The Alaskan Wolf War: The Public Trust Doctrine Missing In Action, Edward A. Fitzgerald
Animal Law Review
Wolf killing in Alaska is authorized by the Board of Game (BOG), an agency captured by hunting and trapping interests. The BOG’s wolf killing policies have generally been supported by state legislatures and governors. Alaskan courts have not halted the wolf killing. The courts have viewed wolf killing as an issue of administrative law and deferred to BOG expertise. This article argues that the courts should have invoked Alaska’s public trust doctrine, which prevents the granting of preferences over state natural resources. The courts should have also rigorously examined the BOG’s wolf killing policies and protected the wolf as a …

In 2008, the United States Court of Appeals for the Federal Circuit issued eight trademark decisions and designated one of those eight decisions as precedential. These numbers are significantly lower than in recent years. The cases consist of appeals from the Trademark Trial and Appeal Board (“TTAB”), the United States Court of International Trade, and the United States Court of Federal Claims. Of the eight trademark decisions, four focused on substantive issues and four primarily involved procedural issues. The Federal Circuit generally adopted the findings of the lower tribunals, affirming all but one of the eight decisions on appeal. The …

With the National Labor Relations Act of 1935 (NLRA), Congress intended to provide private-sector employees with the right to organize collectively for their mutual aid and protection in the workplace. However, the NLRA faces a tsunami of criticism, much of which highlights its inadequacies with respect to protecting collective activity among employees. In light of the NLRA’s myriad limitations, some scholars have developed promising proposals to identify new legal bases for protecting collective activity among employees outside of the NLRA. International space law has long imposed a duty to rescue astronauts and return errant spacecraft to the launching state. However, the existing space law treaties contain a number of gaps and interpretational problems that, among other things, call into question whether the duty to rescue and return applies to space tourists and spacecraft owned by private companies. These issues are of critical importance to the survival of the new space tourism industry, which is made up of a growing number of companies - such as Virgin Galactic, Rocketplane, and Blue Origin - that intend to launch their maiden flights in …

Nadya Suleman used sperm from a man she knows to conceive fourteen children using assisted reproduction. It is clear that Suleman is the legal mother of the children. The unanswered question is: "Are the children legally fatherless?" The answer to this question is important because experts predict that it will take well over one million dollars to support the children until they reach the age of majority. My article seeks to provide some insight into the resolution of this issue. Although Suleman did not conceived using artificial insemination, the information examined in my article may be applied to her situation. …

Space, a major visual element, can be examined in depth in Jeff Koons’s artwork. Koons produces art in different series and each series contains numerous pieces. The appendages of the mechanical devices, a major element of space in the early series, accentuate the sexuality present in Koons’s art, as well as the surface quality and materials used in all the series. Koons’s obsession with perfection is what generates the flawless exteriors making the surface material void of human touch and elevating the sometimes kitsch subjects of the pieces. Yellow-flowered alfalfa (YFA) has great potential to improve rangelands in the Northern Plains. Greater than 99% of YFA seeds from soil were viable but less than 4% germinated under standard laboratory conditions. The objective was to determine if low germination was due to physical or physiological seed dormancy. The experiment utilized a random complete block design with two trials, eight replications per trial. Each replication consisted of ten treatments plus a control, four stratification treatments consisting of a combination of two temperatures (-5°C, -20°C) and two durations (48 hr, 72 hr), one warm treatment (4 min, 60°C), four sandpaper scarification …

This paper examines how the ecology, communication networks, politic decisions, and issue networks of the University have influenced the University administration to have a goal towards sustainability yet refuse formal commitments to improving the sustainability of the University. Autism spectrum disorders (ASD) are characterized by social deficits in emotional comprehension. Since typical emotional attribution improves when using the left visual field, effects of lateralization on facial affect assessment were compared between children with ASD, pervasive developmental disorder not otherwise specified (PDD-NOS) and typical development (TD). The ASD group showed significantly lower percent accuracy, longer response time and slower pulse rate than the TD group. Within the ASD group, there was a significant right visual field bias in emotional attribution tasks, which contrasted with the left visual field bias seen within the TD group. Numerous protocols are available for the isolation of plant genomic DNA. Often times, these protocols utilize a wide variety of solutions. The primary purpose of this project was to examine the use of LiCl for the removal of RNA contaminants within genomic DNA samples and its dependency on incubation time and temperature. Our results indicate that LiCl is sufficient for the removal of high molecular weight RNA contaminants from genomic DNA. In addition, our results illustrate varying incubation times with LiCl yield minimal differences in the recovery of genomic DNA and the removal of RNA contaminants. Purpose: This study examines the utility of implementing the mini-CEX at a student-run primary care clinic. The mini-CEX is a validated tool for clinical skills feedback and evaluation. The implementation of the mini-CEX sought to improve quality standards in providers clinical skills, and therefore to set a model for continuous quality improvement in medical education. Hypothesis: The primary hypothesis tested is that a minimum of three mini-CEXs per week will produce a positive utility for both students and faculty. Clinical trials investigating autologous stem cell transplantation (ASCT) have historically excluded elderly patients due to the risk of treatment-related morbidity related to the administration of high dose chemotherapy. While the availability of this procedure continues to expand, the elderly still represent a population for which the role of ASCT needs to be fully defined. 201 patients who underwent autologous stem cell transplantation (ASCT) for Non Hodgkins lymphoma (NHL) at a single institution following BEAM conditioning between January 1, 2000 and December 31, 2007 were retrospectively identified from the Yale University School of Medicine Bone Marrow Transplant Database. 67 patients were …

