"But For The Grace Of God There Go I": Justice Thomas And The Little Guy, Nicole Stelle Garnett Jan 2009

"But For The Grace Of God There Go I": Justice Thomas And The Little Guy, Nicole Stelle Garnett

Journal Articles

This Essay, prepared for a NYU Journal of Law and Liberty symposium on “The Unknown Justice Thomas,” challenges the oft-repeated criticism that Justice Clarence Thomas’s opinions reflect a lack of empathy for the less fortunate. The Essay argues that, on the contrary, Justice Thomas’s opinions are replete with expressions of concern for the “little guy,” which are frequently overlooked or misinterpreted. The Essay explores three themes reflecting this concern in Thomas’s opinions.

Orientation Of Community-Based Tourism Programs Towards Sustainable Tourism Criteria In A Newly Established Democracy: The Case Of Cbt Kochkor, Kyrgyz Republic, Trent F. Milam

Graduate Theses, Dissertations, and Problem Reports (ETD)

Due to its limited scale, sustainable tourism in less developed countries remains a difficult case to study. However, even though these operations are challenged in capacity and financial strength, their efforts and results are worth recognition and consideration. This study evaluates the sustainable tourism organization known as CBT Kochkor, a locally managed and staffed organization whose mission is to assist rural citizens in the post-Soviet country of Kyrgyzstan during its transition to a free market economy. Created under the tenets of sustainable tourism, CBT Kochkor provides income generation opportunities through community employment while minimally affecting the resource's natural environment and …

Taming The Employment Sharks: The Case For Regulating Profit-Driven Labor Market Intermediaries In High Mobility Labor Markets, Harris Freeman, George Gonos Jan 2009

Taming The Employment Sharks: The Case For Regulating Profit-Driven Labor Market Intermediaries In High Mobility Labor Markets, Harris Freeman, George Gonos

Faculty Scholarship

Over the last quarter century, a profound restructuring of U.S. labor markets has occurred. Long-term job tenure, internal labor markets, and employer-sponsored benefits have waned under the pressures of neoliberal globalization. The trend is toward increasingly precarious, shorter-term, serial employment relationships that offer significantly lower wages, reduced job-related benefits, and formidable obstacles to the exercise of employment rights. This fundamental shift has moved so-called “non-standard” employment arrangements, once viewed as marginal, into the core economy. As a result, a remarkable array of profit-driven labor market intermediaries (LMIs) are now embedded in mainstream labor markets. Temporary help and staffing agencies, payrolling …

Toward A Comprehensive Program For Regulating Vacant Or Abandoned Dwellings In North Carolina: The General Police Power, Minimum Housing Standards, And Vacant Property Registration, C. Tyler Mulligan

Campbell Law Review

Part I of this Article provides a brief introduction to North Carolina's experience thus far with the foreclosure crisis and introduces the broad array of statutorily granted tools local governments might employ to deal with vacant or abandoned dwellings in varying stages of neglect. Part II discusses the general police power that serves as the first line of defense against the decline of vacant or abandoned housing, as well as how that power is limited by state statutes governing minimum housing standards. Part III then turns to those minimum housing statutes to examine their operation and limitations. Part IV analyzes …

The C.A.P. Effect: Racial Profiling In The Ice Criminal Alien Program, Trevor George Gardner, Aarti Kohli Jan 2009

The C.A.P. Effect: Racial Profiling In The Ice Criminal Alien Program, Trevor George Gardner, Aarti Kohli

Scholarship@WashULaw

The goal of the Criminal Alien Program (CAP) is to improve safety by promoting federal-local partnerships to target serious criminal offenders for deportation. Indeed, the U.S. Congress has made clear that Immigration and Customs Enforcement (ICE) “should have no greater immigration enforcement priority than to remove deportable aliens with serious criminal histories from the United States…” The Warren Institute’s analysis of arrest data pursuant to an ICE-local partnership in Irving, Texas demonstrates that ICE is not following Congress’ mandate to focus resources on the deportation of immigrants with serious criminal histories.

This study also shows that immediately after Irving, Texas …

Pentecostal Theology According To The Theologians: An Introduction To The Theological Methods Of Pentecostal Systematic Theologians, Christopher Adam Stephenson Jan 2009

Pentecostal Theology According To The Theologians: An Introduction To The Theological Methods Of Pentecostal Systematic Theologians, Christopher Adam Stephenson

Dissertations (1934 -)

This dissertation is a twofold argument that 1) existing pentecostal systematic theology can be interpreted according to four analytical categories and that 2) future pentecostal theological method should incorporate a form of lex orandi, lex credendi for the benefit of pentecostal theology and spirituality.

