Rhetoric Versus Reality: The Jurisdiction Of Rape, The Indian Child Welfare Act, And The Struggle For Tribal Self-Determination, Maire Corcoran Feb 2009

Rhetoric Versus Reality: The Jurisdiction Of Rape, The Indian Child Welfare Act, And The Struggle For Tribal Self-Determination, Maire Corcoran

William & Mary Journal of Race, Gender, and Social Justice

This note examines the rape crisis affecting Native American women today and the jurisdictional issues that affect how and whether tribes may prosecute and punish rapists. This note also examines the efficacy of the Indian Child Welfare Act (ICWA) in preventing inappropriate removal of Native children from their tribal environment. A comparison of these two subjects reveals that, although tribes are theoretically experiencing an era of tribal "self-determination," federal Indian law and policy, both old and new, continue to prevent tribes from achieving health and independence. Ultimately, the note concludes that a true solution to the problems affecting tribes can …

When Gender Meets Sex: An Exploratory Study Of Women Who Seduce Adolescent Boys, Kay L. Levine Feb 2009

When Gender Meets Sex: An Exploratory Study Of Women Who Seduce Adolescent Boys, Kay L. Levine

William & Mary Journal of Race, Gender, and Social Justice

This article describes the origins, design, and implications of a new study exploring female-perpetrated statutory rape against adolescent boys in the United States. In contrast to both legal frameworks, which typically regard statutory rape as a male-on-female phenomenon, and existing literature from the fields of psychology and psychiatry derived from clinical samples and sex offender registries, this study examines the incidence of female-perpetrated statutory rape using data from electronic news reports covering the period 1990-2008. In this short article, the author explains the advantages of her approach over those taken by prior scholars, in terms of the size of the …

A Quasi Experimental Evaluation Of Thinking For A Change: A Real-World" Application, Christopher T. Lowenkamp, Dana Jones Hubbard, Mathew D. Makarios, Edward J. Latessa Feb 2009

A Quasi Experimental Evaluation Of Thinking For A Change: A Real-World" Application, Christopher T. Lowenkamp, Dana Jones Hubbard, Mathew D. Makarios, Edward J. Latessa

Sociology & Criminology Faculty Publications

Due to the popularity of cognitive behavioral interventions, programs that follow this model are often assumed to be effective. Yet evaluations of specific programs have been slow in coming. The current investigation seeks to bridge this gap by evaluating the effectiveness of Thinking for a Change (TFAC), a widely used cognitive behavioral curriculum for offenders. Furthermore, this evaluation provides a “real-world” test of TFAC, because it was implemented by line staff in a community corrections agency as opposed to being a pilot project implemented by program developers. The results of the analyses indicate that offenders participating in the TFAC program …

What Proportion Of Children Stay In The Same Location As Adults, And How Does This Vary Across Location And Groups?, Timothy J. Bartik Feb 2009

What Proportion Of Children Stay In The Same Location As Adults, And How Does This Vary Across Location And Groups?, Timothy J. Bartik

Upjohn Institute Working Papers

This paper provides new information on what proportion of individuals spend their adult work lives in their childhood metropolitan area or state. I also examine how this proportion varies across different demographic groups, and with the size and growth rate of the metropolitan area. I find that the proportion of individuals who spend most of their adulthood in their childhood metropolitan area is surprisingly high. Furthermore, this proportion does not go down as much as one might think for smaller or slower-growing metropolitan areas, or for college-educated persons. These findings imply that state and local investments in children may pay …

Complex Personhood As The Context For Intimate Partner Victimization: One American Indian Woman's Story, Sharon B. Murphy, Lynne Lemire, Mindi Wisman Feb 2009

Complex Personhood As The Context For Intimate Partner Victimization: One American Indian Woman's Story, Sharon B. Murphy, Lynne Lemire, Mindi Wisman

Peer-Reviewed and Other Publications

This qualitative case study explores one American Indian (AI) woman’s experience of intimate partner violence and the subsequent murder of her abusive partner. The lens of complex personhood (Gordon, 1997) has been applied as a method for understanding “Annie’s” multiple identities of AI woman, victim of intimate partner violence, mother, and convicted felon. The aim of the current case study was to uncover implicit and explicit meanings embedded in the experiences of moving from a victim of IPV to an off ender by applying a framework of hermeneutic phenomenology as the methodology. Three relational themes emerged from the interview data: …

A Question Of Costs: Considering Pressure On White-Collar Criminal Defendants, Sarah Ribstein Feb 2009

A Question Of Costs: Considering Pressure On White-Collar Criminal Defendants, Sarah Ribstein

Duke Law Journal

Because of the expense of defending white-collar criminal cases, individual corporate defendants can rarely fund their own defenses and often rely on their employers to pay their legal costs. Employers, however, often feel pressure to refuse to pay their employees' attorneys' fees. When employers decline to pay their employees' defense costs, defendants can be, in effect, coerced into pleading guilty because they do not have the financial resources to defend themselves at trial. Commentators have discussed the problem of pressure on white-collar defendants but have not traced the cause of the pressure back to one of its most basic roots: …

The Dark Triad: Facilitating A Short-Term Mating Strategy In Men, Peter K. Jonason, Norman P. Li, Gregory D. Webster, David P. Schmitt Feb 2009

The Dark Triad: Facilitating A Short-Term Mating Strategy In Men, Peter K. Jonason, Norman P. Li, Gregory D. Webster, David P. Schmitt

Research Collection School of Social Sciences

This survey (N=224) found that characteristics collectively known as the Dark Triad (i.e. narcissism, psychopathy and Machiavellianism) were correlated with various dimensions of short-term mating but not long-term mating. The link between the Dark Triad and short-term mating was stronger for men than for women. The Dark Triad partially mediated the sex difference in short-term mating behaviour. Findings are consistent with a view that the Dark Triad facilitates an exploitative, short-term mating strategy in men. Possible implications, including that Dark Triad traits represent a bundle of individual differences that promote a reproductively adaptive strategy are discussed. Findings are discussed in …

Raising Revenue For Persons With Disabilities, Joel P. Dittmer Feb 2009

Raising Revenue For Persons With Disabilities, Joel P. Dittmer

Arts, Languages and Philosophy Faculty Research & Creative Works

Whereas right-libertarians do not think that it is a requirement of justice that we raise revenues for persons with disabilities, both left-libertarians and liberal egalitarians think that there is such a requirement. An issue remains for the latter two theorists—how ought we to raise this revenue? Liberal egalitarians typically endorse either universal taxation or taxation of the wealthy. Left-libertarians, on the other hand, cannot so easily appeal to the methods of universal taxation and taxation of the wealthy, as they are illegitimately coercive. One such method left open to the left-libertarian is one proposed by Michael Otsuka. He argues that …

Declaration Of Intent With Signatures, Mississippi Truth Project

Documents and Files

The declaration grew out of community meetings around the state starting in January 2008. During 2008, organizers traveled the state to get feedback on the draft in order to secure support for a truth and reconciliation commission in Mississippi. On January 31, 2009, at a gathering in Jackson, a large group of Mississippians met and accepted the declaration, pledging to move forward together on a truth and reconciliation commission in the state.
