Loo Law: The Public Washroom As A Hyper-Regulated Place, Irus Braverman Jan 2009

Loo Law: The Public Washroom As A Hyper-Regulated Place, Irus Braverman

UC Law SF Journal on Gender and Justice

The article suggests that the public washroom is the most regulated of all common spaces in the United States. It offers several possible explanations for this hyper-juridical attention. First and foremost, the article argues that such hyper regulation of the public washroom has to do with the sanitary and moral significance of this space. Secondly, it argues that the intensity of washroom regulation is due to its ambiguous public/private properties. Finally, the articie suggests that the intense regulation of the public washroom is the result of physio-anatomical functions performed in it.

Anabaptism And The State: An Uneasy Coexistence, Sandra F. Joireman Jan 2009

Anabaptism And The State: An Uneasy Coexistence, Sandra F. Joireman

Political Science Faculty Publications

In any compilation of Christian views of the state, the Anabaptist position stands out as unique or, if one wanted to be less complimentary, extreme. The Anabaptist view of the state is less focused on articulating the division between church and state responsibilities than the Reformed or Lutheran traditions. Indeed, Anabaptists have no assigned role for government beyond the creation of order, emphasizing scriptural interpretations that give primacy to the church in the life of a Christian. As a result, political theology distances Anabaptists from both the Catholic Church and the mainstream of the Reformation.

The Role Of Black Barbudans In The Establishment Of Open-Range Cattle Herding In The Colonial Caribbean And South Carolina, Andrew Sluyter Jan 2009

The Role Of Black Barbudans In The Establishment Of Open-Range Cattle Herding In The Colonial Caribbean And South Carolina, Andrew Sluyter

Faculty Publications

Some significant problems remain in understanding the establishment of open-range cattle herding in the Caribbean and North America, especially regarding the role of blacks in that process. Research to date has identified the Greater Antilles, especially Spanish Cuba and British Jamaica, as the sole Caribbean sources of settlers who established the herding systems of, respectively, Mexico and South Carolina. Yet an open-range cattle herding system also occurred in the British Lesser Antilles, which provided many of the settlers for the South Carolina colony. Archival and field research in Antigua and Barbuda provide the basis for comprehensive reconstruction of that system’s …

The Long Game: Hamas, The Ira, And The Politics Of Radicalization In Palestine And Northern Ireland, Dan O'Sullivan Jan 2009

The Long Game: Hamas, The Ira, And The Politics Of Radicalization In Palestine And Northern Ireland, Dan O'Sullivan

Honors Theses

The value of a comparative study of the two conflicts stems from a remarkable similarity in the structural organization of political violence by its most influential practitioners: the IRA and Hamas. At the core, I have merely tried my best to approach a beguiling question in a fresh, dynamic way. The stultifying discourse of conflict that serves as lingua franca for the Israeli‐Palestinian issue has largely reduced strategic debate to how best the conflict can be managed – not ended. Prime Minister Benjamin Netanyahu’s focus on “economic peace” and unwillingness to commit to a two‐state solution – the consensus that …

Factors Influencing Conservation Success Or Failure In Tiger Range States, Megan C. Saunders Jan 2009

Factors Influencing Conservation Success Or Failure In Tiger Range States, Megan C. Saunders

Honors Theses

Tigers are currently found in 13 countries. Three of eight recognized subspecies are extinct and the other subspecies are considered endangered throughout their range. Major threats to tigers include habitat and prey loss and poaching. Most studies of tiger decline, to date, have explored direct threats. This study uses a range-wide approach to explore possible underlying drivers of tiger decline. I used recent tiger population estimates and identified 6 biological measures and 27 socioeconomic measures to ask why some countries are more successful in conserving tigers than others. Data were analyzed using correlation and regression analyses in SPSS. Higher rates …

Choosing Those Who Will Die: The Effect Of Race, Gender, And Law In Prosecutorial Decision To Seek The Death Penalty In Durham County, North Carolina, Isaac Unah Jan 2009

Choosing Those Who Will Die: The Effect Of Race, Gender, And Law In Prosecutorial Decision To Seek The Death Penalty In Durham County, North Carolina, Isaac Unah

Michigan Journal of Race and Law

District prosecutors in the United States exercise virtually unfettered power and discretion to decide which murder cases to prosecute for capital punishment. According to neoclassical theory of formal legal rationality, the process for determining criminal punishment should be based upon legal rules established and sanctioned by the state to communicate the priorities of the political community. The theory therefore argues in favor of a determinate mode of decision-making that diminishes the importance of extrinsic elements such as race and gender in the application of law. In the empirical research herein reported, I test this theory using death eligible cases in …

Determining The (In)Determinable: Race In Brazil And The United States, D. Wendy Greene Jan 2009

