Federalization In Information Privacy Law, Patricia L. Bellia Jan 2009

Federalization In Information Privacy Law, Patricia L. Bellia

Journal Articles

In Preemption and Privacy, Professor Paul Schwartz argues that it would be unwise for Congress to adopt a unitary federal information privacy statute that both eliminates the sector-specific distinctions in federal information privacy law and blocks the development of stronger state regulation. That conclusion, though narrow, rests on descriptive and normative claims with broad implications for the state-federal balance in information privacy law. Descriptively, Professor Schwartz sees the current information privacy law landscape as the product of successful experimentation at the state level. That account, in turn, fuels his normative claims, and in particular his sympathy with theories of competitive …

The Idea Of Pollution, John Copeland Nagle Jan 2009

The Idea Of Pollution, John Copeland Nagle

Journal Articles

Pollution is the primary target of environmental law. During the past forty years, hundreds of federal and state statutes, administrative regulations, and international treaties have established multiple approaches to addressing pollution of the air, water, and land. Yet the law still struggles to identify precisely what constitutes pollution, how much of it is tolerable, and what we should do about it.

But environmental pollution is hardly the only type of pollution. Historically, the idea of pollution referred to a host of effects upon human environments. This remains evident in contemporary anthropological literature, which studies the pollution beliefs of cultures throughout …

Public Bioethics And The Bush Presidency, O. Carter Snead Jan 2009

Public Bioethics And The Bush Presidency, O. Carter Snead

Journal Articles

Public bioethics figured prominently during the tenure of President George W. Bush. This Article explores the Bush legacy in this domain. It begins by articulating and examining the grounding norms of President Bush’s approach to public bioethics. Next, it analyzes how these norms were applied to concrete areas of concern. Building on this analysis, the next section reflects on what the President’s actions illustrate about the capacity of the Executive Branch to shape public bioethics. The Article concludes with a brief discussion of the possible metrics by which the Bush Administration’s efforts might be judged, and then offers several assessments …

Removal Of Phosphorus/Selenium From Aqueous Solutions By Adsorption Processes, Shilpa Bhojappa

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present study includes two parts: (1) Acid mine drainage (AMD) sludge, a waste product from coal mine water treatment, was used as an adsorbent to develop a cost-effective treatment approach to phosphorus removal from municipal secondary effluents. (2) Synthesized nano-magnetite was used as an adsorbent to develop an innovative technology for selenium removal from aqueous solutions. Each case involved a series of batch adsorption experiments conducted to evaluate adsorption kinetics, isotherms, and adsorptive thermodynamics. The effects of pH, temperature, concentration, contact time, and competing anions on the concerned pollutant removal were examined as well.;Adsorption of phosphorus onto AMD sludge …

Fuzzy Rock Typing: Enhancing Reservoir Simulation And Modeling By Honoring High Resolution Geological Models, Vida Gholami Jan 2009

Fuzzy Rock Typing: Enhancing Reservoir Simulation And Modeling By Honoring High Resolution Geological Models, Vida Gholami

Graduate Theses, Dissertations, and Problem Reports (ETD)

Rock typing is an essential part of building geologic model for an asset. Millions of dollars are invested in logs, core measurements, SCAL studies, and geological interpretation that result in definition of different rock types. Rock types overlap and do not have crisp boundaries.;Upon definition of rock types for a series of geological formations geoscientists use approximation of multiple and overlapping rock types to identify a dominant rock type for any grid block in a reservoir simulation model. This defeats the original purpose of performing detail geological, petrophysical studies as far as reservoir flow models are concerned.;The objective of this …

Privacy And The Limits Of History, Neil M. Richards Jan 2009

Privacy And The Limits Of History, Neil M. Richards

Scholarship@WashULaw

A short review essay of Lawrence Friedman's "Guarding Life's Dark Secrets: Legal and Social Controls over Reputation, Propriety, and Privacy" (Stanford Press 2007). The essay argues that Friedman tells a nuanced and compelling story of the rise and fall of the "Victorian Compromise," a series of interlocking legal doctrines protecting the reputations of elites around the turn of the twentieth century. "Dark Secrets" undeniably advances our understanding of both the genesis of privacy law and the relationships between law and culture in the Gilded Age. As a work of legal history, it is an instant classic–a must-read for anyone interested …

