Toward A Better Competition Policy For The Media: The Challenge Of Developing Antitrust Policies That Support The Media Sector's Unique Role In Our Democracy, Maurice Stucke, Allen Grunes
Scholarly Works
It is difficult to formulate meaningful competition policy when there is a fierce debate over the current competitiveness of the media industry. After addressing the importance of the marketplace of ideas in our democracy, our article examines the current state of the media industry, including the response of traditional media to audience declines, the growth of new media, the impact of media consolidation (including its impact on minority and women ownership), and the role of the Internet. In response to recent calls for liberalizing cross-ownership rules to protect traditional media, our article outlines why conventional antitrust policy is difficult to …

Compassion: Why It Is Better To Eat Fish, Knowledge@Smu
Compassion: Why It Is Better To Eat Fish, Knowledge@Smu
Knowledge@SMU
Compassion was probably the farthest notion from Colonel Sanders’ mind when he became the global poster boy for delicious fried chicken. He had started his business in the early twentieth century – a period marked by the great depression and two world wars. Prejudices festered under the hostile global climate then, where little consideration was given to the suffering of human beings, much less animals. However, with the progress of time, scientific advancements have urged us, increasingly, to be kinder to fellow humans, animals, the environment… and that we really ought to be munching on fried fish instead.

Inter-Disciplinary Approaches To International Law: Legal & Non-Legal Rituals For Genocide Survivors, Knowledge@Smu
Knowledge@SMU
Legal processes, however powerful and authoritative they might be, are not cure-alls. Case in point: victims of the Khmer Rouge regime in Cambodia are still seeking healing and closure thirty years on. While the international tribunal might be able to hold the perpetrators accountable, there is a disconnect between what this international legal procedure can achieve, and what the victims want, notes SMU law professor Mahdev Mohan. To help the victims, he said non-legal actions are needed.

Gaming The Network Poetic: Networking And Code In Art Games, Joshua A. Fishburn
Electronic Theses and Dissertations
Videogames have historically used networking either to connect players for competition or cooperation or to provide an ephemeral connection to allow the upload, comparison, or assessment of single-player achievement data. The majority of videogames take place on a screen and on established platforms each of which have physical, technical, and sociocultural constraints that dictate how a player will interact. Recent art games, such as those by Jason Rohrer and the Atari VCS games of Ian Bogost highlight experiments in a more focused use of the medium from concept to interaction, both between the player and the software but also foregrounding …

Picture Perfect Job: An Analysis Of The Effects Of Weight On Internship Interviews, John R. Gatermann, Kimberly N. Gould
Picture Perfect Job: An Analysis Of The Effects Of Weight On Internship Interviews, John R. Gatermann, Kimberly N. Gould
Undergraduate Psychology Research Methods Journal
The purpose of this study was to discover if weight perception has an effect on obtaining an internship. It was hypothesized that a less qualified individual with an average weight appearance will be chosen more often than a qualified person who was above average weight when compared for an internship. Furthermore, people’s perception of weight and how they perceive others based on weight was observed. In the study, participants were directed to evaluate two resumes: one being qualified and one being unqualified and each having either an average weight or above average weight candidate’s photo identification attached. Then, the participants …

Impact Of Mad Money Stock Recommendations: Merging Financial And Marketing Perspectives, Ekaterina Karniouchina, William L. Moore, Kevin J. Cooney
Business Faculty Articles and Research
This article relies on advertising and persuasive communications theories to uncover persistent variations in investor response to television stock recommendations targeting naive investors. The authors use an event study methodology to determine the size of the next-day abnormal market reaction to recommendations on Mad Money with Jim Cramer. Although viewers are actively looking for recommendations, the results show that any individual recommendation is still subject to many of the same communication challenges as traditional advertisements. A regression analysis finds that traditional advertising variables, such as message length, recency-primacy effects, information clutter, and source credibility, influence the size of the market …
Copyright Consultation Submission, Laura Murray
Copyright Consultation Submission, Laura Murray
Osgoode Hall Review of Law and Policy
In this submission, the author articulates the principles that she feels should guide copyright reform. Appropriate reforms would aim to restore legitimacy to the Copyright Act by ensuring technological neutrality, and by implementing the WIPO treaties in a manner that best suits Canada‘s specific circumstances, policy traditions, and cultural goals. Clear legal drafting so that ordinary Canadians can understand the Act is also essential. Strong users’ rights foster expression, enhance learning opportunities, and make creation possible in the first place. With respect to specific reforms, Digital Rights Management must not prohibit anti-circumvention for non-infringing purposes, licensing regimes must be accountable …

