The Author reviews journalist Silja Talvi’s Women Behind Bars: The Growing Crisis of Women in the U.S. Prison System (“Women Behind Bars”) which presents an engaging overview of issues affecting incarcerated women. It succinctly illustrates some of the important connections involving the War on Drugs, racial disparity, and the high rate of substance abuse and physical and sexual abuse among incarcerated women. Lawyering At The Extremes: The Representation Of Tom Mooney, 1916-1939, Rebecca Roiphe

This article explores the complex and often strained relationship between Tom Mooney, the famous labor radical who was framed for a bombing murder, and his lawyers over the course of the 23-year long battle to gain his freedom. The author uses the lawyers’ archives to explore the intense difficulties that arise between a client who believes the legal system is hopelessly corrupt and his lawyers who hope to free their client and redeem the justice system at the same time. Competition And Tax Evasion : A Cross Country Study, Yiqun Wang

This paper investigates the determinants of informality (tax evasion in particular) utilizing rich cross-country data of firm-level survey from the World Bank, and hypothesizing that competition is a significant factor determining tax evasion behaviors. Competition pressure is a key stimulus to induce questionable manipulations of tax reporting behaviors. However its effect works at a decreasing speed. It is also hypothesized that business obstacles facing firms such as tax administration and corruption play significant roles in explaining tax evasion. This paper further hypothesizes that firm characteristics such as size, age, ownership are important evasion determinants. Empirical results are found supporting these …

Local Employment, Poverty, And Property Value Effects Of Geographically-Targeted Tax Incentives: An Instrumental Variables Approach, Andrew R. Hanson

Economics Faculty Research and Publications

The federal Empowerment Zone (EZ) program is a set of tax incentives targeted to areas of select cities. I estimate the effect of the EZ program on employment, poverty, and property values by comparing areas that received an EZ to areas that applied (and qualified), but were rejected. Because of endogeneity concerns, I use political representation to instrument for EZ designation. OLS results show a positive and statistically significant effect of the program on employment and poverty. IV estimates suggest the program had no effect on employment and poverty, and instead had a large statistically significant effect on property values.

This Article examines the ongoing power struggle between the content industries (with a particular focus on Hollywood) and the technology industry. These two sectors are intertwined like never before, yet their fates seem wildly divergent, with content stumbling while distribution technology thrives.

The Article begins by illustrating that, even before the recession took hold, traditional paid content was in trouble, and that this was and is true across a range of distribution platforms and content types, including theatrical motion pictures, home video, network television, music, newspapers, books, and magazines. In this short essay I focus on the contemporary human rights movement, and in particular three broad areas of human rights. I provide a descriptive listing or cataloguing, commencing with a short consideration of the definition of what we refer to as the human rights movement. Based on my remarks as part of a panel discussion, I consider the human rights movements in three somewhat distinct categories: first, the structure and proliferation of human rights organizations; second, the seemingly growing human rights culture; and third, human rights violations by nations and private actors.

Professional Malpractice In A World Of Amateurs, Thomas D. Morgan

An increasing number of tasks once reserved to lawyers are now being performed by non-lawyers. That reality seems likely to continue. The question then becomes against what standard of performance such “amateur” practice should be assessed. One answer might be that a non-lawyer should be guilty of malpractice if the work is performed below the level of quality to which a lawyer would be held. This paper argues that the work should instead be judged against the standard of performance the non-lawyer purported to be able to deliver.

Reconciling Southern Identity: Revising The Public Memory Of Lucius Quintus Cincinnatus Lamar, James Matthew Hopper

This project explores the accepted historical narrative of white male Southern identity based upon L.Q.C. Lamar's public memory. My objective is to reinterpret some long held beliefs about Lamar s life, career, and politics, while analyzing the effect of those interpretations in fostering and challenging white male Southern identity. I found that Lamar was never fully reconstructed from his Confederate views and many of his pre-war principles made him popular and garnered loyalty among his constituency. In reinventing himself as a reconstructed politician, he used the death of Charles Sumner to offer a reconciliatory version of Southern masculinity in an …
