Downhill Slopes Look Shallower From The Edge, Z. Li, Frank H. Durgin Oct 2009

Downhill Slopes Look Shallower From The Edge, Z. Li, Frank H. Durgin

Psychology Faculty Works

A dramatic failure of orientation constancy is documented in the perception of downhill slopes. Contrary to naïve expectation, steep downhill slopes look shallower from the edge than they do from back from the edge. Three experiments document and quantify this failure of constancy for real and virtual surfaces using a variety of dependent measures. Two additional studies document overestimation of both non-visually perceived head pitch and perceived gaze declination. A model of orientation constancy failure is fit to the data that combine exaggerations in perceived gaze declination with exaggerated scaling of perceived optical slant. These findings support a functional scale-expansion …

Misunderstanding Provocation, Samuel H. Pillsbury Oct 2009

Misunderstanding Provocation, Samuel H. Pillsbury

University of Michigan Journal of Law Reform

Provocation is and always has been a compromise rule whose success depends on its ability to appeal to all ideological constituencies, and therefore will always-as long as it lasts-resist the final categorization that this question seeks. As long as provocation involves an inquiry into reasonableness, it will include considerations of justification. As long as it provides for mitigation of punishment based on the difficulty of resisting temptations to violence inspired by strong emotion, it will speak to considerations of excuse.

Adequate (Non)Provocation And Heat Of Passion As Excuse Not Justification, Reid Griffith Fontaine Oct 2009

Adequate (Non)Provocation And Heat Of Passion As Excuse Not Justification, Reid Griffith Fontaine

University of Michigan Journal of Law Reform

For a number of reasons, including the complicated psychological makeup of reactive homicide, the heat of passion defense has remained subject to various points of confusion. One persistent issue of disagreement has been the justificatory versus excusatory nature of the defense. In this Article, I highlight and categorize a series of varied American homicide cases in which the applicability of heat of passion was supported although adequate provocation (or significant provocation by the victim) was absent. The cases are organized to illustrate how common law heat of passion may apply in instances in which there is no actual provocation or …

The Values Of Interdisciplinarity In Homicide Law Reform, Robert Weisberg Oct 2009

The Values Of Interdisciplinarity In Homicide Law Reform, Robert Weisberg

University of Michigan Journal of Law Reform

Professor Reid Fontaine's article, Adequate (Non)Provocation and Heat of Passion as Excuse Not Justification, makes a convincing case for treating heat of passion wholly as an excuse not a justification, as the only sensible way to comprehend its various forms. In doing so, Professor Fontaine stimulates further thinking about heat of passion doctrine, along two dimensions.

Unjustified: The Practical Irrelevance Of The Justification/Excuse Distinction, Gabriel J. Chin Oct 2009

Unjustified: The Practical Irrelevance Of The Justification/Excuse Distinction, Gabriel J. Chin

University of Michigan Journal of Law Reform

In recent decades, the distinction between justification and excuse defenses has been a favorite topic of theorists of philosophy and criminal law. Notwithstanding the impressive intellectual efforts devoted to the task, no single scholar or viewpoint appears to be on the verge of generating practical consensus about the concepts of justification and excuse, categorization of the defenses, or categorization of difficult individual cases. This Essay suggests that none of these goals can be usefully advanced through the justification/excuse distinction.

On Passion's Potential To Undermine Rationality: A Reply, Reid Griffith Fontaine Oct 2009

On Passion's Potential To Undermine Rationality: A Reply, Reid Griffith Fontaine

University of Michigan Journal of Law Reform

This Reply is organized into several sections. Following the Introduction, I respond to my six distinguished commentators. In Section II, I consider Professor Chin's concern that the distinction between justification and excuse bears no practical relevance for the criminal law. In Section III, I respond to Professor Baron's argument that reasonable mistake of fact is consistent with justification-a view, she observes, that is generally reflected in the criminal law. Building on the discussion of whether mistake and justification are compatible, Section IV addresses Professor Pillsbury's treatment of heat of passion as a hybrid defense that uniquely incorporates components of both …

Cultural Tourism In Botswana And The Sexaxa Cultural Village: A Case Study, Rachel Jones

Independent Study Project (ISP) Collection

Botswana has seen tremendous growth in its tourism industry since its real inception the 1980s. Unfortunately, the tourism sector has almost solely focused on photographic and hunting safaris at the expense of cultural tourism. Because there is potential for rural development through effective cultural tourism, this study aimed to look at the case of one such rural community and their venture into cultural tourism. The Sexaxa community and their Cultural Village was studied to understand multiple facets of the issue. The history of the Bayei tribe, the history of the cultural village, how much the cultural village reflects the modern …

Street Culture Of Mombasa: Are The Survivors Really Surviving?, Danny Low

Independent Study Project (ISP) Collection

Street children of Mombasa, Kenya were ethnographically studied in order to determine the effects of Swahili culture and structural violence on the children’s culture and place within greater society. It was discovered that Mombasa magnetizes street children as a result of the generosity of Swahili culture. Drug use was inextricably linked to street culture, yet children nonetheless held strong dreams of education. Since street children were also discovered to be significantly stratified, future policy and programming must account for these divisions to appropriately address the education and health problems facing Mombasa street children.