Determining The (In)Determinable: Race In Brazil And The United States, D. Wendy Greene

Michigan Journal of Race and Law

In recent years, the Brazilian states of Rio de Janeiro, So Paulo, and Mato Grasso du Sol have implemented race-conscious affirmative action programs in higher education. These states established admissions quotas in public universities for Afro-Brazilians or afrodescendentes. As a result, determining who is "Black'' has become a complex yet important undertaking in Brazil. Scholars and the general public alike have claimed that the determination of Blackness in Brazil is different than in the United States; determining Blackness in the United States is allegedly a simpler task than in Brazil. In Brazil it is widely acknowledged that most Brazilians are …

Uncharted Dimensions Of Media: A Map Of The Social Implications Of Geographic Information Systems (Gis), Caitlin Dufraine Jan 2009

Uncharted Dimensions Of Media: A Map Of The Social Implications Of Geographic Information Systems (Gis), Caitlin Dufraine

Honors Theses

I explore how scholars are beginning to understand the social and historical implications of the introduction, development, and increasingly widespread use of GIS. This paper uses an STS framework to evaluate both literature from the early 1990s and more recent literature that examines the influence and social implications of GIS. I provide context for my discussion of the social implications of GIS by commenting on the merits and shortcomings of theoretical frameworks that scholars have used to evaluate the influence of GIS on society. To gain a holistic appreciation of issues surrounding the role of GIS in society I have …

The Effect Of Coalmine Effluent On The Parasite Assemblages Of Lepomis Spp. In The Saline River Basin, Andrew Claxton Jan 2009

The Effect Of Coalmine Effluent On The Parasite Assemblages Of Lepomis Spp. In The Saline River Basin, Andrew Claxton

Masters Theses

To determine the efficacy of using parasite assemblages as bioindicators of coalmine effluent, a survey of gastro-intestinal helminths from the gut of sunfish, Lepomis spp, was performed. Five species of Lepomis, L. cyanellus, L. nwcrochirus, L. megalotis, L. microlophus, and L. gulosus, were collected from six locations near the Palzo mine, an abandoned coalmine that actively discharges into the lower reach of Sugar Creek. Sunfish were collected from three sites which did not receive effluent from the Palzo mine (Sugar Creek (37° 37'/ 88° 50'), South Fork(37° 41 '/ 88° 52'), and the Little Saline River (37° 38'/ 88° 38')) …

Reexamining Depressive Realism Using Estimates Of Real Life Events, Lindsay Babcock Jan 2009

Reexamining Depressive Realism Using Estimates Of Real Life Events, Lindsay Babcock

Masters Theses

Early reports of the phenomenon known as depressive realism suggest the counter-intuitive notion that depressed people are more accurate in their perception of reality. These studies have been criticized for relying solely on judging control over laboratory tasks that do not relate to real life and for the use of deception. The present study investigates the relationship between depression, anxiety, locus of control, and accuracy of judgments with an emphasis on real world occurrences, as well as examining individuals' confidence in their judgments. While depression, anxiety, and locus of control were all found to be highly correlated, significant results were …

Evaluating Highly Resolved Paleoclimate Records In The Frequency Domain For Multidecadal-Scale Climate Variability, Kristine L. Delong, Terrence M. Quinn, Gary T. Mitchum, Richard Z. Poore Jan 2009

Evaluating Highly Resolved Paleoclimate Records In The Frequency Domain For Multidecadal-Scale Climate Variability, Kristine L. Delong, Terrence M. Quinn, Gary T. Mitchum, Richard Z. Poore

Marine Science Faculty Publications

[1] Do the chronological methods used in the construction of paleoclimate records influence the results of the frequency analysis applied to them? We explore this phenomenon using the Dongge Cave speleothem record (U-series chronology with variable time steps, Δt) and the El Malpais tree-ring index (cross-dating of ring-width series). Interpolation of the Dongge Cave record to a constant Δt resulted in the suppression of periodicities (<20 years) altering the red noise model used for significance testing. Frequency analysis of temporal subsets of the El Malpais tree-ring index revealed that concentrations of variance varied with the number of ring-width series. Frequency analyses of these records identified significant periodicities, some common to both (∼25 and ∼69 years). Cross-wavelet analysis, which examines periodicities in the time domain, revealed that coherency between these records occurs intermittently. We found the chronology methods can influence the ability of frequency analysis to detect periodicities and tests for coherency.

