This Note seeks to explore the application of mechanisms of Alternative Dispute Resolution ("ADR") to overcome problems associated with the traditional methods of international patent litigation, with a focus on the BRIC countries. It starts with an outline of patent rights including their international licensing. The Note will then move on to a discussion of the present mechanisms of international patent protection and perceived problems with the current system, the ways in which ADR can help overcome these problems and the limitations of ADR in this field. This Note will show that, because of the lack of scholarly research addressing the use of humor in mediation, general perceptions about the legal profession, and current perceptions about the use of humor in mediation, some mediators shy away from using humor in their practice because they do not fully understand when to use it and how to embrace it. While there are significant risks to consider when assessing whether humor is appropriate for a particular mediation, this Note seeks to identify some of the benefits of using humor in practice. Recent advances in optical designs and electronic circuits have allowed the transition from passive to active proximal sensors. Instead of relying on the reflectance of natural sunlight, the active sensors measure the reflectance of modulated light from the crop and so they can operate under all lighting conditions. This study compared the potential of active and passive canopy sensors for predicting biomass production in 25–32 randomly selected positions of a Merlot vineyard. Both sensors provided estimates of the normalized difference vegetation index (NDVI) from a nadir view of the canopy at veraison that were good predictors of pruning weight. Although …

BACKGROUND: Psocids are emerging pests in stored products, particularly in amylaceous commodities such as grains. Currently, their control is based on the use of fumigants and contact insecticides; however, newer data indicate that psocids are tolerant to insecticides used to control other stored-grain species. This study evaluated the insecticides registered in the USA for use on stored maize, rice and wheat for control of the psocid species Lepinotus reticulatus, Liposcelis entomophila, L. bostrychophila and L. paeta. Mortality of exposed adult females was recorded after 7 and 14 days of exposure, while progeny production was assessed after 30 …

This Note analyzes a set of constitutional stories that has not been the subject of focused study—the constitutional stories we tell our schoolchildren in our most widely used high school textbooks. These stories help reinforce a constitutional culture that is largely deferential to the Supreme Court, limiting references to popular resistance to the Court and often linking such popular resistance to the actions of self-interested politicians, at best, and historical villains, at worst. Our textbooks are especially critical of blunt institutional checks on the Court (like judicial impeachment and “court-packing”), but are sometimes receptive to subtler, longer-term checks (like social …

There is minimal research on Gay, Lesbian, Bisexual, Transgender, and Queer (GBTQ) dating violence on college campuses. This qualitative study was facilitated using focus groups that included students that identified as being GBTQ at the University of Central Florida (UCF). The focus group questions were open ended in a discussion format. Participants were recruited from student organizations like the Gay Lesbian Bisexual Student Union (GLBSU) and Knight Allies on campus. There were a total of 10 students that participated in 2 different focus group sessions. The purpose of this study was to investigate whether the George W. Bush administration became victims of groupthink when they made the policy decision to invade Iraq in 2003. Groupthink is a policy-making model which was first put forward by Irving Janis which attempts to explain how experienced and elite policy-makers can make decisions which lead to disastrous outcomes due to conditions which cause defective decision-making. As global warming becomes an ever increasing problem, it is Salve Regina University and the Newport communities job to do their part. In an effort to reduce their carbon footprint, we performed a series of tests on the heating and building of McKillop library at Salve Regina to measure its carbon emissions and environmental impact. As a team, we tested for areas of heat loss and temperature change and internal temperature and humidity fluctuation. This study focuses on the differential induction of extracellular phenolic amides that accumulate in potato cell suspensions during the first few hours of the interaction between these plant cells and either bacterial pathogens or pathogen-related elicitors. Using suspension cells of Solanum tuberosum we identified 4 hydroxycinnamic acid amides that accumulate in the extracellular environment. Treatment of the suspension cells with pathovars of the plant pathogens Pseudomonas syringae or Ralstonia solanacearum or with pathogen-related elicitors changed the composition of the extracellular phenolic amides within hours and the composition differed for each treatment. An Evaluation Of Financial And Non-Financial Environmental Disclosures Of Ten Publicly-Listed Mining Companies In The Philippines, Nimpha M. Aquino

DLSU Business & Economics Review

This study determined the environmental disclosure practices of 10 mining companies in the Philippines by examining the nature and extent of disclosures in the financial and non-financial sections of their 2006 corporate annual reports. It was found out that there was no uniformity in the environmental disclosures of the 10 mining companies. It was also discovered that there was no existing environmental reporting standards as far as environmental disclosure is concerned. The study provided recommendations to the standard-setting council to improve the firms’ environmental disclosure compliance with a discussion regarding the benefits these recommendations might offer.
