Saving Missouri's Public Defender System: A Call For Adequate Legislative Funding, Justine Finney Guyer Apr 2009

Saving Missouri's Public Defender System: A Call For Adequate Legislative Funding, Justine Finney Guyer

Missouri Law Review

The Constitutions of both the United States and the state of Missouri guarantee an indigent defendant the right to effective legal counsel when the defendant's freedom is in jeopardy. Due to a caseload crisis that is compounded by many other factors, the Office of the Missouri Public Defender cannot serve all the indigent clients who depend on it. The most notable of the issues plaguing the public defender system is that of funding. As a result of a severely underfunded system, public defenders are without resources necessary to effectively represent all of their clients. In order to improve client services …

When Mira Liens Trump Attorney Fee Claims: A Harsh Result In Light Of Karpierz, Carrie B. Williamson

Missouri Law Review

The Missouri Incarceration Reimbursement Act ("MIRA") is a powerful tool which allows the State to recover incarceration costs directly from an inmate's personal assets. But what if the inmate's assets include funds obtained in some fashion by the legal services of an attorney? Could a subsequent MIRA claim take priority over that attorney's interest in being paid from the fruit of his labor? In the 2003 case of State ex reL. Nixon v. Karpierz, the Missouri Supreme Court sought to provide answers to these questions. Karpierz placed a limitation on the parameters of MIRA's reach by allowing a plaintiff inmate's …

Prevent Child Abuse Georgia: A Look At Management And Marketing, Nicole R. Tullis

Dissertations, Theses and Capstone Projects (Full IR Collection)

I did my internship at Prevent Child Abuse Georgia (PCA Georgia) which is Georgia’s only private, statewide community nonprofit organization with the sole objective of preventing child abuse. During the internship, I worked with the resource department team which includes the director of stakeholder and public relations and the resource development specialist. The CEO has taken a substantial role in resource development due to the financial hardships of the organization.

PCA Georgia had a positive outlook on its financial position when projections were made for FY09. Unfortunately, the fiscal year saw a negative turn in economic conditions and the organization …

Absent Class Members: Are They Really Absent? The Relationship Between Absent Class Members And Class Counsel With Regards To The Attorney-Client And Work Product Privileges, Mindi Guttmann Apr 2009

Absent Class Members: Are They Really Absent? The Relationship Between Absent Class Members And Class Counsel With Regards To The Attorney-Client And Work Product Privileges, Mindi Guttmann

Cardozo Public Law, Policy & Ethics Journal

The note argues that absent class members in class action litigation do not have the same attorney-client or work product privileges as traditional clients due to the fundamentally different nature of their relationship with class counsel. It critiques the ambiguity in defining "client" and proposes clearer distinctions to address judicial confusion and ensure effective legal representation while protecting sensitive information.

A Homeowner’S Last Gasp: Looking At The Redemption Process In Hennepin County, Minnesota, Michael Samuelson Apr 2009

A Homeowner’S Last Gasp: Looking At The Redemption Process In Hennepin County, Minnesota, Michael Samuelson

Geography Honors Projects

While the causes of foreclosure are generally well understood, the outcomes of foreclosure have been poorly documented. Although rare, home redemptions – when foreclosed homeowners retain their home after it has been sold in a foreclosure auction – are a possible outcome. This paper explores the occurrence of foreclosure redemptions in Hennepin County, Minnesota in the year 2005, and examines how and why some homeowners were able to keep their house after being foreclosed upon. Using GIS data from the Hennepin County Sheriff’s Office and County Assessor, this paper analyzes the likelihood and spatial patterns of redemption.

Flying The Pirate Flag: Understanding The Fight Against And Prevalence Of The Internet Gift Economy, Zachary G. O'Leary

Pell Scholars and Senior Theses

The number of citizens affected by common internet access makes arguments over its governance of primary concern to all. Peer-to-peer file sharing, oftentimes allowing for copyright infringement, is currently a major use of internet infrastructure. A review of the legislative and technological attempts to prevent such infringement, as well as the reasoning behind its prevalence, provides insight into the tension created by present intellectual property rights; this is a tension between those it intends to protect and to reward.

“For They Shall Inherit The Earth”: Seeking Solutions For Durban’S Street Children, Allison La Fave Apr 2009

“For They Shall Inherit The Earth”: Seeking Solutions For Durban’S Street Children, Allison La Fave

Independent Study Project (ISP) Collection

As a visiting white, American female, I could not help but be struck by Durban’s highly visible population of young African boys in the streets and on the beachfront. Although my experiences at a student-run homeless shelter and in the Housing Unit of Boston Legal Services have made me well aware of urban poverty and racial inequality, I was nonetheless shocked to see the extent to which young people bear the brunt of the problem in one of Africa’s most “developed” young democracies. Interested in what, if any, measures were being taken to curb the problem, I began to investigate …

A Model Of Employee Satisfaction: Gender Differences In Cooperative Extension, Richard P. Vlosky, Francisco X. Aguilar

Journal of Extension

Employee satisfaction is an important issue for management and employees in any organizational setting. We developed a generalized model of employee satisfaction and tested it for both female and male U.S Extension employees. Results indicate that there are no differences in the antecedents of employee satisfaction between genders.

Changes To The Czech Republic's Vat Act: The Use And Enjoyment Rules, Richard Thompson Ainsworth Mar 2009

Changes To The Czech Republic's Vat Act: The Use And Enjoyment Rules, Richard Thompson Ainsworth

Faculty Scholarship

On January 1, 2009 a minor change in the Czech Republic VAT became effective. A use and enjoyment standard was added to modify the sourcing of certain service transactions. Traditional proxy-based rules, derived from Articles 43 and 56(1) of the Recast VAT Directive (RVD), are set aside by this modification when the customer receiving the services has a permanent establishment (PE) in the Czech Republic. The modification is authorized by RVD 58.

This change is a limited adoption of RVD 58(b), and functions like a full force of attraction principle in direct taxation. If caught by these rules, transactions that …