Scaling "Local": The Implications Of Greenhouse Gas Regulation In San Bernardino County, Hari M. Osofsky Jan 2009

Scaling "Local": The Implications Of Greenhouse Gas Regulation In San Bernardino County, Hari M. Osofsky

Michigan Journal of International Law

This Essay analyzes local climate regulation in San Bernardino County as a window into the complexities of defining a local scale in an interconnected world. In so doing, it aims to contribute to the Symposium's broader dialogue about "Territory Without Boundaries" and the Panel's more specific discussion of "Urban Territory in a Global World." As a purely territorial matter, U.S. cities and counties differ substantially in their sizes, the quantity and physical characteristics of their land, the size and density of their populations, and the needs of their citizens. Structurally, these localities remain administrative subunits of states, but they also …

Believing And Doubting As Hermeneutic Method: Reading And Teaching Paradise Lost, Sheridan Blau Jan 2009

Believing And Doubting As Hermeneutic Method: Reading And Teaching Paradise Lost, Sheridan Blau

The Journal of the Assembly for Expanded Perspectives on Learning

Using a variation on Peter Elbow's believing game, I help students discover the degree to which Milton in Paradise Lost succeeds in his explicit attempt to justify God's ways to man and in that success also offers us an account of human happiness and misery that is psychologically sophisticated, spiritually illuminating, entirely rational, and supremely wise as a guide to living a humanly satisfying life. Such an approach to Paradise Lost also fosters an experience of the text through which many students undergo a modern version of the spiritual transformation and enlightenment that Milton explicitly aimed to make possible for …

Diverse Contexts Of Reception And Feelings Of Belonging, Alex Stepick, Carol Dutton Stepick Jan 2009

Diverse Contexts Of Reception And Feelings Of Belonging, Alex Stepick, Carol Dutton Stepick

Sociology Faculty Publications and Presentations

The theoretical focus of this paper is the context of reception experienced by migrants in their new homeland. In particular we examine relations between established residents and newcomers or immigrants from Cuba, Haiti, and other Caribbean and Latin American nations in South Florida. Based upon long term fieldwork among late adolescents and young adults, we develop a framework and give ethnographic examples of established resident-newcomer relations that influence the contexts of reception for immigrants in South Florida. These contexts range from positive to negative, vary between national and local settings, and change over time.

Open Borders, Intellectual Property & Federal Criminal Trade Secret Law, 9 J. Marshall Rev. Intell. Prop. L. 24 (2009), Shubha Ghosh

UIC Review of Intellectual Property Law

Many scholars have demonstrated that labor mobility between firms has lead to the economic success of Silicon Valley. California‘s policy against enforcing covenants not to compete has been shown to provide the legal infrastructure for high labor mobility. Does the argument extend to mobility of skilled labor across national borders? This Article addresses that question in the context of the Economic Espionage Act of 1996, the first federal criminal trade secret law in the United States. By analyzing the scholarly literature and the case law under the Act, the author presents a theoretical framework for assessing the Act based on …

1. A Bible with Old and New Testaments (NASB95, ESV, NRSV, or RSV recommended; but NIV is acceptable). Electronic Bible versions in Logos Bible Software are available for purchase individually (see link below), or come bundled with various packages. The advantage of having a Logos electronic version is to be able to access Scripture texts from the class readings via the "linking" capability within Logos Bible Software. The RSV in Logos is least expensive ($9.95) and is used in Asbury's IBS classes; but in Logos it contains no marginal notes; the NASB95 ($24.95) has linking to marginal notes. 2. David …

Symposium: The Civil Rights Roots Of Tinker's Disruption Tests, Kristi L. Bowman Jan 2009

Symposium: The Civil Rights Roots Of Tinker's Disruption Tests, Kristi L. Bowman

American University Law Review

This past spring marked the fortieth anniversary of Tinker v. Des Moines Independent Community School District, the landmark student speech case in which the Supreme Court held that three students were protected by the First Amendment when they wore black armbands in their Des Moines, Iowa public schools to protest the Vietnam War. Looking at Supreme Court precedent alone, it would seem as though the Tinker tests were created out of whole cloth: the substantial or material disruption, reasonable anticipation of such disruption, and rights of others tests did not have much of a basis in earlier Supreme Court decisions. …

The Ancient Maya Drought Cult: Late Classic Cave Use In Belize, Jaime J. Awe, George A. Brook, Holley Moyes Jan 2009

The Ancient Maya Drought Cult: Late Classic Cave Use In Belize, Jaime J. Awe, George A. Brook, Holley Moyes

KIP Monographs

Caves were used as ritual venues by the ancient Maya from the Early Preclassic to the Postclassic period. These sites have been intensively investigated, but little research has been devoted to changes in cave use over time. Work at Chechem Ha Cave in western Belize investigates transformations in ritual practice occurring between the Early and Late Classic peri- ods using an explanatory framework that incorporates high-definition archaeological research with a paleoclimate recon- struction derived from speleothems. This is one of the first projects to directly link these data to the archaeological record. We also introduce new methodology to evaluate changes …
