Clinical Report: Land-Based Versus Pool-Based Exercise For People Awaiting Joint Replacement Surgery Of The Hip Or Knee: Results Of A Randomized Controlled Trial, C. Rudisile-Smith, M. Loosli, J. Brumitt

Faculty Publications - College of Physical Therapy

Background: Individuals with either knee or hip osteoarthritis are at risk of experiencing pain and developing functional limitations (Bennell 2005). In many cases, to alleviate pain and improve one's quality of life, an individual may require a total joint replacement. Despite advances in surgical technique and joint replacement hardware, surgical procedures are not without risk. Conservative treatments, including therapeutic exercise programmes, may improve a patient's status while avoiding the potential risks associated with surgery (pain, medication utilisation, long bouts of rehabilitation, and/ or death). Researchers have demonstrated that some patients may experience improvements in pain and functional abilities after participating …

The Fair Labor Standards Act Exemptions And The Pharmaceuticals Industry: Are Sales Representatives Entitled To Overtime?, Steven I. Locke

Barry Law Review

This article discusses the battle in the courts as to whether highly compensated pharmaceutical sales representatives are entitled to overtime pay under the Fair Labor Standards Act, or whether they are excluded from such an entitlement under one or more of the Act’s “exemptions.” This article also conducts a review of the courts’ various conflicting positions and charts a course for addressing the issue before the Courts of Appeals and ultimately the Supreme Court.

In-Season Rehabilitation Of A Division Iii Female Wrestler After A Glenohumeral Dislocation, Jason Brumitt, Alma Sproul, Philip Lentz, Linda Mcintosh, Richard Rutt

Faculty Publications - College of Physical Therapy

Objective: Wrestling is a popular sport in the United States at both the high school and collegiate levels. Traditionally a men’s sport, participation by female athletes in wrestling is increasing. There exists a paucity of literature regarding injury incidence in women’s wrestling. This lack of information challenges the ability of sports medicine and strength training professionals to design optimal injury prevention programs, training routines, and rehabilitation strategies. The objective of this report is to detail the successful conservative rehabilitation of a female wrestler after an initial glenohumeral dislocation.

Design: Case report

Case description: A 20-year-old female wrestling student–athlete presented to …

Transport Of Fungal Symbionts By Mountain Pine Beetles, K. P. Bleiker, S. E. Potter, C. R. Lauzon, Diana Six Jan 2009

Transport Of Fungal Symbionts By Mountain Pine Beetles, K. P. Bleiker, S. E. Potter, C. R. Lauzon, Diana Six

Ecosystem and Conservation Sciences Faculty Publications

The perpetuation of symbiotic associations between bark beetles (Coleoptera: Curculionidae: Scolytinae) and ophiostomatoid fungi requires the consistent transport of fungi by successive beetle generations to new host trees. We used scanning electron microscopy and culture methods to investigate fungal transport by the mountain pine beetle (MPB), Dendroctonus ponderosae Hopkins. MPB transports its two main fungal associates, Grosmannia clavigera (Robinson-Jeffrey and Davidson) Zipfel, de Beer and Wingfield and Ophiostoma montium (Rumbold) von Arx, in sac-like mycangia on the maxillary cardines as well as on the exoskeleton. Although spores of both species of fungi were observed on MPB exoskeletons, often in pits, …

The "Spiritual Temperature" Of Contemporary Popular Music, Tracy Reilly Jan 2009

The "Spiritual Temperature" Of Contemporary Popular Music, Tracy Reilly

Vanderbilt Journal of Entertainment & Technology Law

The purpose of this Article is to contribute to the volume of legal scholarship that focuses on popular music lyrics and their effects on children. This interdisciplinary cross-section of law and culture has been analyzed by legal scholars, philosophers, and psychologists throughout history. This Article specifically focuses on the recent public uproar over the increasingly violent and lewd content of death-metal and gangsta-rap music and its alleged negative influence on children. Many legal scholars have written about how legal and political efforts throughout history to regulate contemporary genres of popular music in the name of the protection of children's morals …

Respect My Authority! South Park's Expression Of Legal Ideology And Contribution To Legal Culture, Kimberlianne Podlas Jan 2009

Respect My Authority! South Park's Expression Of Legal Ideology And Contribution To Legal Culture, Kimberlianne Podlas

Vanderbilt Journal of Entertainment & Technology Law

This Article recognizes that television programs outside of the law genre can engage in legal discourse: to wit, South Park. South Park has been called one of the most profane programs on television, as well as one of the most ideological. Indeed, through sophisticated, no-holds-barred satire, South Park contemplates a number of American culture's most complex and contentious legal issues. This Article systematically analyzes the legal ideologies conveyed by South Park, combining an interpretive ethnographic analysis with quantitative content analyses. Ultimately, these examinations reveal that South Park communicates a libertarian ideology of law. In doing so, however, it does not …

Who Monitors The Monitor? Virtual World Governance And The Failure Of Contract Law Remedies In Virtual Worlds, Hannah Yeefen Lim Jan 2009

Who Monitors The Monitor? Virtual World Governance And The Failure Of Contract Law Remedies In Virtual Worlds, Hannah Yeefen Lim

Vanderbilt Journal of Entertainment & Technology Law

This Article is a study of the interaction of rules and contractual terms within the context of fraudulent conduct in virtual worlds. It makes two main arguments: first, that virtual world providers cannot generally be trusted to regulate themselves; and second, that contractual remedies alone do not provide players with useful solutions to player disputes. The Article highlights the shortcomings of relying solely on the existing web of contractual documents to resolve the issues and disputes currently experienced in virtual world communities. Starting with the applicability of real-world laws to virtual worlds, this Article examines a case study that demonstrates …

Thyroid Lymphoma As A Cause Of Dysphagia And Dyspnea In A Patient Without Palpable Nodules Or Goiter, Jarrod D. Frizzell, Brandon J. Perkins, R. Scott Morehead Jan 2009

Thyroid Lymphoma As A Cause Of Dysphagia And Dyspnea In A Patient Without Palpable Nodules Or Goiter, Jarrod D. Frizzell, Brandon J. Perkins, R. Scott Morehead

Internal Medicine Faculty Publications

Tumors originating in the neck are well-known causes of progressive dysphagia and dyspnea (including stridor), and thyroid lymphoma is an uncommon example. Physical examination provides an important first step in the evaluation of such complaints, as tumors large enough to produce such symptoms are typically considered to be palpable, if not able to be seen grossly. In this case presentation, the authors describe a nonsubsternal thyroid lymphoma measuring 3 x 4 cm at its largest diameter, producing dysphagia and leading to respiratory emergency, that was entirely nonpalpable to physical exam even after confirmation of its presence by computed tomography.
