Privacy In The Age Of Tracking Technology: Why G.P.S. Technology Should Not Be Used To Track Process Servers, Talia E. Neri
Cardozo Public Law, Policy & Ethics Journal
The article argues that the expansion of GPS technology in the process service industry and workplace surveillance raises significant Fourth Amendment concerns, as it erodes privacy expectations and creates a chilling effect on personal autonomy. While courts have upheld the use of GPS in certain employment contexts, the author contends that such surveillance often outweighs its benefits, particularly when less intrusive alternatives are available. The analysis critiques the legal standards governing surveillance, particularly the "readily available" standard from United States v. Kyllo, and advocates for a more balanced approach that prioritizes privacy protections.

Taking Empirical Research Seriously, Susan Saab Fortney
Taking Empirical Research Seriously, Susan Saab Fortney
Hofstra Law Faculty Scholarship
This essay considers how empirical research on the legal profession can bridge the divide between theory, social science, and the ethical practice of law. After providing background information on the growing field of empirical legal research, Part I of this essay focuses on developments in empirical legal research on lawyering. Part II discusses how collaboration with practitioners and other stakeholders can help researchers address challenges related to accessing data. Once data are obtained, Part III suggests how dissemination and sharing of research can link the academy and practicing lawyers. The conclusion urges a collaborative course of action for legal ethics …

All That You Can’T Leave Behind: Making And Administering Laws In The Select Government Localities Of Komenda, Cape Coast, And Accra, Andrew Freeman
Independent Study Project (ISP) Collection
This paper is an attempt to understand how laws are created and maintained on the local level in Komenda, Cape Coast, and Accra. It explains how bylaws are created in those localities through the use of the General Assemblies. The paper then examines the judicial system in those same areas. Komenda uses an Arbitration Committee. Cape Coast and Accra both have a Circuit Court and a High Court. After detailing how the legislative and court system function, the paper compares and contrasts the different ways that the legislative and judicial branches are executed.

Rescuing Children And Punishing Poor Families: Housing Related Decisions, Corey Shdaimah
Rescuing Children And Punishing Poor Families: Housing Related Decisions, Corey Shdaimah
The Journal of Sociology & Social Welfare
Child welfare policy is not self implementing; an understanding of child welfare policy must therefore include the decision making practices by those whom Michael Lipsky (1980) has called "streetlevel bureaucrats." This article reports data from a qualitative study exploring perceptions of child welfare professionals about housing-related child welfare decisions. Interviews were conducted with a purposive sample of 18 child welfare lawyers, judges, and masters level social workers from a large city in the mid-Atlantic U.S. All agreed that there is insufficient affordable adequate housing. They held conflicting views, however, on: 1) the standard for adequate housing in the absence of …
