Elizabeth Bayley Seton Writings: Current State And Future Plans, Regina Bechtle S.C., Judith Metz S.C.

Vincentian Studies

Having published the collected writings of Elizabeth Seton, the Seton Writings Committee decided that correspondence to Elizabeth should be published as well. As an illustration of the fresh perspectives that could be gleaned from this publication, this article summarizes letters about the conflict over superiors for the Sisters of Charity. The article explains the circumstances surrounding the resignation of the first superior, William Dubourg, and the disagreements between Elizabeth and Dubourg’s successor, Jean-Baptiste David.

Elizabeth Bayley Seton's Commonplace Book Of Poetry Archives, St. Joseph Provincial House, Rare Book 31, Ellin M. Kelly Ph.D.

Vincentian Studies

Elizabeth Seton’s commonplace book of poetry, compiled between 1788 and 1801, is presented. According to Ellin Kelly, “the collection provide[s] valuable insights into young Elizabeth Bayley’s character in the years prior to and after her marriage to William McGee Seton” that are not found in other sources. They show her transition from teenager to wife and mother. Forty-eight selections from thirty-two poets are included, ranging from a few lines to complete poems. Aside from Shakespeare and Milton, almost all the other poets were prominent in Elizabeth’s time. Themes among the poems include nature, the human condition, virtue, romantic love, friendship, …

Finance Flies High: How Unilever Redesigned The Finance Function To Build Brand Value And Drive Growth, Barbara M. Tarasovich, Bridget Lyons

WCBT Faculty Publications

Unilever's finance team played a key role in the success of their brands. The company achieved its fourth consecutive year of accelerating organic sales growth from less than 0.5% in 2004 to more than 7% in 2008, according to Jim Lawrence, Unilever's CFO. Its strategy is to focus on volume growth and strengthening the competitive position of the company's brands. In this article, the authors examine how the finance function at Unilever was redesigned to deliver the firm's strategic goals, including an emphasis on volume growth and competitive position of its brands. Beginning in 2005, the finance team at Unilever …

Privacy In The Age Of Tracking Technology: Why G.P.S. Technology Should Not Be Used To Track Process Servers, Talia E. Neri Oct 2009

Privacy In The Age Of Tracking Technology: Why G.P.S. Technology Should Not Be Used To Track Process Servers, Talia E. Neri

Cardozo Public Law, Policy & Ethics Journal

The article argues that the expansion of GPS technology in the process service industry and workplace surveillance raises significant Fourth Amendment concerns, as it erodes privacy expectations and creates a chilling effect on personal autonomy. While courts have upheld the use of GPS in certain employment contexts, the author contends that such surveillance often outweighs its benefits, particularly when less intrusive alternatives are available. The analysis critiques the legal standards governing surveillance, particularly the "readily available" standard from United States v. Kyllo, and advocates for a more balanced approach that prioritizes privacy protections.

Effect Of Self-Determination Theory-Based Strategies For Staging Recreation Encounters On Intrinsic Motivation Of Youth Residential Campers, Mark F. Roark, Gary D. Ellis Oct 2009

Effect Of Self-Determination Theory-Based Strategies For Staging Recreation Encounters On Intrinsic Motivation Of Youth Residential Campers, Mark F. Roark, Gary D. Ellis

Kinesiology and Health Science Faculty Publications

Parents and caregivers generally believe that the camp experiences they purchase for their children will not only yield transient pleasure and lasting memories of fun encounters, but significant developmental outcomes as well. Camp professionals serving over 11 million youths each year embrace such outcomes and commonly advance mission statements that point to the development of friendship skills, self-confidence, competence, self-reliance, independence, citizenship, and many other developmental outcomes. Empirical evidence of how these outcomes might be facilitated through specific recreation leadership strategies (e.g., activity staging) is lacking. The Self-Determination Theory (SDT) would suggest that youth leaders (e.g., camp counselors, recreation activity …

Airway Smooth Muscle As An Immunomodulatory Cell., Gautam Damera, Omar Tliba, Reynold A. Panettieri, Jr. Oct 2009

Airway Smooth Muscle As An Immunomodulatory Cell., Gautam Damera, Omar Tliba, Reynold A. Panettieri, Jr.

College of Pharmacy Faculty Papers

Although pivotal in regulating bronchomotor tone in asthma, airway smooth muscle (ASM) also modulates airway inflammation in asthma. ASM myocytes secrete or express a wide array of immunomodulatory mediators in response to extracellular stimuli, and in chronic severe asthma, increases in ASM mass may also render the airway irreversibly obstructed. Although the mechanisms by which ASM secretes cytokines and chemokines are shared with those regulating immune cells, there exist unique ASM signaling pathways that may provide novel therapeutic targets. This review provides an overview of our current understanding of the proliferative as well as synthetic properties of ASM.

