Montana Indians: Their History And Location, Montana Office Of Public Instruction

Tribal Nations Documents

In this handbook we are attempting to give a brief look at Indians in Montana. We have organized the material by reservation areas, even though in some cases, more than one tribe is located on one reservation. There are also many Indians who reside on reservations not their own . A section on Montana's "Landless" Indians, the Little Shell Tribe of Chippewa, is included. A section on urban Indians is also included.

The Role Of Visual Representation In Mathematical Problem Solving, Jennifer L. Vitullo Apr 2009

The Role Of Visual Representation In Mathematical Problem Solving, Jennifer L. Vitullo

Mathematical and Computing Sciences Masters

The objective of this study was to determine the role of diagrams in solving word problems. Many studies that focused on this topic concluded that when students were shown how to implement schematic diagrams in their solutions, they were more successful in achieving correct answers. Students were separated into two groups; a group that received instruction on creating and employing schematic diagrams in solving three different problem types, and a group that were given problems to solve without any instructional support. Despite detailed instruction and increased completion time, there was no considerable difference in the final results of the students, …

This study was carried out in four different LE classes during the 2008-2009 academic school year. Each of the classes sequentially participated in a jigsaw and group investigation (GI) activity. The scores from previous traditional delivered instruction were used as control group. Students in the jigsaw group were divided into five home groups (Groups A, B, C, D and E). Each of these home groups consisted of four students (pending on class size). In the jigsaw activity, students examined …

A Proposed Transjudicial Approach To S. 15(2) Charter Adjudication, Vanita Goela Apr 2009

A Proposed Transjudicial Approach To S. 15(2) Charter Adjudication, Vanita Goela

Dalhousie Law Journal

Canada and India are both pluralistic democracies with diverse populations. Both countries have drafted constitutional provisions which enshrine equality rights and permit affirmative action. In India, various disadvantaged groups receive special protection from the Constitution of India, such as the Other Backward Classes (OBC). The Supreme Court of India has held that States and the Central government must identify the "creamy layer" within the OBC category so that reservations target members who are most in need. Otherwise, the OBC category is overinclusive. The creamy layer includes those who are socially and economically advanced and who no longer require the benefits …

Service To The Nation: A Living Legal Value For Justice Lawyers In Canada, Josh Wilner Apr 2009

Service To The Nation: A Living Legal Value For Justice Lawyers In Canada, Josh Wilner

Dalhousie Law Journal

Lawyers working within a living government require a living ethics, an approach to ethics that accounts for their day-to-day professional lives within the Department of Justice Canada. There are different archetypes of Justice lawyers, and thus a living ethics is also an ethics of place, one which is sensitive to the government institutions within and for which lawyers work and the functions they accomplish. The focus of this paper, which employs a virtue ethics methodology, is primarily civil litigators. Distinguishing between values (enduring beliefs that influence action) and ethics (the application of values in practice), the paper proposes "service to …

Student Characteristics, On-Line Course Characteristics, Cross-Cultural Adaptability, Classroom Community, And On-Line Course Performance, Cheryl Mcdowell

Graduate Student Dissertations, Theses, Capstones, and Portfolios

On-line higher education courses continue to receive growing interest among students, and colleges and universities throughout the country strive to ensure that quality education is provided in an on-line environment. Characteristics of the student and of the course, the student's ability to interact cross-culturally, and the impact of class community on course performance are all critical components that need further investigation. Continuing the development and implementation of on-line higher education courses can provide students with more successful on-line higher educational experiences.

Structural and process variables attribute to the makeup of on-line courses and components involved in their delivery. A discussion …

Training The Execution Of Single-Case Research Methodology Skills In An Early And Intensive Behavioral Intervention Setting, Jessa R. Love Apr 2009

Training The Execution Of Single-Case Research Methodology Skills In An Early And Intensive Behavioral Intervention Setting, Jessa R. Love

Dissertations

Early and intensive behavioral intervention (EIBI) for children with autism is a fruitful area for conducting research on clinically relevant problems in an attempt to investigate some of the unanswered questions about which procedures are most effective and efficient. Unfortunately, it is unlikely that therapists providing these services have received adequate training in conducting relevant single-case design research in this area. Providing such therapists with the skills needed to implement single-case design research protocols could improve the use of the scientist-practitioner model in these settings and greatly expand the base of scientific knowledge in the area.

