Aggregate Litigation Across The Atlantic And The Future Of American Exceptionalism, Richard A. Nagareda

In long-running debates over civil justice reform, two points remain broadly shared: the legal regime for civil litigation in this country is exceptional by comparison to European systems as a positive matter, and the United States is much the worse for it in normative terms. The positive dimension of this account pinpoints several exceptional features of the U.S. civil justice system: class actions, primarily on an opt-out basis; contingency-fee financing of litigation; rejection of Euro-style "loser-pays" rules that link responsibility for the fees of both sides to the outcome of the litigation; extensive reliance on juries as fact finders; costly …

Bats And Bell Holes: The Microclimatic Impact Of Bat Roosting, Using A Case Study From Runaway Bay Caves, Jamaica, Joyce Lundberg, Donald A. Mcfarlane

The microclimatic effect of bats roosting in bell holes (blind vertical cylindrical cavities in cave roofs) in Runaway Bay Caves, Jamaica, was measured and the potential impact of their metabolism on dissolution modelled. Rock temperature measurements showed that bell holes with bats get significantly hotter than those without bats during bat roosting periods (by an average of 1.1 °C). The relationship is clearest for bell holes with more than about 300 g aggregate bat body mass and for bell holes that are moderately wide and deep, of W:D ratio between 0.8 and 1.6. A Note On The Thermal Ecology And Foraging Behaviour Of The Egyptian Fruit Bat, Rousettus Aegyptiacus, At Mt. Elgon, Kenya, Donald A. Mcfarlane, Joyce Lundberg

The Egyptian fruit bat, Rousettus aegyptiacus, is an abundant and widely distributed African pteropid (Nowak, 1999). The species is unusual amongst pteropids in being an obligate cave-dweller (Kwiecinski & Griffiths, 1999), sometimes reaching colony sizes in the thousands (Kingdon, 1974). In the caves of Mt. Elgon National Park, western Kenya (1° 08′N, 34° 39′E), precision temperature loggers placed in major Rousettus roosts and intervening passages have allowed us to precisely monitor bat emergence and return times.

This technical document supports the Forest Service’s requirement to assess the status of renewable natural resources as mandated by the Forest and Rangeland Renewable Resources Planning Act of 1974 (RPA). It updates past reports on national and regional trends in population and harvest estimates for species classified as big game and small game. The trends reported here were derived from State Wildlife Agency biologists and supplemented with data from the North American Breeding Bird Survey for those bird species that are commonly sought by upland game hunters. Big game populations and harvests have generally increased over the 1975-2000 period. Small …

Xenophilia As A Cultural Trap: Bridging The Gap Between Transpersonal Psychology And Religious/Spiritual Traditions, Harris Friedman

Xenophilia, seen as a type of romanticism, is proposed as an explanation for the tendency
within transpersonal psychology to privilege so-called exotic religious and spiritual traditions,
as opposed to the xenophobic tendency within mainstream Western psychology of
religion and spirituality to privilege the Judeo-Christian tradition. Claims made in a recent
article published in a major psychology journal that Buddhism does not rest on supernatural
faith and is the most psychological spiritual tradition are challenged as examples of this type

The Plurality Of Religions And The Spirit Of Pluralism: A Participatory Vision Of The Future Of Religion, Jorge N. Ferrer
International Journal of Transpersonal Studies
This paper first uncovers the subtle spiritual narcissism that has characterized historical approaches
to religious diversity and discusses the shortcomings of the main forms of religious pluralism that
have been proposed as its antidote: ecumenical, soteriological, postmodern, and metaphysical. It
then argues that a participatory pluralism paves the way for an appreciation of religious diversity that
eschews the dogmatism and competitiveness involved in privileging any particular tradition over the
rest without falling into cultural-linguistic or naturalistic reductionisms. Discussion includes the
question of the validity of spiritual truths and the development of a participatory critical theory of

While half of all human tumors possess p53 mutations, inactivation of wild-type p53 can also occur through a variety of mechanisms that do not involve p53 gene mutation or deletion. Our laboratory has been interested in tumor cells possessing wild-type p53 protein and elevated levels of HdmX and/or Hdm2, two critical negative regulators of p53 function. In this study we utilized RNAi to knockdown HdmX or Hdm2 in MCF7 human breast cancer cells, which harbor wild-type p53 and elevated levels of HdmX and Hdm2 then examined gene expression changes and effects on cell growth. As this symposium demonstrates, criminology has much to offer criminal law and procedure. But there are limits to this endeavor, such as when public policy is distorted by powerful emotions that ignore the lessons of legal doctrine and social science. This article presents one possible response in such circumstances: expanding the interdisciplinary relationship to include literary and cultural materials usually associated with the humanities. These works can inspire the public imagination in ways that law and criminology cannot, at times offering an alternative narrative to counter emotion-driven claims of necessity, for instance, and raising the exact type of questions that …

Fishing for crustaceans including southern and western rock lobster and deep-sea crab species on the south coast of Western Australia began in the 1960s and has developed significantly through improvements in technology, vessel reliability and the risk and endeavour of some fishers. The expansion in the capacity of the fleet has lead to the development of two managed fisheries.
This paper provides a brief outline of the history of the fishery; details the fishing and management methods presently used; and discusses the options available for future management, particularly ways of limiting fishing effort.

The Western Australian Department of Fisheries is responsible for the management of aquaculture in WA and is committed to implementing ESD. These principles are contained within the objectives of the Fish Resources Management Act 1994 and the Department is keen to demonstrate both to the Government and the broader community that these principles are being achieved. The Department developed a policy statement in 2002 - Policy for the Implementation of Ecologically Sustainable Development for Fisheries and Aquaculture within Western Australia - (Fletcher 2002) that described its direction to the Department on incorporating ESD within fisheries and aquaculture management.

Nebraska and its adjoining states represent a nearly unique ornithological situation. Although they are almost entirely grassland, the plains states are variably dissected by river-bottom forests that provide natural passageways for forest-adapted species to enter the plains and sometimes to cross them. Although eastern and western bird faunas tend to be separated by the plains, they often mingle to some degree, resulting in competition and sometimes hybridization. The central Great Plains thus are exceedingly interesting from ecological, evolutionary, and zoogeographic perspectives, and the plains bird fauna is significant both for what is present and for what has been variably excluded. …