Copyright Consultations Submission, Michael Geist
Osgoode Hall Review of Law and Policy
In this submission, the author presents seven principal proposals for reform that he argues would foster innovation, creativity and marketplace success. First, he argues for an expanded fair dealing provision that would enhance its flexibility. His second reform proposal engages with the issue of anti-circumvention provisions, where he argues: 1) for a direct link between anti-circumvention provisions and copyright infringement; 2) against bans on devices that can be used to circumvent technological protection measures (provided that it has non-infringing uses); 3) for the creation of authorized circumventers; and 4) for a positive requirement to unlock for exceptions/right of access. In 2008, due to increasing stakeholder dissatisfaction with assessment results and school report cards, South Carolina revised its 1998 Educational Accountability Act and required public engagement with stakeholders including parents/guardians, educators, business and community leaders, and taxpayers. The legislation created partnerships between SC‟s Education Oversight Committee (EOC) and Clemson University. The project also brought together within the university the fields of Applied Sociology, Computer Science, and Educational Leadership. The project involved mixed methods using phone/web surveys with focus groups eliciting perceptions from key stakeholders and under-represented voices in the surveys.

Provenance, from the French word “provenir”, describes the lineage or history of a data entity. Provenance is critical information in scientific applications to verify experiment process, validate data quality and associate trust values with scientific results. Current industrial scale eScience projects require an end-to-end provenance management infrastructure. This infrastructure needs to be underpinned by formal semantics to enable analysis of large scale provenance information by software applications. Further, effective analysis of provenance information requires well-defined query mechanisms to support complex queries over large datasets. This paper introduces an ontology-driven provenance management infrastructure for biology experiment data, as part …

Assessing Animal Welfare: Different Philosophies, Different Scientific Approaches, David Fraser
Assessing Animal Welfare: Different Philosophies, Different Scientific Approaches, David Fraser
Assessment of Animal Welfare Collection
Attempts to improve animal welfare have commonly centered around three broad objectives: (1) to ensure good physical health and functioning of animals, (2) to minimize unpleasant ‘‘affective states’’ (pain, fear, etc.) and to allow animals normal pleasures, and (3) to allow animals to develop and live in ways that are natural for the species. Each of these objectives has given rise to scientific approaches for assessing animal welfare. An emphasis on health and functioning has led to assessment methods based on rates of disease, injury, mortality, and reproductive success. An emphasis on affective states has led to assessment methods based …

Microalgal Biomass For Greenhouse Gas Reductions: Potential For Replacement Of Fossil Fuels And Animal Feeds, D. E. Brune, Tryg Lundquist, J. R. Benemann
Civil and Environmental Engineering
Microalgal biomass production offers a number of advantages over conventional biomass production, including higher productivities, use of otherwise nonproductive land, reuse and recovery of waste nutrients, use of saline or brackish waters, and reuse of CO2 from power-plant flue gas or similar sources. Microalgal biomass production and utilization offers potential for greenhouse gas (GHG) avoidance by providing biofuel replacement of fossil fuels and carbon-neutral animal feeds. This paper presents an initial analysis of the potential for GHG avoidance using a proposed algal biomass production system coupled to recovery of flue-gas CO2 combined with waste sludge and/or animal manure …

