Those who frequent our courthouses and work with low and moderate - income individuals have no illusions about the large gap between the rhetoric of justice and the present reality of our legal system. All over the country, courts are plagued by long dockets, slashed personnel, scarce resources, and self-represented individuals who are not literate in the law and represent themselves in complex legal proceedings or transactions out of necessity. If the accessibility of the legal system remains the top priority for ensuring justice, then perhaps we must consider forging new alliances, healing the political wounds of previous generations, and …

Strategery's Refuge, Christopher W. Seeds
Strategery's Refuge, Christopher W. Seeds

By popular account, the Supreme Court’s recent decisions on effective assistance of counsel in capital sentencing—aggressive critiques of counsel’s failure to investigate and present mitigating evidence—initiate an era of improved oversight of the quality of legal representation in death penalty cases. One would expect the new and improved jurisprudence to curb post hoc efforts by trial counsel to disguise incomplete trial preparation as a tactical decision, a practice that has long undercut the Strickland doctrine. But the shelters for post hoc rationalizations—the refuges for “strategery”—remain. Surveying decisions of the federal courts of appeals since the turn of the century, this …

Performing Discretion Or Performing Discrimination: An Analysis Of Race And Ritual In Batson Decisions In Capital Jury Selection, Melynda J. Price
Law Faculty Scholarly Articles
Research shows the mere presence of Blacks on capital juries--on the rare occasions they are seated--can mean the difference between life and death. Peremptory challenges are the primary method to remove these pivotal participants. Batson v. Kentucky developed hearings as an immediate remedy for the unconstitutional removal of jurors through racially motivated peremptory challenges. These proceedings have become rituals that sanction continued bias in the jury selection process and ultimately affect the outcome of capital trials. This Article deconstructs the role of the Batson ritual in legitimating the removal of African American jurors. These perfunctory hearings fail to meaningfully interrogate …

'A Literary Man & A Merchant': The Legal Career Of Sir William Young, William H. Laurence
'A Literary Man & A Merchant': The Legal Career Of Sir William Young, William H. Laurence
PhD Dissertations
Sir William Young (1799-1887) of Halifax was a leading lawyer, served as Attorney General, promoted legal reforms in the Assembly, sat as Chief Justice of the Nova Scotia Supreme Court, and promoted the establishment of Dalhousie University's Faculty of Law. He thereby fulfilled a variety of roles in his pursuit of two professional goals he had set at an early age, namely material success and intellectual interest. Nonetheless, his career in the law has been mostly ignored. By examining Young's legal career in detail, especially by paying attention to the duties he performed in his professional roles, this thesis seeks …
Retribution's Role, John Bronsteen
Retribution's Role, John Bronsteen
Indiana Law Journal
Two main types of principle, retributive and consequentialist, have long been identified as the main approaches to justifying criminal punishment. Retributivists deem punishment justified by the wrongdoing of the offender, whereas utilitarians deem it justified by its good consequences such as deterring future crime. Over the past fifty years, each has spent decades as the dominant theory, and many hybrid theories have also been advanced. But few, if any, of the hybrid approaches have valued heavily both retributive and consequentialist considerations while locating the particular justificatory role each category plays. This Article points in that direction by reframing the central …

Preserving And Providing Access To Digital State Publications In Alabama: A Case Of Cooperation, Rickey Best
Preserving And Providing Access To Digital State Publications In Alabama: A Case Of Cooperation, Rickey Best
The Southeastern Librarian
As initiatives to achieve a more interactive web-format for government information expand, concerns continue to mount over data security and preservation. While efforts to address these issues are ongoing at the federal level, at the state and local levels there continues to be gaps between state and local agencies creating digital publications and services and ensuring the long-term preservation of those publications. The nature of government information on theWeb also presents challenges. Some information is generated from databases (often federal) which pull together information and make it readily available. Such data, such as the Alabama’s agricultural statistics, are actually derived …

Protecting The Family Pet: The New Face Of Maryland: Domestic Violence Protective Orders, Gary C. Norman
Celebrating WCL Student Authors
Domestic violence is on the rise, and pets are increasingly becoming the victims of marital disputes. There is a demonstrated link between acts and offenses of domestic violence and animal abuse. Domestic abusers often do not think twice about beating or otherwise harming pets that have bonded with the other spouse in order to control, coerce, intimidate, or cause emotional harm to that spouse.
There is an emerging awareness that animals are more than just property. Several states have recognized, through the enactment of legislation fortifying their family law systems, that animals play an integral role in the lives of …

Contingent Constitutionalism: State And Local Criminal Laws And The Applicability Of Federal Constitutional Rights, Wayne A. Logan
Contingent Constitutionalism: State And Local Criminal Laws And The Applicability Of Federal Constitutional Rights, Wayne A. Logan
William & Mary Law Review
Americans have long been bound by a shared sense of constitutional commonality, and the Supreme Court has repeatedly condemned the notion that federal constitutional rights should be allowed to depend on distinct state and local legal norms. In reality, however, federal rights do indeed vary, and they do so as a result of their contingent relationship to the diversity of state and local laws on which they rely. Focusing on criminal procedure rights in particular, this Article examines the benefits and detriments of constitutional contingency, and casts in new light many enduring understandings of American constitutionalism, including the effects of …

Privacy In The Age Of Tracking Technology: Why G.P.S. Technology Should Not Be Used To Track Process Servers, Talia E. Neri
Cardozo Public Law, Policy & Ethics Journal
The article argues that the expansion of GPS technology in the process service industry and workplace surveillance raises significant Fourth Amendment concerns, as it erodes privacy expectations and creates a chilling effect on personal autonomy. While courts have upheld the use of GPS in certain employment contexts, the author contends that such surveillance often outweighs its benefits, particularly when less intrusive alternatives are available. The analysis critiques the legal standards governing surveillance, particularly the "readily available" standard from United States v. Kyllo, and advocates for a more balanced approach that prioritizes privacy protections.
