A Crooked Picture: Re-Framing The Problem Of Child Sexual Abuse, Eric S. Janus

This article discusses the problem of ending child sexual abuse using an allegory explaining that certain types of punitive solutions as solving the river "downstream", or in problem-solving mode, as opposed to "upstream", or in prospective problem avoidance. The thesis of this brief article is that our public policy is focused too far downstream. We rightly condemn child sexual abuse, but our public discourse frames the issue in a way that misdirects our public policy towards downstream solutions. If we truly want to protect our children from sexual abuse and end the cycle of violence, we need to reframe the …

The Constitutionalization Of Self-Defense In Tort And Criminal Law, Grammatically-Correct Originalism, And Other Second Amendment Musings, Alan Brownstein

The Supreme Court's opinion in Heller raises numerous questions. One of these is whether Heller requires the constitutionalization of self-defense decisions in tort and criminal law. Put simply, if the Second Amendment protects an individual's right "to keep and bear" the means to exercise self-defense, as Heller holds, can the Court avoid extending some level of constitutional protection to the act of self-defense itself? Answering this question in the affirmative leads to other issues. The justification of self-defense is grounded on an ad hoc evaluation of the reasonableness of the defendant's conduct. That analysis may be appropriate for tort or …

Nine government and industry organizations via a steering committee organized, planned and executed this forum. The forum brought together approximately 215 representatives from Federal, State and foreign government offices along with domestic and foreign natural gas and hazardous liquid pipeline operators. The forum’s goals included identifying key challenges facing industry and government, sharing information on current research efforts, and identifying research that can help to meet the challenges.

Social Value As A Policy-Based Limitation Of The Ordinary Duty To Exercise Reasonable Care, Mark A. Geistfeld

One whose affirmative conduct creates a foreseeable risk of physical harm is subject to the ordinary duty to exercise reasonable care with respect to those who might be foreseeably harmed by the conduct. In exceptional cases, this ordinary duty has been limited by judges as a matter of law. Judges have invoked a variety of public-policy factors to support such a limitation of liability, but have not adequately explained the nature of the justification. Consequently, the Restatement (Third) of Torts: Liability for Physical Harms recognizes that courts can limit duty when “an articulated countervailing principle or policy warrants denying or …

The article discusses the debate on counterterrorism law. The author states that adhering to the pre-existing rules such as the habeas corpus and the Geneva Conventions during emergency situations underestimate the consequences of dangers. It states that rules which constrain the executive are needed for flexibility that is required for effectiveness in confronting the terrorist threats. It further notes that the existing emergency rules can impede responses to danger and disaster when these rules are slavishly followed. The Unjust Selection Of Justice Professionals: Balancing Fairness For Police Officer Applicants And The Potential Citizens They Will Serve, Robert W. Boyle

This paper examines the effects on the community when its police officers are held to different physical standards based upon their sex. Through a Platonic analysis of the modern day "guardians of the city," it can be seen that the community is deprived of the strongest and best police force when the department compensates individuals based upon a "weakness" that thier class of applicants possesses. This process proves to be unfair to both the applicants and to the citizens they may subsequently serve.

How did the United States Supreme Court in Boumediene v. Bush conclude that the detention facility in Guantdnamo Bay, Cuba is indeed American territory for the purpose of habeas corpus? Why did the Court extend habeas to non-citizens as well? Which legal provisions and precedents guided the Supreme Court's analysis? The United States Constitution's Suspension Clause, precluding the suspension of habeas corpus except in well defined and discrete national security urgencies, is the controlling trump card raised by the detainees. Beginning with the premise that both the number and percentage of mentally ill inmates as sharply risen in recent years, this Article explores the path of mentally ill offenders in the American criminal justice system. It seeks to identify points of relief from the current crisis, in which a recent report stated that over 40% of state prisoners reported symptoms that met the criteria for mania. The challenge is exacerbated by the fact that prisons now provide a large share of the mental health treatment in the United States, taxing the resources of even the most progressive correctional systems. This Article seeks to begin to define a role for cities and their inhabitants in climate change governance. Part I argues that if there is a failure to take into account global urbanization and its defining characteristics, namely extreme squalor and associated social ills, as a central feature of climate change policy, we face a future where cities will experience sustained and perhaps intractable urban violence and social disintegration, a development that can only hasten the separate but related harms caused by climate change on the world’s human and biological populations. This Article discusses the political and legal barriers that have surfaced to undermine the ability of courts to fashion remedies that offer justice to aggrieved individuals and to render rights-based institutional reform litigation a judicial relic. Part II examines the historical development of institutional reform litigation and examines the political factors that created the opportunity for dramatic changes in legal approaches to the issue of racial inequality. Part III examines litigation challenging segregation in Dallas public schools. This article describes the origins, design, and implications of a new study exploring female-perpetrated statutory rape against adolescent boys in the United States. In contrast to both legal frameworks, which typically regard statutory rape as a male-on-female phenomenon, and existing literature from the fields of psychology and psychiatry derived from clinical samples and sex offender registries, this study examines the incidence of female-perpetrated statutory rape using data from electronic news reports covering the period 1990-2008. The term "Gun Show Loophole" came about as a result of the passage of the Firearm Owners Protection Act of 19861 and the Brady Handgun Violence Prevention Act of 1993. These laws effectively created a dual standard for gun sales based on the federal license status of the seller. The Brady Act mandated that licensed gun dealers must conduct criminal background checks on potential buyers regardless of whether the sale takes place at the dealer's store or at a gun show, whereas the Firearm Owners Protection Act expressly exempted "persons making occasional sales or selling all or part of a …

Efficient Tracking Of Many Objects In Structured Environments, Nathan Jacobs, Michael Dixon, Scott Satkin, Robert Pless

We consider the special case of tracking objects in highly structured scenes. In the context of vehicle tracking in urban environments, we offer a fully automatic, end-to-end system that discovers and parametrizes the lanes along which vehicles drive, then uses just these pixels to simultaneously track dozens of objects. This system includes a novel active contour energy function used to parametrize the lanes of travel based only on the accumulation of spatio-temporal image derivatives, and a tracking algorithm that exploits longer temporal constraints made possible by our compact data representation; we believe both of these may be of independent interest. …

In the shadow of a mountain of scandalous behavior exhibited by both government and business, it is easy to lose trust that any regulatory method can be effective. Transparency holds promise as a means to hold business and government accountable; particularly when both mandatory and voluntary disclosure are driven and shaped by their intended audience: Consumer/customer, employee, supplier, regulator or investor.