Constructivist learning theory is based upon the tenets that students come to learning experiences with prior knowledge and experiences that the learner will choose from to make sense of the present situation. This leads to a mixture of understandings among students. This study proposed to reveal students‟ understanding of atomic structure and cell structure as well as the relationships between atoms and cells.

This Article examines environmental rhetoric and argues that a nationalist conception of nature has long distorted environmental policies. Environmental discourse frequently seeks to explain the natural world by reference to the world of nations, a phenomenon that can be characterizeda s the "nationalizationo f nature." A contemporary example of the nationalization of nature is the rhetoric of "Invasive species," which depicts harmful foreign plants and animals in ways that bear an uncanny resemblance to the demonization of foreigners by opponents of immigration. Mandated health benefit laws figure prominently in health reform debates. These laws, which are primarily enacted by the states, require health insurers to cover specific medical treatment, services, or supplies such as mental health treatment, mammograms, or diabetes testing supplies. Critics argue that mandated health benefit laws increase health insurance costs, decrease consumer choice, and often are the product of rent-seeking, rather than sound public policy. This Article seeks to further the discussion of mandated health benefit laws by systemically identifying permissible rationales for such laws. Almost half of Americans between 17 and 24 years of age are enrolled in higher education. College is an important life transition period when many young adults establish independence and adopt lasting behavior patterns, especially with regard to diet and physical activity. The incidence of autism continues to rise with no cure or understanding of the cause of the disorder. Approximately one in 150 children will be diagnosed with an (ASD) Autism Spectrum Disorder although recent prevalence data suggest one in 91. The objective of the study is to assess medicinal intake regarding prescription and nonprescription medications of children with Autism Spectrum Disorders and its affect on their nutritional status compared to age, and sex matched healthy children. In a series of papers, Martin Weitzman has proposed a Dismal Theorem. The general idea is that, under limited conditions concerning the structure of uncertainty and preferences, society has an indefinitely large expected loss from high-consequence, low-probability events. Under such conditions, standard economic analysis cannot be applied. The present study is intended to put the Dismal Theorem in context and examine the range of its applicability, with an application to catastrophic climate change. Background: The chemopreventive effects of resveratrol (RSV) on prostate cancer have been well established; the androgen receptor (AR) plays pivotal roles in prostatic tumorigenesis. However, the exact underlying molecular mechanisms about the effects of RSV on AR have not been fully elucidated. A model system is needed to determine whether and how RSV represses AR transcriptional activity. Methodology: The AR cDNA was first cloned into the retroviral vector pOZ-N and then integrated into the genome of ARnegative HeLa cells to generate the AR(+) cells. N,N-dimethyl-N' -(2-methylbenzoyl)thiourea, C_{11}H_{14}N_2SO (HL^1), N,N-dibutyl-N' -(2-methylben\-zoyl)thiourea, C{17}H{26}N2SO (HL^2), and N,N-dihexyl-N' -(2-methylbenzoyl) thiourea, C{21}H{34}N2SO (HL^3) were synthesized and characterized by elemental analysis, spectroscopic methods (FT-IR, NMR), and single crystal X-ray diffraction. Compound HL^1 crystallizes in the monoclinic system, space group P21/c, Z = 4. Compound HL^3 also crystallizes in the monoclinic system, space group P21/n, Z = 8 with 2 independent molecules in the asymmetric unit. Compound HL^2 crystallizes in the orthorhombic system, space group Pcnn, Z = 8. In all compounds, molecules form dimers through the strong intermolecular N-H...S hydrogen bonds. Only recently have critical criminologists begun a systematic exploration of genocide, war crimes and crimes against humanity as state crimes (Kramer and Michalowski 2005; Mullins and Rothe 2008; Haveman and Smeulers 2008). This paper contributes to that growing literature through examining the nature and dynamics of sexual violence as it occurred during the 1994 Rwandan genocide. It draws upon empirical examination of events depicted in transcripts of trials held before the International Criminal Tribunal for Rwanda. Spatial heterogeneity in predation risk can ameliorate impacts on prey populations, particularly for prey of generalists. In this study, the authors explore English as a Second Language (ESL) placement as a measure of how schools label and process immigrant students. Using propensity score matching and data from the Adolescent Health and Academic Achievement Study and the National Longitudinal Study of Adolescent Health, the authors estimate the effect of ESL placement on immigrant achievement. In schools with more immigrant students, the authors find that ESL placement results in higher levels of academic performance; in schools with few immigrant students, the effect reverses.