American Media Portrayals Of The Uighur Minority Pre And Post 9/11, Anna File Apr 2009

American Media Portrayals Of The Uighur Minority Pre And Post 9/11, Anna File

Res Publica - Journal of Undergraduate Research

The Muslim Uighur ethnic minority in China has long been repressed by the Chinese Central Government in a way not dissimilar from the Tibetan ethnic minority. While policy decisions, assimilation projects, and systematic restriction of freedoms support this claim, Americans with interest in the area have a more complex relationship with opinion on Uighurs. Americans have a history of supporting restive groups within Communist systems, but post 9/11 there has been a backlash against those groups that also can be identified as Muslim fundamentalists. Through observing American newspaper sources it is expected that a shift will be seen in the …

Representaciones De La Memoria De La Guerrilla Antifranquista En La Novelística Española Contemporánea, Nuño Castellanos Apr 2009

Representaciones De La Memoria De La Guerrilla Antifranquista En La Novelística Española Contemporánea, Nuño Castellanos

Dissertations

In the last few years a very controversial concept known as "the recovery of historic memory" has become of utmost importance in certain social and political spheres in Spain. This matter has been addressed by a law approved in July of 2006 during the socialist government under Rodríguez Zapatero. This law recognizes the efforts of those who in 1936 defended the Republican democracy, those who were persecuted by Franco regime and suffered internal and external exile, and those who fought against dictatorship and in defense of the fundamental liberties that Spaniards enjoy today. This complicated process of memory recuperation is …

Contesting National Identities In An Ethnically Homogeneous State: The Case Of Armenian Democratization, Arus Harutyunyan Apr 2009

Contesting National Identities In An Ethnically Homogeneous State: The Case Of Armenian Democratization, Arus Harutyunyan

Dissertations

This study of recent Armenian identity politics raises two intertwined theoretical questions. First, it asks whether there can be contesting national identities in an ethnically homogeneous state. Second, following theoretical propositions of liberal nationalism it explores whether identity contestation in an ethnically homogeneous state affects political trust, perceptions of social justice, and democratic attitudes.

My research focuses on the analysis of politically relevant national identity issues: Genocide and Relations with Turkey, War in Mountainous Karabagh and Possible Solutions, and Dual Citizenship for Diaspora, and the ways these are perceived by the public and political elites in the Armenian Republic. To …

Cognitive And Social Help Giving In Online Teaching: An Exploratory Study, Joan Whipp, Rebecca A. Lorentz Apr 2009

Cognitive And Social Help Giving In Online Teaching: An Exploratory Study, Joan Whipp, Rebecca A. Lorentz

College of Education Faculty Research and Publications

While literature suggests that college students may be less reluctant to seek help in online rather than traditional courses, little is known about how online instructors give help in ways that lead to increased student help seeking and academic success. In this study, we used theories and research on learning assistance and scaffolding, teacher immediacy, social presence, and academic help seeking to explore through a cross-case study design how three online instructors differed in their use of cognitive and social supports and how those differences related to student perceptions of support, help seeking, and performance. Primary data sources included all …

Flâneurs And Infiltrators (How To Read Cityscapes Via Textscapes), Joe Culpepper Apr 2009

Flâneurs And Infiltrators (How To Read Cityscapes Via Textscapes), Joe Culpepper

Reconstruction: Studies in Contemporary Culture

“Read your city anew” and “awaken from the spells cast by signs” are the mantras of this article. In Toronto, the radical spirit of revelation present in Walter Benjamin's Passagen-Werk (The Arcades Project) is embodied in an experiential approach to the capitalist city's hidden, forbidden, and inaccessible areas. Infiltration is a multifaceted phenomenon (a zine, a website, and a practice). The project is dedicated to the investigation, exploration, and mapping out of Toronto's abandoned buildings, defunct subway stations, luxury hotels, metropolitan marketplaces (i.e. the Hudson's Bay Company) and more. Circulated to encourage citizens of today's cultural metropolises to …

The Rights Of Migrants, Eric A. Posner, Adam B. Cox Apr 2009

The Rights Of Migrants, Eric A. Posner, Adam B. Cox

Coase-Sandor Institute for Law & Economics Research Paper Series

Why do states provide migrants rights associated with citizenship? Existing accounts typically answer this question in terms of obligation—of a duty on the part of states to confer citizenship. Moreover, scholars tend to lump together the bundle of rights conventionally associated with citizenship when they answer this question. In contrast, this Article disaggregates the rights associated with citizenship, asks what both states and migrants want, and inquires into how the suite of rights associated with citizenship might advance those interests. States want to encourage migrants to enter their territory and to make country-specific investments, but have an interest in being …

