Political, Economic, And Legal Influences On Gender Inequality, Brittani Melvin Apr 2009

Political, Economic, And Legal Influences On Gender Inequality, Brittani Melvin

XULAneXUS

Abstract Obtaining equality has been a continuous struggle in the United States. Race, class, and gender inequality are extensive in this country, so much so that these aspects of inequality often intersect, making the effects of inequality more prevalent. In discussing gender inequality, many only consider the variations in income, employment, and opportunity that exist between men and women. The purpose of this paper is to examine the inequalities that occur within gender inequality, namely on the basis of race and class. This paper will attempt to answer how the political, economic, and legal practices that often govern this nation …

Discredited Evidence And The Liklihood Of A Conviction By A Jury Using The Juror Bias Scale, Adrinne Glover Apr 2009

Discredited Evidence And The Liklihood Of A Conviction By A Jury Using The Juror Bias Scale, Adrinne Glover

XULAneXUS

The present study examines whether mock jurors presented with discredited evidence will show less ability in delivering an objective verdict than mock jurors who have not been presented with discredited evidence. Undergraduate participants (N = 27) were randomly presented with original mock criminal trial scenarios containing either credited or discredited evidence, and were then asked to complete the Juror Bias Scale in order to measure bias. Participants presented with discredited trial scenarios were more likely to favor the prosecution (p-biased), and those presented with credited trial scenarios were more likely to favor the defense (d-biased). The results indicated that the …

Recidivism Among Child Sexual Abusers: Initial Results Of A 13 Year Longitudinal Random Sample, Steven Patrick, Robert Marsh

Sociology Faculty Publications and Presentations

In the initial analysis of data from a random sample of all those charged with child sexual abuse in Idaho over a 13 year period, only one predictive variable was found that related to recidivism of those convicted. Variables such as ethnicity, relationship, gender and age differences did not show a significant or even large association with recidivism. The only variable that seemed to show both a significant and almost moderate association to recidivism was the Risk Assessment in the Sex Offender Evaluation re-offense. Comparisons were made to prior research as well as a discussion of implications of the sex …

Advancing The Study Of Violence Against Women: Evolving Research Agendas Into Science, Carol E. Jordan Apr 2009

Advancing The Study Of Violence Against Women: Evolving Research Agendas Into Science, Carol E. Jordan

Office for Policy Studies on Violence Against Women Publications

Decades of research produced by multiple disciplines has documented withering rates of violence against women in the United States and around the globe. To further an understanding of gendered violence, a field of research has developed, but recent critiques have highlighted weaknesses that inhibit a full scientific exploration of these crimes and their impacts. This review extends beyond prior reviews to explore the field’s unique challenges, its community of scientists, and the state of its written knowledge. The review argues for moving beyond “research agendas” and proposes creation of a transdisciplinary science for the field of study of violence against …

Do 'Off-Site' Adult Businesses Have Secondary Effects? Legal Doctrine, Social Theory, And Empirical Evidence, Alan Weinstein, Richard D. Mccleary Apr 2009

Do 'Off-Site' Adult Businesses Have Secondary Effects? Legal Doctrine, Social Theory, And Empirical Evidence, Alan Weinstein, Richard D. Mccleary

Law Faculty Articles and Essays

Recent federal court decisions appear to limit the ability of cities to mitigate the ambient crime risks associated with adult entertainment businesses. In one instance, a court has assumed that criminological theories do not apply to “off-site” adult businesses. After developing the legal doctrine of secondary effects, we demonstrate that the prevailing criminological theory applies to all adult business models. To corroborate the theory, we report the results of a before/after quasi-experiment for an off-site adult business. When an off-site adult business opens, ambient crime risk doubles compared to a control area. As theory predicts, moreover, ambient victimization risk is …

Revisiting Prosecutorial Disclosure, Alafair S. Burke Apr 2009

Revisiting Prosecutorial Disclosure, Alafair S. Burke

Indiana Law Journal

After the exoneration of more than 200 people based on post-conviction DNA evidence, a growing movement against wrongful convictions has called increased attention to the prosecutorial suppression of material exculpatory evidence. Commentators frequently study prosecutorial failures to disclose as a form of intentional misconduct, coloring both the description of the problem and the recommended solutions. This Article, in contrast, explores how even ethical prosecutors might fail to disclose exculpatory evidence because off laws in the Brady doctrine itself-specifically, the Court's limitation of the doctrine to "material" exculpatory evidence. The materiality standard amplifies cognitive biases that distort even an ethical prosecutor's …
