In September 1864, Union General William T. Sherman's Savannah Campaign targeted the growing animosity between wealthy and poor Georgians when he proposed that Union forces "arouse the latent enmity of Georgia." This thesis continues the study of the March to the Sea by examining the effect of Sherman's campaign as it pertained to the social divisions between Georgians. Sherman's army alone did not ruin the state's ability to remain a vital contributor to the war effort, but rather focused upon the already growing social disputes between Georgians over economic contributions, military sacrifice, and political support. This study examines the relationship between several factors which have been identified in previous research as co-occurring and risk relevant to aggressive behavior. Although many factors have been addressed independently for various reasons in other studies, this study looks at the unique combination of a select few of these variables and their relationship for propensity towards aggression. The results of this study show propensity towards aggression is significant for two specific mental health issues; anxiety, and history of severe head injury. Results also indicate that co-occurring factors are prevalent in this sample and those inmates with prior mental illness are …

A Validation Study Of Risk Management Systems, Bridget Kelly

The purpose of this study was to examine the predictive validity of Risk Management Systems (RMS) as a risk assessment instrument. To date, a published validation study does not exist for the RMS. The study employs secondary data analysis to examine the predictive validity of RMS recidivism and violence scores on three outcomes: arrest, unsuccessful termination from supervision, and technical violations. The study sample consisted of 830 probationers from the United States Probation Office, District of Nevada. The analyses showed that RMS recidivism and violence scores were moderately predictive of all three outcomes.

In recent years, local governments in the United States have increasingly used eminent domain to promote economic development, raising concerns among property-right advocates over what those advocates view as unlawful, or what should be unlawful, takings of private property in order to benefit another private property owner. This philosophical and legal dispute reached a crisis point in the 2005 United States Supreme Court decision in Kelo v. City of New London. Could Government Speech Endorsing A Higher Law Resolve The Establishment Clause Crisis., Bruce Ledewitz

The Establishment Clause crisis exists due to the Supreme Court’s promise that America would have a secular government—meaning one which was neutral between religion and irreligion, as well as being neutral to all religions. This promise evolved pursuant to the Supreme Court’s interpretation of the Establishment Clause. Nevertheless, the commitment to neutrality was never carried to fulfillment by the Court. The crisis may be illustrated by Congress’ addition of the words “under God” to the Pledge of Allegiance in 1954. This addition seemed to violate the promise of neutrality made by the Supreme Court in Everson v. Board of Education …

Unless states can provide a way to identify these youth at an earlier stage, intervene, and provide meaningful and effective treatment, the future of those youths as well as the public safety is in jeopardy. Research has shown, as illustrated by Utah's C3 Court, that a comprehensive and collaborative approach to treating these kids can "reduce both crime and costs in the long run while improving (and even saving) the lives of young people today." Disability-Selective Abortion And The Americans With Disabilities Act, Dov Fox, Christopher L. Griffin, Jr.

This Article examines the influence of the Americans with Disabilities Act (ADA) on affective attitudes toward children with disabilities and on the incidence of disability-selective abortion. Applying regression analysis to U.S. natality data, we find that the birthrate of children with Down syndrome declined significantly in the years following the ADA’s passage. Controlling for technological, demographic, and cultural variables suggests that the ADA may have encouraged prospective parents to prevent the existence of the very class of people it was designed to protect. Not Guilty…Until Recommitment: The Misuse Of Evidence Of The Underlying Crime In Ngri Recommitment Hearings, Jana R. Mccreary

A criminal defendant found not guilty by reason of insanity was found not guilty. Commitment to a state mental facility is not designed to be punishment for a crime. The commitment is meant instead to address the acquittee’s insanity. Involuntary commitment strips a person of a vital liberty interest, and under our Constitution it should be done only with adequate due process. Recommitment of the person, though, is due that same protection. Accordingly, use of unfairly prejudicial evidence should be limited unless a court deems it necessary to a jury’s determination.

For this content analysis, the portrayal of law enforcement officials in young adult fiction was examined. This researcher read and analyzed 15 young adult fiction titles portraying a law enforcement official in either a primary or secondary character role. The main research question this researcher sought to answer was: How are law enforcement officials portrayed in young adult fiction? Based on the findings of her study, this researcher concluded that law enforcement officials in the examined titles are portrayed as having indifferent attitudes toward adolescents in general. Children's books may be the only views of farming urban students experience, yet books depicting farms with one or two cows are outdated. There is a lack of information available for children to learn about modem dairy farming practices. The dairy industry has experienced substantial changes in its history, including the introduction of many technologies. Modem dairy farms have incorporated technologies into everyday tasks, yet few children's books show farmers working at computers or even milking machines. In the last decade, several fatal truck related crashes occurred on the elevated freeway over the Atchafalaya Basin. In an attempt to reduce the crash rates, the Louisiana Department of Transportation and Development implemented two policies to regulate the truck traffic on this rural divided freeway that has two lanes in each direction of flow. These policies restricted truck traffic to the right lane and reduced the maximum truck speed limit to 55-mph. On the other hand, maximum car speed limit was kept at 60-mph. This article examines the appropriate and inappropriate role of "preventive detention" in responding to terrorist threats. It offers a constitutional jurisprudence of preventive detention, maintaining that absent a showing that dangerous behaviour cannot be addressed through criminal prosecution, preventive detention is unconstitutional. But criminal prosecution is not always a realistic option, and in those circumstances, preventive detention, carefully circumscribed and meticulously safeguarded by procedural protections, may be permissible. Familiar examples of accepted preventive detention regimes include civil commitment of dangerous persons who because of a mental disability cannot be held criminally responsible, and detention of enemy soldiers in a traditional …

While scholars have written extensively about the victims’ rights movement in capital and criminal cases, there has been very little discussion about the intersection of victims’ rights and the juvenile justice system. Statutes that allow victims to attend juvenile hearings and present oral and written impact statements have shifted the juvenile court’s priorities and altered the way judges think about young offenders. While judges were once primarily concerned with the best interests of the delinquent child, victims’ rights legislation now requires juvenile courts to balance the rehabilitative needs of the child with other competing interests such as accountability to the …

In light of the Byrd precedent and the various amendments to the law over the past thirty years, this comment will address two concerns: first, whether the North Carolina Supreme Court's logic in deciding Byrd was sound, especially in view of the seemingly clear intent of North Carolina's Open Meetings Law; and second, given the present-day version of North Carolina's Open Meetings Law, whether state agencies and other governmental bodies may still operate through the purported Byrd loophole.

Given the public's fear and anxiety regarding sex offenders, especially those who target children, society is predisposed to lock them up and throw away the key. To avoid reproach, however, our society must trust in our judicial processes and involuntarily commit only those who are found to be sexually violent predators beyond a reasonable doubt. Creeping bentgrass (Agrostis stolonifera L.) is commonly used on golf course greens and fairways in cool-humid regions but is plagued by numerous fungal diseases, one of which is dollar spot disease (Sclerotinia homoeocarpa F. T. Bennett). Dollar spot occurs frequently throughout the growing season requiring biweekly fungicide applications for complete control. The objective of this study was to investigate methods of reducing the number of fungicide applications needed to maintain dollar spot at acceptable levels through dew removal and potential mechanisms of resistance in bentgrass. There is a need for a human performance modeling tool which not only has the ability to accurately estimate skilled user task time for any interface design, but can be used by modelers with little or no programming knowledge and at a minimal cost. To fulfill this need, this research investigated the accuracy of task time prediction of a modeling tool – CogTool - on two versions of an interface design used extensively in the petrochemical industry – DeltaV.
