Dispute Systems Design: The United Nations Compensation Commission, Francis Mcgovern

Faculty Scholarship

The Security Council of the United Nations established the United Nations Compensation Commission (“UNCC”) with its Resolution 687 on April 3, 1991.1 It was the first compensation system established under the authority of Chapter VII of the U.N. Charter and was designed to process and pay claims arising from the Iraqi invasion of Kuwait in 1990. The purpose of this paper is to examine the design of the UNCC from a variety of perspectives: its historical setting, the alternative design approaches that have been taken in other compensation contexts, the details of its design, and its role in the design …

Constitutions For The 21st Century: Emerging Patterns-The Eu, Iraq, Afghanistan…, Chibli Mallat Jan 2009

Constitutions For The 21st Century: Emerging Patterns-The Eu, Iraq, Afghanistan…, Chibli Mallat

Faculty Scholarship

Professor Mallat delivered the Third Annual Herbert L. Bernstein Memorial Lecture in Comparative Law in 2004 and this article is based on his remarks. The article is included in the inaugural volume of CICLOPs that collects the first six Bernstein lectures. Strong moments in constitution-making often result from traumas; the breakthroughs by the European Union and constitutional achievements by both Iraq and Afghanistan stand as modern examples. The traumas of Europe, Afghanistan, and Iraq have been typified by violent conflict over the past century, including two World Wars, the Cold War, and the ‘war on terrorism’. Efforts and successes at …

Responding To Foreclosures In Cuyahoga County: Program Year Three Evaluation Report, March 1, 2008 Through February 28, 2009, Kathryn W. Hexter, Molly Schnoke

All Maxine Goodman Levin School of Urban Affairs Publications

Cuyahoga County, Ohio is at the epicenter of the foreclosure crisis. With close to 13,000 foreclosure filings a year since 2005, more than 10,000 vacant and derelict structures and thousands of homeowners losing their homes, the effects of the crisis will be long lasting and far reaching. In Ohio, County courts, agencies and departments have some level of authority and responsibility for virtually every step of the foreclosure process. So it is not surprising that the fifteen mayors of the First Suburbs Consortium2 turned to Cuyahoga County to help them address this crisis. In response, in August 2005, the Cuyahoga …

Enhancing Statistics Instruction In Elementary Schools: Integrating Technology In Professional Development, Maria Meletiou-Mavrotheris, Efi Paparistodemou, Despina Stylianou

The Mathematics Enthusiast

The research discussed in this article comes from an ongoing multifaceted program for the teaching and learning of early statistical reasoning in Cyprus. The initial stage of the program was concerned with the design of a line of instructional materials for the development of statistical reasoning. Central to this design was the functional integration with existing core curricular ideas of the recently developed dynamic statistics software Tinkerplots@, which provides young students with the opportunity to model and investigate real world problems of statistics. Next, professional development seminars for the teaching of statistics with the use of Tinkerplots® were designed and …

Global Chloroplast Phylogeny And Biogeography Of Bracken (Pteridium: Dennstaedtiaceae), Joshua P. Der, J. A. Thomson, J. K. Stratford, Paul G. Wolf

Biology Faculty Publications

Bracken ferns (genus Pteridium ) represent an ancient species complex with a natural worldwide distribution. Pteridium has historically been treated as comprising a single species, but recent treatments have recognized several related species. Phenotypic plasticity, geographically structured morphological variation, and geographically biased sampling have all contributed to taxonomic confusion in the genus. We sampled bracken specimens worldwide and used variable regions of the chloroplast genome to investigate phylogeography and reticulate evolution within the genus. Our results distinguish two major clades within Pteridium , a primarily northern hemisphere Laurasian/African clade, which includes all taxa currently assigned to P. aquilinum , and …

Economic Diversification And Sustainable Development: The Role Non-Timber Forest Products Play In The Monetization Of Kayapó Livelihoods , Laura C. Zanotti Jan 2009

Economic Diversification And Sustainable Development: The Role Non-Timber Forest Products Play In The Monetization Of Kayapó Livelihoods , Laura C. Zanotti

Journal of Ecological Anthropology

This paper analyzes the level of market integration of a relatively isolated Kayapó community. The goal is to understand how the commercial networks devoted to non-timber forest products are affecting one community by including cash-income into the economic life of communities previously dominated by non-monetary transactions but currently dominated by a mix of monetary and non-monetary practices. Non-timber forest product projects are a much lauded and much criticized form of sustainable forestry management. This case study analyses different non-timber forest product projects in Aukre, a village that is part of the Kayapó Indigenous Territories, Brazil. Th is article identifi es …