Transcriptional Regulation Of Cytokine Function In Airway Smooth Muscle Cells., Deborah Clarke, Gautam Damera, Maria B. Sukkar, Omar Tliba Oct 2009

Transcriptional Regulation Of Cytokine Function In Airway Smooth Muscle Cells., Deborah Clarke, Gautam Damera, Maria B. Sukkar, Omar Tliba

College of Pharmacy Faculty Papers

The immuno-modulatory properties of airway smooth muscle have become of increasing importance in our understanding of the mechanisms underlying chronic inflammation and structural remodeling of the airway wall in asthma and chronic obstructive pulmonary disease (COPD). ASM cells respond to many cytokines, growth factors and lipid mediators to produce a wide array of immuno-modulatory molecules which may in turn orchestrate and perpetuate the disease process in asthma and COPD. Despite numerous studies of the cellular effects of cytokines on cultured ASM, few have identified intracellular signaling pathways by which cytokines modulate or induce these cellular responses. In this review we …

Deep Rationality: The Evolutionary Economics Of Decision Making, Douglas T. Kenrick, Vladas Griskevicius, Jill M. Sundie, Norman P. Li, Jessica Yexin Li, Steven L. Neuberg Oct 2009

Deep Rationality: The Evolutionary Economics Of Decision Making, Douglas T. Kenrick, Vladas Griskevicius, Jill M. Sundie, Norman P. Li, Jessica Yexin Li, Steven L. Neuberg

Research Collection School of Social Sciences

What is a “rational” decision? Economists traditionally viewed rationality as maximizing expected satisfaction. This view has been useful in modeling basic microeconomic concepts, but falls short in accounting for many everyday human decisions. It leaves unanswered why some things reliably make people more satisfied than others, and why people frequently act to make others happy at a cost to themselves. Drawing on an evolutionary perspective, we propose that people make decisions according to a set of principles that may not appear to make sense at the superficial level, but that demonstrate rationality at a deeper evolutionary level. By this, we …

Conscientiousness Is Not Always A Good Predictor Of Performance: The Case Of Creativity, Roni Reiter-Palmon, Jody J. Illies, Lisa M. Kobe-Cross Oct 2009

Conscientiousness Is Not Always A Good Predictor Of Performance: The Case Of Creativity, Roni Reiter-Palmon, Jody J. Illies, Lisa M. Kobe-Cross

Psychology Faculty Publications

Meta-analyses investigating the relationship between Conscientiousness and performance suggest a positive relationship for a variety of criteria. However, recently it has been argued that Conscientiousness is not always a good predictor of performance, particularly for creative performance. Additionally, it has been suggested that Conscientiousness includes two distinct components, achievement and dependability, which may have different relationships with criterion measures. Two studies were conducted to determine whether the components of Conscientiousness predict creativity better than the full factor. Students in each study completed a measure of the Five Factor Model and a measure of creative performance. In the first study, creative …

Mental Illness And Self-Representation: Faretta, Godinez And Edwards, Christopher Slobogin Oct 2009

Mental Illness And Self-Representation: Faretta, Godinez And Edwards, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In the recent decision of Indiana v. Edwards the Supreme Court held that the right to represent oneself may be denied to defendants who are competent to stand trial if they "still suffer from severe mental illness to the point where they are not competent to conduct trial proceedings by themselves." Edwards was a surprise, given the Court's holding 15 years earlier in Godinez v. Moran that Nevada courts did not err when they permitted a mentally ill person who had been found competent to stand trial to waive the right to counsel, plead guilty and waive the presentation of …

On The Limits Of Supremacy: Medical Marijuana And The States' Overlooked Power To Legalize Federal Crime, Robert A. Mikos Oct 2009

On The Limits Of Supremacy: Medical Marijuana And The States' Overlooked Power To Legalize Federal Crime, Robert A. Mikos

Vanderbilt Law School Faculty Publications

Using the conflict over medical marijuana as a timely case study, this Article explores the overlooked and underappreciated power of states to legalize conduct Congress bans. Though Congress has banned marijuana outright, and though that ban has survived constitutional scrutiny, state laws legalizing medical use of marijuana constitute the de facto governing law in thirteen states. This Article argues that these state laws and (most) related regulations have not been, and, more interestingly, cannot be preempted by Congress, given constraints imposed on Congress's preemption power by the anti-commandeering rule, properly understood. Just as importantly, these state laws matter, in a …

The Ethical Health Lawyer: An Empirical Assessment Of Moral Decision Making, Ellen Wright Clayton, Joshua E. Perry, Ilene N. Moore, Bruce Barry, Amanda R. Carrico Oct 2009

The Ethical Health Lawyer: An Empirical Assessment Of Moral Decision Making, Ellen Wright Clayton, Joshua E. Perry, Ilene N. Moore, Bruce Barry, Amanda R. Carrico

Vanderbilt Law School Faculty Publications

The empirical literature exploring lawyers and their moral decision making is limited despite the “crisis” of unethical and unprofessional behavior in the bar that has been well documented for over a decade. In particular we are unaware of any empirical studies that investigate the moral landscape of the health lawyer’s practice. In an effort to address this gap in the literature, an interdisciplinary team of researchers at Vanderbilt University designed an empirical study to gather preliminary evidence regarding the moral reasoning of health care attorneys. The primary research question was how health lawyers respond when they encounter ethical or moral …