Rethinking Free Speech And Civil Liability, Neil M. Richards, Daniel J. Solove Jan 2009

Rethinking Free Speech And Civil Liability, Neil M. Richards, Daniel J. Solove

Scholarship@WashULaw

One of the most important and unresolved quandaries of First Amendment jurisprudence involves when civil liability for speech will trigger First Amendment protections. When speech results in civil liability, two starkly opposing rules are potentially applicable. Since New York Times v. Sullivan, the First Amendment requires heightened protection against tort liability for speech, such as defamation and invasion of privacy. But in other contexts involving civil liability for speech, the First Amendment provides virtually no protection. According to Cohen v. Cowles, there is no First Amendment scrutiny for speech restricted by promissory estoppel and contract. The First Amendment rarely requires …

No Future Without (Personal) Forgiveness: Reexamining The Role Of Forgiveness In Transitional Justice, John D. Inazu Jan 2009

No Future Without (Personal) Forgiveness: Reexamining The Role Of Forgiveness In Transitional Justice, John D. Inazu

Scholarship@WashULaw

The role of forgiveness has been much discussed in the literature on transitional justice, but a basic point has been muddled: most acts of forgiveness are inherently personal and cannot be achieved by state actors alone. What I call personal forgiveness is extended by a single human victim who has been harmed by a wrongdoer. Personal forgiveness is distinguishable from three other forms of forgiveness: group forgiveness, legal forgiveness (a form of group forgiveness), and political forgiveness. In the context of transitional justice, I argue that: (1) personal forgiveness is a necessary condition for political forgiveness; (2) group forgiveness (including …

Is A School Based Educational Program Effective In Changing Knowledge Regarding The Prevention Of Shaken Baby Syndrome?, Margaret Kay Stelzel

Dissertations (1934 -)

Shaken baby syndrome (SBS) involves physiological and neuropsychological sequelae secondary to parental or caregiver handling of an infant or young child (Goldberg & Goldberg, 2002). According to the American Academy of Pediatrics (APA) (2001), non-accidental head injuries are the leading cause of traumatic death and cause of child abuse fatalities. The prognosis is extremely poor with a death rate of 26-36% and up to 78% of the survivors suffer long-term disability (Barlow & Minns, 2000). According to Prevent Violence Against Children Act, 2005 Wisconsin Act 165; SECTION 7.121.02(1)(L)6 educational SBS requirements are mandated, effective school year 2007-2008. Two instrument development …

"Ordinary Talents And Extraordinary Perseverance": The Life Of Sir Thomas Fowell Buxton, David Bruce Jan 2009

"Ordinary Talents And Extraordinary Perseverance": The Life Of Sir Thomas Fowell Buxton, David Bruce

Dissertations (1934 -)

Born into a gentry family with roots in the Society of Friends, the evangelical social conscience of Thomas Fowell Buxton (1786-1845) was developed as he operated a brewery in Spitalfields, perhaps London's poorest parish. He was instrumental in raising funds for poor relief and establishing soup and bread kitchens there during the winter of 1816-1817. His interest and research on penal discipline brought him national prominence and led to a parliamentary seat which he held for nearly two decades. Buxton's association with noted activist William Wilberforce (1759-1833) led to his own involvement in the anti-slavery movement, a cause he fiercely …

The Primary Prevention Of Sexual Violence Against Adolescents In Racine County And The Community Readiness Model, Theresa A. Dewalt Jan 2009

The Primary Prevention Of Sexual Violence Against Adolescents In Racine County And The Community Readiness Model, Theresa A. Dewalt

Dissertations (1934 -)

Sexual violence affects tens of thousands of people annually in the United States. The majority of sexual assault victims are under the age of 18. Victims of sexual violence often experience severe, long-lasting ramifications, including post-traumatic stress disorder, depression, anxiety, interpersonal problems, suicidal ideation, self-harm behaviors, and eating disorders. As a result of these effects, it is imperative that communities provide effective primary prevention of sexual violence programs. However, it is challenging to effectively implement sexual violence primary prevention strategies for a variety of reasons. One challenge is because it is difficult to construct a prevention program that changes the …

Effects Of Individual Secularity, Institutional Secularity And Campus Activity Involvement On College Student Suicidal Ideation And Attempts, Christopher Daood Jan 2009