Determining The Phylogeographic Dynamics Of The Edge Relationships Between Aphonopelma Hentzi (Girard) And Its Neighbors Along The Colorado River Basin (Araneae, Mygalomorphae, Theraphosidae), Chris A. Hamilton Jan 2009

Determining The Phylogeographic Dynamics Of The Edge Relationships Between Aphonopelma Hentzi (Girard) And Its Neighbors Along The Colorado River Basin (Araneae, Mygalomorphae, Theraphosidae), Chris A. Hamilton

Biology Theses - Archive

Theraphosids, commonly known as “tarantulas”, are a group of large, hirsute spiders that have drawn relatively little interest in ecological, behavioral, or evolutionary research from biologists. The lack of research on theraphosids is problematic because of conservation concerns for this group and the need to compile good life history data, and determine taxonomic and phylogenetic relationships. I examined the phylogenetic relationships among populations of tarantulas of the genus Aphonopelma along the Colorado River basin in Texas to construct a framework within which to test ecological, evolutionary, and biogeographical hypotheses in an area of species transition and possible Pleistocene refugia. In …

Reconstruction Of Brooksville Ridge Cave Temperatures From Speleothem Samples, Amor Elder Jan 2009

Reconstruction Of Brooksville Ridge Cave Temperatures From Speleothem Samples, Amor Elder

Undergraduate Journal of Mathematical Modeling: One + Two

A problem was proposed to use an adjusted version of Dorale's speleothem delta function to model the temperature fluctuations in the Brooksville Ridge Cave from the Medieval Warm Period to the present. The temperature values reconstructed by the model can be compared to the known temperature trend during the same selected time period. If the results matched the trend, it indicates that the cave's temperature was the dominant influence. If not, a different variable was the main influence of the cave.

Using δ18O values gathered from a speleothem, past temperatures of the cave were modeled. Results show that …

'Doing Religion' Overseas: The Characteristics And Functions Of Ghanaian Immigrant Churches In Toronto, Canada, Mensah Jan 2009

'Doing Religion' Overseas: The Characteristics And Functions Of Ghanaian Immigrant Churches In Toronto, Canada, Mensah

Societies Without Borders

While the importance of immigrants' transnational economic activities is readily acknowledged, the cultural factors that facilitate their initiation and sustenance of memberships in multiple locations have been overlooked. It is this lacuna that the present study addresses, using Ghanaian immigrant churches in Toronto as a case study. The paper examines how Ghanaian immigrant churches were founded; how they are organized; and the kinds of social services they provide. While the churches facilitate the settlement of Ghanaian immigrants, through the provision of social services, they seem to, inadvertently, undermine their eventual integration into the broader Canadian society.

Assemblage-Oriented Ocean Resource Management: How The Marine Environment Washes Over Traditional Territorial Lines, John A. Duff Jan 2009

Assemblage-Oriented Ocean Resource Management: How The Marine Environment Washes Over Traditional Territorial Lines, John A. Duff

Michigan Journal of International Law

This Essay assesses challenges that arise when marine territorial boundaries do not encompass the appropriate assemblage of resources and relationships necessary for effective authority and management. It reviews the manner in which certain offshore resource uses have been "quasi-territorialized" by the application of other forms of jurisdiction. It also highlights regime-jurisdiction-private interest-oriented responses to territory-oriented challenges in the form of assemblages of authority, interests, space, and time. Given the scalar progression of the links in the discussion, the assessment moves from international principles to exercises of national sovereignty to domestic administration of space and resources to private legal interests.

The Shifting Border Of Immigration Regulation, Ayelet Shachar Jan 2009

The Shifting Border Of Immigration Regulation, Ayelet Shachar

Michigan Journal of International Law

While American immigration law is still largely informed by the doctrine of plenary power, which holds that "[a]dmission to the United States is a privilege granted by the sovereign" (as the Supreme Court asserted in Knauff more than fifty years ago), what has dramatically changed in recent years is the location of "our gates," which no longer stand at the country's territorial edges. Instead, the border itself has become a moving barrier, a legal construct that is not tightly fixed to territorial benchmarks. This shifting border of immigration regulation, as we might call it, is selectively utilized by national …