Touring Polygamous Utah With Elizabeth W. Kane, Winter 1872–1873, Lowell C. Bennion, Thomas R. Carter

BYU Studies

This article, originally a lecture given at Brigham Young University in 2009, was published as part of a special issue of BYU Studies featuring Thomas L. Kane. Although Kane was not a member of The Church of Jesus Christ of Latter-day Saints, he was an advocate for the Mormon cause and a trusted friend of Mormon leaders for almost forty years. Bennion and Carter consider the ideas presented by Elizabeth Kane, Thomas's wife, who expressed her dismay with plural marriage in her writings about her visit to Utah in 1872–73. The authors combine Elizabeth's views with their interest in Mormon …

How The New Economics Can Improve Employment Discrimination Law, And How Economics Can Survive The Demise Of The "Rational Actor", Scott A. Moss, Peter H. Huang Oct 2009

How The New Economics Can Improve Employment Discrimination Law, And How Economics Can Survive The Demise Of The "Rational Actor", Scott A. Moss, Peter H. Huang

William & Mary Law Review

Much employment discrimination law is premised on a purely money-focused "reasonable" employee, the sort who can be made whole with damages equal to lost wages, and who does not hesitate to challenge workplace discrimination. This type of "rational" actor populated older economic models but has been since modified by behavioral economics and research on happiness. Behavioral and traditional economists alike have analyzed broad employment policies, such as the wisdom of discrimination statutes, but the devil is in the details of employment law. On the critical damages-and liability issues the Supreme Court and litigators face regularly, the law essentially ignores the …

Standing And Speaking Constitutional Truth To Local Power Regarding Undocumented Immigrant Residents Dwelling With We The People Of The United States, L. Darnell Weeden Oct 2009

Standing And Speaking Constitutional Truth To Local Power Regarding Undocumented Immigrant Residents Dwelling With We The People Of The United States, L. Darnell Weeden

Southern Illinois University Law Journal

Under the due process clause of the 14th Amendment of the United States Constitution, undocumented immigrants must be treated fairly. Across the nation, state and municipal governments attempt to regulate immigration by enacting laws with harsh penalties directly aimed at undocumented immigrants. When state and municipal governments take such action, they cause fear and unrest among all citizens living in their communities. This fear and unrest often leads to violence against the undocumented immigrants.
In addition, federal courts sometimes fail to recognize that undocumented immigrants have standing to challenge local government attempts to regulate immigration. Not only do these regulations …

When What You Don’T Know Can Hurt You: Third Party Liability For Fraudulent Misrepresentation In Non-Commercial Settings After Doe V. Dilling, 888 N.E.2d 24 (Ill. 2008), Laura Barke Oct 2009

When What You Don’T Know Can Hurt You: Third Party Liability For Fraudulent Misrepresentation In Non-Commercial Settings After Doe V. Dilling, 888 N.E.2d 24 (Ill. 2008), Laura Barke

Southern Illinois University Law Journal

Fraudulent misrepresentation actions most commonly arise in the commercial context. In Doe v. Dilling, however, the plaintiff attempted to expand the tort’s usage to an extremely personal context and hold the parents of her fiancée liable for fraudulently misrepresenting her fiancée’s HIV status. Although this Casenote agrees that the Illinois Supreme Court reached the correct result in denying the plaintiff’s claim, it argues that the court failed to provide a clear framework for future cases. Because this case is susceptible to misinterpretation and could potentially bar all claims for fraudulent misrepresentation within non-commercial settings, this Casenote sets forth a test …

Faculty and Staff Publications

A critical feature of Mycobacterium tuberculosis, the causative agent of human tuberculosis (TB), is its ability to survive and multiply within macrophages, making these host cells an ideal niche for persisting microbes. Killing the intracellular tubercle bacilli is a key requirement for efficient tuberculosis treatment, yet identifying potent inhibitors has been hampered by labor-intensive techniques and lack of validated targets. Here, we present the development of a phenotypic cell-based assay that uses automated confocal fluorescence microscopy for high throughput screening of chemicals that interfere with the replication of M. tuberculosis within macrophages. Screening a library of 57,000 small molecules led …

‘That Ye May Know Each Other’: Late Victorian Interactions Between British And West African Muslims, Brent D. Singleton

Library Faculty Publications & Presentations

From the early 1890’s to 1908 members of the Liverpool Moslem Institute led by Sheik William Henry Abdullah Quilliam had extensive contacts with their West African Muslim counterparts. This era was marked by several trends including the disintegration of the Ottoman Empire, European colonialism, extensive overseas Christian missionary activities as well as the vast expansion of Islam in West Africa. In this milieu, the British and West African Muslims built a mutually beneficial relationship with equality, respect, and brotherhood as its cornerstone. Their contacts developed and flourished quickly, leading to extensive correspondence, visits, and general support for one another’s causes. …
