-fire plant colonization may assist management decision-making. We examined plant communities, soils, and soil seed banks two years after the 2005 Loop Fire, located in a creosote-blackbrush community in Red Rock Canyon National Conservation Area in southern Nevada’s Mojave Desert. Based on a spring sampling of 20, 0.01-ha plots, live + dead cover of the exotic annual Bromus rubens averaged nine times lower on the burn than on a paired unburned area. Perennial species …

This research explored and documented issues of sustainability associated with the reintroduction of bison in four different bison herds on Reservations in South Dakota. The four herds were managed by: a tribal family cooperative, an individual tribal member, a tribal university and a tribal fish and wildlife agency. The objectives were to identify management practices associated with the sustainability of bison introduction by American Indians; to explore the role of American Indian culture in the management of bison for sustainability; and to investigate rangeland criteria that could be used to measure sustainability of bison reintroduced by American Indians. By making federal law supreme to state law, the U.S. Constitution gives Congress "an extraordinary power." Perhaps the extraordinarily powerful nature of the Supremacy Clause is the reason for its checkered treatment by the Supreme Court. Recent preemption decisions give lip service to federalism concerns, but in many cases state statutes, regulations, and remedies have been struck down with little regard for either federal-state comity or institutional competence. If federal regulatory regimes always accomplished optimal regulation perfect equipoise between protecting human health and promoting economic development while fostering innovation by governments and regulated entities-preemption of state law would be far …
