Stop The Integration Principle?, Prof. Dr. Jan H. Jans Jan 2009

Stop The Integration Principle?, Prof. Dr. Jan H. Jans

Fordham International Law Journal

Lord Slynn of Hadley is probably not primarily known as an environmental lawyer. His contributions to the development of European environmental law are, however, considerable. On May 24, 1988, Slynn delivered his famous opinion in the so-called "Danish Bottles" case. In that case, the European Court of Justice ("ECJ") held that a system requiring manufacturers and importers to market beer and soft drinks only in reusable containers (which had to be approved by a National Agency for the Protection of the Environment) was subject to what is now article 34 of the Treaty on the Functioning of the European Union …

Free Movement Of Goods And Their Use -- What Is The Use Of It?, Laurence W. Gormley Jan 2009

Free Movement Of Goods And Their Use -- What Is The Use Of It?, Laurence W. Gormley

Fordham International Law Journal

Shortly before the disappearance of the European Community, the European Court of Justice ("ECJ") handed down three judgments on the free movement of goods relating to the use to which goods are put. They are remarkable because they put an end to a serious controversy about the scope of what is now article 34 of the Treaty on the Functioning of the European Union ("TFEU") (article 28 of the Treaty Establishing the European Community ("EC Treaty")), which saw a considerable divergence in approach between the Advocates General concerned in these cases. The judgments also surely herald an end to attempts …

Assessing The European Market For Legal Services: Developments In The Free Movement Of Lawyers In The European Union, Julian Lonbay Jan 2009

Assessing The European Market For Legal Services: Developments In The Free Movement Of Lawyers In The European Union, Julian Lonbay

Fordham International Law Journal

This Article focuses on recent developments in European multi-jurisdictional practice rights that have major implications for the control of entry to the legal professions and some of the related deontological rules that govern access to professional legal life across the European Union ("EU") and the European Economic Area ("EEA"). Additionally, it looks at their impact on rules regulating the competence of lawyers and admission to the legal professions, primarily in Europe, but with some reference to the position in the United States as well.

A National Survey Investigating Uk Prescribers' Opinions On Chemotherapy Dosing And 'Dose-Banding'., Sa Kaestner, Gj Sewell Jan 2009

A National Survey Investigating Uk Prescribers' Opinions On Chemotherapy Dosing And 'Dose-Banding'., Sa Kaestner, Gj Sewell

School of Health Professions

AIMS: The primary purpose of dose-banding for cancer chemotherapy is to reduce patient waiting times, but dose-banding also has additional benefits, such as reduced drug wastage, reduced stress for staff, and prospective quality control of infusions. However, the uptake of dose-banding seems fairly low. Possible reasons for this are a reluctance to use dose-banding for clinical reasons or a lack of awareness. Despite the seemingly minor change from established practice of dose preparation, dose-banding has the potential to alter patient chemotherapy exposure. The aim of this study was to investigate prescribers' awareness of dose-banding and their opinions on the scope …

Protein Responsive Synthetic Materials For Biomedical Applications, Youyou Zheng Jan 2009

Protein Responsive Synthetic Materials For Biomedical Applications, Youyou Zheng

Doctoral Dissertations

"The production of synthetic materials with molecular recognition abilities towards biomacromolecules has been widely researched because of its potential applications in separations, sensing, therapeutics, etc. While molecular imprinting has become a commercially viable method for the production of synthetic materials with molecular recognition abilities towards small molecules, little success has been recorded towards protein targets. Proteins are difficult to imprint as they present a number of epitopes for imprinting, are difficult to remove from the completed material, and are incompatible with the densely crosslinked structures required. As a result, a novel surface molecular imprinting technique was developed to synthesize polymeric …

Fighting Piracy In Somalia (And Elsewhere): Why More Is Needed, Milena Sterio Jan 2009

Fighting Piracy In Somalia (And Elsewhere): Why More Is Needed, Milena Sterio

Fordham International Law Journal

This Article argues that pirates should be treated as terrorists and that piracy-fighting countries should rely on a variety of antiterrorist conventions to justify the capture and prosecution of pirates. To provide a comprehensive outlook on piracy, Part I of this Article describes the history of piracy and its reappearance in the modern world. Part II briefly describes the resurgence of modern-day piracy, first in Southeast Asia and then in Somalia. Part III provides the current international legal framework for battling piracy, by focusing first on the definition of piracy in international law, and then on the existing international legal …

