The Impact Of Social Capital On Youth Substance Use, Ali Unlu
The Impact Of Social Capital On Youth Substance Use, Ali Unlu
Electronic Theses and Dissertations
Substance use, such as alcohol, cigarette, and marijuana, is a threat to the health and well-being of the youth, their families, and society as well. Government supports and implements several programs to protect youth from substance use. The aim of this study is to evaluate the impact of social capital on youth behavior and to suggest evidence-based policy interventions. Social capital refers to individual embeddedness in web of social relations and their behaviors guided by social structure. Therefore, adolescents' social interactions with their peers, parents, and community were investigated. The substance use was measured by the usage of cigarettes, alcohol, …
C.B.C. Distribution And Marketing, Inc. V. Major League Baseball Advanced Media, L.P.: The First Amendment Versus The Right Of Publicity In The Eighth Circuit, Surina Mann
UC Law SF Communications and Entertainment Journal
This note examines the friction between the First Amendment and the right of publicity by examining the case of C.B.C. Distribution and Marketing, Inc. v. Major League Baseball Advanced Media, L.P., a case regarding fantasy league baseball. This note begins by discussing the legacy of the right of publicity, the policy goals that the right of publicity was devised to further, and several different tests that courts have designed to balance the right of publicity with the rights guaranteed by the First Amendment. This note then goes on to illustrate the background of fantasy league baseball and critique the C.B.C. …
The Politics Of Power: A Social Architecture Analysis Of The 2005-2008 Federal Shield Law Debate In Congress, Cathy Packer
The Politics Of Power: A Social Architecture Analysis Of The 2005-2008 Federal Shield Law Debate In Congress, Cathy Packer
UC Law SF Communications and Entertainment Journal
Would a federal shield law hamper the U.S. Department of Justice's power to combat terrorism and other crimes? Would the law protect the media from the chilling effects of federal subpoenas? Or would the law unwisely grant the already powerful media legal rights denied to other citizens? And who should have the power to decide whether to allow the media to refuse to comply with federal subpoenas? These and similar questions about how power should be distributed among branches of the federal government and the media were at the center of the Congressional hearings and debate on the proposed federal …

Revelation And Idolatry: Holy Law And Holy Terror, Regina Schwartz
Revelation And Idolatry: Holy Law And Holy Terror, Regina Schwartz
Faculty Working Papers
THE Book of Exodus desscribes the identity of justice and the law. Because elsewhere the gap between justice and the law is so wide -- in Christian theology when it sees the Pharisaic law as inhibiting the realization of justice; in philosophy where from Plato on, law is formal while is justice substantive; in political theory, which includes those who endorse "procedural justice" when they abandon substantive justice -- this radical biblical vision, wherein the law is justice is surely unique. This is not an understanding of the law as a series of prescriptions, the "yoke of the law" but …
The "Define And Punish" Clause And The Limit Of Universal Jurisdiction, Eugene Kontorovich
The "Define And Punish" Clause And The Limit Of Universal Jurisdiction, Eugene Kontorovich
Faculty Working Papers
This Article examines whether the "Define and Punish" clause of the Constitution empowers Congress to criminalize foreign conduct unconnected to the United States. Answering this question requires exploring the Constitution's "Piracies and Felonies" provision. While it is hard to believe this can still be said of any constitutional provision, no previous work has examined the scope of the "Piracies and Felonies" powers. Yet the importance of this inquiry is more than academic. Despite its obscurity, the Piracies and Felonies power is the purported Art. I basis for a statute currently in force, which represents Congress's most aggressive use of universal …

