Hanging In A Balance: Freedom Of Expression And Religion, Puja Kapai, Anne S Y Cheung Sep 2009

Hanging In A Balance: Freedom Of Expression And Religion, Puja Kapai, Anne S Y Cheung

Buffalo Human Rights Law Review

When the liberty to freely express oneself is at odds with another's right to freedom of religion, we are confronted with the classic dilemma of choosing between two equally fundamental, constitutionally and internationally protected rights. The contours of the said two rights however, are far from clear. Whilst freedom of expression is not an absolute right, its limits are controversial. Equally, while it is undisputed that freedom of religion is an internationally protected human right enshrined in various international instruments, there is no comprehensive international treaty which addresses as its subject the content and extent of the right of freedom …

Measuring Illness Uncertainty In Men Undergoing Active Surveillance (As) For Prostate Cancer, Peter C. Albertsen Sep 2009

Measuring Illness Uncertainty In Men Undergoing Active Surveillance (As) For Prostate Cancer, Peter C. Albertsen

Articles - Patient Care

Uncertainty is an aversive experience and plays an important role in the lives of men undergoing active surveillance (AS) (earlier referred to as watchful waiting) for early-stage prostate cancer. Yet reliable and valid measures of uncertainty have not been fully tested in this population. This secondary analysis therefore tested the reliability of the Mishel Uncertainty in Illness Scale – Community Form (MUIS-C; Mishel, 1997b) for use with a population of men undergoing AS for prostate cancer.

New Tfii-I Family Target Genes Involved In Embryonic Development, Aleksandr V. Makeyev, Dashzeveg Bayarsaihan

SoDM Articles

Two members of the TFII-I family transcription factor genes, GTF2I and GTF2IRD1, are the prime candidates responsible for the craniofacial and cognitive abnormalities of Williams syndrome patients. We have previously generated mouse lines with targeted disruption of Gtf2ird1 and Gtf2i. Microarray analysis revealed significant changes in the expression profile of mutant embryos. Here we described three unknown genes that were dramatically down-regulated in mutants. The 2410018M08Rik/Scand3 gene encodes a protein of unknown function with CHCH and hATC domains. Scand3 is downregulated during mouse embryonic stem cell (ES) differentiation. 4933436H12Rik is a testis-specific gene, which encodes a protein with no known …

Effects Of Nicotine Patch Or Nasal Spray On Nicotine And Cotinine Concentrations In Pregnant Smokers, Cheryl A. Oncken, Winston A. Campbell, Grace Chan, Henry R. Kranzler

UCHC Articles - Research

Objective To examine the short-term effects of the nicotine patch or nasal spray on measures of nicotine exposure, withdrawal symptoms, and on maternal and fetal heart rates in pregnant smokers. Methods We measured nicotine/cotinine concentrations and maternal and fetal heart rates during an 8-hour monitoring session while smoking and again after 4 days of nicotine patch (15 mg/16 hours), nasal spray (recommended regimen of 24 doses per day), or placebo treatment. Nicotine withdrawal symptoms were assessed daily. Results Twenty-one subjects, who smoked an average of 17 cigarettes per day, completed both monitoring sessions. Nicotine concentrations decreased from baseline smoking concentrations …

Dobbey V. Illinois Department Of Corrections: A Small Piece Of A Growing Policy Puzzle, Ashley M. Belich

Seventh Circuit Review

The First Amendment right to petition is deeply intertwined with the other liberties offered by the Bill of Rights. However, the right to petition is still rarely analyzed in the legal world. This already difficult topic has become even more muddled in the prison system. Although the Prison Litigation Reform Act sought both to help prisoners and reduce the abundance of inmate lawsuits, inmate grievance processes actually suffocate the right to petition in prisons, sometimes going so far as to create a culture that offers barely any First Amendment protection. The Seventh Circuit's decision in Dobbey v. Illinois Dept. of …

Raising The Bar: How The Seventh Circuit Nearly Struck Down The Diploma Privilege Under The Dormant Commerce Clause, Paul C. Huddle Sep 2009

Raising The Bar: How The Seventh Circuit Nearly Struck Down The Diploma Privilege Under The Dormant Commerce Clause, Paul C. Huddle

Seventh Circuit Review

In Wiesmueller v. Kosobucki, the Seventh Circuit considered whether the Wisconsin diploma privilege violated the dormant Commerce Clause of the United States Constitution. The diploma privilege grants graduates of the University of Wisconsin Law School and Marquette University Law School admission to the Wisconsin bar without examination. This privilege does not extend to graduates of other ABA-accredited law schools who desire to practice in Wisconsin. Because the issue was dismissed prematurely in the lower court, the Seventh Circuit declined to decide the issue. Nonetheless, the Seventh Circuit suggested that the diploma privilege arbitrarily discriminated against interstate commerce. This Comment …

True To The Fable?: Examining The Appropriate Reach Of Cat's Paw Liability, Emily M. Kepner Sep 2009

True To The Fable?: Examining The Appropriate Reach Of Cat's Paw Liability, Emily M. Kepner

Seventh Circuit Review

In its recent decision in Staub v. Proctor Hospital, the Seventh Circuit clarified its approach to the colorfully named "cat's paw" theory of employment discrimination. The cat's paw doctrine holds employers vicariously liable when an employee involved in the decisionmaking process, other than the non-biased formal decisionmaker, possessed discriminatory intent. Currently, the circuits disagree about how much control the biased employee must possess over the decisionmaker to impose liability on the employer. In Staub, the Seventh Circuit held that liability should be imposed only when the biased employee possessed "singular influence" over the formal decisionmaker, aligning the court …

The Seventh Circuit Giveth, And The District Of Columbia Circuit Taketh Away: The National Labor Relations Board's Authority To Act Under Section 3(B) Of The National Labor Relations Act, Tyler T. Murphy Sep 2009

The Seventh Circuit Giveth, And The District Of Columbia Circuit Taketh Away: The National Labor Relations Board's Authority To Act Under Section 3(B) Of The National Labor Relations Act, Tyler T. Murphy

Seventh Circuit Review

On May 1, 2009, the Seventh Circuit and the D.C. Circuit issued decisions interpreting Section 3(b) of the National Labor Relations Act. In New Process Steel, LP v. NLRB, the Seventh Circuit interpreted Section 3(b) as allowing the National Labor Relations Board to issue decisions through a two-member panel. However, the D.C. Circuit declared the same two-member panel unlawful in Laurel Baye Healthcare of Lake Lanier, Inc. v. NLRB. The Supreme Court will now resolve the issue, having granted certiorari to New Process Steel. This Note argues that Section 3(b)'s plain language and legislative history fail to …

The Other Forgotten War: Understanding Atrocities During The Malayan Emergency, Christi Siver Sep 2009

The Other Forgotten War: Understanding Atrocities During The Malayan Emergency, Christi Siver

Political Science Faculty Publications

In this chapter, I briefly outline the dependent variable in this case, the various units actively engaged in combat in Malaya between 1948 and 1952. I then explore the most common explanations for the Scots Guards’ actions and reveal why they are not helpful in explaining why other units did not similarly kill civilians. To better understand this variation, I explore three alternative explanations: Did the military socialize units in the laws of war and appropriate behavior toward civilians? Did government leaders encourage units to kill civilians? Finally, did different units’ subcultures make them more likely to kill civilians? I …