I analyze the theological methods of major past and present pentecostal systematic theologians and demonstrate that they have followed four basic patterns. First, Myer Pearlman, E. S. Williams, and French L. Arrington take the material for their theologies almost exclusively from the Bible. Second, Steven J. Land and Simon K. H. Chan center their theologies on …

Effects Of Individual Secularity, Institutional Secularity And Campus Activity Involvement On College Student Suicidal Ideation And Attempts, Christopher Daood Jan 2009

Effects Of Individual Secularity, Institutional Secularity And Campus Activity Involvement On College Student Suicidal Ideation And Attempts, Christopher Daood

Dissertations (1934 -)

Using undergraduate data from a recent study on the Nature of College Student Suicidality, this paper explored the impact of campus activity involvement, individual secularity and institutional secularity as risk and/or protective factors for college student suicidal ideation and attempts. Results revealed that students who participated in at least one campus activity and students who affiliate with a Christian faith were less likely to seriously consider suicide in the last twelve months. Gender differences were found in the relationship between institutional secularity and serious consideration of suicide, with non-secular institutions serving as a protective factor for women, but not men. …

Measuring Marital Satisfaction: A Comparison Of The Revised Dyadic Adjustment Scale And The Satisfaction With Married Life Scale, Peter J. Ward, Neil R. Lundberg, Ramon Zabriskie, Kristen Berrett Jan 2009

Measuring Marital Satisfaction: A Comparison Of The Revised Dyadic Adjustment Scale And The Satisfaction With Married Life Scale, Peter J. Ward, Neil R. Lundberg, Ramon Zabriskie, Kristen Berrett

Faculty Publications

Marital satisfaction has been psychometrically measured using many different instruments not soundly based on theory. The Revised Dyadic Adjustment Scale (RDAS), consisting of 14 items, is commonly accepted by researchers and practitioners tomeasure marital satisfaction but was not specifically designed to measuremarital satisfaction. The Satisfaction with Married Life Scale (SWML), consisting of five items, is a short scale specifically targeted toward measuring marital satisfaction. An online sample collected from 1,187 couples throughout the United States was used to compare these instruments’ correlation (r¼.782), factor structures, reliability (SWML, a¼.958; RDAS, a¼.943), theoretical foundation, and validity. These instruments are on parity with …

Promoting Breast Cancer Screening Among Chinese American Women Through Young Children's Theatrical Performance, Angela Sun Jan 2009

Promoting Breast Cancer Screening Among Chinese American Women Through Young Children's Theatrical Performance, Angela Sun

Walden Dissertations and Doctoral Studies

Research has revealed that underutilization of breast cancer screening by ethnic minorities often is related to language difficulties and cultural values and beliefs about cancer. The problem addressed in this secondary data analysis was the late diagnosis of breast cancer in the Chinese immigrant community. The purpose of the quasi-experimental study was to test the efficacy of a theatrical preschool performance, guided by the diffusion of innovation theory, in educating Chinese American women about breast cancer detection. The research questions sought to determine whether the performance increased the participants' knowledge of breast cancer screening guidelines and whether country of origin, …

An Examination Of Cooperative Learning Models And Achievement In Middle And Secondary Level Social Studies, Jeffrey R. Niemi Jan 2009

An Examination Of Cooperative Learning Models And Achievement In Middle And Secondary Level Social Studies, Jeffrey R. Niemi

Walden Dissertations and Doctoral Studies

There is a lack of understanding of different cooperative learning methods and their effects on student achievement in middle and secondary level social studies education. The purpose of this quasi-experimental study was to compare two different cooperative learning models in terms of their effects on student achievement in middle level social studies classes. The research question addressed in this study involved understanding the nature of the relationships between different cooperative learning models, gender, ability level and achievement in social studies students. The two cooperative learning models compared were the structured dyad model, which was effective in studies on reading achievement, …

Social Construction Of Knowledge In A Semiformal, Long -Term Learning Environment: A Qualitative Study, Alycia Harris Jan 2009

Social Construction Of Knowledge In A Semiformal, Long -Term Learning Environment: A Qualitative Study, Alycia Harris

Walden Dissertations and Doctoral Studies

Social learning plays a critical role in cognitive apprenticeship, community of practice, and knowledge production theories. Gunawardena's interaction analysis model, which provides a means of evaluating discourse for social construction of knowledge, is comprised of five phases: (a) sharing and comparing, (b) disagreement, (c) negotiation and co-construction of new knowledge, (d) testing of knew knowledge, and (e) use or phrasing of new knowledge. There is a paucity of research that has empirically explored social construction of knowledge, especially in an extended semiformal asynchronous graduate learning experience. This study explored two research questions: whether social construction of knowledge took place, and …

Leadership As Role And Relationship In Social Dynamics: An Exploratory Study Seeking A Leadership Archetype, Brian W. Bridgeforth Jan 2009

Leadership As Role And Relationship In Social Dynamics: An Exploratory Study Seeking A Leadership Archetype, Brian W. Bridgeforth

