Home Sweet Home? The Efficacy Of Rental Restrictions To Promote Neighborhood Stability, Ngai Pindell Jan 2009

Home Sweet Home? The Efficacy Of Rental Restrictions To Promote Neighborhood Stability, Ngai Pindell

Scholarly Works

Homeownership is an enduring and fundamental American tradition whose economic and social benefits are well examined and have received renewed attention in recent articles and books. Tax laws encourage homeownership; debtor-creditor and property laws protect homeowners; and constitutional protections defend homeowners from governmental attempts to exercise eminent domain.

The current economic and housing crises have forced commentators and policymakers to reexamine the connection between traditional conceptions of homeownership and economic stability, particularly for low-income residents. This article questions that traditional conception by exploring how local governments, in an effort to promote regulatory land use goals, frequently limit homeowners' power to …

The Insurance Policy As Thing, Jeffrey W. Stempel Jan 2009

The Insurance Policy As Thing, Jeffrey W. Stempel

Scholarly Works

Insurance policies are a type of contract. But characterizing them only as contracts misses much of the richness of the insurance arrangement, policyholder-insurer relations, and the degree to which insurance policies, which are heavily standardized, are designed to perform a particular function. Because of their mass standardization and deployment to address particular risk management issues, insurance policies are in many respects like products or chattels. Insurers and the insurance trade press in fact frequently speak of a line of insurance "products" or a new "product" being introduced to address an emerging risk. Appreciating this aspect of the insurance policy can …

The "Other" Intermediaries: The Increasingly Anachronistic Immunity Of Managing General Agents And Independent Claims Adjusters, Jeffrey W. Stempel

Scholarly Works

This article addresses the "other" intermediaries involved in the administration of insurance policies, specifically "downstream" intermediaries, who are engaged in the administration of insurance claims. The focus is on managing general agents, third-party administrators and independent contractor claims adjusters, who perform the nuts-and-bolts tasks of the insurance industry, and are generally less well compensated than commercial insurance brokers. Since these "other" intermediaries are immune from judicial claims by policyholders, they are also less incentivized to perform their duties well. The article argues that, in order to improve the claims process, the "other" intermediaries should be held accountable for their misconduct, …

Queer Lockdown: Coming To Terms With The Ongoing Criminalization Of Lgbtq Communities, Ann Cammett Jan 2009

Queer Lockdown: Coming To Terms With The Ongoing Criminalization Of Lgbtq Communities, Ann Cammett

Scholarly Works

The criminal justice system exacts a toll on some Lesbian, Gay, Bisexual, Transgender, and Queer (LGBTQ) communities. The experience of living in poverty and the concomitant exposure to a variety of governmental systems puts all poor, but especially LGBTQ low-income people of color, at risk of incarceration. What typically goes unexamined are the myriad ways that LGBTQ people are drawn into and experience the carceral system because of sexual identities and expression. This negative effect surfaces at every conceivable level: the marginalization and subsequent criminalization of queer youth; anti-gay bias in the judicial system; the rerouting of domestic violence cases …

Nonlinear Time Series Analysis Of Knee And Ankle Kinematics During Side By Side Treadmill Walking, Jeff A. Nessler, Charles J. De Leone, Sarah Gilliland Jan 2009

Nonlinear Time Series Analysis Of Knee And Ankle Kinematics During Side By Side Treadmill Walking, Jeff A. Nessler, Charles J. De Leone, Sarah Gilliland

Physical Therapy Faculty Articles and Research

Nonlinear time series analysis was used to estimate maximal Lyapunov exponents of select ankle and knee kinematics during three different conditions of treadmill walking: independent, side by side, and side by side with forced synchronization of stepping. Stride to stride variability was significantly increased for the condition in which individuals walked side by side and synchronized unintentionally when compared to the conditions of forced synchronization and independent walking. In addition, standard deviations of three kinematic variables of lower extremity movement were significantly increased during the condition in which unintentional synchronization occurred. No relationship was found between standard deviation and estimates …

Assessment, Surgeon, And Society, John Norcini, Jamsheer J Talati

Section of Urology

An increasing public demand to monitor and assure the quality of care provided by physicians and surgeons has been accompanied by a deepening appreciation within the profession of the demands of self-regulation and the need for accountability. To respond to these developments, the public and the profession have turned increasingly to assessment, both to establish initial competence and to ensure that it is maintained throughout a career. Fortunately, this comes at a time when there have been significant advances in the breadth and quality of the assessment tools available. This article provides an overview of the drivers of change in …

Does The Duration Of Type 2 Diabetes Correlate With Changes In Taste Deficits?, Ann T. Mclaughlan Jan 2009

Does The Duration Of Type 2 Diabetes Correlate With Changes In Taste Deficits?, Ann T. Mclaughlan

