The Emperor's New Clothes: Exposing The Failures Of Regulating Land Use Through The Ballot Box, Marcilynn A. Burke
The Emperor's New Clothes: Exposing The Failures Of Regulating Land Use Through The Ballot Box, Marcilynn A. Burke
Notre Dame Law Review
This Article analyzes the recent trend of regulating land use through ballot initiatives. Most of this activity occurs in jurisdictions west of the Mississippi River, and as the West becomes the new political battleground, the significance of these initiatives continues to grow. Supporters tout ballot initiatives as a positive mechanism of direct democracy, but this Article makes two normative claims to the contrary. First, regulation of land use from the ballot box produces a deliberative failure. Second, such regulation leads to a planning failure. To prove these claims, the analysis focuses on three areas of land use law at both …

Fisheries Research Report No. 189 - Results Of A 2007 Survey Of The Swan River Region For Four Introduced Marine Species, Justin I. Mcdonald, Fred E. Wells
Fisheries Research Reports
A survey of the Swan River region for four non-indigenous marine species was conducted in 2007: the European shore crab Carcinus maenas, the Asian bag mussel Musculista senhousia, the European fan worm Sabella spallanzanii, and the scallop Scaeochlamys livida. The first three of these species are global in their distribution and on the ‘top-ten world’s worst invaders listing; the last species is introduced from the eastern states of Australia.
In this survey divers on SCUBA examined 43 sites for each of the listed species. Despite previous records of Carcinus maenas and Musculista senhousia in this region …

La Crisis Financiera De 1982-1983 En Chile: Orígenes, Intervención, Efectos Y Implicancias Para El Modelo Neoliberal, Luke Shoemaker
Independent Study Project (ISP) Collection
This project is an analysis of the financial crisis in Chile between 1982 and 1983. I will begin with a summary of the crisis with respect to three variables: the origin of the crisis, the government’s intervention to confront the crisis, and the effects of the crisis. Afterwards I will discuss the implications that the financial crisis has for the neoliberal model. There are two hypotheses for this discussion. One hypothesis is that the neoliberal model caused the crisis. The alternative hypothesis is that the crisis was caused by errors in the application of the neoliberal model and other external …

Review Of Teaching The Trees, Charles Yaple
Review Of Teaching The Trees, Charles Yaple
Taproot: A Journal of Outdoor Education
Wallace Stegner is credited with authoring the statement, “Trees are the geography of hope.” Joan Maloof appears to have taken Stegner’s words to heart and testifies as to their validity in a delightful collection of essays about local trees in Maryland – Oaks, Beech, Pine, Red Maple, Black Locust, Cherry, Walnut and others. Teaching the trees… beautifully combines science, philosophy, and spirituality to make the case for preserving treed landscapes at all costs. Thoreau, Leopold and others who wrote about the importance of trees would give Maloof a standing ovation.

Global Christian Shifts And Missional Church Movements: Linking The Postcolonial Global South With The Postmodern West, Stephen P. Lewis
Global Christian Shifts And Missional Church Movements: Linking The Postcolonial Global South With The Postmodern West, Stephen P. Lewis
Doctor of Ministry
This dissertation engages cunent shifts in global Christianity. The problem we are studying is the movement toward the postmodern emerging church in the West and the postcolonial church emerging in the global South, in order to understand both the past failings in the relationship of the Western and Southern church and their present common context, in order to help postmodern and postcolonial churches repent of previous failures and move forward utilizing a common set of experiences and cultural conditions, so that God's people will love and work with one another as co-heirs, co-equals, and comissionaries of the Kingdom.
In order …

The Ties That Bind: Urban Migration, Family Networks, And Cultural Change In Modern Mongolia, Christopher R. Williams
The Ties That Bind: Urban Migration, Family Networks, And Cultural Change In Modern Mongolia, Christopher R. Williams
Independent Study Project (ISP) Collection
Migrants represent the future of Mongolia. They are those members of Mongolian society who pursue, and often achieve, a better life by choosing to uproot themselves and their families to move to the capital city of Ulaanbaatar. Along the way they face many obstacles, and are in turn blamed for many of the problems that plague the city. However, they do not face these obstacles on their own. Migrants succeed with help, be it from society, friends, or family. Family in particular plays an important role in the lives of Mongolian migrants, creating important, nationwide networks which can support individual …

In Boumediene v. Bush, decided June 12, 2008, the U.S. Supreme Court extended the constitutional privilege of habeas corpus to noncitizens detained at Guantanamo Bay, Cuba. Courts will now be called upon to assess the propriety of American detainee treatment practices against unclear constitutional standards. The strength and contours of the due process protections the U.S. Constitution will afford these detainees is still an unsettled question. The Lexington Principles are designed to help guide the development of American due process standards as they move outside our borders. These Principles are also intended to serve as a model for those …

Channel Coordination In A Green Supply Chain In The Presence Of Demand Expansion Effects:, Sanjeev Swami, Janat Shah
Channel Coordination In A Green Supply Chain In The Presence Of Demand Expansion Effects:, Sanjeev Swami, Janat Shah
Working Papers
We consider the problem of a single manufacturer who sells its products to a single retailer. The manufacturer puts in some effort for greening its operations, and the retailer also puts in a corresponding greening effort in retailing the product. Their respective greening efforts are considered to have "expansion" effects on the retail demand. The manufacturer makes decisions on the wholesale prices and its greening efforts, while the retailer makes decisions on the retail price and its corresponding greening efforts. Our results show that: (i) The ratio of the optimal greening efforts put in by the manufacturer and retailer is …
Governing The Socially Responsible Corporation: A Gandhian Perspective, N Balasubramanian
Governing The Socially Responsible Corporation: A Gandhian Perspective, N Balasubramanian
Working Papers
There is increasing evidence of migration towards an integrated model of governance which is sensitive to the needs of the society even as it emphasizes the imperatives of shareholder wealth creation, its accounting and reporting, and equitable distribution. While much of this transformation is usually credited to initiatives from the developed markets of the west, there is in fact a large measure of such wisdom and counsel available in the Indian tradition, and Gandhi has been among its foremost exponents and interlocutors in modern times. Gandhian concepts of trusteeship, truth, non-violence, and satyagraha or truth-force are in perfect sync with, …
The Evangelical Sisterhood Of Mary: Profile Of A Protestant Monastic Order, George Faithful
The Evangelical Sisterhood Of Mary: Profile Of A Protestant Monastic Order, George Faithful
Collected Faculty Scholarship
It is not self-evident that there should be Protestant nuns. Yet the Evangelical Sisterhood of Mary has existed in Germany for over sixty years. Why? How did the Sisterhood come to be? And what are the Sisters’ distinctive practices and beliefs? To answer these questions, I will provide a brief historical overview of the sisters’ founding, followed by a survey of the teachings of Mother Basilea, their preeminent founder, which I will augment with an analysis of the architecture of the sisters’ communities.
