The Impact Of Perceived Barriers To Export: An Analysis Of Kentucky Agricultural And Food Processing Firms, Kelly A. Davidson Jan 2009

The Impact Of Perceived Barriers To Export: An Analysis Of Kentucky Agricultural And Food Processing Firms, Kelly A. Davidson

University of Kentucky Master's Theses

As intra-industry trade increases in U.S. agricultural and food processing industries, the historical agricultural trade surplus is tightening. In efforts to maintain the trade surplus a focus has shifted towards the promotion of agricultural and processed food exports among small and medium sized firms. This study intends to identify and evaluate the potential for exports among small to medium sized agricultural and food processing firms in Kentucky through a collection of survey data. The objectives of this thesis are to identify the state’s product marketing opportunities and product specifications for international exports while identifying transaction requirements for potential exports. An …

The Arctic In World Environmental History, Jonathan D. Greenberg Jan 2009

The Arctic In World Environmental History, Jonathan D. Greenberg

Vanderbilt Journal of Transnational Law

For millions of years, the Arctic has been the world's most important "barometer of global change and amplifier of global warming." For twenty thousand years, the Arctic has been the homeland of modern human settlement, and it has played a central role in the interplay between global climate change and human migration throughout Eurasia and the Americas. Since the late fifteenth century, Arctic aboriginal peoples, lands, and seas have been thoroughly integrated into the international history of European trade, capitalism, and colonization; the territorial expansion of modern nation states; and the transnational strategic history since the outset of the Cold …

Trawling Dna Databases For Partial Matches: What Is The Fbi Afraid Of?, David H. Kaye Jan 2009

Trawling Dna Databases For Partial Matches: What Is The Fbi Afraid Of?, David H. Kaye

Faculty Scholarship

DNA evidence is often presented as the “gold standard” for forensic science. But this was not always the case. For years, eminent scientists complained that the estimates of the tiny frequencies of DNA types were unfounded. It took scores of research papers, dozens of judicial opinions, and two committees of the National Academy of Sciences to resolve the dispute by the mid-1990s. Since 2000, however, reports have surfaced of shocking numbers of “partial matches” among samples within large DNA databases, and some scientists have complained that the infinitesimal figures used in court to estimate the probability of a random match …

The Copyright Revision Act Of 2026, Jessica Litman Jan 2009

The Copyright Revision Act Of 2026, Jessica Litman

The Honorable Helen Wilson Nies Memorial Lecture

Congress may be persuaded to embark on a new round of copyright revision. If history is any guide, a revised copyright law is likely to be longer, broader, more complicated and less flexible than the one we have now. Before committing ourselves to that enterprise, Prof. Litman suggests we take the opportunity to imagine what the copyright system might look like if we were free to write on a blank slate. We should enact a statute that is much shorter and simpler, that gives creators a larger share of copyright goodies and distributors a smaller one, and that builds in …

Testing Modern Trademark Law's Theory Of Harm, Mark P. Mckenna Jan 2009

Testing Modern Trademark Law's Theory Of Harm, Mark P. Mckenna

Journal Articles

Modern scholarship takes a decidedly negative view of trademark law. Commentators rail against doctrinal innovations like dilution and initial interest confusion. They clamor for clearer and broader defenses. And they plead for greater First Amendment scrutiny of various applications of trademark law. But beneath all of this criticism lies overwhelming agreement that consumer confusion is harmful. This easy acceptance of the harmfulness of confusion is a problem because it operates at too high a level of generality, ignoring important differences between types of relationships about which consumers might be confused. Failure to differentiate between these different relationships has enabled trademark …

The Evolution Of Chinese Merger Notification Guidelines: A Work In Progress Integrating Global Consensus And Domestic Imperatives, Susan Beth Farmer Jan 2009

The Evolution Of Chinese Merger Notification Guidelines: A Work In Progress Integrating Global Consensus And Domestic Imperatives, Susan Beth Farmer

Faculty Scholarship

China is among the most recent entrants into global competition enforcement, having adopted the first competition law of general application, the Anti-Monopoly Law (AML) after more than a decade of drafting. The AML and Merger Notification Thresholds, rules issued by decree of the State Council, became effective on August 3, 2008. Both the law and the guidelines were subject to public review and comment, and went through a number of drafts before final adoption.

This article is a comprehensive comparison of merger standards across jurisdictions, with particular focus on the evolution of merger regulation in China. It comprises six parts; …

Politics At The Pulpit: Tax Benefits, Substantial Burdens, And Institutional Free Exercise, Lloyd Hitoshi Mayer Jan 2009

Politics At The Pulpit: Tax Benefits, Substantial Burdens, And Institutional Free Exercise, Lloyd Hitoshi Mayer

Journal Articles

More than fifty years ago, Congress enacted a prohibition against political campaign intervention for all charities, including churches and other houses of worship, as a condition for receiving tax deductible contributions. Yet the IRS has never taken a house of worship to court for alleged violation of the prohibition through political comments from the pulpit, presumably at least in part because of concerns about the constitutionality of doing so. This decision is surprising, because a careful review of Free Exercise Clause case law - both before and after the landmark Employment Division v. Smith decision - reveals that the prohibition …

The Literature Of Difference In Cultures Of Science, Scout Calvert Jan 2009

The Literature Of Difference In Cultures Of Science, Scout Calvert

University of Nebraska-Lincoln Libraries: Faculty Publications

Review of The Nature of Difference: Sciences of Race in the United States from Jefferson to Genomics, edited by Evelynn M. Hammonds and Rebecca M. Herzig.