PCOM Biomedical Studies Student Scholarship

The loss of insulin sensitivity in Type 2 diabetes interferes with cellular utilization of glucose. The underlying down-regulation of insulin receptors and the resulting insulin resistance is wide-spread throughout the body. The cardiovascular consequences may be indirectly responsible for decreased taste sensitivity because of diminished perfusion of the taste buds in this patient population. This study utilized an inexpensive, non-invasive technique, electrogustometry, to directly stimulate the taste buds by applying a variable, direct-current stimulus to measure taste receptor thresholds in newly-diagnosed ( < 2 years) and long-standing diagnosed (> 6 years) male and female Type 2 diabetes mellitus subjects. Taste thresholds were elicited by application of an …

Hiv And Aids Stigma And Discrimination In China: Results From A National Survey, Karen Hardee, Tim Manchester, Victor Yuan, Benjamin Y. Clark, Amy Qi, Sarah Bradley, Zoe Shen

All Maxine Goodman Levin School of Urban Affairs Publications

Because stigmatizing and discriminatory attitudes and tendencies are largely prevalent in China, national and local mass media interventions have an important role to play in making Chinese citizens aware of the debilitating effects of stigma and discrimination and in reinforcing information on HIV/AIDS to reduce baseless fears of transmission.

Apexification Of Nonvital Immature Mandibular Premolars Using Two Different Techniques, Ping-Han Wen, Ji-Uei Liou, Bor-Ren Duh Jan 2009

Apexification Of Nonvital Immature Mandibular Premolars Using Two Different Techniques, Ping-Han Wen, Ji-Uei Liou, Bor-Ren Duh

Journal of Dental Sciences

The purpose of this report was to present two cases of mandibular premolars with necrotic pulp and open apices treated with two different techniques. The first case was a 20-year-old female whose teeth 35 and 45 were diagnosed with pulpal necrosis and chronic apical periodontitis, possibly resulting from dens evaginatus. Traditional apexification with Ca(OH)2 was chosen; however, teeth 35 and 45 fractured after 2 and 9 months, respectively. The second case was an 11-year-old boy whose tooth 45 was diagnosed with necrotic pulp and a chronic apical abscess, possibly resulting from dens evaginatus. The mineral trioxide aggregate (MTA) barrier technique …

Dental Caries Associated With Dietary And Toothbrushing Habits Of 6- To 12-Year-Old Mentally Retarded Children In Taiwan, Hsiu-Yueh Liu, Shun-Te Huang, Szu-Yu Hsuao, Chun-Chih Chen, Wen-Chia Hu, Ya-Yin Yen Jan 2009

Journal of Dental Sciences

Background/Purpose In this study, we analyzed the influence of dietary factors and toothbrushing habits on dental caries in children with mental retardation (MR). Materials and methods In total, 168 children with MR, aged 6–12 years, were selected from a large cross-sectional survey entitled “Oral health survey and oral hygiene education for the disabled in Taiwan”, which used a stratified cluster sampling design and probability proportional to size for sampling. Oral examinations were carried out by dentists, who were trained such that the kappa score of their interexaminer agreement exceeded 0.8. Data on demographics, diet and toothbrushing habits were collected using …

Long-Term Stability Of An Adult Class Iii Open-Bite Malocclusion Treated With Multiloop Edgewise Archwire, Chien-Chun Kuo, Yi-Jane Chen, Eddie Hsiang-Hua Lai, Chung-Chen Jane Yao, Jenny Zwei-Chieng Chang

Journal of Dental Sciences

This case report describes the treatment of a 17-year-old girl with an anterior open- bite and Class III malocclusion, who had a history of thumb-sucking habit in childhood. The multiloop edgewise archwire technique was used on the mandibular arch to facilitate uprighting of the mandibular posterior teeth, change the cant of occlusal plane, close the anterior open-bite, and correct the Class III malocclusion. At the end of treatment, Class I occlusion and correction of the anterior open-bite had been achieved. An examination 8 years 8 months after treatment revealed long-term stability of the treatment results.

Altruism And Intermediation In The Market For Babies, Kimberly D. Krawiec Jan 2009

Altruism And Intermediation In The Market For Babies, Kimberly D. Krawiec

Washington and Lee Law Review

Central to every legal system is the principle that certain items are offlimits to commercial exchange. In theory, babies are one such sacred object. This supposed ban on baby selling has been lamented by those who view commercial markets as the most efficient means of allocating resources, and defended by those who contend that commercial markets in parental rights commodify human beings, compromise individual dignity, or jeopardize fundamental values. However, the supposed and much-discussed baby selling ban does not, and is not intended to, eliminate commercial transactions in children. Instead, it is an asymmetric legal restriction that limits the ability …

Personal Liability As Administrative Law, David Zaring Jan 2009

Personal Liability As Administrative Law, David Zaring

Washington and Lee Law Review

Administrative Law has almost exclusively concerned itself with Lawsuits against agencies as collective entities, under the auspices of the Administrative Procedure Act. In light of the growing number and prominence ofsuits by war on terror plaintiffs against senior government officials, this Article considers the use ofpersonal liability to discipline government officials and assesses it as an alternative to traditional administrative Law. It compares the civil suits to criminal prosecutions of these officials and compares both of them to lessobviously Law related scandal campaigns. Personal sanctions--of which Bivens complaints are a principal example-are worth more attention. These mechanisms, and the constitutional …
