Settlement Raises Questions About Housing Obligations, John R. Nolon, Jessica A. Bacher

It is well established that zoning regulations which operate in an exclusionary capacity are unconstitutional. However, a bright line has yet to be drawn by either the New York legislature or the New York courts as to what constitutes an exclusionary zoning provision. This article examines several restricted holdings of the New York courts and compares the limited New York legislation, such as the 2008 Long Island Workforce Housing Act, to more powerful state legislation from surrounding states, which have had more success abolishing exclusionary zoning.

Incarcerated Male Adolescent Suicide In Utah: A Case Study, Kristy Straubhaar

Theses and Dissertations

Adolescent suicide has been described as a major public health problem calling for the aid of researchers willing to better identify factors related to suicide risk. Suicide is the third-leading cause of death for 15 to 24 year olds. Despite the fact incarcerated adolescents act in self-destructive ways, minimal research has focused on suicide behavior among incarcerated adolescents. Existing data indicates that suicide among adolescent males is especially prevalent in the juvenile justice system. Several variables have been identified as risk factors for suicidal behavior, including interpersonal relationship dysfunction, substance abuse, and psychological variables such as depression and dichotomous thinking. …

On September 23rd, Westchester County settled a lawsuit with U.S. Department of Housing and Urban Development and the Anti-Discrimination Center of Metro New York under which it agreed to develop and carry out an implementation plan to construct 750 affordable housing units in Westchester communities with low percentages of African American and Hispanic households. Under this agreement, the County will provide over $50 million to create housing in these communities; if needed, the County agreed to withhold benefits from the communities or to bring litigation against them if the 750 units are not constructed. The Internal Revenue Service (IRS) compiles tax return data each year. They match returns from one year to the next utilizing social security numbers. The newest data for 2008 was released in October 2009. The 2008 data should be interpreted as tax returns filed in the spring of 2008 (April 2008) for tax year 2007. The comparison is made between where the people filed in the current year versus their address when filing in the previous year (spring of 2007 for the 2006 tax year). Background. Autoregressive regression coefficients for Anopheles arabiensis aquatic habitat models are usually assessed using global error techniques and are reported as error covariance matrices. A global statistic, however, will summarize error estimates from multiple habitat locations. This makes it difficult to identify where there are clusters of An. arabiensis aquatic habitats of acceptable prediction. It is therefore useful to conduct some form of spatial error analysis to detect clusters of An. arabiensis aquatic habitats based on uncertainty residuals from individual sampled habitats. Incarceration American-Style, Sharon Dolovich

In the United States today, incarceration is more than just a mode of criminal punishment. It is a distinct cultural practice with its own aesthetic and technique, a practice that has emerged in recent decades as a catch-all mechanism for managing social ills. In this essay, I argue that this emergent carceral system has become self-generating—that American-style incarceration, through the conditions it inflicts, produces the very conduct society claims to abhor and thereby guarantees a steady supply of offenders whose incarceration the public will continue to demand. Punishing Pharmaceutical Companies For Unlawful Promotion Of Approved Drugs: Why The False Claims Act Is The Wrong Rx, Vicki W. Girard

This article criticizes the shift in focus from correction and compliance to punishment of pharmaceutical companies allegedly violating the Food, Drug, & Cosmetic Act (FD&C Act) prohibitions on unlawful drug promotion. Traditionally, the Food and Drug Administration (FDA) has addressed unlawful promotional activities under the misbranding and new drug provisions of the FD&C Act. Recently though, the Justice Department (DOJ) has expanded the purview of the False Claims Act to include the same allegedly unlawful behavior on the theory that unlawful promotion “induces” physicians to prescribe drugs that result in the filing of false claims for reimbursement.