Uprooting Children In The Name Of Equity, Merle H. Weiner Jan 2009

Uprooting Children In The Name Of Equity, Merle H. Weiner

Fordham International Law Journal

This Article ultimately recommends that courts should reign in, if not abandon, the doctrine of equitable estoppel as it is used in Hague child abduction cases. This Article supports its thesis in four parts. Part I describes the equitable estoppel argument as it has emerged within the Hague Convention framework. Part II then examines the Convention's legislative history and argues that the doctrine is incompatible with that history. Part III analyzes the principle policy basis offered in support of the doctrine: the deterrence of concealment. Part IV focuses on the best way to address concealment within the confines of the …

Hydrogen Infrastructure: Resource Evaluation And Capacity Modeling, Kevin B. Martin Jan 2009

Hydrogen Infrastructure: Resource Evaluation And Capacity Modeling, Kevin B. Martin

Doctoral Dissertations

"A hydrogen economy could offer energy stability, economical, and environmental benefits. Several issues are involved in the design and implementation of a hydrogen economy such as the selection of feedstocks, generation and storage technologies, transportation methods, appropriate equipment capacity, codes/standards and public awareness. The design of a hydrogen infrastructure may seem insurmountable; however, as the system is deconstructed a proper design can be achieved. In order to better understand how a hydrogen system for light duty vehicles might operate, both hydrogen resource and capacity analysis and modeling is conducted. Specifically, an evaluation of leading near term production and distribution technologies …

Death Of The Role-Play, Nadja Alexander, Michelle Lebaron Jan 2009

Death Of The Role-Play, Nadja Alexander, Michelle Lebaron

Research Collection Yong Pung How School Of Law

Setting someone up to fail does indeed sound unfair. In fact it could be described as an ambush – outlaw facilitators lying in wait for unsuspecting students. Not only is this unsettling in a training environment, we can ask whether this lack of transparency runs counter to the behavior expected of negotiators and mediators. Far from being a figment of our fertile imaginations, this short vignette is drawn from a real life learning situation at which both authors were present. Participants were asked at the beginning of the postgraduate workshop about their learning preferences. While most replied enthusiastically about learning …

Qualitative And Quantitative Methods In Occupational-Stress Research, Irvin Sam Schonfeld, Edwin Farrell Jan 2009

Qualitative And Quantitative Methods In Occupational-Stress Research, Irvin Sam Schonfeld, Edwin Farrell

Publications and Research

The paper examined the ways in which qualitative and quantitative methods support each other in research on occupational stress. Qualitative methods include (a) eliciting from unconstrained descriptions of work experiences, (b) careful first-hand observations at the workplace, and (c) participant‑observers describing “from the inside” a particular work experience. The paper shows how qualitative research stimulates theory development, hypothesis generation, and the identification of job stressors and coping responses. The limitations of qualitative research, particularly in the area of verification, are also described.

Synergies And Tensions Between Rural Social Movements And Professional Researchers, Marc Edelman Jan 2009

Synergies And Tensions Between Rural Social Movements And Professional Researchers, Marc Edelman

Publications and Research

This essay outlines approaches to analysing and managing relations between rural activists and academic researchers. It suggests (a) that contemporary social movements engage in knowledge production practices much like those of academic and NGO-affiliated researchers and (b) that the boundaries between activists and researchers are not always as sharp as is sometimes claimed. These blurred boundaries and shared practices can create synergies in activist– academic relations. The essay then examines tensions in the relationship, including activists’ expectation that academic research will be immediately applicable to their struggles and researchers’ expectation that movement participants will accommodate their needs. The final section …

Continuous-Flow, Rapid Lysis Devices For Biodefense Nucleic Acid Diagnostic Systems, Robert W. Doebler, Barbara Erwin, Anna Hickerson, Bruce Irvine, Denice Woyski, Ali Nadim, James D. Sterling

Business and Information Technology Faculty Research & Creative Works

Two mechanical lysis devices have been developed as compact, robust components to provide rapid sample preparation for nucleic acid diagnostic systems. One such component, known as the Micro Bead-Beater™ (μBB™, BBTM, Claremont BioSolutions, Upland, CA), is a compact device that is capable of ultrarapid lysis (>90% lysis in 30 s) of micro volumes (< 80 μL) of Bacillus spores in a continuous-flow format or in a disposable single-tube format. The μBB is also capable of processing much larger volumes of solutions containing spores or vegetative cells using a continuous-flow mode. A second mechanical lysis device designed as a disposable component is the microfluidic bead blender, which uses a small electric motor to spin vanes within the bead-laden solution. DNA quantification results using dsDNA-binding fluorescence dyes and real-time PCR are presented, comparing the lysis of Bacillus subtilis spores using the μBB™ with other well-known lysis techniques. Nanoscale imaging results obtained using scanning electron microscopy and transmission electron microscopy on B. subtilis spores lyzed using the μBB™ are also presented. © 2009, Society for Laboratory Automation and Screening.