The Story Of Bivens V. Six Unknown-Named Agents Of The Federal Bureau Of Narcotics, James E. Pfander
Faculty Working Papers
In Bivens v. Six Unknown-Named Agents of the Federal Bureau of Narcotics, the Supreme Court recognized the right of an individual to sue federal government officials for a violation of constitutional rights. Drawing on interviews with some of the participants, including Webster Bivens himself and one of the agents who conducted the search, this chapter in the forthcoming book Federal Courts' Stories describes the events that led to the litigation and the complex array of factors that informed the Court's approach to the case. After placing the Bivens decision in context, the chapter evaluates the competing narratives that have grown …
Two Ways To Think About The Punishment Of Corporations, Albert Alschuler
Two Ways To Think About The Punishment Of Corporations, Albert Alschuler
Faculty Working Papers
This article compares the criminal punishment of corporations in the twenty-first century with two ancient legal practices—deodand (the punishment of animals and objects that have produced harm) and frankpledge (the punishment of all members of a group when one member of the group has avoided apprehension for a crime). It argues that corporate criminal punishment is a mistake but that viewing it as frankpledge is less ridiculous than viewing it as deodand. The article considers the implications of the choice between these concepts for standards of corporate guilt and for the sentencing of corporate offenders. After a brief historical description …

Estimating The Differential Costs Of Criminal Activity For Juvenile Drug Court Participants: Challenges And Recommendations, Kathryn E. Mccollister, Michael T. French, Ashli J. Sheidow, Scott W. Henggeler, Colleen Halliday-Boykins
Sociology Faculty Articles and Papers
Juvenile drug court (JDC) programs have expanded rapidly over the past 20 years and are an increasingly popular option for rehabilitating juvenile offenders with substance use problems. Given the high cost of crime to society, an important economic question is whether and to what extent JDC programs reduce criminal activity among juvenile offenders. To address this question, the present study added an economic cost analysis to an ongoing randomized trial of JDC conducted in Charleston, South Carolina. Four treatment conditions were included in the parent study: Family Court with usual community-based treatment (FC, the comparison group), Drug Court with usual …

Delinquent Or Distracted?: Attention Deficit Disorder And The Construction Of The Juvenile Offender, Rashmi Goel
Delinquent Or Distracted?: Attention Deficit Disorder And The Construction Of The Juvenile Offender, Rashmi Goel
Sturm College of Law: Faculty Scholarship
William and Billy, 1 two boys, each 13 years old, appear in juvenile court. Neither has any criminal history. Both are doing poorly in school. Both have been cited for truancy in the past. Both are appearing on assault charges arising out of schoolyard fights. If we could peer into their brains, we would find that both have the same brain chemistry, characteristic of Attention Deficit Hyperactivity Disorder (ADHD). 2 In the end, the court finds one delinquent, and the other merely distracted. The court finds one in need of confinement, and the other in need of care. Two different …

The Supreme Court As The Major Barrier To Racial Equality, Ivan E. Bodensteiner
The Supreme Court As The Major Barrier To Racial Equality, Ivan E. Bodensteiner
Law Faculty Publications
This Article suggests that the U.S. Supreme Court, through its decisions in cases alleging race discrimination, stands as a major barrier to racial equality in the United States. There are several aspects of its decisions that lead to this result. Between 1868 and 1954, the Equal Protection Clause of the Fourteenth Amendment, while it had been interpreted to strike down a few blatant forms of de jure discrimination, allowed government to separate the races based on the “separate but equal” fiction. Beginning in 1954, Brown and a series of subsequent decisions attacked this fiction, and for a period of nearly …
Annoyancetech Vigilante Torts And Policy, Robert F. Blomquist
Annoyancetech Vigilante Torts And Policy, Robert F. Blomquist
Law Faculty Publications
The twenty-first century has ushered in demand by some Americans for annoyancetech devices—novel electronic gadgets that secretly fend off, punish, or comment upon perceived antisocial and annoying behaviors of others. Manufacturers, marketers, and users of certain annoyancetech devices, however, face potential tort liability for personal and property damages suffered by the targets of this “revenge by gadget.” Federal, state, and local policymakers should start the process of coming to pragmatic terms with the troubling rise in the popularity of annoyancetech devices. This is an area of social policy that cries out for thoughtful and creative legislative solutions.
