This is a challenging moment for the law of discrimination. The state's role in discrimination has largely shifted from requiring discrimination – through official policies such as segregation – to prohibiting discrimination – through federal laws covering areas such as employment, housing, education, and public accommodations. Yet the problem of discrimination persists, often in forms that are hard to regulate or even to recognize.

Do foreign terrorists have rights under American law? And can they be prosecuted under such law? These questions may seem novel and singularly dificult. In fact, the central legal questions raised by foreign terrorism have long been familiar and have long had answers in the principle of protection.

This Article explains the principle of protection and its implications for terrorism. Under the principle of protection, as understood in early American law, allegiance and protection were reciprocal. Rapidly innovating industries are not behaving the way theory expects. Conventional industrial organization theory predicts that, when parties in a supply chain have to make transaction-specific investments, the risk of opportunism will drive them away from contracts and toward vertical integration. Despite the conventional theory, however, contemporary practice is moving in the other direction. Instead of vertical integration, we observe vertical disintegration in a significant number of industries, as producers recognize that they cannot themselves maintain cutting-edge technology in every field required for the success of their products. A Robust, Multisite Holocene History Of Drift Ice Off Northern Iceland: Implications For North Atlantic Climate, John T. Andrews, Dennis A. Darby, Dennis Eberle, Anne E. Jennings, Matthias Moros, Astrid Ogilvie

An important indicator of Holocene climate change is provided by evidence for variations in the extent of drift ice. A proxy for drift ice in Iceland waters is provided by the presence of quartz. Quantitative xray diffraction analysis of the < 2 mm sediment fraction was undertaken on 16 cores from around Iceland. The quartz weight (wt.)% estimates from each core were integrated into 250-yr intervals between −0.05 and 11.7 cal. ka BP. Median quartz wt.% varied between 0.2 and 3.4 and maximum values ranged between 2.8 and 11.8 wt.%. High values were attained in the early Holocene and minimum values were reached 6–7 cal. ka BP. Quartz wt.% then rose steadily during the late Holocene. Our data exhibit no correlation with counts on haematite-stained quartz (HSQ) grains from VM129-191 west of Ireland casting doubt on the ice-transport origin. A pilot study on the provenance of Fe oxide grains in two cores that cover the last 1.3 and 6.1 cal. ka BP indicated a large fraction of the grains between 1 and 6 cal. ka BP were from either Icelandic or presently unsampled sources. However, there was a dramatic increase in Canadian and Russian sources from the Arctic Ocean ~1 cal. ka BP. These data may indicate the beginning of an Arctic Oscillation-like climate mode.

The Republic of Turkey is the most controversial candidate state for European Union membership to date. Not only does Turkey face obstacles with the technical aspects of the enlargement process such as changes in domestic policies, the legal system, and economy, but the proposed accession of Turkey to the European Union exposes a divergence in norms, values and state identity. The process of international socialization is one explanation for the domestic changes occurring in Turkey as part of European Union membership negotiations. Background: Recent studies have noted myriad qualitative and quantitative inconsistencies between the medieval Black Death (and subsequent ‘‘plagues’’) and modern empirical Y. pestis plague data, most of which is derived from the Indian and Chinese plague outbreaks of A.D. 1900615 years. Previous works have noted apparent differences in seasonal mortality peaks during Black Death outbreaks versus peaks of bubonic and pneumonic plagues attributed to Y. pestis infection, but have not provided spatiotemporal statistical support. Our objective here was to validate individual observations of this seasonal discrepancy in peak mortality between historical epidemics and modern empirical data.

On April 10, 2008, the U.S. Army Corps of Engineers (Corps) and Environmental Protection Agency (EPA) jointly published final regulations defining standards and procedures for authorizing compensatory mitigation of impacts to aquatic resources the Corps permits under Section 404 of the Clean Water Act (Section 404). Prior to the rule, the Section 404 compensatory mitigation program had been administered under a mish-mash of guidances, inter-agency memoranda, and other policy documents issued over the span of 17 years. Shanghai and Singapore are two economically vibrant Asian cities that have recently adopted creative/cultural economy strategies. In this article I examine new spatial expressions of cultural and economic interests in the two cities: state-vaunted cultural edifices and organically evolved cultural spaces. I discuss the simultaneous precariousness and sustainability of these spaces, focusing on Shanghai's Grand Theatre and Moganshan Lu and on Singapore's Esplanade-Theatres by the Bay and Wessex Estate. French’s study of the middling sorts in England seeks to explore the origins and role ofthe ‘middling sorts’ in the social and economic culture of the early modern period. Hisresearch focuses on parochial and extra-parochial perceptions of middling socialidentity based on a series of case studies across a broad area, including Dorset, Essex,Suffolk and Lancashire. The purpose of such a wide geographical spread is to explorethe development of the middling sorts in regions of diverse agriculture, economy andindustry as a basis for a comparative survey.

This essay is a look at a little known Irish poet, William Allingham, who invokes the fairy as a vehicle for a political change in Ireland. It offers a close reading of a few of his poems as well as historically approaches the use of fairies in the popular culture of the nineteenth century. Location And Landscape In Literary Americanisms: H. L. Davis And F. Scott Fitzgerald, David T. Sumner

Well into the twentieth century, western American literature was still dismissed as regional or was boxed in by the genre expectations of pulp Westerns. This chapter focuses less on the causes of an eastern dismissal of western literature and more on what is unique about western literature, including how it reflects the larger western experience. Sumner looks at the particular Americanisms evident in the letters of the American West, using two short stories to make his argument: H. L. Davis’s Open Winter and F. Scott Fitzgerald’s Babylon Revisited.

Large-scale litigation, such as the Vioxx, Zyprexa, and asbestos cases, breeds conflict. Conflicts arise between attorneys and their clients (agency problems), plaintiffs and other plaintiffs (group problems), and plaintiffs' attorneys and other plaintiffs' attorneys (competition problems). Although these cases cannot be certified as class actions, they still proceed en masse to achieve economies of scale and present a credible threat to defendants. In response to the rise in visitor harassment in tourist destinations, there is a need to further our understanding of its impacts on the tourist experience. The purpose of this study was to understand tourist-host interactions in the context of harassment and its influence on overall quality of the tourism experience. This study compared high school student's perceptions of technology and technological literacy to those perceptions of the general public. Additionally, individual student groups were compared statistically to determine significant differences between the groups. The ITEA/Gallup Poll instrument was used to survey high school student's perceptions of technology in the study. The instrument has been used twice (2001, 2004) in the United States and once (2005) in Hong Kong to survey adult's perceptions of technology. The United States faces a skills shortage that goes beyond academic and technical skills. Employers report entry-level workers lack the necessary "soft" skills, also referred to as workplace readiness skills, needed for success in the workforce; thus, calling on educational institutions to make improvements in high school curriculum in order to address the skills gap. The intent of this dissertation was to examine high school marketing education teachers' knowledge of workplace readiness skills and whether that knowledge had an impact on student workplace readiness skill achievement.