‘These Things Are Simply Very Difficult’: An Exploration Of The Existence Of And The Relationship Between Sectarianism And Racism In Present-Day Northern Ireland, Coreen Walsh Oct 2009

‘These Things Are Simply Very Difficult’: An Exploration Of The Existence Of And The Relationship Between Sectarianism And Racism In Present-Day Northern Ireland, Coreen Walsh

Independent Study Project (ISP) Collection

This report is the outcome of a month-long exploratory study of the relationship between sectarianism and racism in present-day Northern Ireland. This exploration compares and contrasts the ideas and beliefs behind sectarianism and racism as well as how these issues exist and continue to be manifested in society. Data was obtained by way of qualitative methods using semi-structured interviews, participant observation and desk research. It is concluded that sectarianism and racism have very similar origins and exist in parallel ways, but these two things are not identical. Sectarianism and racism both represent distorted ways of relating to others and managing …

The Effects Of Early Reading Interventions On Student Reading Levels And Achievement, Theresa F. Arnold Oct 2009

The Effects Of Early Reading Interventions On Student Reading Levels And Achievement, Theresa F. Arnold

Dissertations

The purpose of this study was to investigate the academic impact of reading interventions provided to kindergarten through third grade students identified as at-risk for reading failure. Studies have indicated that educators become very concerned when the number of elementary students who struggle with reading increase. It is difficult for students to reach grade level reading expectation when they have a poor start at learning to read. The gap between these children and children who read well widens as they progress through the grade levels. The research questions included 1) What gains are seen in reading abilities for children who …

Warm Ideas And Chilling Consequences, Arthur P. Bochner Oct 2009

Warm Ideas And Chilling Consequences, Arthur P. Bochner

Communication Faculty Publications

In the process of writing my academic memoirs spanning a period of more than thirty-five years, I discovered how crucial the work of Gregory Bateson had been to my life as a teacher, a scholar, and a relational partner. In this paper I celebrate Bateson's charming and incisive ideas about how communication works, his deep reservations about the worship of quantification, and his astute analysis of what is at stake when we make epistemological errors in everyday life. Reviewing a turning point in my academic life—a conference held in 1979, I reaffirm the importance of warm ideas and provide a …

The Influence Of Being "Out" On Perceptions Of Managerial Credibility And Positive Affect, Justin P. Boren, Mary B. Mcpherson Oct 2009

The Influence Of Being "Out" On Perceptions Of Managerial Credibility And Positive Affect, Justin P. Boren, Mary B. Mcpherson

Communication

The purpose of this study was to determine if the revelation of sexuality by a gay man or lesbian manager would affect potential employees' perceptions of that manager. Using EVT, three hypotheses predicted that the manner in which information is revealed about the manager influences perceptions of that revelation as a violation, as well as perceptions of managerial credibility and positive affect. Employed participants (N = 470) completed surveys about a hypothetical manager. Results showed that the manner in which managers' sexuality was revealed influenced levels of expectedness. Mixed results were found for credibility and positive affect. The relationship between …

School-Based Services For Traumatized Refugee Children, Dana Doran-Myers, Susan C. Davies Oct 2009

School-Based Services For Traumatized Refugee Children, Dana Doran-Myers, Susan C. Davies

Counselor Education and Human Services Faculty Publications

In 1991, civil war raged in Somalia and the country’s infrastructure began to disintegrate. Since then, millions have fled the violence and instability. Many Somali refugees have settled in the United States; Ohio now has the second larg- est settlement of Somali refugees in the country. Most of these refugees reside in the Columbus area, where numerous out- reach services have been developed. The Somalis are one of many refugee popula- tions that have enrolled children in Ohio schools. In such cases, there is often little or no warning of the children’s arrival and thus little time to prepare a …

Interview With Mary Scott Boria, Pamela Birchard

Chicago Anti-Apartheid Movement

Length: 92 minutes

Oral history interview of Mary Schott Boria by Pamela Birchard

Mary Scott Boria begin by detailing her childhood as the daughter of a divorced, interracial couple in the 1950s. She explains how at the age of 14, she packed a suitcase and joined her mother in Chicago where she participated in the Civil Rights Movement, joining the NAACP and, later, the Black Panther Party while in college. She recalls joining the Chicago Committee in Solidarity with Southern Africa (CCISSA) in the 1980s, working toward the divestment of the Apartheid government, participating in demonstrations, helping put together newsletters, …