Walden Dissertations and Doctoral Studies

Previous research on leadership as archetype considered archetype as metaphor and not as it is understood in other literatures as a collectively accepted and defined role within and across cultures. Archetypical theories are posited as useful because they help us understand universal aspects of human behavior; however, empirical research demonstrating archetypical thinking and behavior remains rare. Accordingly, this phenomenological study investigated whether a leadership archetype exists as a shared cognitive template and if so, what characteristics define it. The theoretical framework used to examine the phenomenon of leadership combined leadership theory, philosophy of the mind, Jungian psychology, social constructionist theory, …

Factors Related To Caring For The Elderly Among Three Generations Of Nurses, Joanna Fairley Jan 2009

Factors Related To Caring For The Elderly Among Three Generations Of Nurses, Joanna Fairley

Walden Dissertations and Doctoral Studies

Three generations of registered nurses make up the current nursing workforce: Baby boomers, Gen X, and Gen Y. Each generation brings its own values, behaviors, and beliefs to the workplace. The generational diversity among nurses needs to be assessed along with other factors, such as social values of the elderly, anxiety toward aging, and practice settings, to examine how each factor impacts registered nurses' attitudes toward caring for the elderly. An exploration of these factors is significant to nurse leaders, since nurses have been known to display negative attitudes toward the elderly. The theoretical foundation for this study was based …

Mandated Differentiated Instruction Effectiveness Examined, Kathlyn Joan Graham Jan 2009

Mandated Differentiated Instruction Effectiveness Examined, Kathlyn Joan Graham

Walden Dissertations and Doctoral Studies

Educational institutions are implementing curriculum mandates without data to support the benefits of the mandates to students. The purpose of this concurrent, mixed-method study, which utilizes quasi-experimental and case study approaches, was to address the effectiveness of mandated differentiated instruction in a suburban high school. This study investigated the significant differences in achievement before and after the implementation of differentiation as well as differences in achievement between a school that mandated the use of differentiation and one that did not. The study also investigated strategies used to implement differentiation and student and teacher attitudes toward it. For ninth grade literature …

Identity Factory: The Mass Production Of The Masses, Greenpoint, Brooklyn, Peter W. Bartash Jan 2009

Identity Factory: The Mass Production Of The Masses, Greenpoint, Brooklyn, Peter W. Bartash

Architecture Theses and Projects

Greenpoint, Brooklyn, is a location whose identity is its layered manufacturing history. Within the infrastructural system of corridors that organizes its urban fabric exists a tectonic language of an architecture whose purpose is in providing opportunities for making. Operating within one of these corridors, the Identity Factory allows that an individual become aware of activity shaping his or her own identity, the relationship of that identity to a greater context, and the potential to define oneself engaged in a cultural landscape through the process of manufacturing

Learning From Their Own Learning: How Metacognitive And Meta-Affective Reflections Enhance Learning In Race-Related Courses, Nancy L. Chick, Terri Karis, Cyndi Kernahan Jan 2009

Learning From Their Own Learning: How Metacognitive And Meta-Affective Reflections Enhance Learning In Race-Related Courses, Nancy L. Chick, Terri Karis, Cyndi Kernahan

International Journal for the Scholarship of Teaching & Learning

This interdisciplinary project examined how students think and feel about their learning in race-related diversity courses. Students in four classes (literature, psychology, geography) reflected on cognitive and affective dimensions of their own and their classmates’ learning. The Color Blind Racial Attitudes Scales (CoBRAS) confirmed qualitative analyses of learning patterns in three of the classes that resulted in moving from lack of awareness about racism to increased understanding and in the fourth class that lacked this movement. Findings include what helped students learn, cognitive and affective obstacles to learning, and the benefit of exposing students to multiple perspectives, empathy-enhancing activities, and …

Operationalization Of Innovative And Traditional Pedagogical Practices Within Undergraduate Bioengineering Courses, Monica F. Cox Jan 2009

Operationalization Of Innovative And Traditional Pedagogical Practices Within Undergraduate Bioengineering Courses, Monica F. Cox

International Journal for the Scholarship of Teaching & Learning

This study operationalizes pedagogical practices using classroom observation data collected in twenty-eight bioengineering courses at a southeastern research university over five semesters. Using an index that distinguishes pedagogy reflecting principles of the “How People Learn” framework and pedagogy representing traditional, lecture-based instruction, the author presents five “How People Learn” instructional practices (i.e., guidance by the instructor, comments, praise, monitoring, and question and response) and four statistically significant subcategories representing traditional instructional practices (i.e., instruction by media, lecture, praise, and no response) that were most likely to occur within observed How People Learn-oriented classes and traditional, lecture-based classes, respectively. Included are …

Teacher Education For Undergraduates, Alicia Leger

Capstone Projects and Master's Theses

This is a capstone research project to assess the effectiveness of a bachelor's degree in the Social and Behavioral Sciences (SBS) in preparing the undergraduate student to become an elementary school teacher. I will be assessing the course pathways in comparison to scholarly research in the field of teacher preparation education. I will be using both Grounded Theory, an inductive theory composed from a wide selection of data, and Bloom's Taxonomy of Learning to review the literature. The methodology I will be using is a composition of research and creation of curriculum. This is geared toward answering my research question …