Effects Of Individual Secularity, Institutional Secularity And Campus Activity Involvement On College Student Suicidal Ideation And Attempts, Christopher Daood

Dissertations (1934 -)

Using undergraduate data from a recent study on the Nature of College Student Suicidality, this paper explored the impact of campus activity involvement, individual secularity and institutional secularity as risk and/or protective factors for college student suicidal ideation and attempts. Results revealed that students who participated in at least one campus activity and students who affiliate with a Christian faith were less likely to seriously consider suicide in the last twelve months. Gender differences were found in the relationship between institutional secularity and serious consideration of suicide, with non-secular institutions serving as a protective factor for women, but not men. …

Learning Through Nature: Mount Holyoke Environmental Research And Education Center, Sari M. Lipnick

Architecture Theses and Projects

I plan on doing this by creating an area located along a river or body of water that people will be able to interact and learn from its ecosystem and wildlife. I would like this to be a space that allows for the public to come and learn either indoors or outdoors with a variety of tools. By creating two defined areas functioning as elementary learning and university learning it would allow the variety of participants to come into the space and even interact with each other. One goal of mine would be to explore this interaction and control it, …

Strabismal Existence, Jordan Dubreuil Jan 2009

Strabismal Existence, Jordan Dubreuil

Architecture Theses and Projects

This thesis experiments with small prefabricated living spaces to examine the notion of existence. How small can a space become before an individual must expand and how to channel that expansion through architecture using several types of structures. The first is a Self Sustaining Mobile Living Unit that provides freedom and enriches the basic needs for existence. The second is a Demountable Structure where people are provided tools for expanding themselves creatively. The third is an existing mill structure within a local artist community in Fall River, Massachusetts.

Bridging The Gap: A Symbiotic Approach, Nicholas Czarniecki Jan 2009

Bridging The Gap: A Symbiotic Approach, Nicholas Czarniecki

Architecture Theses and Projects

Some architectural themes to be explored in this project have to deal with sustainability, passive environment systems, the play between new and old, and public and private. These themes are important because of the obvious need for solutions for energy usage when it comes to building sustainably. The goal of the thesis is to creat a culture that is sustainable through the interaction of young and old people in a built environment.

My goal is to generate modern experiences through fundemental communication and mediation between Old Order Amish teenagers and modern amerricans during their Rumspringa. This center for development will enable the teens to retain a modern identity successfully until they make a decision to be baptized into the Amish community. I want to execute this primarily focusing on education for the amish teens. This center will also allow them …

Center For The Creation And Performance Of The Arts, Dennis P. Mcgowan Jan 2009

Center For The Creation And Performance Of The Arts, Dennis P. Mcgowan

Architecture Theses and Projects

The design is geared towards experience and interaction both in and outside the building, as well as the interaction with the city. The Project creates a place that wants to give back to the community. If the building and space is popular, it will attract people and make them want to become a part of the environment. For instance, after the center is constructed companies and businesses would be attracted to be part of the neighborhood because of the energy and activity that is generated by the building.

Movement Architecture: An Investigation Into The Manipulation Of Movement Through Form And Space, Rachel Hampton Jan 2009

This project will investigate the effect of movement on one’s perception of space and their surroundings. Means by which movement can be altered, manipulated and designed in order to alter perceptions will be explored. These means will focus on architectural organizational strategies such as nesting, layering and revealing certain types and speeds of movements. These organizations will occur at various scales, but the main exploration will occur at the program and site level, and their associated movements. The differing motions of the project and urban site will be forced into architectural interactions and relationships with one another. This investigation will …

Interdisciplinary Project-Based Model For Enhanced Instruction Of Courses, Douglas Johansen, Claudia Scaff, Jace Hargis

International Journal for the Scholarship of Teaching & Learning

This study examines ability of an interdisciplinary group project to develop student’s abilities to work successfully in groups in a creative context. Group dynamics were investigated via interaction effects between students in a Graphic Design and Marketing class project. A repeated measures survey technique was used to assess student’s perceptions of group projects and their attributes. As a result of the project, student perceptions concerning the importance of creative contributions, as well as group participation factors became more positive, demonstrating that interdisciplinary group projects with students in a creative discipline offer business students a unique “outside the box” learning opportunity.
