Group-Conflict Resolution: Sources Of Resistance To Reconciliation, Erin O'Hara O'Connor
Group-Conflict Resolution: Sources Of Resistance To Reconciliation, Erin O'Hara O'Connor
Scholarly Publications
In the past few years a number of scholars in a variety of intellectual disciplines have contributed to a better understanding of dyadic conflicts and their resolution. In particular, sociologists, psychologists, anthropologists, lawyers, and others have explored the dynamics of apology and its role in deescalating disputes and promoting forgiveness and reconciliation. Furthermore, we have a better understanding today of the benefits to individuals from forgiveness and reconciliation. Victims who are able to forgive their transgressors have better psychological and physical health and lead richer lives.2 Because lawyers tend to focus their attentions on legal disputes, a growing body of …

He Versus She: A Gender Specific Analysis Of Legal And Extralegal Effects On Pretrial Release For Felony Defendants, Jeremy Ball, Lisa Growette Bostaph
He Versus She: A Gender Specific Analysis Of Legal And Extralegal Effects On Pretrial Release For Felony Defendants, Jeremy Ball, Lisa Growette Bostaph
Criminal Justice Faculty Publications and Presentations
The current study seeks to identify significant predictors of pretrial processing for both male and female defendants in an aggregate sample. The data used in this study is taken from the State Court Processing Statistics (SCPS), 1990-2000: Felony Defendants in Large Urban Counties (Bureau of Justice Statistics 2004). The original sample included a total of 87,437 felony cases. The relationship between relevant independent variables and five separate dependent variables (denial of bail, non-financial release, amount of bail set, making bail, and pretrial incarceration) were analyzed using both multivariate regression and Z-score comparisons within gender-specific models. Findings suggest that effects of …
The Effects Of Christian Religiosity On Support For The Death Penalty Versus Life Without Parole, Kevin Wozniak
The Effects Of Christian Religiosity On Support For The Death Penalty Versus Life Without Parole, Kevin Wozniak
Working Papers
While numerous scholars have examined the relationship between individuals’ Christian religiosity and their support for the death penalty, empirical tests of this relationship show mixed results. In this paper, I argue that past empirical inconsistencies may be due to measurement error in the religious variables and dependent variable. Using the Fourth National Survey of Religion and Politics, I test the effects of individuals’ religious belonging, beliefs, and behaviors on their preference for replacing the death penalty with a sentence of life without parole. I find that Roman Catholic affiliation, Biblical literalism, and more frequent practice of religious behaviors affect support …

Comment On Using Criminal Punishment To Serve Both Victim And Social Needs, John O. Haley
Comment On Using Criminal Punishment To Serve Both Victim And Social Needs, John O. Haley
Law and Contemporary Problems
Haley comments on the argument underlying the article by Erin Ann O'Hara and Maria Mayo Robbins, which emphasizes on victim-offender mediation (VOM). By expanding the frame of reference, restorative justice can be defined as a paradigm whose scope encompasses more than VOM and whose emphasis includes the needs of society and offenders as well as victims. Restorative justice involves a wide variety of processes and programs that are more apt to restore both those who commit and those who suffer wrongs. It includes children at risk programs, drug courts, violence-treatment programs, as well as VOM programs. It also includes efforts …

Worker Safety Within The Child Welfare System, Sylvia Hawranick Msw, Ed.D, Peg Mcguire Ph.D, Lisw, Candell Livingston Looman Lsw
Contemporary Rural Social Work Journal
Literature surrounding safety issues affecting the child welfare system is examined with a special emphasis on rural Appalachia. A review of the existing literature regarding personal safety and safety training of child welfare employees revealed limitations. The annual conference of the National Association of Social Workers in West Virginia provided a venue for gathering information regarding overall incidents of a threatening nature to child welfare social workers. Information regarding the numbers and types of safety trainings provided to the child welfare social workers was also explored. Two of the authors designed a workshop as a focus group from which information …

Academic Leadership: The Online Journal (2003-2012)
Two events specific to this study occurred in 1999, 1) the National Crime Prevention and Privacy Compact became effective which provided reciprocity among the states to share records without charging each other for the information, and 2) all 50 states and the District of Columbia were finally members of the National Association of State Directors of Teacher Education and Certification (NASDTEC) Clearinghouse which collects information concerning the status of educational certificates and can then share (reciprocate) this information to any interested member of the NASDTEC Clearinghouse. The purpose of this study was to determine whether reciprocity among the 50 states …
Curriculum Reform In American Public High Schools And Its Impact On Minority Students, Jayesh D'Souza
Curriculum Reform In American Public High Schools And Its Impact On Minority Students, Jayesh D'Souza
Academic Leadership: The Online Journal (2003-2012)
It seems like the high school curriculum reform effort in the United States has come full circle. While its development has taken place over time, statistical differentials in academic performance among racial/ethnic groups makes one question, the adequacy of the modern day high school curriculum in addressing the needs of all segments of society. After all, progress in the evolution of the high school curriculum has been slow and no matter what changes were made to it, there always seemed the need for further development. The early stages of educational reform can be traced back to the early nineteenth century …

A Reflection And Response To Using Criminal Punishment To Serve Both Victim And Social Needs, Kenneth R. Downes
A Reflection And Response To Using Criminal Punishment To Serve Both Victim And Social Needs, Kenneth R. Downes
Law and Contemporary Problems
Downes comments on Erin Ann O'Hara and Maria Mayo Robbins' article that accurately describes the nuanced and complex nature of apology and forgiveness. These are not actions that can be programmed--they happen at their own pace and in paths that are winding and unchartable. One of the reasons that victim-offender mediation is unpopular with some is that it can be emotionally messy and slow. Thus, one of the most helpful insights in his work has been that forgiveness is developmental, meaning that it often happens in normal and predictable stages. Forgiveness can be divided into manageable pieces. Indeed, their article …