The Nature of Difference is a timely addition to conversations about race and genomics, organized so as to allow readers to make new connections between contemporary discourses and the histories of science and race. The text’s selections and the organization of the selections with introductory material are especially helpful, serving as navigational aids to the sometimes astounding statements of racial fact that could otherwise be conversation stoppers. The book would be useful either as …

Organizational Narcissism And Virtuous Behavior, Dennis Duchon, Brian Drake Jan 2009

Organizational Narcissism And Virtuous Behavior, Dennis Duchon, Brian Drake

Department of Management: Faculty Publications

Extreme narcissistic organizations are unable to behave ethically because they lack a moral identity. While such organizations are not necessarily unethical intentionally, they become self-obsessed and use a sense of entitlement, self-aggrandizement, denial, and rationalizations to justify anything they do. Extreme narcissistic organizations might develop formal ethics programs, but such programs will have little effect on behavior.

Oxalic Acid: A Prospective Tool For Reducing Varroa Mite Populations In Package Bees, Nicholas P. Aliano, Marion D. Ellis Jan 2009

Oxalic Acid: A Prospective Tool For Reducing Varroa Mite Populations In Package Bees, Nicholas P. Aliano, Marion D. Ellis

Department of Entomology: Faculty Publications

Abstract   Numerous studies have investigated using oxalic acid (OA) to control Varroa mites in honey bee colonies. In contrast, techniques for treating package bees with OA have not been investigated. The goal of this study was to develop a protocol for using OA to reduce mite infestation in package bees. We made 97 mini packages of Varroa-infested adult bees. Each package contained 1,613 ± 18 bees and 92 ± 3 mites, and represented an experimental unit. We prepared a 2.8% solution of OA by mixing 35 g OA with 1 l of sugar water (sugar:water = 1:1; w:w). Eight treatments …

Jor: A Journal-Guided Reconstruction Optimization For Raid-Structured Storage Systems, Suzhen Wu, Dan Feng, Hong Jiang, Bo Mao, Lingfang Zeng, Jianxi Chen

School of Computing: Conference and Workshop Papers

This paper proposes a simple and practical RAID reconstruction optimization scheme, called JOurnal-guided Reconstruction (JOR). JOR exploits the fact that significant portions of data blocks in typical disk arrays are unused. JOR monitors the storage space utilization status at the block level to guide the reconstruction process so that only failed data on the used stripes is recovered to the spare disk. In JOR, data consistency is ensured by the requirement that all blocks in a disk array be initialized to zero (written with value zero) during synchronization while all blocks in the spare disk also be initialized to zero …

Genomic Regions Conserved In Lineage Ii Escherichia Coli O157:H7 Strains, Marina Steele, Kim Ziebell, Yongxiang Zhang, Andrew K. Benson, Roger Johnson, Chad Laing, Eduardo Taboada, Victor Gannon

Department of Food Science and Technology: Faculty Publications

Populations of the food- and waterborne pathogen Escherichia coli O157:H7 are comprised of two major lineages. Recent studies have shown that specific genotypes within these lineages differ substantially in the frequencies with which they are associated with human clinical disease. While the nucleotide sequences of the genomes of lineage I strains E. coli O157 Sakai and EDL9333 have been determined, much less is known about the genomes of lineage II strains. In this study, suppression subtractive hybridization (SSH) was used to identify genomic features that define lineage II populations. Three SSH experiments were performed, yielding 1,085 genomic fragments consisting of …

Genomic Instability In Regions Adjacent To A Highly Conserved Pch Prophage In Escherichia Coli O157:H7 Generates Diversity In Expression Patterns Of The Lee Pathogenicity Island, Zhijie Yang, Jaehyoung Kim, Chaomei Zhang, Min Zhang, Joeseph Nietfeldt, Carolyn M. Southward, Michael G. Surette, Stephen D. Kachman, Andrew K. Benson

Department of Food Science and Technology: Faculty Publications

The LEE pathogenicity island has been acquired on multiple occasions within the different lineages of

enteropathogenic and enterohemorrhagic Escherichia coli. In each lineage, LEE expression is regulated by complex networks of pathways, including core pathways shared by all lineages and lineage-specific pathways. Within the O157:H7 lineage of enterohemorrhagic E. coli, strain-to-strain variation in LEE expression has been observed, implying that expression patterns can diversify even within highly related subpopulations. Using comparative genomics of E. coli O157:H7 subpopulations, we have identified one source of strain-level variation affecting LEE expression. The variation occurs in prophage-dense regions of the genome that …

Vivir Sola No Es Lo Mismo Que Estar Sola: Carmen Alborch Y El Compromiso De La Soledad, Iker González-Allende

Human Ubc9 Contributes To Production Of Fully Infectious Human Immunodeficiency Virus Type 1 Virions, Tareq Jaber, Christopher R. Bohl, Gentry L. Lewis, Charles Wood, John T. West Jr., Robert A. Weldon Jr. Jan 2009

Human Ubc9 Contributes To Production Of Fully Infectious Human Immunodeficiency Virus Type 1 Virions, Tareq Jaber, Christopher R. Bohl, Gentry L. Lewis, Charles Wood, John T. West Jr., Robert A. Weldon Jr.

Nebraska Center for Virology: Faculty Publications

Ubc9 was identified as a cellular protein that interacts with the Gag protein of Mason-Pfizer monkey virus. We show here that Ubc9 also interacts with the human immunodeficiency virus type 1 (HIV-1) Gag protein and that their interaction is important for virus replication. Gag was found to colocalize with Ubc9 predominantly at perinuclear puncta. While cells in which Ubc9 expression was suppressed with RNA interference produced normal numbers of virions, these particles were 8- to 10-fold less infectious than those produced in the presence of Ubc9. The nature of this defect was assayed for dependence on Ubc9 during viral assembly, …
