Justice Ginsburg's Gradualism In Criminal Procedure, Christopher Slobogin Oct 2009

Justice Ginsburg's Gradualism In Criminal Procedure, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This article, written for a symposium analyzing Justice Ginsburg’s jurisprudence on the 15th anniversary of her tenure on the Supreme Court, is the first sustained look at her views on criminal procedure issues (search and seizure, interrogation, the right to counsel, trial rights, sentencing procedures, and the criminal appeals and collateral review processes). Not surprisingly, given her ACLU background, she tends to vote in favor of criminal defendants’ positions more often than most other justices, and she is the most likely to do so since Chief Justice Roberts joined the Court. At the same time, the gradualist tendencies that she …

Mental Illness And Self-Representation: Faretta, Godinez And Edwards, Christopher Slobogin Oct 2009

Mental Illness And Self-Representation: Faretta, Godinez And Edwards, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In the recent decision of Indiana v. Edwards the Supreme Court held that the right to represent oneself may be denied to defendants who are competent to stand trial if they "still suffer from severe mental illness to the point where they are not competent to conduct trial proceedings by themselves." Edwards was a surprise, given the Court's holding 15 years earlier in Godinez v. Moran that Nevada courts did not err when they permitted a mentally ill person who had been found competent to stand trial to waive the right to counsel, plead guilty and waive the presentation of …

On The Limits Of Supremacy: Medical Marijuana And The States' Overlooked Power To Legalize Federal Crime, Robert A. Mikos Oct 2009

On The Limits Of Supremacy: Medical Marijuana And The States' Overlooked Power To Legalize Federal Crime, Robert A. Mikos

Vanderbilt Law School Faculty Publications

Using the conflict over medical marijuana as a timely case study, this Article explores the overlooked and underappreciated power of states to legalize conduct Congress bans. Though Congress has banned marijuana outright, and though that ban has survived constitutional scrutiny, state laws legalizing medical use of marijuana constitute the de facto governing law in thirteen states. This Article argues that these state laws and (most) related regulations have not been, and, more interestingly, cannot be preempted by Congress, given constraints imposed on Congress's preemption power by the anti-commandeering rule, properly understood. Just as importantly, these state laws matter, in a …

Standing And Speaking Constitutional Truth To Local Power Regarding Undocumented Immigrant Residents Dwelling With We The People Of The United States, L. Darnell Weeden Oct 2009

Standing And Speaking Constitutional Truth To Local Power Regarding Undocumented Immigrant Residents Dwelling With We The People Of The United States, L. Darnell Weeden

Southern Illinois University Law Journal

Under the due process clause of the 14th Amendment of the United States Constitution, undocumented immigrants must be treated fairly. Across the nation, state and municipal governments attempt to regulate immigration by enacting laws with harsh penalties directly aimed at undocumented immigrants. When state and municipal governments take such action, they cause fear and unrest among all citizens living in their communities. This fear and unrest often leads to violence against the undocumented immigrants.
In addition, federal courts sometimes fail to recognize that undocumented immigrants have standing to challenge local government attempts to regulate immigration. Not only do these regulations …

In With The New, Out With The Old: Expanding The Scope Of Retroactive Amelioration, S. David Mitchell Oct 2009

In With The New, Out With The Old: Expanding The Scope Of Retroactive Amelioration, S. David Mitchell

Faculty Publications

The legislative decision to amend a statute and reduce a sentence but not to apply it retroactively to pending prosecutions or to finalized convictions is in accord with the principles of retroactivity, but contrary to legitimate goals of punishment, i.e. deterrence and retributivism. Genarlow Wilson, convicted at seventeen of aggravated child molestation, a felony, for consensual oral sex with a fifteen-year old classmate, was sentenced to a mandatory minimum of ten years. While his appeal was pending, the Georgia Legislature reclassified the conduct as a misdemeanor and reduced the sentence to a maximum of one year but decided not to …

Stop The Killing: Potential Courtroom Use Of A Questionnaire That Predicts The Likelihood That A Victim Of Intimate Partner Violence Will Be Murdered By Her Partner, Amanda Hitt, Lynn Mclain Oct 2009

Stop The Killing: Potential Courtroom Use Of A Questionnaire That Predicts The Likelihood That A Victim Of Intimate Partner Violence Will Be Murdered By Her Partner, Amanda Hitt, Lynn Mclain

All Faculty Scholarship

Judges in domestic cases often underestimate the risk to a mother and her children that an angry and abusive father or other intimate partner poses. In a recent Maryland case, for example, two judges refused to deny a father visitation or require that visitation be supervised, despite the fact that the father had threatened suicide. During the father’s unsupervised visitation, he drowned all three of his children, then attempted to kill himself.

