Fitting Punishment, Juliet Stumpf Sep 2009

Fitting Punishment, Juliet Stumpf

Washington and Lee Law Review

Proportionality is conspicuously absent from the legal framework for immigration sanctions. Immigration Law relies on one sanctiondeportation- as the ubiquitous penalty for any immigration violation. Neither the gravity of the violation nor the harm that results bears on whether deportation is the consequence for an immigration violation. Immigration Law stands alone in the legal landscape in this respect. Criminal Law incorporates proportionality when imposing graduated punishment based on the gravity of the offense; contract and tort Law provide for damages that are graduated based on the harm to others or to society. This Article represents the first and fundamental step …

Emotional Behavior In Subclinical Psychopathy, Kristen Lee Godenick

Loma Linda University Electronic Theses, Dissertations & Projects

The unique interpersonal qualities of individuals who fall on the so-called ‘psychopathic spectrum’ have been regularly documented since Cleckley’s observations (1941). The literature reflects the importance of understanding individuals who have high and low levels of psychopathic personality traits for research (Lilienfeld, 1998, Patrick, Edens, Poythress, Lilienfeld & Benning, 2006), clinical (Patrick, Hicks, Blonigen & Krueger, 2003) and risk assessment purposes (Skeem, Poythress, Edens, Lilienfeld & Cade, 2003) through bringing forth the position that psychopathic traits can fall on a continuum (Benning, Patrick, Salekin & Leistico, 2005). The purpose of this study was to investigate the association between psychopathic personality …

Introduction To The Symposium On The Model Penal Code's Sentencing Proposals, Christopher Slobogin Sep 2009

Introduction To The Symposium On The Model Penal Code's Sentencing Proposals, Christopher Slobogin

Vanderbilt Law School Faculty Publications

Begun in the 1950s, the drafting of the Model Penal Code (the Code) differed from the typical American Law Institute (AL) "restatement" of the law project because it was an explicit attempt to provide a model statute that would advance doctrine and practice rather than merely describe it. Scores of lawyers, judges, academics and policymakers actively participated in the process of devising the Code. Their efforts paid off. As Gerard Lynch wrote in 1998, "[t]he Model Penal Code is among the most successful academic law reform projects ever attempted.", During the 1960s and 1970s, well over half the states revamped …

The Writer-Of-Violence-As-School-Shooter-Stereotype: How Columbine, Virginia Tech, And Public Fear Make Writing Violence Dangerous For High School And College Students, Matt Foy

UNIversitas: Journal of Research, Scholarship, and Creative Activity

This Time Magazine excerpt from “The Legacy of Columbine,” published on March 11, 2001, nearly two years after the infamous attack at Columbine High School, is a chilling reminder of the culture of fear that consumed the United States in the wake of the massacre, at that point the most horrific incident of gun violence in a United States school. The bloody rampage of teenage gunmen Eric Harris and Dylan Klebold, respectively 18 and 17 years old and both seniors at upper class, mostly white Columbine High School in Littleton, Colorado, instantly captured the awe, grief and outrage of the …

Hate Studies: Toward Jesuit Leadership On Curriculum Development, James M. Mohr

Journal of Catholic Education

To make the connections between social justice and the study of hate, the paper begins with a description of Hate Studies and a brief overview of the Jesuit conception of social justice as it relates to higher education. Following these descriptions it is explained how Jesuits can influence the development of a curriculum for Hate Studies. The influence is …

Remarks, More Remarks And A Grounds Of Decision: One Judgment Too Many? Tt Durai V Public Prosecutor, Unreported Magistrate's Appeal, S. Chandra Mohan

Research Collection Yong Pung How School Of Law

In May 2008, the High Court dismissed the appeal of former NKF CEO, T T Durai, against his conviction and sentence. What is little known is that one of Durai's six grounds of appeal was in fact upheld. The appellate judge subsequently devoted nine out of 12 paragraphs of his four-page Grounds of Decision, to explain is reasons for doing so. Although this ruling did not affect the final outcome of the Durai appeal, it has to some extent helped to settle a question that has vexed criminal law practitioners in recent years. This concerns the legality and propriety of …

This article presents findings from a qualitative study exploring how family support affects adjudicated adolescent girls' experiences in a residential treatment facility. The perspectives of nine professionals working with this population were gathered using an online survey that collected demographic data and open-ended questions. Data analysis was conducted using a grounded theory method and ten themes were identified: support by biological relative, support by non-biological relative, appropriateness/effectiveness of treatment, dependent on behaviors, face-to-face contact, non-face-to-face contact, socioeconomic reasons, personal reasons, negative effect on behavior, and positive effect on behavior. An Exploration Of Diferences In Childhood Maltreatment Between Violent And Non-Violent Male Juvenile Delinquents, And, Childhood Maltreatment And Its Effects On Male Delinquent Crime : Physical Neglect Trumps All, Caroline Irene Robertson

Theses, Dissertations, and Projects

Violent crime is a significant economic (Corso, Mercy, Simon, Finkelstein, and Miller, 2007) and public health problem (Krug, Mercy, Dahlberg, and Zwi, 2002) in the United States. Although adults commit the bulk of this nation's violent crime, juveniles contribute significantly to violent crime in the United States; juveniles committed twelve percent of all violent crimes in 2004 (Snyder, 2006). Although there are many individual and family characteristics that predispose juveniles to commit violent acts (Farrington, 1989; Howard and Jenson, 1999; Saner and Ellickson, 1996; Sherline, Skipper, and Broadhead, 1994; Stone and Dover, 2007), a potentially significant influence on later violence …

Impulsive And Antisocial Personality Characteristics Amongst Male Adolescent Sexual Offenders :, Amanda Raquel Santiago Aug 2009

Impulsive And Antisocial Personality Characteristics Amongst Male Adolescent Sexual Offenders :, Amanda Raquel Santiago

Theses, Dissertations, and Projects

Although adolescent violent crime arrests have declined over the years (Snyder and Sickmund, 2006; Sickmund 2005) the number of adolescent nonviolent and violent sexual offenses continues to peril social health. As such, empirically based treatment options are needed to meet the diverse needs of this heterogeneous group of youth. The purpose of this study was to review current literature for impulsive and antisocial personality characteristics amongst male adolescent sexual offenders. Two separate quantitative research papers were written to assess the significant relationship between these personality traits and adolescent sexual offenders. To help leverage our understanding of these youth, the first …

Having Our Say : Stressors And Readjustment Issues Of Veterans Of The Wars In Iraq And Afghanistan From The Perspective Of Loved Ones, Karen Davis Mcginty

Theses, Dissertations, and Projects

This qualitative study explores the stressors and readjustment issues experienced by veterans of the wars in Iraq and Afghanistan, from the perspective of loved ones. A review of the literature on veterans' experiences is vast; however there is little literature that discusses the stressors from the perspective of a loved one. This study examines the "common" post-combat stressors, psychosocial issues, and mental illnesses impacting combat veterans in the words and observations of those closest to them. Twelve loved ones of veterans of the current wars in Iraq and Afghanistan participated in this study, providing narrative data based on their veterans' …