Algae Grown On Dairy And Municipal Wastewater For Simultaneous Nutrient Removal And Lipid Production For Biofuel Feedstock, Ian Woertz, A. Feffer, Tryg Lundquist, Yarrow Nelson
Civil and Environmental Engineering
Algae grown on wastewater media are a potential source of low-cost lipids for production of liquid biofuels. This study investigated lipid productivity and nutrient removal by green algae grown during treatment of dairy farm and municipal wastewaters supplemented with CO2. Dairy wastewater was treated outdoors in bench-scale batch cultures. The lipid content of the volatile solids peaked at Day 6, during exponential growth, and declined thereafter. Peak lipid content ranged from 14–29%, depending on wastewater concentration. Maximum lipid productivity also peaked at Day 6 of batch growth, with a volumetric productivity of 17 mg/day/L of reactor and an …

Exploring The Motivations Of Base Jumpers: Extreme Sport Enthusiasts, Tara L. Allman, Robin D. Mittelstaedt, Bruce Martin, Marni Goldenberg
Recreation, Parks and Tourism Administration
Little previous research has been conducted exploring the motivational factors that influence a person's desire to participate in extreme sports. The researchers used a means-end approach (e.g. semi-structured interviews) to explore motivations for participation in the extreme sport of BASE jumping. BASE jumping is the activity of parachuting from bridges, buildings, antennas, and cliffs, in which participants have been identified as voluntary-risk takers. The results indicated that BASE jumpers deliberately took risks as a means of becoming positively transformed, which was essential to their quality of life. The study findings hold important implications for researchers interested in further studies of …

Yeast Ste23p Shares Functional Similarities With Mammalian Insulin-Degrading Enzymes, Benjamin Alper, Jarrad W. Rowse, Walter K. Schmidt
Chemistry & Physics Faculty Publications
The S. cerevisiae genome encodes two M16A enzymes: Axl1p and Ste23p. Of the two, Ste23p shares significantly higher sequence identity with M16A enzymes from other species, including mammalian insulin-degrading enzymes (IDEs). In this study, recombinant Ste23p and R. norvegicus IDE (RnIDE) were isolated from E. coli, and their enzymatic properties compared. Ste23p was found to cleave established RnIDE substrates including the amyloid-β peptide (Aβ 1-40) and insulin B chain. A novel internally quenched fluorogenic substrate (Abz-SEKKDNYIIKGVnitroY-OH) based on the polypeptide sequence of the yeast P2 a-factor mating propheromone was determined to be a suitable substrate for …

Fearing Fear Itself: Photo Identification Laws, Fear Of Fraud, And The Fundamental Right To Vote, Joel A. Heller
Fearing Fear Itself: Photo Identification Laws, Fear Of Fraud, And The Fundamental Right To Vote, Joel A. Heller
Vanderbilt Law Review
In his first inaugural address, President Franklin Roosevelt assured the American people that "the only thing we have to fear is fear itself." President Roosevelt's famous statement begs the question, however, of why we should fear fear itself. What, or whom, does fear harm? When faced with the presence of fear, society must consider what steps it is willing to take and what it is willing to give up in order to address that fear. These considerations become particularly acute when the government uses the existence of fear as a rationale for legislation. The propriety of fear-based lawmaking is questionable, …

Selected Comparison Of Global Health Organizations, Steven C. Mccullar
Scholarship in Medicine - All Papers
Due to a potential, worldwide adverse impact on health, transnational dependencies, and the need for effective response, global cooperation is imperative (Buchanan & Decamp, 2006). There are more than 100 global health agencies, including the World Health Organization. As the number of organizations increases, each with their own agendas, so does the concern for lack of coherence and collaboration among organizations in the effort of disease eradication and development of health systems (Beaglehole & Bonita, 2008). The focus of this study is on comparing the effectiveness of selected global health organizations in efforts to detect a need to either establish …