Auditory Coding Based Speech Enhancement, Yao Ren, Michael T. Johnson Apr 2009

Auditory Coding Based Speech Enhancement, Yao Ren, Michael T. Johnson

Dr. Dolittle Project: A Framework for Classification and Understanding of Animal Vocalizations

This paper demonstrates a speech enhancement system based on an efficient auditory coding approach, coding of time-relative structure using spikes. The spike coding method can more compactly represent the non-stationary characteristics of speech signals than the Fourier transform or wavelet transform. Enhancement is accomplished through the use of MMSE thresholding on the spike code. Experimental results show that compared with the spectral domain logSTSA filter, both the subjective spectrogram evaluation and objective SSNR improvement for the proposed approach is better in suppressing noise in high noise situations, with fewer musical artifacts.P

Optimal Distributed Microphone Phase Estimation, Marek B. Trawicki, Michael T. Johnson Apr 2009

Optimal Distributed Microphone Phase Estimation, Marek B. Trawicki, Michael T. Johnson

Dr. Dolittle Project: A Framework for Classification and Understanding of Animal Vocalizations

This paper presents a minimum mean-square error spectral phase estimator for speech enhancement in the distributed multiple microphone scenario. The estimator uses Gaussian models for both the speech and noise priors under the assumption of a diffuse incoherent noise field representing ambient noise in a widely dispersed microphone configuration. Experiments demonstrate significant benefits of using the optimal multichannel phase estimator as compared to the noisy phase of a reference channel.

The Path Of Jihad In The Yacoubian Building, Michel Gardaz Apr 2009

The Path Of Jihad In The Yacoubian Building, Michel Gardaz

Journal of Religion & Film

The field of religion and film is growing steadily. Films are the most popular cultural productions in today's global world. In some cases, the Seventh Art is used to further the cause of religiopolitical ideologies. This article analyses the theme of Jihad in the film Yacoubian Building (2006): the most important Egyptian production to date. The film is based on the best-selling novel by Alaa Al-Aswany originally published in Arabic (2002). The film presents the Yacoubian Building (located downtown Cairo) as a moral microcosm of Egyptian society. In substance, the film is a harsh criticism of Egyptian society during Iraq's …

Why Paretians Can’T Prescribe: Preferences, Principles, And Imperatives In Law And Policy, Robert C. Hockett Apr 2009

Why Paretians Can’T Prescribe: Preferences, Principles, And Imperatives In Law And Policy, Robert C. Hockett

Cornell Law Faculty Publications

Recent years have witnessed two linked revivals in the legal academy. The first is renewed interest in articulating a normative “master principle” by which legal rules might be evaluated. The second is renewed interest in the prospect that a variant of Benthamite “utility” might serve as the requisite touchstone. One influential such variant now in circulation is what the Article calls “Paretian welfarism.”

This Article rejects Paretian welfarism and advocates an alternative it calls “fair welfare.” It does so because Paretian welfarism is inconsistent with ethical, social, and legal prescription, while fair welfare is what we have been groping for …

Global City, Megacity: Calixthe Beyala And The Limits Of The Urban Imaginary, Dawn Fulton Apr 2009

Global City, Megacity: Calixthe Beyala And The Limits Of The Urban Imaginary, Dawn Fulton

French Studies: Faculty Publications

Calixthe Beyala is well known for her ambivalent relationship with both France and Africa. Her novels, meanwhile, are often divided according to tone and geography, between the grim portrayal of West African settings and the relatively upbeat (and more popular) novels of migration to the French hexagon. This article compares two novels encompassing this apparent divide – Tu t'appelleras Tanga (1988) and Le petit prince de Belleville (1992) – with a focus on Beyala's vision of the urban landscape as an inscription of a bilateral history. These texts present contrasting portraits of urbanism that seem to confirm the dichotomies of …

Courting Specialization: An Empirical Study Of Claim Construction Comparing Patent Litigation Before Federal District Courts And The International Trade Commission, David L. Schwartz Apr 2009

Courting Specialization: An Empirical Study Of Claim Construction Comparing Patent Litigation Before Federal District Courts And The International Trade Commission, David L. Schwartz

William & Mary Law Review

The United States International Trade Commission (ITC) has recently become an important adjudicator of patent infringement disputes, and the administrative law judges (ALJs) on the ITC are widely viewed as experts on patent law. This Article empirically examines the performance of the ITC in patent claim construction cases. The Article also compares the performance of the ITC on claim construction with that of federal district courts of general jurisdiction. This study does not find any evidence that the patent-experienced ALJs of the ITC are more accurate at claim construction than district court judges or that the ALJs learn from the …