The Danger Assessment tool (the D.A.) developed by a Johns Hopkins Nursing professor and validated by herself and other social scientists shows how much the father’s thoughts of …

Sources Of Informal Social Control And The Relationship To Victimization In Southeastern Virginia, Jennifer R. Jones Oct 2009

Sources Of Informal Social Control And The Relationship To Victimization In Southeastern Virginia, Jennifer R. Jones

Sociology & Criminal Justice Theses & Dissertations

The link between community characteristics and crime has been at the forefront of criminological research for some time. Social disorganization theory focuses on the relationship between structural characteristics of communities and crime. Recent examination of the social disorganization perspective has emphasized the role of informal social control as mediating the effects of structural characteristics on victimization. In this study, contemporary social disorganization theory was tested using data from the U.S. Census Bureau: Census Tract Fact Finder (2000) and the Southeastern Virginia Community Survey (2008). This research addressed three central research questions: Is there a relationship between structural characteristics (i.e., poverty, …

The Psychology Of Conflicts Of Interest In Criminal Cases, Tigran W. Eldred Oct 2009

The Psychology Of Conflicts Of Interest In Criminal Cases, Tigran W. Eldred

Faculty Scholarship

This article demonstrates that current Sixth Amendment jurisprudence fails to account for how defense lawyers respond to conflicts of interest in criminal cases. Too often, the Supreme Court has made assumptions about the behavior of defense lawyers without empirical support. The result has been a confusing doctrinal landscape, which both relies upon and questions the ability of defense lawyers to address and resolve conflicts of interest.

This article fills the gap in existing literature by viewing conflicts of interest in criminal cases through the prism of behavioral economics. The research reveals that defense lawyers are subject to psychological biases that …

On The Limits Of Supremacy: Medical Marijuana And The States' Overlooked Power To Legalize Federal Crime, Robert A. Mikos

Using the conflict over medical marijuana as a timely case study, this Article explores the overlooked and underappreciated power of states to legalize conduct Congress bans. Though Congress has banned marijuana outright, and though that ban has survived constitutional scrutiny, state laws legalizing medical use of marijuana not only survive careful preemption analysis, they constitute the de facto governing law in thirteen states. This Article argues that these state laws and most related regulations have not been and, more interestingly, cannot be preempted by Congress, given constraints imposed on Congress's preemption power by the anti-commandeering rule, properly understood. No Rational Basis: The Pragmatic Case For Marijuana Law Reform, Eric D. Blumenson, Eva Nilsen Oct 2009

No Rational Basis: The Pragmatic Case For Marijuana Law Reform, Eric D. Blumenson, Eva Nilsen

Faculty Scholarship

This article presents a critique of marijuana prohibition and suggests some alternative regulatory approaches that would be more productive and consonant with justice. Part I relies on a forty-year empirical record to demonstrate that (1) reliance on a law enforcement approach has aggravated rather than mitigated the risks involved with marijuana use, and (2) criminalization, which results in the arrest of more than 700, 000 Americans annually for possession of any amount of marijuana, is an inhumane and destructive response to an act that almost 100 million Americans have committed. Part II assesses the relative merits of several alternative reform …

Parent-Adolescent Discrepancies In Ratings Of Youth Victimization: Associations With Psychological Adjustment, Kimberly Goodman Sep 2009

Parent-Adolescent Discrepancies In Ratings Of Youth Victimization: Associations With Psychological Adjustment, Kimberly Goodman

Theses and Dissertations

Epidemiological research indicates that parents report lower levels of youths’ exposure to violence than youth self-report, and theory suggests that such discrepancies reflect parents’ lack of knowledge of youth victimization and impaired ability to help children cope with victimization. This study extends prior research examining the implications of parent-youth informant discrepancies on ratings of victimization. Latent class analysis (LCA) was employed to identify groups of dyads distinguished by patterns of parent and youth report of victimization, uncovering heterogeneity based on patterns of parent-youth ratings of victimization. Analyses examined how latent classes reflecting parent-youth agreement on victimization were related to adjustment …

What's Race Got To Do With It? Press Coverage Of The Latino Electorate In The 2008 Presidential Primary Season, Laura Gomez

Faculty Scholarship

This article presents a critical analysis of press coverage of Latinos and the presidential election during the Democratic Primary, from January through June 2008. The foundation of this article is a content analysis of 408 articles published in four newspapers about Latinos and the presidential election during the primary season. The four newspapers -- The Los Angeles Times, The New York Times, The Chicago Tribune and The Dallas Morning News -- were selected because they are well respected as newspapers of record and because they represent diverse regions of the country (two from the northeast, two from the southwest). Each …

Comparison Of The Trauma Symptom Checklist For Children, Ucla Ptsd Index, And Child Behavior Checklist In Children With A Trauma History, Melissa Verish Broome Sep 2009

Comparison Of The Trauma Symptom Checklist For Children, Ucla Ptsd Index, And Child Behavior Checklist In Children With A Trauma History, Melissa Verish Broome

Dissertations

The purpose of this dissertation was to study a host of PTSD assessment-related problems in children with a trauma history (N = 110) who were seeking treatment at a community mental health clinic. Exploratory factor analyses using the trauma-related and non-trauma-related subscales on the Child Behavior Checklist (CBCL; Achenbach 1991), UCLA PTSD Index (Pynoos 1998), and the Trauma Symptom Checklist for Children (TSCC; Briere 1996) were conducted. Results indicated that in children aged 7 to 11, but not in older children aged 12 to 17, the UCLA PTSD Index and the TSCC trauma-related scales formed a trauma factor. The CBCL …
